How was this guide prepared and what is its scope?
This guide is the main page of the publication series of Güneş & Güneş Law Firm on property division. It explains together the relationships among ownership, the liquidation claim, interim protection, the time limit for the action and collection. The details of special topics are examined in the related articles below.
Laws and decisions are shown in the relevant section and in the sources. The outcome of each dispute depends on the contracts, the dates of events and the state of the evidence.

What is the difference between the matrimonial property regime and ownership?
The matrimonial property regime determines how the value of the spouses’ assets during the marriage will be classified at liquidation and which claims will arise between them. As a rule:
- Marriage does not automatically make the spouses co-owners of all property.
- The fact that a real property is registered in the other spouse’s name does not by itself eliminate the participation claim.
- An asset being classified as acquired property does not mean that half of the title deed will be registered to the plaintiff.
- The right of the liquidation creditor is mostly a personal monetary claim.
- A real right can be requested only in limited cases regulated by law or if there is a separately valid legal ground.
The decision of the 2nd Civil Chamber of the Court of Cassation (Yargıtay 2. Hukuk Dairesi) dated September 11, 2025, E. 2025/4456, K. 2025/7122 also explains that the contribution claim, the share in increased value and the participation claim are, as a rule, personal claims, and that allocation (özgüleme) in co-owned property based on superior benefit and the surviving spouse’s rights concerning the family residence and household goods are limited exceptions to this rule.
Which matrimonial property regime applies between the spouses?
What is the rule for those who married after January 1, 2002?
Under Turkish Civil Code Article 202, unless the spouses have chosen another regime, the statutory regime is the regime of participation in acquired property. Within the limits of the law, the spouses may choose the separation of property, the separation of property with sharing or the community of property regime.
What are the basic differences among the four matrimonial property regimes?
| Regime | Management of property | Liability for debts | Basic result at termination | Main risk |
|---|---|---|---|---|
| Participation in acquired property | Each spouse manages and disposes of his or her own property; special restrictions in the law are reserved. | As a rule, each spouse is liable for his or her own debts with all of his or her property. | A participation claim over the residual value of acquired property; if the conditions are met, a share in increased value and equalization arise. | Two opposite wrong assumptions: “all property is joint” or “whoever is named in the land registry is the sole owner.” |
| Separation of property | Each spouse manages, uses and disposes of his or her own property. | Each spouse is liable for his or her own debt; the provisions on joint debts and on representing the family union are reserved. | There is no automatic participation in the residual value; ownership, debt, contribution and the general provisions become important. | The contributing spouse being unable to prove the payment and the purpose of the contribution. |
| Separation of property with sharing | While the regime continues, management close to the separation of property applies. | As a rule, personal liability for debts continues. | Certain assets allocated to the family’s joint use and investments are shared according to the rules in the law. | Wrongly determining which asset falls within the scope of sharing. |
| Community of property | The principles of joint management and disposal provided by law apply over the community assets. | The distinction between community and personal debts is important. | Community assets and personal assets are separated and divided. | Overlooking the scope of the contract and the rights of third parties and creditors. |
The choice of matrimonial property regime is not only a question of “how much will be received at divorce.” It also affects management, disposal, debts, company shares, inheritance, the position of creditors and the consequences in the event of death during the marriage. A regime contract chosen by the parties cannot eliminate the acquired rights of third parties; nor does it apply the consequences of past periods retroactively in a way the law does not permit.
How is property divided for those who married before January 1, 2002?
Under Law No. 4722 Article 10, for spouses who married earlier, the former regime applies until January 1, 2002; after that date, the regime of participation in acquired property applies unless another choice was made within one year. For this reason, two periods can arise within a single marriage:
| Period | General approach | Possible claim |
|---|---|---|
| Before January 1, 2002 | Separation of property principles of the former Civil Code period | If the conditions are met, a contribution claim or a claim for ownership/return |
| January 1, 2002 and after | Regime of participation in acquired property | Participation claim, share in increased value, equalization and return |
Practical warning: A loan may have been paid after 2002 on a real property bought in 2001, or personal assets from before 2002 may have been converted into another asset after 2002. Looking only at the date of the title deed produces a wrong result in files with mixed financing.
When and how can a matrimonial property regime contract be made?
The spouses may make a matrimonial property regime contract before the marriage or during the marriage. The contract is made by notarial drawing up or certification; written notification of the choice at the time of the marriage application is also possible. The contract can only choose one of the regimes recognized by law and may make changes within the limits permitted by law.
Can spouses treat acquired property as personal property?
Turkish Civil Code Article 221 makes it possible for the spouses, by a matrimonial property regime contract, to agree that values arising from the practice of a profession or from the operation of a business, which should be included in acquired property, are to be regarded as personal property, and that the income of personal property will not be included in acquired property. It cannot be concluded that every kind of property can be declared personal property without limit.
What is the extraordinary matrimonial property regime?
If there is a justified reason, one of the spouses may, under Turkish Civil Code Article 206, ask the judge to convert the existing regime into the separation of property. The other spouse’s being insolvent, not providing information about his or her assets, endangering the share of the community, or being permanently incapable of judgment are among the examples in the law. This action is different from the divorce action and from the action for the liquidation claim; the time of the claim, jurisdiction, venue and court fees must be set out separately.
When does the matrimonial property regime begin and when does it end?
What is the starting date?
The matrimonial property regime, as a rule, begins on the date of the marriage. A valid regime contract made later or a court decision starts the new period according to the time rules in the law.
On which day does it end in a divorce?
Under Turkish Civil Code Article 225, if a decision for divorce is given, the matrimonial property regime ends with effect from the date on which the divorce action was filed. However, this retroactive effect depends on the divorce judgment being accepted and becoming final.
Example: If the divorce action was filed on March 12, 2024 and the judgment became final on January 8, 2026, the liquidation cutoff date for the matrimonial property regime is March 12, 2024. Salary or new property acquired after this date, as a rule, no longer enters the liquidation period; the income, debt, substitute value and increase in value of earlier property are examined separately.
What happens if the divorce action is dismissed?
