A foreign child from a previous marriage may obtain a family residence permit in Türkiye when the required conditions are met. The sponsor may be the child's own mother or father, or a new spouse who meets the conditions set out in the law. However, permission for the child to stay in Türkiye does not mean that leaving another country, settling in Türkiye, custody, contact with the other parent or citizenship matters are resolved automatically. In a sound settlement plan these procedures should be carried out together, but each within its own legal requirements. [1, m.34–35]
A mother or father living abroad who remarries and moves to Türkiye may need the child to join the new family arrangement as well. Sometimes the parent has not yet divorced; sometimes custody is shared, the other parent has died, or the child is approaching eighteen. In every case, rather than using the same document list, the family relationships and any existing court decisions should be examined first.
This guide explains, together, the family residence permit for a child from a previous marriage, the consent document, foreign custody orders, school and health procedures, the legal position of the new spouse, and possible citizenship routes. The explanations are based on legislation and official sources reviewed as of 14 October 2026. The approach may change if the country, citizenship, court decision or the child's actual living arrangements change.
Can a family residence permit be granted for a child from a previous marriage?
Law No. 6458 on Foreigners and International Protection (YUKK) covers not only the sponsor's biological child but also the minor foreign child of the spouse. Therefore, a family residence permit for a foreign national's child from a previous marriage is legally possible where that foreign national marries a Turkish citizen. It is not necessary for the new spouse to adopt the child first. However, the family relationship must be documented, the sponsor requirements must be met, and the authority to represent the child must be clarified. [1, m.34–35]
Who may act as the sponsor?
The groups listed in Article 34 of the law are Turkish citizens, persons falling under Article 28 of Law No. 5901 on Turkish Citizenship, foreign nationals holding residence permits in Türkiye, refugees and holders of subsidiary protection status. The Blue Card is important for documenting that a person falls under Article 28. The position of persons with work permits is determined by assessing the provisions that replace a residence permit together with the family residence permit conditions. [1, m.27, 34–35]
Different statuses such as temporary protection, conditional refugee status and an application for international protection cannot be used in place of one another. Saying only that someone "has an identity in Türkiye" does not establish that the sponsorship conditions are met. A similar point is also discussed in the article International Protection and Temporary Protection Law.
Example: A foreign mother whose child from a previous marriage is ten years old marries a Turkish citizen. A family relationship can be established through the new spouse, who is a Turkish citizen. It is not correct to automatically impose on the child's mother a separate requirement of having lived in Türkiye for one year. The sponsor and the applicable exception must be determined first.
What conditions must the sponsor meet?
The main conditions are sufficient monthly income, housing suitable for the size of the household, health coverage covering all family members, an address registration, and documentation that no conviction for an offence against the family order has been imposed within the last five years. For income, the total must not be less than the minimum wage, and at least one third of the minimum wage per household member must be ensured. The calculation must be made using the amount in force on the date of application. The official list of required documents states that a written income declaration will be accepted as sufficient for a Turkish citizen sponsor. [1, m.35] [2]
As a general condition, a foreign sponsor must have been staying in Türkiye for at least one year on a residence permit. There are statutory exceptions for holders of residence permits for scientific research or work permits, for persons covered by Article 28 of Law No. 5901, and for foreign nationals married to Turkish citizens. Refugees and holders of subsidiary protection status in Türkiye may not be subject to sponsor conditions. The one-year waiting requirement that applies to foreigners does not apply to a Turkish citizen. [1, m.35] For details on this subject, see the article Work Permits for Foreign Nationals in Türkiye.
For how many years is the child's permit issued?
A family residence permit may be issued for no more than three years at a time; issuing it for three years is not an automatic right. The permit cannot exceed the period of the foreign sponsor's residence. The validity of the passport also affects the outcome: a passport or equivalent document valid for at least sixty days longer than the requested permit period must be held. Each child requires a separate permit and application record; the mother's or father's card does not replace the child's card. [1, m.21, 23, 34]
Why are travel, settlement and residence permits assessed separately?
