Which Route Is Considered in Your Administrative Dispute?

A permit refusal, a disciplinary penalty and harm arising from a public service are not resolved by the same legal route. The nature of the act, the date of service, the competent authority and the result you want are the basis of the first review.

Annulment of the act

Judicial review of a final and enforceable decision alleged to be unlawful. Competence, form, reason, subject matter and purpose are examined.

Interim legal protection

A request to stay the application of the act while the case is pending. Manifest unlawfulness and harm that is difficult or impossible to remedy are assessed together.

Redress of harm

Claims for pecuniary and non-pecuniary damage arising from an administrative act or action. The conditions of prior application, liability and causation are determined.

Our Attorney Services in Administrative Law

We assess applications, lawsuits, interim protection and post-decision steps together, according to the needs of the file. The summaries below explain the scope of the relevant service and the basic distinctions.

Checking Time Limits and Service of Documents in Administrative Cases

The following are general rules. A special law, expedited proceedings, the type of act and the method of service may give rise to different or shorter time limits.

60 / 30 days

Unless a special time limit applies, the time limit for filing an action is 60 days before the Council of State (Danıştay) and the administrative courts, and 30 days before the tax courts. The starting date is determined according to the dispute.

Application and implied rejection

Under Articles 10 and 11 of the Administrative Procedure Law No. 2577 (İYUK), the general period of non-response is 30 days. In an Article 11 application, the days that passed beforehand are not lost; the remaining time to file an action is tracked.

Prior application for harm caused by an action

Under Article 13 of İYUK, an application is generally made to the administration within 1 year of learning of the action and within 5 years of the action. Harm that arises later and the administrative nature of the matter are examined separately.

UETS tracking for companies and persons abroad

A notification that reaches the National Electronic Notification System is deemed to have been served at the end of the fifth day following its arrival. Failing to read it or to see the SMS does not postpone the time limit. The records of Registered Electronic Mail (KEP), UETS and physical service must be assessed separately.

Guide to applications, service of documents and time limits

Basis: Articles 7–13 of İYUK; Article 7/a of Law No. 7201 on Notification. To calculate the time limit, the decision and the service document must be examined together.

How Do We Handle Your Administrative File?

  1. Priority and time limit

The decision, the notification, the institution, the earlier application and the urgent effect are identified.

  2. Legal route and evidence

Subject-matter and territorial jurisdiction, capacity, the application requirement and the required records are examined.

  3. Application and representation

Within the agreed scope, the petition, the request for protection and the litigation steps are carried out.

  4. Decision and implementation

The outcome of the decision, the available legal remedy, enforcement and additional requests are assessed.

The clarity the first consultation provides

The suitable route of application, missing documents, time-limited steps and the need for protection are identified. The attorney’s fee, as well as any court fees and expenses that may arise separately, are explained. The scope of representation becomes clear after acceptance of the matter and authorization; no commitment to a result is given.

Preparing for the First Consultation: Which Documents Are Needed?

First, the decision and the service record

  • All pages and attachments of the decision; the institution, date and number.
  • The service envelope and the service receipt (mazbata) or the UETS evidence record; if any, the public announcement and information on when you learned of the act.
  • Earlier applications and objections, delivery records and the administration’s replies.
  • The relevant documents of the permit, inspection, personnel, tender or technical file.
  • Documentation of the harm and of the urgent effect; a short chronology and the result you want.

Frequently Asked Questions About Administrative Cases

What is the difference between an annulment action and a full remedy action (tam yargı davası)?

An annulment action aims at review of the lawfulness of an administrative act; a full remedy action aims at redress of a right violated by an administrative act or action. For compensation, the conditions of harm and liability must be shown separately.

Does the act stop when an action is filed with the administrative court?

As a rule, no. For the application of the act to stop, the conditions of a stay of execution and the relevant special provisions are examined. Statutory exceptions in tax disputes are assessed separately.

I objected to the administration; does my time limit for filing an action start over?

Not every objection stops the time limit. In an application that meets the conditions of Article 11 of İYUK, the remaining time runs after rejection or implied rejection; the days that passed before the application are counted.

I did not read the UETS message; could the notification have been served?

Yes. Service is deemed to have taken place at the end of the fifth day following arrival at the UETS address. Waiting for the notification SMS or not opening the message does not postpone the time limit. The records of arrival and the evidence of service must be examined.

To which court is an application made against an administrative fine?

The special regulation on which the fine is based and the related acts are decisive. Not every administrative fine is taken to the administrative court; a distinction is made between the criminal judgeship of peace (sulh ceza hâkimliği) and administrative justice.

How long does a case take; how are fees and expenses determined?

The court, the scope of the file, the expert examination and legal remedies affect the duration; a definite end date cannot be given. The attorney’s fee, court fees, expert and other expenses are explained after the consultation, according to the scope of service. If the conditions are met, legal aid is assessed separately.

Can I apply from abroad or on behalf of a company?

An online preliminary consultation can be held for administrative acts in Türkiye. The company’s authority of representation, the power of attorney, and the need for translation and certification of foreign documents are assessed; service of documents and time-limit tracking are carried out separately.

An inquiry alone does not create an attorney–client relationship and does not stop time limits. The legal conditions of the specific matter are reviewed separately.