If the divorce action is dismissed, the termination consequence under Turkish Civil Code Article 225 does not arise and the statutory regime continues. The effect of statements about a liquidation right that never arose in the earlier, dismissed divorce file is also assessed according to its specific content. The decision of the Civil General Assembly of the Court of Cassation (Yargıtay Hukuk Genel Kurulu) E. 2017/8-1673, K. 2018/251 held that a waiver of the liquidation claim asserted in an earlier divorce action that was dismissed because of a waiver produces no effect with respect to the right that arose upon a divorce accepted later.
Can a matrimonial property regime action be filed while the divorce is pending?
Yes; however, the divorce being accepted and becoming final is a condition for the liquidation to be heard. According to the decision of the 8th Civil Chamber of the Court of Cassation dated March 10, 2014, E. 2013/23669, K. 2014/3820, a liquidation action filed while the divorce action is pending should not be dismissed merely because it was filed early; the divorce action should be made a preliminary question warranting a stay. If the divorce is dismissed, no judgment can be rendered on the merits of the liquidation action.
Which property claims can be asserted in a divorce?
| Claim | Basic function | Typical example |
|---|---|---|
| Participation claim | A monetary claim over half of the other spouse’s residual value | The net value of a residence bought with salary during the marriage |
| Share in increased value | Return, in proportion to the increase in value, of one spouse’s gratuitous contribution to the other spouse’s asset | Inheritance money invested in a house bought in the other spouse’s name |
| Equalization | Correction of shifts between the acquired and personal property groups of the same spouse | Payment of a personal debt with acquired money |
| Contribution claim | The consideration for a proven contribution, especially in the period of separation of property before January 1, 2002 | A 1998 house bought in the other spouse’s name with one spouse’s earnings |
| Ownership or return | The asset actually belonging to the plaintiff or remaining in his or her possession | Personal belongings, gold jewelry, money held in trust |
| Allocation based on superior benefit | Awarding a share in co-owned property to one spouse if the conditions are met | A residence in co-ownership |
| Claim against a third party | Completion of the liquidation claim that remains short under the statutory conditions | Gratuitous disposition within the scope of Turkish Civil Code Article 241 |
Are the participation claim and the share in increased value the same thing?
No. The participation claim arises from the residual value of the other spouse’s acquired property and, as a rule, does not require proof of a direct contribution. The share in increased value, on the other hand, is based on the gratuitous contribution one spouse made to an asset belonging to the other spouse and on the share of that contribution in the value of the asset. The two claims may overlap in calculation on the same asset; the order must be set correctly so that double recovery does not occur.
Is “participation share” the correct term?
The technical term in the law is participation claim. Although “participation share” is seen in everyday usage, the legal nature of the right and the result of the claim should be written clearly in the petition.
What is acquired property?
In examining acquired property, the time of acquisition, the consideration and the statutory presumption are evaluated together. The details of salary, income and the values that replace them are explained in the related article. Detailed explanation: Which Property Is Divided in a Divorce? What is personal property?
Proof of the source is important for property from before the marriage, inheritance, gifts and the values that replace them. The asset itself and its income should not be treated as the same. Detailed explanation: Is Property from Inheritance, Gifts and Family Divided in a Divorce?
What does the presumption of acquired property in Turkish Civil Code Article 222 mean?

The statutory presumption, the exception asserted and the claim of third-party ownership are evaluated together. Detailed explanation: Which Property Is Divided in a Divorce? Acquired Property and Personal Property
How are company shares, businesses and professional earnings divided?
The spouse’s company share, the spouse’s receivable from the company, the income distributed and the property of the company’s legal entity are separated. Do crypto assets, foreign currency and digital accounts enter the liquidation?
The digital form of safekeeping does not eliminate the matrimonial property regime examination. Entitlement, source of acquisition, valuation and actual collection are separate stages. Detailed explanation: How Are Crypto Assets Identified and Divided in a Divorce?
How are cooperatives, the Housing Development Administration, the private pension system, intellectual property rights and new-generation income evaluated?
The matrimonial property regime does not consist only of registered real property and bank deposits. Economic values that have not yet turned into a title deed, that are conditional, or that will provide payment in the future must also be investigated with regard to the time of acquisition, the source of financing, transferability and their existing state at the cutoff date.
| Asset or right | Key issue to investigate | Priority record |
|---|---|---|
| Cooperative membership and the right in the Housing Development Administration (Toplu Konut İdaresi Başkanlığı) | Date of membership/application, source of the dues and installments paid, stage of allocation or title deed | Cooperative ledger, allocation decision, payment statement, Housing Development Administration contract |
| Private pension and individual retirement savings | In which period and from which property group the premiums were paid; the distinction regarding state contribution, deductions and the post-retirement period | Private pension system account statement, fund movements, premium and exit calculation |
| Stock options, restricted stock units and employee share programs | For which working period the right is the consideration, the vesting condition, and whether it was earned at the cutoff date | Employment contract, vesting schedule, employer and safekeeping institution records |
| Copyright, patent, trademark and license income | Separation of the right itself from the income arising during the regime period | Turkish Patent and Trademark Office (TÜRKPATENT), professional association, license and royalty contracts |
| Self-employed practice and client base | Separation of personal professional reputation from the transferable business value | Tax records, contracts, client concentration, comparable transfers and financial statements |
| Agricultural holding | The income-value criterion in the law, the integrity of the holding, personal/acquired financing | Land registry, Farmer Registration System (ÇKS), production and income records, expert valuation |
| Timeshare and long-term right of use | The nature of the real/personal right, term, price and transferability | Land registry, contract, membership and payment records |
| Digital business and platform income | Ownership of the account, advertising/subscription income, economic value of the brand and user data | Platform payment reports, tax, bank, domain name and account management records |
| Pending lawsuit, compensation or insurance receivable | The cause and date of the receivable’s arising; whether it is a personal loss or the consideration for work or property | Case file, policy, damage and payment documents |
Not all of these assets are automatically acquired property. For example, while an intellectual property right itself may be of the nature of a personal creation or an acquisition from before the marriage, license income obtained during the regime period may be classified differently. Likewise, whether an employee share that has not yet been earned and is entirely dependent on a future condition will be counted as an asset existing at the cutoff date cannot be determined without examining the vesting contract.
How are co-ownership, joint account and compensation for unjust occupation claims separated?