The question "Can I bring my child to Türkiye?" involves at least four different procedures. A positive outcome in one of them does not automatically complete the others.
| Procedure | Question to be answered | Records to be examined first |
|---|---|---|
| Passport and border crossing | Are the child's travel document, visa and accompaniment conditions in order? | Passport, visa rules, departure country and carrier requirements |
| Settlement in Türkiye | Who is authorised to change the child's centre of life? | Custody decision, right to decide on settlement, the other parent's rights |
| Residence permit | Under what status will the child stay in Türkiye? | Family relationship, sponsor, YUKK and application documents |
| Daily life and representation | Who will handle school, health and official procedures? | Parenthood, custody or guardianship documents and the institution's conditions for processing |
For example, a permit granted for a two-week holiday may not prove that the child has been allowed to live in Türkiye indefinitely. The child's lawful entry into the country also does not remove the other parent's right to determine the child's place of residence. Obtaining a residence permit in Türkiye is not a court decision that changes a foreign custody order.
What powers and responsibilities does custody cover?
Custody covers the child's care, education, protection, representation and decisions relating to personal development. Under Turkish law, parents make decisions by taking the child's best interests into account, and the child's views are considered in line with the child's maturity. Custody does not give one parent the power to end the other parent's relationship with the child arbitrarily. The duty to contribute to the child's maintenance and education also continues. [3, m.182, 323–324, 327–339]
Expressions used in a foreign decision, such as "sole custody", "joint custody", "parental responsibility" or "residence order", should not be reduced to a single Turkish label. The fact that the child's day-to-day care lies with one parent does not show that the power to choose the country of residence also lies only with that parent. The operative part of the decision, the applicable law and any later decisions should be read together.
When is the other parent's consent required?
Article 34(3) of the law provides that the consent of a mother or father who is outside Türkiye and holds joint custody is required for a child's family residence permit. In addition, the Presidency of Migration Management's current list of documents for family residence permits states that a certified custody document is required in a divorce case and, where the other parent has the right to see the child, that the other parent's certified consent must also be provided. The statutory provision and the documents requested in the application must therefore be read separately. [1, m.34/3] [2]
As a result, neither "I alone hold custody, so no consent is ever needed" nor "every divorced family must always provide the same consent document" is a reliable general rule. Even in a file where there is only one custody decision, a request for documents concerning the other parent's contact right may arise. Where there has been a death, a declaration of absence, single parenthood, removal of custody or a special court decision, the situation must be explained with the appropriate official document.
| Situation in the family | Matter to be clarified in the file |
|---|---|
| Joint custody | The other parent's consent to the settlement and residence application; the sharing of authority under the decision |
| Sole custody and contact with the other parent | Custody document, contact arrangement and the consent request in the official application list |
| Death of the other parent | Certified death certificate and existing authority of representation |
| Declaration of absence or single parenthood | The relevant official decision or record; not relying on a personal statement alone |
| The other parent cannot be reached or refuses consent | The type of application required, the competent national authority, the legal interest and the child's best interests |
How should the consent document be prepared?
The document must be clear and suited to the procedure for which it is used. The identity details of the child and the parents, the procedure permitted, the person with whom the child will live in Türkiye, the purpose of settlement and, where applicable, the period must be specified. The scope of consent for a passport, for travel, for living in Türkiye and for a residence permit application is not the same. Rather than adding every heading to the document at random, it should be checked whether the authority needed can lawfully be granted.
When preparing an enforceable text, the following points are considered:
- Does the consent cover only a particular trip, or also settlement in Türkiye?
- Is it clear with which parent and in which country the child will live?
- Does the consent cover the residence application and, if necessary, any extension procedures?
- Are the arrangements for contact with the other parent and holiday periods consistent with the existing decision?
- Have the approval requirements in the country where the document was issued, and the requirements for its use in Türkiye, been met?
It cannot be said that every consent document is valid for six months under the law. Validity depends on the content of the document, the type of procedure, the applicable law and the currency requirement of the authority that will accept it. A request for currency and the period of residence approved in the document are different matters. A holiday consent signed by a parent in the past should not be used as a permanent settlement consent without examining its scope.
