We Review the Act Together with Your Personnel Status and Its Professional Effects

Public personnel law covers appointment, discipline, working conditions and personnel rights, from entry into service to departure from it. Civil servants (memur), contracted personnel and public-sector workers are not subject to the same legal regime. In the initial review, we determine your status, the authority that issued the act, the date of notification and the right that must be protected.

Our Services in Public Personnel Disputes

Distinguish Between the Time Limits for Defense, Objection and Action

At least 7 days

The minimum period to be granted for a defense under Law No. 657 Art. 130. The scope of the request for a defense and special personnel legislation are examined separately.

7 days

For disciplinary penalties under Law No. 657 Art. 135, the time limit for an administrative objection is seven days from notification of the decision. The competent board varies according to the type of penalty.

General rule: 60 days

For an action before the administrative court, a sixty-day period applies where there is no special period. Notification, prior application and special procedural conditions are determined separately.

Basis: Law No. 657 Art. 129–130 and Art. 135; Law No. 2577 Art. 7–11. The seven-day administrative objection and an annulment action are not the same route. This table is not a last-day calculation specific to any individual.

Do not track the notification only through the notification message.

UETS is the National Electronic Notification System operated by PTT. Electronic notification under Law No. 7201 Art. 7/a is deemed to have been made at the end of the fifth day following its arrival at the address. Do not wait for an SMS or e-mail alert; download the proof of notification. In postal or intra-institutional notification, the delivery and signature records, the addressee and the procedure applied are examined separately. KEP is not the same system as UETS; the five-day rule does not apply to every KEP message.

Legal Distinctions to Know Before Applying

You can examine the section relevant to your need by opening it. The route of application and the claim are determined on the basis of your documents and the legislation that applies.

Appointment, transfer and assignment

The administration’s discretionary power and the reasons for the act

In appointment, transfer, temporary assignment, promotion and change-of-title acts, competence, procedure, the concrete service need, equality and the public interest are assessed. Basing the act solely on the institution’s discretion does not make it unnecessary to examine the reasons and the supporting documents.

Hardship grounds and examination documents

Hardship grounds based on family unity, health or disability are considered together with the conditions of the staff position and the service region. In a dispute over an examination or interview, the announcement, evaluation criteria, scores, commission records and accessible documents are compared. The same time limit for filing an action or the same trial procedure does not apply to every examination.

Disciplinary investigation and defense

Establishing the link between the accusation and the evidence

The approval of the investigation, the act attributed, the date of the event, the connection to duty and the evidence are examined together. The defense is not limited to an account of the event; documents in your favor, witnesses, procedural deficiencies, the proportionality of the penalty and the applicable disciplinary provision are assessed.

Defense safeguards and type of penalty

The period for a defense under Law No. 657 Art. 130 cannot be less than seven days. In a request for dismissal from civil service, the safeguards in Art. 129 of examining the file, having witnesses heard and defending oneself before the board are also important. Special personnel laws may contain different rules.

A disciplinary investigation and a criminal investigation are separate processes. The outcome of one does not automatically determine the other in every case. The statute of limitations for the investigation and for imposing a penalty is checked separately, taking the dates of learning of the act and of the act itself as the basis.

Security investigation and non-appointment

Concrete and individual assessment

In an adverse act issued as a result of a security investigation or archive research, the law applied, the nature of the duty, the accuracy of the underlying records and their connection to the person are examined. An administrative assessment and a criminal conviction are not the same thing; not every record alone leads to the same result.

Access to the file and judicial review

The grounds of the act, the application documents and the known records are collected; where necessary, the court is asked to obtain the underlying documents. The relationship between confidentiality grounds and the right of defense is assessed in the specific file. No outcome of automatic acceptance or rejection is promised regarding data concerning the person or a relative.

Suspension from duty and end of service

Distinguishing an interim measure from a final sanction

Suspension from duty, ending of service and non-renewal of a contract are different legal acts. The authority for the measure, its grounds, the conditions for its continuation and its review are examined, and the basis and procedure of the final act are examined separately.

Stay of execution and the pursuit of rights

An annulment action does not stop the act automatically. For a stay of execution, manifest unlawfulness and damage that is difficult or impossible to remedy are assessed together. Livelihood, health, family order and professional effects are demonstrated with documents; the date a decision will be given or the date of return to duty is not guaranteed.

Personnel rights, financial rights and compensation

Addressing status and monetary claims together

In grade and step, adaptation (intibak), length of service, pay, supplementary payments, leave and other personnel rights, the administrative act is separated from its monetary consequences. Payroll and payment documents are compared period by period; the scope of the claim, interest and conditions for application are determined.

Mobbing, damage and the link to retirement

In allegations of psychological harassment, the continuity of the events, correspondence, assignments, health records and witness information are assessed together. An annulment decision does not mean automatic acceptance of every item of compensation. Disputes over retirement and the combination of service periods are examined together with the social security regime to which the person is subject.

Public personnel with special status

The same rule does not apply to every public employee

For teachers, health personnel, academic staff, law enforcement, military personnel and contracted employees, the relevant special laws and regulations are decisive. The time limits and objection authorities under Law No. 657 are not carried over to these statuses uncritically.

Distinguishing public-sector workers from contracted personnel

An institution being a public body does not mean that all employment disputes will be heard in the administrative courts. The form of employment, the contract and the subject of the dispute are examined together. Employee claims or trade union rights are assessed in coordination with the relevant service area.

How Do We Evaluate Your File?

  1. Status and time limits

Position, contract, special legislation, and the act and notification records are determined.

  2. File and evidence

Investigation, personnel, examination and payment documents are compared.

  3. Defense and application

Objection, annulment, interim protection and monetary claims are planned.

  4. Decision and implementation

Legal remedies and the fulfillment of the requirements of the decision are monitored.

The legal route, evidence and expected result are addressed together.

In the initial assessment, we clarify the scope of the act, the routes that can be used, missing documents and any need for urgent protection. The fee and litigation costs are explained according to the scope of the work undertaken. The method of communication for reporting developments in the process is determined; the application and implementation steps after the decision are assessed separately.

Frequently Asked Questions About Public Personnel and Civil Servant Law

Can I get an attorney’s support before a disciplinary penalty?

Yes. Legal support can be considered before a penalty is imposed, to review the request for a defense, identify documents in your favor and exercise the rights available during the investigation stage.

Can I file an action without an administrative objection?

The objection route under Law No. 657 Art. 135 and the route of an action are separate. The route to follow should be determined on the basis of the type of penalty, special legislation and the concrete act. It cannot be said that an objection is compulsory first in every file.

Is suspension from duty the same as dismissal from civil service?

No. An interim measure and the final act that ends the service are different. Time limits, financial rights and application routes are examined according to the relevant status.

Does an appointment or disciplinary act stop when I file an action?

As a rule, no. A request for a stay of execution may be considered together with the annulment action or during the case; the decision depends on the court’s examination.

Does acquittal in a criminal case remove a disciplinary penalty?

No automatic conclusion can be drawn. The grounds of the acquittal, findings on the material facts and the nature of the disciplinary accusation are assessed together.

How are the attorney’s fee and the scope of the file determined?

At the initial review, the legal route, the expected work, the fee, litigation costs and the method of communication are explained. The scope of the defense, litigation and legal remedies is clarified in the agreement; no definite result or end date is promised.

This content is general information. Information and documents you share are kept confidential and used for legal assessment and within the agreed scope of service. An inquiry alone does not create an attorney–client relationship and does not stop time limits. The legal conditions of the specific matter are reviewed separately.