The share in the land registry, the liquidation claim, the usage charge and the dissolution of co-ownership are different claims. Joint accounts and investment assets are examined separately. Detailed explanation: Spouses’ Rights in a Jointly Titled Home: Division, Compensation for Use and Dissolution of Co-Ownership
How do debts, mortgages and suretyships affect property division?
Not every debt that arises during the marriage is automatically placed on the other spouse. The real debt, the relevant property group, the security limit and the company’s separate debt must be distinguished from one another. Detailed explanation: How Is the Participation Claim Calculated? Debts, Equalization and Residual Value
How is the liquidation of the matrimonial property regime calculated?
For each spouse, the property groups, debts, values to be added back and equalization are determined; then the residual value and the mutual claims are calculated. It is not enough to divide the gross assets in two. Detailed explanation: How Is the Participation Claim Calculated? Debts, Equalization and Residual Value
How is the share in increased value claim calculated?
The source, consideration and ratio of the contribution made to the property belonging to the other spouse are examined. The conditions of the participation claim and of the share in increased value are not the same. Detailed explanation: What Is the Share in Increased Value Claim? Proof and Calculation of a Contribution to the Spouse’s Property
What is equalization?
Equalization corrects the transfer of value between the personal and acquired property groups of the same spouse. Confusing it with the contribution between spouses may lead to a double calculation. Detailed explanation: What Is the Share in Increased Value Claim? Proof and Calculation of a Contribution to the Spouse’s Property
According to which date is the valuation made?
The date on which the property group is determined, the date on which the nature of the asset is taken as the basis and the pricing date are separate questions. An asset disposed of and the rendering of a new judgment require special examination. Detailed explanation: Valuation Date in Property Division and Objection to the Expert Report
Do transfers made for the purpose of diverting assets affect the liquidation?
A gratuitous disposition, a transfer made to reduce the claim and simulation may be the subject of different legal routes. The party to the action and the result of the claim must be determined correctly. Detailed explanation: How Is Asset Diversion Prevented in a Divorce? Interim Injunction and Transfer to a Third Party
How are an interim injunction and protection of assets requested?
Interim protection should be linked to a concrete risk, a probable right and an applicable asset. The scope and duration of the injunction are reviewed according to changing conditions. Detailed explanation: How Is Asset Diversion Prevented in a Divorce? Interim Injunction and Transfer to a Third Party
When does review by the Constitutional Court and the European Court of Human Rights come into play in matrimonial property regime actions?
A matrimonial property regime action does not consist only of the calculation rules in the Turkish Civil Code. Keeping assets under an injunction for years, the scope of the injunction being disproportionate to the probable claim, or an unnecessary delay in the proceedings may be separately reviewed with regard to the right to property in Article 35 of the Constitution, the right to a fair trial in Article 36, and Article 1 of Protocol No. 1 to the European Convention on Human Rights.
This review is not a “fourth instance” legal remedy that takes the place of the lower court and recalculates the participation claim. First, the ordinary objection and legal remedies must be used effectively; requests for lifting, narrowing or replacing the injunction with security must be asserted with concrete facts; an individual application should be assessed only within its own admissibility conditions.
Does a long-lasting interim injunction violate the right to property?
Not every long injunction automatically constitutes a violation. An injunction protecting a legitimate claim may have a legal basis and a purpose. However, the interference must retain its necessity and proportionality throughout its entire duration. The court should assess in particular the following elements with current data:
- The plaintiff’s probable claim amount, proved on a prima facie basis
- The current total value of the assets or rights under the injunction
- How concrete the danger of transfer, diversion or making collection impossible is
- The duration of the injunction and whether the delay in the proceedings can be attributed to the parties
- The real effect of the injunction on using, renting, operating or accessing financing for the asset
- The adequacy of lighter means, such as an injunction of narrower scope, partial lifting or security
- The concrete and current reasoning of the decisions given on requests for lifting and modification
The decision of the Constitutional Court (Anayasa Mahkemesi) in Alican Özdemir, Application No. 2024/2070, January 28, 2026, examines the effect on the right to property of a long-lasting injunction in an action for a contribution claim. The necessity and duration of the injunction and its proportion to the current claim must be assessed concretely. [17]
These decisions do not say that “no injunction can be granted in a matrimonial property regime action.” The basic conclusion they draw is that an injunction cannot be continued automatically for years on the reasoning of the day it was first granted, and that its scope and duration must be reviewed again according to the changing circumstances of the file.
Can a complaint about trial within a reasonable time be taken directly to the Constitutional Court?
A complaint that the proceedings were not concluded within a reasonable time and a complaint that the injunction is a disproportionate interference with the right to property are separate subjects of application. The Compensation Commission (Tazminat Komisyonu) route applicable under Law No. 6384 and the legal remedies that follow it must be exhausted. In the Alican Özdemir decision, a violation of the right to property was found, while the complaint about a reasonable time was found inadmissible because the application routes had not been exhausted. [31, 17]
The three complaints must not be confused with one another:
| Complaint | Core issue | First legal focus |
|---|---|---|
| Unnecessary prolongation of the proceedings | Right to a trial within a reasonable time | Applicability of the current Compensation Commission and the judicial routes that follow it |
| Disproportion in the scope or duration of the injunction | Right to property | Objection to the injunction; lifting, narrowing or replacement with security; appeal and, depending on the case, an individual application |
| The court wrongly classifying the asset or setting up the calculation incorrectly | Error of substantive law/procedure | Appeal and appeal on points of law; the Constitutional Court is, as a rule, not a legal remedy that recalculates |
Since the application route and the calculation of the time limit may vary according to the date of the decision, the notification, whether the proceedings are continuing and the nature of the complaint, a direct application to the Constitutional Court should not be made relying on old internet content.
What is the standard of the European Court of Human Rights under Article 1 of Protocol No. 1?
The European Court of Human Rights mostly examines temporary restrictions on assets as control of the use of property. It is not sufficient on its own for the interference to be lawful and to pursue a legitimate aim; there must be a reasonable relationship of proportionality between the means used and the aim, and an excessive burden must not be placed on the person.