If consent is refused, can an application be made to a court?
An application may be possible; however, it cannot be said that in every case an action can be brought in Türkiye under the same name so that a court decision takes the place of the other parent's signature. First, the child's habitual residence, the country in which the existing decision was made, international conventions, the nature of the procedure requested and the court's jurisdiction must be determined. Habitual residence means not only population or address registration, but the child's actual centre of life.
The explanations submitted to the court must be concrete: the housing, school and health plan in Türkiye; sources of livelihood; the child's age and views; the relationship with siblings; how contact with the other parent will be maintained; and how travel costs and handover will be covered. A single reason such as "I have a new marriage" does not explain all of the child's interests. Where there is a risk of violence or insecurity, protective measures should not be delayed in the expectation of an agreement.
How should Court of Cassation decisions be read?
In its decision of 17 June 2015, E.2015/11374, K.2015/12897, the Civil Chamber of the Court of Cassation (Yargıtay 2. Hukuk Dairesi) held that the departure abroad of a child by the parent exercising custody does not depend on the consent of the other spouse. However, the decision goes on to reject the claim on the basis that the file contained no document showing that the father's approval was required for the entry visa. It cannot be concluded from the first sentence alone that there is unlimited authority for all foreign-country procedures. [4]
In its decision of 4 July 2024, E.2024/3491, K.2024/5336, a request by the mother exercising custody to travel to Romania was assessed under different concrete circumstances. The decision, which accepted that the mother had a legal interest in seeking judicial intervention where the foreign authority requested consent and the father refused, was upheld. This decision shows that a judicial solution may be possible in the necessary circumstances; it does not mean that every residence application in Türkiye will be accepted with the same result. [5]
How are foreign divorce and custody decisions used in Türkiye?
The existence of a foreign divorce decision and the effect in Türkiye of its custody provisions are different questions. A notarised translation of a document does not show that all of its provisions can be enforced in Türkiye. Similarly, appearing as divorced in the population register does not mean that the custody, personal contact or maintenance provisions have all become enforceable. [6, m.1/2, 50–59] [7, m.27/A]
International conventions are examined first
For Türkiye, the 1996 Hague Child Protection Convention, which entered into force on 1 February 2017, lays down specific rules for child protection measures falling within its scope. The general starting point is the jurisdiction of the authorities of the child's habitual residence. The Convention distinguishes between the automatic recognition of measures taken by a contracting state and the enforcement procedure that may be needed for compulsory implementation. For this reason, it is not accurate to say that every foreign custody decision requires a new recognition action under the Private International Law and Procedure Law (MÖHUK). The relationship in force with the states concerned, and the date and scope of the decision, must be checked. [8, m.5, 23–28, 53] [9]
The Convention is not a regulation that grants residence or immigration permission; immigration and asylum decisions are outside its scope. Separate rules also apply to filiation, adoption, maintenance and certain other matters. The priority of the Convention emphasised in academic commentary does not turn all family disputes into a single procedure. [8, m.4] [10]
Recognition, enforcement and population registration must be kept apart
Where no applicable special convention exists, or where the request falls outside its scope, the provisions of the Private International Law and Procedure Law (MÖHUK) are examined. Benefiting from the res judicata effect of a foreign decision and enforcing that decision are different outcomes. In addition, the administrative registration route in Article 27/A of the Population Services Law No. 5490 concerns the civil status decisions listed in that provision; it is not a route for enforcing custody and maintenance together. [6] [7]
The file should contain the entire decision together with the required finality or enforceability records, any later amendments, the appropriate certification and a Turkish translation. A single page showing the divorce result may not explain who will decide on the child's settlement. It should also be examined whether the custody decision contains any restriction on leaving the country or relocating.
What problem does an apostille solve?
