A property being available for purchase does not mean a tourism facility can be built on it. When choosing land for a tourism investment, the land register entry, the plan land-use decision, agricultural character, protection status, building conditions and infrastructure must be examined together. A "tarla" (field) entry in the title deed is not by itself an absolute prohibition; an "arsa" (plot) entry, however, is not an unconditional right to build.
The research and legal verification date of this guide is 11 October 2026. The rules describing the framework across Türkiye apply together with the current plan and special status of each parcel. In particular, for coastal, forest, protected-site and agricultural land, the municipal zoning certificate alone should not be relied upon.
Which documents should be reviewed before buying land?
Land register record, cadastre and actual use do not show the same thing
The review should begin with the current title deed record and the cadastral boundaries of the property. Ownership shares, mortgages, attachments, interim injunctions, lease annotations, easements and other encumbrances must be checked before an investment price is committed. It should also be verified whether the boundary stated in the sale advertisement, the fence or the actually used area matches the title parcel.
The land-use type recorded in the title register does not by itself reveal all the legal features of a property. The zoning status of a parcel recorded as a field, the classification by the agricultural authority and protection decisions are different sets of data. Likewise, a building appearing in the title record does not prove that its current size and use are licensed. The permit file should be compared with the situation on site.
In practice, a seller's statement that "everyone here has opened a business" is not evidence of lawfulness. The plan, the construction date, the status of acquired rights or the allocation regime of a neighbouring parcel may be different. The review should be carried out in writing, using the block and parcel number of the parcel to be invested in.
What does a shared title deed and cooperative model provide?
Buying a share in a parcel does not, as a rule, mean acquiring independent ownership of a specific corner of that parcel. An actual-use agreement may matter in the relationship between co-owners, but it does not replace an approved subdivision, zoning and building permits. Partition, pre-emption, use disputes and common expenses are assessed separately.
Membership of a cooperative does not automatically grant an independent unit title or a tourism permit either. The right held by a member is determined by the articles of association, the title deed, the allocation and the related contracts. De facto division of small areas of agricultural land under the names "hobby garden" or "tiny house plot" creates separate risks under Law No. 5403 on Soil Conservation and Land Use (Toprak Koruma ve Arazi Kullanımı Kanunu), zoning legislation and partnership provisions. [1][2]
20 June 2026 is also significant for this model. Law No. 7584, published on that date, added a provision to Article 8 of Law No. 5403 which prohibits cooperatives subject to Law No. 1163 from acquiring ownership or limited in rem rights in areas whose agricultural character is to be preserved under the relevant zoning plans, and in areas outside plans that fall within the scope of the Law. An exception requiring ministerial permission exists for agricultural cooperatives. Accordingly, the name of the cooperative and its membership agreement should be reviewed together with the date of acquisition, the status of the land and the permit condition. [2]
Roads, water and electricity should be researched together with legal access
Being able to reach land by car does not show that the property has sufficient legal frontage on a public road. A footpath crossing a neighbour's land, an oral permission or seasonal access may not be sufficient for licensing and operational safety. Right of way, road status and the frontage condition required by zoning law must be kept distinct from one another.
An electricity or water subscription is also not a document establishing the lawfulness of the whole structure. Grid capacity, the land through which a connection line would run, the well permit, the quality of the water and where wastewater will be discharged should be researched. Water shortages in summer and access difficulties caused by forest fires are directly part of the feasibility of nature tourism.
How does the zoning plan determine the tourism investment?
Upper-scale plan, implementation plan and plan notes
The presence of a tourism or ecotourism approach in the environmental layout plan does not in every case mean that a building permit can be obtained directly. The need for a lower-scale plan, the land-use decision, building conditions and the plan notes must be examined. Floor area ratio (emsal), footprint, height, setback distance, minimum parcel size, parking and infrastructure conditions determine the real capacity of the investment. [1]
The coloured plan sheet alone is not sufficient. Expressions in the plan report and notes, such as "day-use only", "without accommodation", "integrated with agricultural production" or "rural tourism", may change the outcome. It should also be checked whether there is a stay of execution or annulment decision concerning the plan.
The Regulation on the Qualifications of Tourism Facilities states that a tourism investment certificate does not constitute a basis for amending a zoning plan. The Ministry's ability to certify a facility type does not confer a zoning right to build that type on every parcel requested. [3, Art. 5] A separate guide, objection to and annulment action against a zoning plan amendment, is also useful.
Can an ecotourism zoning designation be turned into a residential project?
The activity that may be carried out on land designated for ecotourism or rural tourism use is determined by the relevant plan and legislation. Selling accommodation units like individual homes, or dividing them into continuous private-use areas, may conflict with the integrity of the facility and the purpose of the plan. Giving a commercial contract a different name is not enough to turn a permitted tourism investment into a housing development project.