In JGK Statyba Ltd and Guselnikovas v. Lithuania, Application No. 3330/12, decision of November 5, 2013, the effects of a prolonged injunction on two residences and of the civil proceedings were assessed; in Džinić v. Croatia, Application No. 38359/13, decision of May 17, 2016, the marked disproportion between the value of the assets placed under an injunction to secure the confiscation of the probable proceeds of crime in criminal proceedings, and the national courts’ failure to examine this with reasons, were assessed. Neither decision directly concerns a Turkish matrimonial property regime action; they show the general standard of proportionality that may be applied to long and broad asset injunctions.
The route of the European Court of Human Rights is not an alternative appeal route that can be used directly without exhausting domestic remedies and the individual application to the Constitutional Court. The application time limit and the admissibility conditions must be calculated separately on the basis of the nature and notification of the final domestic decision.
Which file records should be preserved for constitutional review?
- A single timeline of the dates of the action, injunction, objection, appeal and appeal on points of law
- Documents showing the initial and current value of each asset under the injunction
- A table comparing the calculation of the probable claim with the total value of the injunction
- Requests for lifting, narrowing or replacement with security, and the decisions given on them
- Documents of the rent, financing or business loss alleged to have arisen because the asset could not be used
- A chronology of each hearing, expert, court inquiry letter and waiting period in the proceedings, showing to whom it can be attributed
- Final decisions, finality/notification records and the application routes exhausted
These records are necessary not only for a possible individual application but also so that the injunction can be reviewed periodically and proportionately by the lower court.
In the Alican Özdemir decision, a violation of the right to property was found because of the long duration of the injunction imposed on May 20, 2013, while the complaint about trial within a reasonable time was found inadmissible because the Compensation Commission route had not been exhausted. The different outcome of the two complaints in the same application shows that the correct application route must be chosen. [17]
Is a family residence annotation the same as a matrimonial property regime action?
Family residence protection does not automatically give the non-owner spouse an ownership share. Consent, the annotation, the third party and the matrimonial property regime claim are assessed separately. Detailed explanation: Can the Family Residence Be Sold Without the Spouse’s Consent? Annotation, Cancellation of Title and Third Party
Does an uncontested divorce protocol end matrimonial property regime rights?
It must be clear which asset and which claim the protocol liquidates. Whether a general statement will be regarded as a waiver is determined by reading the document, the hearing and the judgment together. Detailed explanation: Property Division in an Uncontested Divorce Protocol: Waiver and the Risk of a Later Lawsuit
How is a matrimonial property regime action filed?
Jurisdiction, venue, type of claim, court fees, evidence and injunction are planned together at the start of the file. The relationship between the divorce and liquidation processes is assessed separately. Detailed explanation: How Is a Property Division Action Filed? Court, Type of Action, Court Fees and Claims
What are the tax, title deed fee and stamp tax consequences of the liquidation of the matrimonial property regime?
The calculation of the liquidation claim and the tax/fee consequence of the payment or the transfer of an asset that is agreed are separate transactions. Writing in a protocol that “no tax will arise” does not bind the tax administration; nor can a provision that “all expenses belong to one spouse” do more than establish an internal relationship between the parties, without changing the statutory taxpayer.
Is the participation claim subject to Inheritance and Transfer Tax?
Law No. 7338 taxes transfers by inheritance or without consideration. Payment of a participation/share in increased value claim arising from the law, or a transfer of assets in settlement of a genuine liquidation debt, is, as a rule, not a gift but the performance of a debt. In this assessment, whether the payment is the performance of a genuine debt or a separately made gratuitous disposition must be determined by documents. [32]
However, an additional gratuitous disposition that cannot be explained by the liquidation calculation, a separate gift, or a transfer without consideration made before the divorce becomes final may be examined as a transfer without consideration. A private ruling (özelge) is only an administrative opinion on the facts of the applicant; it is neither a law nor a court decision that binds everyone.
Is a fixed or proportional title deed fee paid on the transfer of real property?
There is no single answer. It is determined whether the transaction is a sale/transfer for consideration, a gift, the reflection of an existing ownership share in the registry, or merely the correction of a record. For transactions in the nature of a real property transfer for consideration, paragraph 20/a of Schedule No. (4) annexed to the Fees Law No. 492 and any special exemption provisions are considered. [33] The existence of a court judgment does not by itself create a general title deed fee exemption.
Before the protocol is signed and the transfer is completed, information on the fee calculation should be obtained from the land registry directorate according to the type of transaction; the reason for acquisition, the declaration not lower than the property tax value, the amount set off against the debt and which party will bear the expense should be clearly set out in the text.
Is the protocol subject to stamp tax?
A court judgment, a petition, a settlement approved by the court and included in the operative part of the judgment, and a monetary contract signed by the parties outside court are not the same document. Stamp tax is determined on the basis of the legal nature of the signed paper and the tables annexed to Law No. 488. It cannot be said that every divorce protocol containing a monetary amount is automatically subject to fixed tax or automatically to proportional tax; the final text should be checked with a financial advisor/tax law specialist and, where necessary, with the opinion of the tax administration.
If a real property acquired through a divorce protocol is sold within five years, does income tax arise?
Income Tax Law Article 80 (repeated) regulates the gain arising from the disposal, within five years from the acquisition, of certain real properties other than acquisitions without consideration. In the private ruling of the Revenue Administration dated June 8, 2021, No. 46480499-120(2020/1732)-55351, the transfer under the protocol was accepted as being for consideration, the date of the court judgment was regarded as the new acquisition date, and an examination of the gain from the increase in value was carried out for the sale within five years. It was also stated that documented earlier loan payments may be taken into account in the cost calculation.
This result is not applied automatically to every case. The initial acquisition, whether the transfer was for or without consideration, the date of the judgment, the date of the title deed, the cost documents, indexation with the Domestic Producer Price Index (Yurt İçi Üretici Fiyat Endeksi) and the sale-year exemption are examined. If the asset is in the assets of a company/an actual commercial enterprise, or if there is continuous real property trade or a transaction giving rise to value added tax, commercial earnings, corporate tax and value added tax may also come into play in addition to income tax.
Financial closing check: Before the protocol is signed, a matrix of “legal ground – transfer date – declared value – title deed fee – probable income/inheritance and transfer tax/stamp tax – party who will bear the expense” should be created for each asset.