An apostille serves to verify the signature, capacity and seal of a foreign official document. It does not change custody, does not make the content of the document lawful and, where necessary, does not replace recognition or enforcement. Where the Apostille Convention does not apply, the appropriate chain of certification must be examined. An exemption from certification may also exist for a particular document or convention; for example, for documents transmitted under the 1996 Convention, Article 43 is taken into account. It cannot be assumed that every document submitted with a residence file falls within this exemption. [2] [8, m.43] [11]
Does obtaining a residence permit prevent an international return claim for the child?
No. A residence permit does not remove the claim that the child was brought to Türkiye in violation of another country's custody rights, or that the child is being wrongfully retained in Türkiye. The 1980 Hague Convention regulates the return of children under the age of sixteen to their state of habitual residence where its conditions are met. In Türkiye, its application is considered together with Law No. 5717 on the Legal Aspects and Scope of International Child Abduction. [12] [13]
The problem is not only that a child has been taken away secretly. Where a child who arrived lawfully for a holiday is not returned on the agreed date, a dispute over wrongful retention may also arise. In the assessment, the custody rights existing under the law of the habitual residence before the removal or retention, and how those rights were actually exercised, are important. It is not enough that two countries are listed as parties; it is also checked whether the Convention applies between them. [12, m.3–5, 38]
The child's enrolment in a school in Türkiye or the issue of a residence card does not automatically create a bar to return. Even the argument about a one-year period and adaptation to a new environment depends on the special conditions of the Convention. Exceptions such as a grave risk of harm and the child's views are assessed on the basis of concrete evidence; these are not a general rule that a child cannot be returned once settled. The return proceedings and the final custody dispute are also not the same matter. [12, m.12–13, 16, 19]
In Türkiye, the Central Authority function is carried out by the Directorate General for Foreign Relations and EU Affairs of the Ministry of Justice. Where such a dispute arises, the residence file and the return file should be assessed together, and contradictory statements in different applications should be avoided. [13] [14]
How is the application for a child from a previous marriage carried out step by step?
1. Determine the child's citizenship and current legal position
First, the child's citizenship, age, passport, current country of residence, lawful period of stay in Türkiye and parentage documents are checked. If the child is already a Turkish citizen, the population and citizenship records should be examined rather than pursuing a residence permit route for a foreign child. The possibility of dual citizenship should also be clarified at the outset. [15, m.7] On this subject, the article Turkish Citizen Spouse and Child: How Do They Affect a Deportation Case? may also be helpful.
2. Complete the custody, settlement and personal contact file
Current examples of the divorce and custody decisions are obtained. Joint custody, personal contact, and any travel or relocation restrictions are identified. If consent is needed, it is prepared to cover the settlement plan in Türkiye. Where a court application is necessary, this stage is planned before flight and school timetables. A telephone approval from the other parent alone may not satisfy the document requested in the official file.
3. Choose the sponsor and the correct type of residence
The family relationship and sponsor conditions of the new spouse are compared with those of the child's own parent. If the child does not fall within the family residence permit category, another route that is actually suitable, such as a student residence permit, is examined. A humanitarian residence permit may be considered on the ground of the child's best interests, but this exceptional route does not make missing custody documents unimportant, nor is it an option that guarantees permission. [1, m.34–38, 46]
4. Prepare the foreign documents and the plan for life in Türkiye
Differences in document names, dates of birth, passport numbers and surnames are compared. Where there has been a change of surname after divorce, the birth certificate and records showing the change are added to the file. Certification and translation are carried out according to the procedure for which each document will be used. Housing, family household composition, income and health coverage are also documented for the child.
5. Create the official e-İkamet application
For applications made from within Türkiye, the official channel is the e-İkamet system. A separate application is created for the child, and the purpose of stay is selected correctly. The application form is signed in a manner consistent with the legal authority of representation. The appointment date, the type of application and the document submission instructions issued for the province are followed. Creating a record in the system is not the same as completing the application with the necessary documents.