Title notations arising from the tourism regulation, and restrictions on condominium ownership, floor easements or timeshare arrangements, should also be assessed in the property file. If holiday timeshare, use rights or membership sales are being planned, consumer legislation may apply separately. The investor should select the marketing model together with the plan review, not after the architectural design. [3]
Is a plan change a right or a possibility to apply?
The owner may request a plan change; however, making a request does not create an acquired right that the change will be approved. Public interest, urban planning principles, plan integrity, infrastructure and institutional opinions are considered. The competent authority is also not the same everywhere. For culture and tourism conservation and development zones and tourism centres, the special planning provisions of Law No. 2634 on the Promotion of Tourism are taken into account. [4, Art. 7]
For this reason, the assumption that a zoning change will certainly be made should not be used in a land contract. If the plan change is refused, delayed or subject to a lawsuit, the fate of the price, the expenses and the contract should be regulated. How this risk allocation is reflected in the contract is explained in the article Contracts and Legal Disputes in this series.
Can a tourism facility be built on farmland?
The class of agricultural land changes the result
Law No. 5403 on Soil Conservation and Land Use is based on the protection of agricultural land. The same permit assessment is not made for absolute agricultural land, special crop land, perennial crop land, irrigated agricultural land and other classes. The existence of a Large Plain Protection Area, an irrigation project or another protection decision also affects the outcome. [2]
The phrase "marginal agricultural land" does not mean that a tourism facility can be built on it directly. The non-agricultural use process, planning and building permits are separate stages. The land class is determined not by the seller's declaration but by the review of the competent agricultural authority. Where necessary, alternative land, a soil conservation project and relevant board assessments come onto the agenda.
Regulation of 4 April 2026 and the 4 August amendment
The Regulation on the Protection and Use of Agricultural Land (Tarım Arazilerinin Korunması ve Kullanılması Hakkında Yönetmelik) was published on 4 April 2026. Requests for agricultural and non-agricultural use, and the application processes, are based on this new regulation. The application should be carried out through the competent authority and within the system provided; it is necessary not to rely solely on a special report submitted by the investor. [5]
The transitional provision added by the 4 August 2026 amendment provides that agricultural structure and non-agricultural use applications made to the Ministry's relevant units before the regulation was published are assessed under the previous regulation. In applying this provision, the date of the application, the authority to which it was made and its subject must be proven. Having acquired the land earlier is not, on its own, a criterion for benefiting from the former legislation. [5]
A change made in the same amendment to the area threshold in a certain annex provision cannot be read as a new minimum parcel size applicable to all tourism investments. The provision applicable to an application must be determined by the investment type and scope; no conclusion should be drawn from the numerical threshold alone.
Does an agricultural-purpose building permit turn into an accommodation permit?
The purpose of storehouses, barns, greenhouses or other agricultural structures is understood from the approved project and permit file. Converting these structures into guest rooms, a restaurant or a retreat hall does not automatically become lawful merely because it takes place alongside agricultural activity. The 2026 Regulation clearly bases the use of agricultural structures on the purpose approved. [5]
Tourism activity may be possible on a real farm; however, the lawfulness of continuing agricultural production and of the accommodation area must be proven separately. Guests taking part in the harvest does not make accommodation units agricultural structures. In a mixed project, the agricultural area, the visitor area, the accommodation and the service areas must be clearly shown.
June 2026 amendment: sanctions, subscriptions and retrospective permits
Law No. 7584 tightened the sanctions in Articles 20 and 21 of Law No. 5403. For the relevant acts, the statutory amount per square metre of the area used or damaged was set at 2,500 Turkish lira (TL); a double rate has been retained for large plain protection areas. Triple sanctions and demolition processes may also arise if the act continues. In calculating the penalty, the date of the act, the applicable clause, the area measurement, the person addressed and any subsequent revaluation are examined together; this amount is not a common tariff for all zoning penalties. [2]
For unpermitted use under Article 21, if an application is made within one month of notification of the administrative fine and permission is obtained under the conditions of Article 13 or 14 to complete the work or to allow its use, it is possible to permit the work to be completed or used. Those who do not apply, or whose applications are not found suitable, are given two months to remove the structures and restore the land to a state suitable for agricultural production. This route is not an amnesty; there must be a suitable site and project for an application. The period for applying for permission and the period for judicial challenge to an administrative decision cannot be used in place of one another. [2]
In addition, under this Law, electricity, water and natural gas connections or subscriptions cannot be established for structures and facilities built without permission. Administrations, institutions or organisations that establish a non-compliant subscription are subject to separate sanctions. The investor should therefore not postpone the permit review on the basis of an approach such as "we will place the units first and solve the infrastructure later". [2]
Olive groves, vineyards, gardens and pastures
In olive groves, the special protection provisions of Law No. 3573 are assessed together with the general regulations on agricultural land. The agricultural character of vineyards and gardens may require a technical determination independent of the name in the title deed. Special exemptions introduced for other sectors do not apply to tourism facilities automatically. [6]
Pastures, highland pastures and winter pastures are subject to a special use regime. Designing a rural tourism facility under the name "highland house" does not give authority to build a structure on pasture land. Where the allocation purpose must be changed, the special process under Pasture Law No. 4342 (Mera Kanunu) and, where applicable, Law No. 2634 must be completed. The actual use of public land, or the payment of compensation for unjust occupation, does not replace a lease or allocation right. [4][6]
Village settlement area and unplanned area exceptions
Why is the claim that no building permit is required in a village incomplete?