How are the type of action and the increase of the claim determined in 2026?

How is a contribution claim from before January 1, 2002 evaluated?
The contribution from the old period and the regime of participation in acquired property are calculated separately. The dates of the marriage and of acquisition and the documents of the contribution form the basis of the file. Are ziynet items part of the matrimonial property regime action?
The ownership of ziynet and the claim for its return are not identical to the liquidation claim. The agreement, custom, the manner in which it was given and the evidence of use are evaluated together. Detailed explanation: Wedding Gold and Jewelry (Ziynet) in a Divorce: Return, Proof and Limitation
How are personal belongings and household goods recovered?
If the ownership belongs to the plaintiff, return in kind may be requested, and if that is not possible, the value. The list of goods must be made concrete with brand, model, serial number, photographs, invoices and distinguishing features. Items for joint use in the family residence, trousseau, gifts and items for personal use are not the same legal category.
Can a matrimonial property regime claim be assigned, attached or pass to heirs?
A personal claim arising at the end of the liquidation can, as a rule, be assigned, attached and pass to heirs in accordance with the general provisions on receivables. However, the assignment of an expectancy before the matrimonial property regime ends, provisions strictly tied to the person, an express waiver and the rights of third parties are assessed differently.
The enforcement of matrimonial property regime judgments is also examined according to the nature of the provision. The mere fact that a judgment was given by the family court does not mean that every monetary liquidation provision cannot be enforced before it becomes final; where there is a real-right outcome, the family residence or a foreign judgment element, special rules may come into play. The postponement of enforcement and security options must also be assessed separately.
The most common mistakes in property division in a divorce
- Thinking that there is no right at all because the title deed is in the other spouse’s name
- Thinking that the physical half of every asset bought during the marriage will be given
- Merging the periods before and after January 1, 2002 into a single calculation
- Confusing the filing date of the divorce action with the finality date
- Equating a company share with the company’s assets
- Not separating loan payments by period and source
- Not documenting the money trail in a personal property claim
- Putting an unclear “no other claim” sentence in the protocol
- In an asset diversion allegation, confusing the routes of Turkish Civil Code Article 229, simulation and Turkish Civil Code Article 241
- Presenting pre-2024 case law on ziynet as the current rule
- Not making the injunction request concrete with the asset, the risk and the approximate claim
- Leaving the type of action solely to the word “for now”
- Not reviewing the legal assumptions in the expert report
- Postponing the evidence and injunction work because there is a ten-year period

A 12-step roadmap to prevent loss of rights
- Establish the regime and the cutoff date.
- Prepare a separate asset inventory for each spouse.
- Separate the periods before and after 2002.
- Establish the source of acquisition and the money trail for each asset.
- Preserve the documents of personal property and gratuitous dispositions.
- Divide loans and debts according to the cutoff date.
- Request company, investment and digital asset records early.
- Determine the correct action and time limit for third-party transfers.
- If an injunction is needed, apply with a concrete risk and proportionality.
- Build the strategy for the type of action, court fees and increase of the claim together.
- Review the expert report in terms of data, method and legal assumptions.
- Plan post-judgment payment, interest, enforcement and the need for enforcement abroad.
Ten questions that determine the direction of the file at the first consultation
In the first assessment, answering the following questions makes it easier to determine the rights and the missing documents:
- What are the date of the marriage, the filing date of the divorce action and the finality date?
- Is there a matrimonial property regime contract or a transition to another regime in the past?
- What assets, accounts, companies and digital assets are in the name of, or under the actual control of, either spouse?
- On what date and with what source of money was each asset acquired?
- Is there an inheritance, a gift, property from before the marriage, or a value that replaces them?
- Is there a loan, a mortgage, a company debt or an allegation of a debt to a third party?
- Is there a transfer, a money withdrawal, a change in company shares or a suspicion of asset diversion before the divorce?
- Which records are with the person and which are with the spouse, a bank, an employer, a company or a public institution?
- Has an uncontested divorce protocol, a waiver, a settlement or another statement been given?
- Is there a foreign asset, a foreign divorce judgment, a death, an heir or a third-party element?
The answers given to these ten questions with documents determine the type of action, the parties, the injunction, the amount of the claim, the need for expertise and the probable calculation model.
Case-law cards: What do the decisions resolve and where do they not apply?
| Decision | Facts/legal issue | Principle adopted | Limit of application and current weight |
|---|---|---|---|
| Civil General Assembly of the Court of Cassation, October 5, 2016, E. 2016/8-1061, K. 2016/959 | Whether a one-year or a ten-year period applies to the participation claim after divorce | The ten-year statute of limitations in Turkish Code of Obligations Article 146 applies instead of the one year in Turkish Civil Code Article 178. | It is a strong Civil General Assembly precedent for the participation claim; it does not change the special time limits of Turkish Civil Code Article 241, ziynet, return in kind and other independent claims. |
| Court of Cassation 8th Civil Chamber, March 9, 2015, E. 2014/5438, K. 2015/5540 | Enforcement, before finality, of a monetary judgment on a participation and goods claim | Because a purely property-related performance judgment does not change family status, it may be put into enforcement under a judgment before it becomes final. | It is not applied automatically to cancellation/registration of title, the law of persons or mixed items tied to the divorce judgment; the operative part is examined item by item. |
| Court of Cassation 8th Civil Chamber, March 10, 2014, E. 2013/23669, K. 2014/3820 | The fate of a liquidation action filed before the divorce became final | The action is not dismissed merely because it was filed early; the divorce is made a preliminary question warranting a stay. | If the divorce is dismissed, the liquidation condition does not arise; it does not automatically resolve the court fee, injunction and procedural strategy. |
| Court of Cassation 8th Civil Chamber, November 22, 2016, E. 2015/7311, K. 2016/15935 | Nature of an asset transferred before the regime ended and the valuation date | While the asset’s nature on the transfer date is preserved, the market value close to the decision date is investigated. | The same method is not applied mechanically to every transfer; the scope of Turkish Civil Code Article 229, the reason for the transfer and the type of asset are determined separately. |