The first application should be planned before the lawful period of stay expires. Extension is made from sixty days before the current permit ends, and in any case before the permit expires. The appointment service itself is free on the official e-İkamet channel; however, this does not mean that fees, card charges, translation or notary costs are free. [1, m.24] [2]
6. Follow the appointment, deficiency notices and notifications
The child and sponsor are required to attend, the original documents must be shown, and the appointment instructions relating to the representative must be followed. The Presidency of Migration Management may request additional documents. The law provides that applications are to be concluded within ninety days at the latest; however, the process of completing missing documents and the start of the review are important, and a definite date for the outcome cannot be given merely from the date the online form was created. The rights provided by the application receipt should also be examined; an application receipt should not be mistaken for a travel document permitting unrestricted entry and exit. [1, m.21] [2]
7. After the card is issued, complete the address, school and health procedures
The identity details on the card are checked. The official list of documents states that for first applications an address registration must be made within twenty working days of the approval of the permit; for extensions and transfers, the existing address registration is also requested. Address registration is a separate procedure from the residence permit. School enrolment, equivalence and the practical availability of health coverage are confirmed afterwards. [2]
Which documents should be prepared for the child?
The list below is used to organise the file. The personal e-İkamet list and the appointment instructions issued for the individual must also be treated as the basis; the provincial directorate may request additional documents depending on the circumstances of the case.
| Document group | Principal records to be prepared |
|---|---|
| Child's identity | Passport or equivalent document, copies of the relevant pages, a visa where required, and a birth certificate showing the parents |
| Application | Signed form, current biometric photographs, records of fees and document charges; the basis of any valid exemption |
| Family relationship | Marriage record, records showing the end of the previous marriage, the link between the new spouse and the child's parent |
| Custody and consent | Current custody decision; where required, consent, court decision, or a death, declaration of absence or single-parenthood document |
| Sponsor | Identity and appropriate status document, income, health coverage, criminal record, address and housing records |
| Foreign documents | Apostille or certification suited to the document, the basis of any exemption where one applies, and the required certified Turkish translation |
| Special situation | Documents showing dependency for an adult dependent child; a power of attorney where there is a representative; additions specific to an extension or transfer |
The current list of documents for family residence permits reviewed states two biometric photographs for the applicant and one photograph for the sponsor. Four photographs as stated in older online articles, or a fixed fee description, should not be used in place of the current application list. For extension and transfer applications, the UETS address document is also on the list; representation of the child in the procedure and electronic notification records should be checked together with the application instructions specific to the individual. [2]
The most common causes of lost time in preparing documents are: presenting only a summary of the decision; failing to connect the child's surname with a parent; using an old consent document for a different purpose; and not checking whether the child is actually covered by the sponsor's health coverage.
How are school, health and the child's daily life arranged?
Can a child with a family residence permit attend school?
A family residence permit provides the right to education in primary and secondary schooling up to the age of eighteen, without a separate student residence permit. However, the identity, address, previous education and, where necessary, equivalence procedures for school enrolment are carried out separately. A residence card alone is not a decision placing the child in a particular school or class. [1, m.34/4]
For foreign school reports, transcripts and records of study, the e-Equivalence process of the Ministry of National Education should be examined. For children under eighteen, transactions are carried out through a parent or legal representative. Where the surname of the mother or father differs from the child's, the birth or civil registration record showing the connection is important. Ministry of National Education statements also provide, for a student who arrives during the school year without a record of study, a route for provisional attendance on the parent's declaration and completion of the documents within three months, so that the student does not fall out of education. This facility should not be read as a general exemption from all residence or school admission conditions. [16]
What should be considered regarding health insurance and medical procedures?
The family residence permit assesses health coverage for all family members. The sponsor being insured does not mean that a child from a previous marriage automatically receives healthcare under the system. A route suited to the file must be identified among coverage through the Social Security Institution (SGK), a bilateral social security agreement, or an appropriate private insurance option, and the child's coverage must be verified with concrete documents. It is not the case in every instance that both a private policy and an SGK record are compulsory. [1, m.35] [2]
Before settlement, vaccination and treatment records, regular medication, and any special education or rehabilitation needs should be prepared. It should be explained at health institutions who is the legal representative. The new spouse taking on a caregiving role in the household does not mean that the spouse may alone consent to every medical procedure as a parent.