Article 27 of Zoning Law No. 3194 (İmar Kanunu) provides an exception to the building permit requirement for certain types of place and structure. This provision is not a general freedom applicable in every village, on every parcel and for every commercial facility. Conditions such as the boundary of the settlement area, the relationship between the municipality and the adjacent area (mücavir alan), the purpose of the structure, approval of the project and notification to the village headman (muhtar) are assessed together. [1, Art. 27]
For example, the exception recognised for housing or certain agricultural structures should not be transferred directly to a multi-unit commercial accommodation facility. In places that have become neighbourhoods within metropolitan municipality boundaries, Article 8 of Law No. 3194 and the decision of the metropolitan municipal council are also important. A tax or service advantage granted by a "rural neighbourhood" decision does not mean that all building permits have been lifted.
The Law also permits a home guesthouse (ev pansiyonculuğu) to be run in dwellings in villages, on condition that a workplace opening and operating permit is obtained. This possibility requires separate assessment of accommodation documentation and safety conditions. Converting a lawfully existing dwelling into a guesthouse operation and establishing a new tourism settlement on vacant land are different files. [1, Art. 8/ğ]
Is the "five percent building coverage" rule valid for all fields?
The specific building provisions of the Regulation on Zoning in Unplanned Areas (Plansız Alanlar İmar Yönetmeliği) are frequently passed on in social media as a general right. However, the area of application, the type of building, parcel conditions, roads, the upper-scale plan and special laws must be considered together before any specific ratio or area limit can be used. Where non-agricultural use requires a permit, a ratio in the zoning regulation does not replace that permit. [1][2]
The question to be answered in an investment file is "for what purpose, and on which legal basis, may a building be constructed?" before "how many square metres will be built?". A capacity calculation made without this basic conformity may give the investor a building right that does not actually exist.
Special rules in coastal, forest and protected areas
Land near the coast is not the same as the coast
Under the Coastal Law No. 3621 (Kıyı Kanunu), the coastal edge line and the coastal strip are decisive. Measuring the distance to the sea by eye, or stating that no sea boundary appears in the title deed, is not sufficient. The approved coastal edge line, the implementation zoning plan and the part of the coast in which the construction falls are determined technically. [7]
Use of the coast is subject to the principles of public interest and equality. The structures and facilities that may be built on the coast and in different sections of the coastal strip are limited. A use that does not permit accommodation cannot be turned into accommodation under the name "removable facility" or "nature camp".
The 24 January 2026 amendment changed some date references in the Regulation on Implementation of the Coastal Law (Kıyı Kanunu'nun Uygulanmasına Dair Yönetmelik) to 17 April 1990, and re-established the coastal strip arrangement relating to old plans. This change does not mean that coasts have generally been opened to tourism construction. The old plan date and the conditions for partial or full construction must be documented as of that date. [8] Details can be found in the article Cancellation of Title to Property Remaining on the Coast.
Distinguishing purchase from allocation on forest land
A tourism investment on land counted as forest is different from an ordinary land investment in private ownership. Forest Law No. 6831, Law No. 2634 and the allocation or lease regime of the area are examined together. A Treasury property, a forest park, or an area allocated to tourism are each not subject to the same authority and transfer rules. [4][9]
Capacity, investment period, price, afforestation obligation, purpose of use and conditions for transfer of operation in the tender or allocation specifications are part of the budget. A preliminary permit, final allocation and a limited in rem right established in the title deed must not be confused. Holding a preliminary permit does not provide a right to begin unrestricted operating activity before the project is completed. For details, see the article Title Cancellation for Forest and 2/B Properties.