| Civil General Assembly of the Court of Cassation, July 1, 2021, E. 2020/8-458, K. 2021/889 | Separating a company share from before the marriage from the company income arising during the regime period | The share may remain personal; the portion falling to the share during the regime period and the existing income must be investigated. | It does not make all of the company’s assets the shareholder’s personal property; for undistributed profit and company value, the legal entity and financial records are examined. |
| Civil General Assembly of the Court of Cassation, October 25, 2022, E. 2019/2-765, K. 2022/1369 | Transfer, without express consent, of a family residence with no annotation | In the family residence, the express consent of the non-owner spouse is required; the absence of an annotation does not by itself remove the protection. | Continuation of the marriage, the family-residence character, consent and the legal status of the third party are assessed in the specific file; the decision is not directly a participation claim calculation. |
| Civil General Assembly of the Court of Cassation, November 29, 2023, E. 2022/2-1205, K. 2023/1188 | Start of the ten-year period in a liquidation claim based on a foreign divorce judgment | Departing from the earlier approach of the recognition date, it started the period from the date the foreign divorce judgment became final. | The finality certificate of the foreign judgment, the applicable law and the recognition conditions are examined separately; the decision does not unify the time limits of all foreign-judgment claims. |
| Civil General Assembly of the Court of Cassation, April 24, 2024, E. 2023/2-467, K. 2024/199 | The defense that a vehicle that appears to have been acquired during the marriage in fact belongs to a third party | Once acquisition within the regime is proven, the party asserting personal property or third-party ownership must prove this exception. | The presumption of Turkish Civil Code Article 222 does not exclude real ownership evidence; the acquisition and payment records of each asset are investigated separately. |
| Court of Cassation 2nd Civil Chamber, April 4, 2024, E. 2023/5704, K. 2024/2402 | Criterion of ownership of ziynet worn at the wedding | First the agreement; if there is none, local custom; if there is none either, the criteria of to whom it was given and whether it is specific to one gender are applied. | It is a chamber decision that changes the earlier generalization of “a gift to the woman”; a concrete ziynet list, custom and proof are still required. |
| Civil General Assembly of the Court of Cassation, April 16, 2025, E. 2023/4-618, K. 2025/231 | Relationship between an action for disposition based on simulation and a liquidation claim not yet determined | The determination of the liquidation claim may be made a preliminary question warranting a stay with respect to the other action. | It does not treat every transfer to a third party as simulated; the type of action, the standing of the parties and the nature of the right to be protected must be set up correctly. |
| Court of Cassation 2nd Civil Chamber, September 11, 2025, E. 2024/9632, K. 2025/7125 | A title deed action that may change the owner of the real property subject to liquidation | An action for cancellation and registration of title should be made a preliminary question warranting a stay in the liquidation action. | The result of the title deed action must be of a nature that can actually affect the liquidation calculation; not every unrelated action is a preliminary question. |
| Civil General Assembly of the Court of Cassation, September 10, 2025, E. 2024/2-7, K. 2025/498 | A general “no property” statement at the hearing when the protocol and the judgment contain no provision | An unclear general statement is not, by itself, regarded as a waiver of a matrimonial property regime claim. | A clear, asset-specific and unhesitating protocol/waiver may still be binding; the decision does not invalidate all general wording. |
| Court of Cassation 2nd Civil Chamber, September 11, 2025, E. 2025/4456, K. 2025/7122 | Whether the liquidation claim is monetary or a real right | Participation, contribution and share in increased value are, as a rule, personal monetary claims; a real right is exceptional. | Separate legal grounds such as Turkish Civil Code Article 226/2, Article 240 and the return of an asset that truly belongs to the plaintiff are reserved. |
| Court of Cassation 2nd Civil Chamber, February 4, 2025, E. 2025/49, K. 2025/923 | Dispute among chambers of the Regional Court of Appeal (Bölge Adliye Mahkemesi) on an injunction on the assets of the company of which the spouse is a shareholder | The subject of the liquidation is the spouse’s company share and the rights attached to the share; an injunction cannot additionally be placed on the assets registered in the name of the company, which has a separate legal personality and is not a party to the action. | It does not prevent an appropriate protection request for the company share, the spouse’s receivable from the company and assets actually belonging to the spouse; a simulation or Turkish Civil Code Article 229 claim must be set up with the right party and cause of action. |
Status of sources: The docket, decision, date and chamber details of decisions should be verified through the Court of Cassation Presidency Decision Search (Karar Arama)/UYAP Precedent (Emsal). The third-party links given in the sources are access copies used where the official system does not produce a permanent decision URL; they are not asserted to replace the official source.
Note on reading case law: What should be used is not the title of a decision but the factual pattern, the result of the claim, the period of legislation applicable, the ground for reversal and the relationship with later case law. Not every decision automatically produces a result for all matrimonial property regime files.
How should Regional Court of Appeal decisions be used in a matrimonial property regime file?
The Regional Court of Appeal is the legal-remedy court that reviews the first-instance decision within the limits of the grounds of appeal and public policy. The decision of a civil chamber of a Regional Court of Appeal does not form a general and binding rule, like Court of Cassation case law, for all courts in the same region or in another region. Nevertheless, Regional Court of Appeal decisions are important for seeing the direction of first-instance practice, the review of evidence and reasoning, interim decision issues such as an interim injunction that often become final, and disputes that do not reach the Court of Cassation.
What should be checked when it is said, “The Istanbul, Ankara or Izmir Regional Court of Appeal decides this way”?
The name of the city alone is not sufficient. There may be different civil chambers with subject-matter jurisdiction within the same Regional Court of Appeal; the chamber’s view may change over time. In a reliable reference to a Regional Court of Appeal, at least the following elements should be shown together:
- The name of the Regional Court of Appeal and the civil chamber
- The date, docket and decision number of the decision
- Whether the decision dismissed the appeal on the merits, set aside the first-instance judgment or rendered a new judgment
- Whether the decision is final and, if it was appealed on points of law, the Court of Cassation result
- The similarity of the principle used to the specific case
- Whether there is a later decision of a Regional Court of Appeal, a chamber of the Court of Cassation or the Civil General Assembly on the same subject
What is the specific example in which Ankara, Izmir and Istanbul Regional Court of Appeal decisions are compared?