How is the child's privacy protected?
The birth, health and custody documents required for an application may contain sensitive family information. The scope required for the school, the health institution and the immigration file should be defined, and the irrelevant details of the divorce file should not be distributed to unnecessary persons. Documents should be shared through a secure channel, and the child's name and face should not be used in public sample files. When the child's views are heard, the dispute between the parents should not be passed on to the child.
What is the legal position of the new spouse, the other parent and the child?
Does the new spouse automatically become a parent or guardian?
No. Marriage does not automatically give the new spouse custody of the child. Article 338 of the Turkish Civil Code requires spouses to care for and show interest in the minor stepchildren, to assist the spouse exercising custody, and to represent the child to the extent that the child's needs require. This provision is not an unlimited authority for all official procedures. [3, m.338]
Being a sponsor for a residence permit is not the same as being a parent in family law. The authority to collect a child from school on a daily basis, a power of attorney for official applications, guardianship and adoption are also separate institutions. A false declaration of parenthood should not be made in order to ease the residence procedure.
Does remarriage end custody or maintenance?
Under Turkish law, remarriage is not in itself sufficient to remove custody. Where the child's interests require it, the existing arrangement may be reconsidered. The other parent's duty to contribute to the child's maintenance and education does not disappear merely because of a new marriage. Where education continues after majority, the maintenance duty may continue depending on the circumstances. [3, m.182–183, 327–328, 349]
The amount of the existing maintenance decision, its currency, the payment account and its enforcement abroad should be planned separately. For the collection in Türkiye of a foreign maintenance judgment, or the enforcement in another country of a Turkish decision, the relevant international conventions and the recognition and enforcement regime are examined separately. Accepting a custody decision does not mean that the maintenance part will be collected by the same route.
How can contact with the other parent be maintained?
In the settlement plan, school holidays, face-to-face meetings, video contact, the handover of the child and travel costs should be made concrete. Video contact is not in every case a full equivalent of in-person personal contact. Where the existing decision does not fit the new living arrangement, it may be necessary to request an arrangement from the competent authority. [3, m.183, 323–324]
Non-payment of maintenance does not give the right to suspend personal contact unilaterally; equally, obstructing contact does not justify the arbitrary cessation of maintenance. However, where there is violence, abuse or a serious risk to the child's safety, an appropriate protective application should be made and the contact arrangement should be assessed by the competent authority. Where the child's interests require, restrictions may arise; the outcome is not automatic.
Does the child acquire Turkish citizenship, the new spouse's surname or inheritance rights?
Does a parent's marriage to a Turkish citizen make the child Turkish?
No. Marriage does not directly grant Turkish citizenship even to a foreign spouse; a spouse meeting the conditions of the law may apply. A child from a previous marriage does not become a citizen automatically because of a new marriage or a residence card. [15, m.16]
By contrast, where the child's own mother or father acquires Turkish citizenship by a decision of the competent authority, joint proceedings for the child may arise under Article 20 of Law No. 5901. Custody and the consent of the other spouse are important; where consent is refused, the route of a court decision provided by law is considered. This is not the same examination as residence permit consent. The possibility that the child was already born to a Turkish citizen mother or father should also be addressed separately under Article 7. [15, m.7, 20]
Is a separate procedure required for the surname and for adoption?
A new marriage does not change the child's surname automatically. Surname, filiation, adoption and the applicable law are examined separately. The fact that the child carries a different surname from the mother does not in itself prevent a family residence permit; the family relationship must be established by documents. Where the same person appears under different names in identity and school records, correction or connecting documents should be prepared. [6, m.16–18] [16]
Adoption by a step-parent, however, is a separate process with its own conditions and judicial review. It is not a mandatory precondition for obtaining a residence permit. The citizenship consequences of adoption are also examined separately under Article 17 of Law No. 5901. [3, m.305 et seq.] [15, m.17]
Are the inheritance rights of a child from a previous marriage affected?
