Summary

A legal assessment of container and refrigerated cargo damage under marine cargo insurance, coverage exclusions, expert surveys, payment denial and the objection process.

Assessing a payment claim under marine cargo insurance requires establishing not only that damage occurred but also which interest, which transit period and which risks the policy covers. Breakage, wetting or temperature-related spoilage in a container may not be subject to the same coverage analysis. For the insured, the right starting point is to limit the loss, notify the insurer without delay and preserve the records that show the cause of the damage. An objection to a payment denial, in turn, should rest on comparing the reasons in the denial letter with the policy wording and the technical findings.

What loss does marine cargo insurance cover?

Cargo insurance addresses the insured interest in the goods being carried. Hull and machinery insurance on the vessel and the carrier's liability insurance govern different relationships. An event for which the carrier is not liable may be covered under the cargo policy; conversely, the existence of a claim against the carrier does not mean the cargo insurer will pay in every case.

First, the exact names of the insured, the policyholder, any beneficiary and the insurer are established. The broker or agent that forwarded the policy and the insurance company that bears the risk may not be the same party. The certificate, open cover, shipment declaration, endorsements and special conditions should be read together. A single page showing only the sum insured may not describe the full scope of cover.

An incoterm in the sales contract, such as CIF, CIP or another delivery term, may affect who is to arrange the insurance. Even so, the claimant's insured interest and its right under the policy are examined separately. If the documents name different companies, assignment, endorsement, insurance for the account of another and representation are clarified. Under Turkish law, this assessment is made under the provisions of the Turkish Commercial Code (TTK) on insurance contracts and property insurance. [1]

How should "all risks" and special clauses be read?

The phrase "all risks" does not mean that every exclusion in the policy falls away. The Institute Cargo Clauses (A) 1/1/2009 set out the scope of cover and the exclusions together. For headings such as inadequate packing or preparation, loss arising from the inherent nature of the goods, and delay, the conditions in the text are examined. For example, under the packing exclusion, who carried out the preparation and when, relative to the commencement of the insurance, matters. [2]

A temperature or refrigeration failure clause added to the policy may expand the standard wording or make cover subject to specific conditions. For that reason, no definite outcome can be stated for every cargo on the sole ground that "there is an A clause" or "there is no refrigeration clause." The type of goods, the version of the form, the special conditions and the law applicable to the contract are assessed together. If there is a difference between the explanation in the insurance proposal and the policy as issued, the proposal and the correspondence should also be kept.

The General Conditions of Cargo Insurance published by the Turkish Insurance Association (Türkiye Sigorta Birliği) regulate the headings on scope and exclusions separately. Selecting a single sentence without establishing the relationship among the general conditions, the special conditions, the endorsements and the mandatory provisions of the law does not make for a sound coverage review. In particular, it should not be assumed that a provision in older general conditions can be applied as written despite the current statute. [1, 3]

Commencement and termination of the insurance

That the damage arose during carriage does not by itself show that the insurance was in force at that moment. The route, transshipment, storage and final delivery place stated in the policy are checked. The transit clause of ICC (A) 2009 regulates the ordinary course of carriage and the various termination events; the sixty days after discharge at the final port of unloading are not an additional cover period guaranteed in every case. A termination event that occurred earlier may be decisive. [2]

Where the shipment is diverted to another port or held in an unplanned warehouse, the need to notify the insurer and to obtain continuation of cover is assessed under the policy. The business's own stock preference is not the same as a compulsory interruption of carriage. If the destination changed in e-mails while the certificate retained the old route, an avoidable dispute may arise later.

What data is needed for refrigerated container damage?

A high temperature measured on arrival in reefer cargo does not by itself explain when and why the problem began. The product's temperature before loading into the container, the set point, the actual unit records, the power connections, ventilation and the stowage method should be examined together. In the same container, air temperature and the product's core temperature may give different results. The report should therefore state the type and location of the measurement.

Instead of screenshots alone, the original electronic file of the records should be obtained where possible. Time zone, unit number, measurement interval and calibration information are added. A power outage at the terminal, an alarm on board and entry into the warehouse are shown on the same timeline. Intervals with no records are also clearly marked; these gaps are not filled with assumed values.