The published file resolving the conflict on an injunction on company assets clearly shows how the Regional Court of Appeal filter is to be used:
| Decision | Specific approach | Later legal situation |
|---|---|---|
| Ankara Regional Court of Appeal 12th Civil Chamber, November 30, 2017, E. 2017/1141, K. 2017/1119; June 7, 2018, E. 2018/922, K. 2018/823 | Because the company was not a party to the action and the company’s assets were not the subject of the dispute, it separated protection over the spouse’s share from the company’s assets. | It is consistent with the distinction adopted in the 2nd Civil Chamber of the Court of Cassation E. 2025/49, K. 2025/923. |
| Izmir Regional Court of Appeal 18th Civil Chamber, April 1, 2021, E. 2021/655, K. 2021/553 | Besides the company not being a party, it did not find it appropriate for an injunction to be placed on a company’s real property without regard to the claim amount, the balance of interests and other existing injunctions. | It was regarded in the Court of Cassation’s conflict-resolving decision as one of the examples of the approach of proportionality and separate legal personality. |
| Istanbul Regional Court of Appeal 6th Civil Chamber, September 8, 2022, E. 2022/2119, K. 2022/1787; February 10, 2022, E. 2022/184, K. 2022/257 | It distinguished between the assets of the company that was not a party to the action and the assets registered in the spouse’s name and the company share. | It converged on the same result with the final conflict-resolving decision of the 2nd Civil Chamber of the Court of Cassation dated February 4, 2025. |
The decision of the 2nd Civil Chamber of the Court of Cassation E. 2025/49, K. 2025/923 resolved the conflict among different final decisions of the Regional Courts of Appeal within the framework of Law No. 5235 Article 35. Because of this decision, in the examples above the result of the Court of Cassation resolving the conflict on the distinction between the company share and the company’s assets, and no longer merely a “regional tendency,” should be taken as the basis.
Can a Regional Court of Appeal decision change the current valuation date?
If the Regional Court of Appeal sets aside the first-instance judgment and renders a new judgment by carrying out the liquidation itself, to which date the market value on which the judgment is based should be closest must be reviewed separately. The case law of the 2nd Civil Chamber of the Court of Cassation E. 2023/4239, K. 2024/5363, which reviewed the decision of the Ankara Regional Court of Appeal 12th Civil Chamber dated December 27, 2022, E. 2019/1662, K. 2022/1446, emphasizes that where the liquidation is carried out by the Regional Court of Appeal, the market value of the asset must be determined according to the date closest to the Regional Court of Appeal’s decision date. This does not mean that a new valuation will automatically be made in every appeal; whether the Regional Court of Appeal has again rendered a judgment on the merits and the effect of the change in value on the result are decisive.
Frequently asked questions
If the house was bought during the marriage, does it belong to whoever is named in the title deed?
Title ownership is with that spouse; however, if the price was paid from acquired property, the other spouse may have a participation claim at the end of the liquidation. The result is generally not half of the title deed but a monetary claim.
Is there property division even if the marriage lasted one month?
There is no minimum duration of marriage in the law. If there is a value acquired within the regime, it can be liquidated; but the source of acquisition and the presumption of personal property are decisive in the specific case.
Can a non-working spouse request a participation claim?
Yes. For a participation claim, proof of a direct monetary contribution to the acquisition of the asset is not, as a rule, required. For the share in increased value and the pre-2002 contribution claim, however, proof of the contribution is a separate matter.
How can I find out about all the property registered in my spouse’s name?
Land registry, vehicle registry, bank, Central Registry Agency (Merkezi Kayıt Kuruluşu), trade registry, tax and other records can be requested through the court; however, the period and the data must be made concrete. One must not resort to unlawful password cracking or unauthorized access to a private account.
What happens if the spouse transfers the house to his or her mother before the divorce?
The price, the transfer date, possession, the purpose and the buyer’s position are examined. The value to be added back under Turkish Civil Code Article 229, the simulation/title deed action, an interim injunction and, if the conditions exist, Turkish Civil Code Article 241 may be assessed together.
Is the rental income of a house received by inheritance divided?
The house itself is personal property. Rental income is, as a rule, acquired property unless the spouses have agreed otherwise by a valid contract.
Does property bought after the divorce action is filed enter the liquidation?
If the divorce is accepted and becomes final, the regime ends on the date of the action; later new acquisitions, as a rule, do not enter. However, the substitution of a right from the matrimonial property regime period, the income of old property or a financing link is examined separately.
My spouse paid the loan installments after the divorce action; does my claim decrease?
A later payment is not automatically deducted from the participation claim, nor is it entirely excluded. The debt at the cutoff date, the person who made the payment, ownership and, if any, the share in increased value are calculated together.
Does the spouse at fault receive less in property division?
Fault in general does not change the share. Only in a divorce based on adultery or attempt on life does Turkish Civil Code Article 236/2 give the judge the power to reduce or remove the share.
If we do not write the property in an uncontested divorce protocol, can we file an action later?
The protocol, the statement at the hearing, the reasoning and the judgment are examined together. An unclear general sentence is not always a waiver; but a clear and specific liquidation/waiver provision may prevent a later action.
Is mediation mandatory in a matrimonial property regime action?
As a rule, no. In disputes over which the parties can freely dispose, voluntary mediation can be considered; disputes involving an allegation of domestic violence are outside the scope. Real property, third-party and enforceability conditions are examined separately.
How long does the action take?
There is no single statutory period. The number of assets, the investigation of companies and foreign countries, the number of experts, notifications, preliminary questions warranting a stay and legal remedies determine the duration. No guarantee can be given about the length of the result.
Will I also be liable for my spouse’s debts?
According to Turkish Civil Code Article 224, each spouse is liable for his or her own debts with all of his or her property. However, representation of the family union, suretyship, a joint loan, joint borrowing and the allocation of debts in the liquidation balance sheet are examined separately.
If the action is won, does the house pass directly to me?
As a rule, no; a monetary claim is awarded. There may be statutory exceptions such as superior benefit in co-owned property or the surviving spouse’s right to the family residence. The debtor spouse may also consider the option of payment in kind within the statutory limits.
Can enforcement be carried out before the judgment becomes final?