Where Turkish succession law applies, a parent's remarriage does not remove the child's filiation to that parent or the statutory inheritance rights that follow from it. As between the child and the new spouse, statutory inheritance does not arise merely by reason of the marriage; adoption and dispositions on death are assessed separately. Where there is a foreign element, the law applicable to the succession and the special rule for immovable property in Türkiye must also be considered. [3, m.495, 500] [6, m.20]
What happens at eighteen, on divorce, on death or if the application is refused?
What options exist if the child turns eighteen?
Persons who have lived in Türkiye on a family residence permit for at least three years may, if they request it after completing eighteen, switch to a short-term residence permit. This special route does not apply automatically to a child without a three-year history on the permit. Student status, another suitable residence reason, or remaining within the category of an adult dependent foreign child are examined separately. The mere fact that the mother or father provides economic support does not in every case lead to the adult child being treated as a dependant; documents showing dependency are important. [1, m.34/1-c, 34/5, 38]
The date of birth, the end of the permit, the passport validity period and the school calendar should be considered together. If the change of age is noticed at the last moment, there may be no time left for the preparation of documents and the application.
What happens to the permit if the new marriage ends or the sponsor dies?
The sponsor on whose basis the child's permit was granted is decisive. Divorce from the new spouse may require the file to be reviewed again for the child. The provision of the law on the shift to a short-term permit for a foreign national married to a Turkish citizen after divorce should not be transferred to the child automatically in all its conditions. The continuation through the child's own parent, or another suitable type of permit, is assessed separately. [1, m.34–36]
Where the sponsor dies, persons who remain on a family residence permit based on that sponsor may be granted a short-term residence permit without a period requirement. This does not mean that the card automatically converts into a new type of permit without the necessary application being made. Changes should be notified in time, and the appropriate transition route should be determined for the person. [1, m.34/7]
How can a refusal, cancellation or refusal to extend be challenged?
First, the reasoned decision and the date of notification should be obtained, and it should be determined which ground was used: a missing document, the sponsor conditions, the family relationship, an entry ban or any other ground. Article 25 of the YUKK requires the assessment of family ties in Türkiye, the length of residence, the situation in the country of origin and the child's best interests. It is important to present the relevant data concerning the child with concrete documents to the file. [1, m.25, 36] For the process and documents, the article Objecting to a Deportation Decision: Service, the Seven-Day Filing Period and Suspension of Enforcement may also be reviewed.
For an action for annulment of an administrative decision on a residence permit, where no special period is provided, the general period for bringing an action is sixty days from the day following written notification. The effect of administrative applications on the period is calculated separately. Bringing an action alone does not stop the decision from being carried out, nor does it give an automatic new right of residence; where the conditions are met, a request for a stay of execution should be made. [17, m.7–8, 11, 27]
Where a deportation or entry ban decision has also been issued, their routes of challenge and time limits should be examined separately. Transferring the sixty-day period for an action on a residence permit to another decision may lead to a loss of rights. For the distinction on this point, our guide on deportation decisions may also be reviewed. See also Entry Ban to Türkiye for Visa and Residence Violations: Periods, Payment and Ways to Apply.
Three situations most often encountered in practice
New Turkish spouse as sponsor: The child's foreign mother or father has married a Turkish citizen. Whether the new spouse can act as sponsor is examined; the family relationship with the child, custody and the rights of the other parent are documented. The new spouse acting as sponsor does not mean that the spouse is the child's guardian.
Sole custody exists, the other parent does not consent: Even where the decision regulates sole custody, the settlement provisions of the foreign country and the documents required in Türkiye are examined. An application to the court is assessed according to the concrete need. Bringing the child first and trying to resolve all problems afterwards may increase return and application disputes.
The child will soon be eighteen: The remaining period of the current family permit and the period spent in Türkiye on the family permit are determined. Education and any dependency documents are prepared. A suitable new status is planned before the permit expires. A new card held by the mother or father does not resolve the change of age of the child by itself.