Document or dataQuestion it answersLimit in the review
Pre-loading product inspectionIn what condition was the product delivered?Does not by itself explain the whole voyage.
Temperature recorder fileIn which time interval is the deviation seen?Location, time and calibration must be verified.
Reefer alarm and service recordsWhat fault or intervention is recorded on the unit? Not every alarm is the cause of the damage.
Terminal power recordsWhen was the electrical connection established?Compared with the product's earlier condition.
Sample and laboratory reportWhat is the nature and extent of the spoilage?Sampling must be representative of the entire cargo.

If the damage is partial, it should not be assumed from the outset that the entire cargo is unusable. The possibility of sorting and reassessment is investigated within the limits of product safety and legislation. For food or similarly sensitive products, the aim of preserving commercial value does not justify placing an unsafe product on the market. Where destruction is required, the official procedure and the quantity and expense records are preserved.

What should the insured do when damage is noticed?

TTK Art. 1446 requires the insurer to be notified without delay once the risk becomes known. The insured should use the communication channel stated in the policy and describe the shipment, when the damage was first noticed, where it is located and the measures currently in place. The fact that the exact loss calculation is not yet ready should not be a reason to postpone the first notice. Reports completed later can be submitted by supplementary notice.

Under TTK Arts. 1447 and 1448, it is important to provide the necessary information and documents, to allow inspection, to mitigate the loss and to preserve the insurer's rights against third parties. Where the insurer's instructions are awaited, reasonable measures to prevent further deterioration of the product must not be neglected. The reasoning behind the decision taken and the expenses incurred should be recorded. [1]

The following documents are useful in the first notice file:

  • The policy, certificate, endorsements and shipment declaration.
  • The bill of lading, commercial invoice, packing list and delivery records.
  • Photographs of the damage, the first report and the current location of the product.
  • The refrigeration instruction, temperature records and relevant maintenance documents.
  • The damage notice sent to the carrier and the invitation to a joint survey.
  • Documents on protection, storage, sorting and, if any, the decision to destroy.

Under Turkish law, the sanction for late notice cannot be generalized as automatic full denial. TTK Art. 1446 assesses whether the delay increased the amount payable and the degree of fault; whether the insurer actually learned of the event beforehand is also important. On the other hand, delaying the notice may cause loss of evidence and may lead to breaches of obligations that are separately disputed. [1]

How is the insurer's reason for denial tested?

A denial letter merely saying "outside cover" does not mean the review has been completed. The clause relied on, the event that constitutes the exclusion, the report relied on and the link between the loss and the exclusion should be asked about. The insured, too, documents its insured interest, the loss and the connection to the policy. TTK Art. 1409/2 places on the insurer the burden of proving that a risk provided for in the contract falls outside cover. [1]

Inadequate packing and loading

In the case of a broken machine, the lashing points, transport vibrations, traces of movement inside the container and loading photographs are compared. The conclusion in the report that "the packing was inadequate" should show which technical standard or concrete deficiency it rests on. It is also investigated whether the damage occurred under ordinary carriage conditions or in an extraordinary event. The capacity and timing of the party who did the stowage are also part of the policy assessment.

In its decision of 17.04.2025, E.2024/3947, K.2025/2551, the 11th Civil Chamber of the Court of Cassation (Yargıtay 11. Hukuk Dairesi) addressed damage arising from machines brought by sea not being properly secured inside the container. The decision denying the claim on the basis of the policy exclusion and technical reports was upheld. The decision does not mean that every machinery loss or every closed-container cargo falls outside insurance; it must be read in light of the concrete packing findings and the policy wording applied. [4]

The link between spoilage and delay

Spoilage of the product because the ship was late and spoilage because the refrigeration unit was not operating may call for different assessments. Delay may coincide with the damage, but that alone does not prove that the technical cause was the delay. Insufficient pre-cooling, obstructed air circulation or unit failure should be investigated independently. Whether the policy's delay exclusion applies to the event cannot be separated from the technical cause analysis.

If the insured's and the insurer's survey reports conflict, the data source of the conflict should be shown. One report may have examined the entire product, the other only a few cartons. Different samples, measurement methods or timing may show that the two results are not comparable as to the same event. For a legal objection, it is more useful to explain these differences than merely to state the conclusion of the opposing report.