According to the approach of the 8th Civil Chamber of the Court of Cassation dated March 9, 2015, E. 2014/5438, K. 2015/5540, a purely performance judgment concerning a monetary claim for participation/share in increased value or the price of goods can be put into enforcement under a judgment before it becomes final. For items concerning the real right in a real property, such as cancellation and registration of title, finality is required. In a mixed judgment, each item of the operative part must be examined separately; the debtor’s rights to postponement of enforcement and security must also be taken into account.
Is a participation claim or a transfer made because of the liquidation subject to tax?
There is no single, automatic answer. Payment of a genuine liquidation claim is, as a rule, the performance of a debt for consideration; however, an additional transfer without consideration, a real property transfer, the way the protocol is structured and a later sale may give rise to separate tax consequences. The examination of the title deed fee, stamp tax, inheritance and transfer tax and Income Tax Law Article 80 (repeated) must be carried out asset by asset. In the private ruling of the Revenue Administration dated June 8, 2021, the date of the judgment was accepted as the acquisition date for a real property acquired through a divorce protocol, and the possibility of a gain from the increase in value for a later sale within five years was assessed; the private ruling is an administrative opinion only as to the specific application.
If a foreign divorce judgment has not been recognized in Türkiye, does the statute of limitations not start?
This assumption is no longer safe. The decision of the Civil General Assembly of the Court of Cassation dated November 29, 2023, E. 2022/2-1205, K. 2023/1188 started the ten-year period from the date on which the foreign divorce judgment became final in its own country. The recognition/registration and liquidation steps should be planned together so that the time limit is not missed.
If a spouse disclaims an inheritance, is the disclaimed value automatically divided?
No. An inheritance is, as a rule, personal property; a disclaimed inheritance is not automatically regarded as a value to be added back under Turkish Civil Code Article 229. The correct provision for the disclaimer by an insolvent heir with the aim of harming creditors is Turkish Civil Code Article 617; creditors or the bankruptcy administration may request annulment within six months from the date of the disclaimer unless security is given. Turkish Civil Code Article 578, on the other hand, regulates loss of inheritance rights.
What can be done if the interim injunction in a matrimonial property regime action lasts for years?
The lifting of the injunction, narrowing of its scope or its replacement with appropriate security should be requested with current asset values, the probable claim amount and the concrete economic effect of the injunction. The existing objection and appeal routes against a dismissal decision must be used within the time limit. The Alican Özdemir decision requires that a long-lasting injunction be assessed on current reasoning; the decision does not automatically lift every injunction. [17]
Can I apply directly to the Constitutional Court for a long-lasting matrimonial property regime action?
A direct application to the Constitutional Court solely for a complaint about trial within a reasonable time is not a safe assumption in the current system. To the extent applicable, the Compensation Commission route under Law No. 6384 and the application routes that follow it must be exhausted. A complaint about the right to property based on the disproportion of the injunction is different; after the ordinary objection and legal remedies are exhausted, it is examined under its own admissibility conditions.
Can a house bought or a business set up together without marriage be the subject of a matrimonial property regime action?
It is evaluated not under the matrimonial property regime provisions but according to the real legal ground of the contribution. Co-ownership, a loan, an ordinary company (adi ortaklık), a contract or unjust enrichment may come into play. Without seeing the bank receipts, messages, joint business plan, title deed and loan records, the conclusion “half is mine” or “I have no right at all” cannot be drawn; the court with subject-matter jurisdiction and the statute of limitations also vary according to the legal ground chosen.
Is an Istanbul, Ankara or Izmir Regional Court of Appeal decision a binding precedent on its own?
No. A Regional Court of Appeal decision is important for the specific file; however, on its own it is not a general rule with the force of nationwide Court of Cassation case law. The chamber, the date, the docket and decision numbers, the finality of the decision and later review by the Court of Cassation must be checked together. The practice among these regional decisions on an injunction on company assets was brought to a common result by the conflict-resolving decision of the 2nd Civil Chamber of the Court of Cassation, E. 2025/49, K. 2025/923.
How does Güneş & Güneş Law Firm work in matrimonial property regime files?
In its work, carried out since 1999 and based in Antalya, Güneş & Güneş Law Firm does not approach a matrimonial property regime dispute only with the question “which asset is in whose name?” Depending on the circumstances of the file, it:
- Builds a regime and date matrix.
- Prepares an asset and debt inventory.
- Creates an evidence plan for land registry, bank, company, investment and foreign records.
- Separates the money trail of personal property and acquired property.
- Reviews the participation claim, share in increased value, contribution and equalization calculations in separate layers.
- Evaluates transfers, simulation, Turkish Civil Code Article 229 and third-party routes together.
- Follows the legal basis, scope and enforcement of the injunction.
- Makes the protocol, waiver and settlement texts concrete asset by asset.
- In files with companies, coordinates with commercial, tax and valuation experts.
- Before the protocol and the judgment, checks the title deed fee, possible taxes, sharing of expenses and the risk of a later sale asset by asset.
- In digital assets, crypto, platform income and offshore structures, prepares a lawful data protection/tracing plan.
- Can provide coordination of documents and procedures in Turkish, English, German and Russian.
- Assesses post-judgment payment, interest, security, enforcement under a judgment, composition with creditors/bankruptcy and recognition/enforcement abroad.
No guarantee of results is given in legal services. The documents of the specific case, the opposing party’s defense, the expert examination and the court’s assessment determine the result.
Conclusion
The correct answer to property division in a divorce is not “everything bought during the marriage is divided in half.” For a sound liquidation, which regime applied on which dates; the ownership, source of acquisition and debt of each asset; personal property contributions; gratuitous transfers; current value; proof; and the correct route of action must be established together.
Final legal principle: First the date, then the property group, then the financing, then the value to be added back, equalization, debt and valuation; and lastly the participation claim and other claims must be clarified.

Consultation preparation documents
To record your assets and debts separately, organize the dates of events and identify missing documents, you can use an asset and debt inventory, a timeline of events and payment dates, and a preparation form for the first consultation with an attorney. These working documents do not by themselves create an action or a legal time limit calculation.
This article is for general legal information. In a specific dispute, the dates of events, the documents, the type of claim and the time limits are assessed together.