These examples are hypothetical; they do not show the outcome of any file or the decision of any particular country's authority.
Conclusion
Settling a child from a previous marriage in Türkiye is not simply a matter of obtaining a residence card. The correct sequence is: determine citizenship and family ties; clarify custody and the authority to settle; complete the necessary consent or judicial steps; make the appropriate residence application; and set up the school and health arrangements. The child's relationship with the other parent and the approaching changes of age should form part of this plan.
Güneş & Güneş Law Firm, active since 1999, can be contacted for a combined assessment of the child's residence file, foreign decisions and family law procedures. The firm offers legal communication in Turkish, English, Russian and German. An initial review that establishes the child's citizenship, age, country of residence and the existing custody decision helps identify the route. Frequently Asked Questions
Can a new Turkish spouse act as sponsor for a child from a previous marriage?
Yes. The law includes a spouse's foreign minor child from a previous marriage within the family residence permit. The family relationship, sponsor conditions, custody and the necessary consent documents are assessed together. Adoption is not mandatory. [1, m.34–35]
If I alone hold custody, is the other parent's consent never required?
Not in every case. Joint custody, contact rights and the requirements of the official document list must all be checked. Even with a sole custody decision, a request for documents concerning the other parent's contact right may arise. [2]
If the other parent does not consent, which court should be approached?
It depends on the type of application, the child's habitual residence, the existing decision and the applicable conventions. An action in Türkiye is not appropriate in every file automatically. The necessary judicial route is selected after the jurisdiction and legal interest have been examined. [5] [8]
Is a consent given for a holiday enough to settle in Türkiye?
It depends on the scope of the document. Permission for a trip for a fixed period may not amount to consent to permanent settlement or to a residence permit application. The scope required by the competent authority and the legal effect of the document should be checked. [2]
If the other parent has died, is their consent required?
The death is shown by a certified document; existing custody or representation authority is examined separately. The official application list provides for a certified death certificate for the death of one of the parents. [2]
Will the application be refused if the child's surname differs from the mother's or father's?
A different surname does not in itself show that there is no family relationship. The connection should be established with a birth certificate, population record and, where necessary, documents for a change of name or surname. The same matter is also important in school equivalence procedures. [2] [16]
Is it enough to have a foreign custody decision apostilled?
Not in every case. An apostille confirms the official character of the document. For the effect of the decision in Türkiye, the applicable convention and the conditions for recognition or enforceability are assessed separately. [6] [8] [11]
Can the return of a child who has obtained a residence permit be requested to another country?
Yes, where the conditions are met. A residence permit does not automatically remove a claim of wrongful removal or retention under the 1980 Hague Convention. Enrolment in school also does not automatically prevent return. [12] [13]
Does a child also need a student residence permit?
A family residence permit provides the right to education in primary and secondary school up to the age of eighteen without a separate student permit. School enrolment and equivalence procedures are still completed. The situation at eighteen and at higher education level should be assessed separately. [1, m.34, 38]
Can the new spouse carry out all of the child's official procedures alone?
Becoming the new spouse does not give general custody or guardianship authority. Depending on the nature of the procedure, legal representation, a special power of attorney or another legal basis may be required. Sponsorship and custody must be kept separate. [3, m.338]
If a parent acquires Turkish citizenship, does the child automatically acquire it too?
The file is examined under Article 20 of Law No. 5901. Custody of the child, the consent of the other spouse and joint proceedings are important. A parent's marriage to a Turkish citizen alone is not sufficient. [15]
Can a child who turns eighteen continue to stay on the family permit?
The scope of the status of a minor child changes. The options of dependent foreign child status, a switch to a short-term permit after at least three years on a family permit, or student status are assessed according to the file. Planning should begin before the permit expires. [1, m.34, 38]
If I file an action against a refusal of my residence application, does my stay in Türkiye automatically continue?
No. An action for annulment does not in itself stop the decision from being carried out, nor does it grant a new permit. Service, the current status, the need for a stay of execution and any separate deportation procedure should be examined together. [17, m.27]