How are the amount payable and the time of payment determined?

The sum insured is not the amount payable on every loss. The valuation basis in the policy, the extent of the damage, the deductible, underinsurance and salvage value are examined. Claiming the full value of repairable goods, or adding the same expense both to the damage amount and to a separate expense item, may produce an erroneous result. Reasonable survey and loss-mitigation expenses under TTK Arts. 1426 and 1448 are assessed separately. [1]

Hypothetically, in a file where the policy provides for a fixed deductible of EUR 4,000, there is no underinsurance and the valuation is undisputed, if EUR 6,000 of salvage value is deducted from EUR 60,000 of damage, EUR 54,000 remains. Only on these assumptions, and if the deductible is applied to this amount, the principal damage payment would be EUR 50,000. Separately recoverable expenses and the policy's different calculation provisions are not included in this example.

Where Turkish law applies, TTK Art. 1427 contains a provision on when the claim falls due, linked to the delivery of documents and the completion of investigations; as a rule, forty-five days after notice is also important. If the investigation is delayed for reasons that cannot be attributed to the insurer, the period does not run. If the investigations cannot be completed within three months, an advance payment comes into play under the conditions set out in the statute. These periods should not be presented in every file as an unconditional guarantee of payment without review. [1]

What path follows after a payment denial?

First, according to the policy and the reason for denial, it is determined whether the issue is missing evidence, a difference of technical opinion or a dispute over legal interpretation. Preparing for an issue that can be resolved with an additional document differs from preparing for a dispute in which cover is denied entirely. The response given to the insurer should draw a clear link among the event, the policy provision, the evidence and the amount claimed. A general objection may not show which assessment is sought to be changed.

For a commercial monetary claim in a Turkish court, mediation as a condition precedent to litigation is considered. For insurance arbitration or contractual arbitration, the scope of the relevant system and the contract is checked separately; it cannot be said that the same arbitration route is open against every foreign insurer. For foreign law and court records, the provisions of the Turkish Private International and Procedural Law (MÖHUK) and any special protective rules are taken into account. [5, 6]

The insurance limitation period under TTK Art. 1420 differs from the period against the carrier under TTK Art. 1188. Under Turkish law, for insurance claims, a two-year period from the date the claim falls due and a six-year outer limit from the risk for compensation are assessed, subject to special provisions. Negotiating with the insurer does not automatically protect the timetable for proceeding against the carrier. If payment is made, subrogation and the records for the insured's uncovered portion are arranged separately. [1]

Conclusion

In a marine cargo insurance dispute, a sound file addresses the interpretation of the policy and the technical cause of the damage together. For refrigerated cargo, temperature records stand out; for container damage, packing and delivery documents; and for a payment denial, the link between the reasons and the evidence. Notice to the insurer, loss mitigation and the preservation of rights against the carrier must be carried out at the same time. The outcome depends on the type of cargo, the actual text of the policy and the applicable law.

Frequently Asked Questions

Does an all-risks policy cover every kind of damage?

No. The scope of the policy, the exclusions and the special conditions apply together. The phrase all risks does not remove the need to examine the cause of the loss and the policy period.

Is a single temperature photograph sufficient when refrigerated cargo spoils?

A single measurement generally does not explain the timing and cause of the damage. The product's initial condition, unit records, power connections, measurement method and sample results are assessed together.

Can the goods be protected before the insurer sends a surveyor?

Reasonable measures to reduce the loss must not be neglected. The action taken, its reasons and its costs should be documented; the insurer should be informed and, as far as possible, the opportunity to inspect should be preserved.

Does late notice forfeit the entire sum insured?

Under Turkish law, no such consequence can be drawn automatically. Conditions such as whether the delay increased the loss, fault and whether the insurer had prior knowledge are examined.

Can payment be obtained from the insurance before the carrier's fault is proven?

A cargo insurance claim and the carrier's liability are different legal relationships. For a loss occurring within the policy's scope, it is not necessary in every case for the carrier's liability to have been determined beforehand by a final judgment.

Does corresponding with the insurer after a denial letter stop the time limits?

Correspondence is not a general step that protects all time limits. The insurance limitation period, the period concerning the carrier's liability and any arbitration conditions should be tracked on separate timetables.