2026 changes to national parks and nature parks
Amendments were made in 2026 to the National Parks Law No. 2873 (Millî Parklar Kanunu) by Law No. 7576. Under the current regulation, planning, permits and the duties of the General Directorate of Nature Conservation and National Parks must be read together. A national park and a natural monument or a nature protection area are not subject to the same investment regime. [10]
The tourist facility permit in Article 8 of the Law depends, under the relevant conditions, on public interest and conformity with the plan. The duration of a usufruct right and the possibility of a conditional extension cannot be read as giving every investor a long-term right directly. For natural monuments and nature protection areas in particular, the permit restriction in Article 10 is additionally taken into account.
The 2026 amendment also regulated the seizure of structures and facilities, their demolition, and administrative assessment. The approach of "we will build first and get the permit later" in protected areas therefore cannot be reduced to the risk of a fine alone. It should not be assumed that an investment made in an area where permission cannot be granted will later be documented.
Archaeological site, natural site and registered building
Cultural property and sites under Law No. 2863 on the Protection of Cultural and Natural Property (Kültür ve Tabiat Varlıklarını Koruma Kanunu), and natural sites, are assessed separately together with their authority and protection decisions. The site degree or category, the transitional protection principles, the conservation zoning plan and the decisions of the relevant board or commission are determinative for the project. [11] For the effect of site areas and protection decisions on property, and for objection and lawsuit routes, see The Effect of Site Areas and Protection Decisions on Property.
Evaluating a registered village house for tourism may be possible; however, repairs, restoration, additional structures, a pool and landscaping may require permits. The fact that a structure is old, or that its external appearance is preserved, does not make an unpermitted intervention lawful. Obtaining a tourism certificate also does not remove a breach of protection decisions.
Glamping and the planning distinction for mobile homes
Luxury tent facilities are subject to different planning rules for private ownership and for certain public properties. On private ownership, a zoning plan and a settlement design and management plan are required together. Applying a special regime to public properties does not mean that protection status or the opinions of relevant institutions are unimportant. [12, Art. 7]
The Council of State (Danıştay) Fourth Chamber, in its decision dated 2 December 2025, case no. E.2023/13548, K.2025/6337, examined this distinction. The decision found a specific exception wording in the former regulation text to be unlawful; it did not regard the whole planning system and all glamping investments as invalid. The text of the decision, which shows an appeal route as open, should not be presented as though it had become final. [13]
For a mobile home facility, the technical nature of the vehicle and the suitability of the land use are separate questions. A concrete terrace, a fixed kitchen, a storeroom or other units built beside an O2-certified vehicle are assessed according to their own legal nature. The settlement as a whole cannot be explained solely by the licence of a single vehicle. A comparison of facility types is provided in the article Rural Tourism and Investment Guide.
Construction, change of use and transition to operation
Building permit, occupancy permit and workplace licence
A building permit covers the construction stage; an occupancy permit (yapı kullanma izni) covers the use of a completed structure; and a workplace opening and operating licence covers the stage of operating activity. A tourism operating certificate is another form of certification. The existence of one document does not remedy the absence of another. [1][3][4]
Using a part shown as a house, storeroom or agricultural structure in the architectural project for tourism purposes may require an alteration permit, a change-of-use approval and fire, parking and accessibility assessments. Adding new rooms, enclosing a terrace or increasing capacity is also not automatically covered by existing documents.
Article 29 of Law No. 3194 sets out the time regime for building permits: as a basic rule, construction must begin within two years of the permit date and be completed within five years, including the starting period. Renewal of the permit, acquired rights and special circumstances are assessed according to the file. A suspension of construction for economic reasons does not automatically stop all permit periods. [1]
Environmental Impact Assessment (ÇED), wastewater, wells and disaster safety
The requirement for an Environmental Impact Assessment is examined through the nature, capacity and location of the project and the relevant lists. Being small-scale does not provide exemption from all environmental permits. A decision made within the scope of the Environmental Impact Assessment (ÇED) process does not by itself replace zoning, building, coastal or protection permits. [14]
For wastewater, the sewerage connection, septic tank or treatment solution must be determined in line with technical and legal conditions. An unpermitted well cannot be dug on the ground that water is present; use of groundwater is subject to Law No. 167 on Groundwater (Yeraltı Suları Hakkında Kanun) and related permits. If the use of geothermal water is being considered, the resource and operating rights under Law No. 5686 on Geothermal Resources and Natural Mineral Waters (Jeotermal Kaynaklar ve Doğal Mineralli Sular Kanunu) must also be researched separately. [14]
Flood zones, stream beds, landslides, earthquake and forest fire risk are not matters for insurers alone. Site selection, escape and evacuation routes, fire brigade access and infrastructure must be built into the project from the outset. The portability of a structure does not remove the obligation to ensure guest safety.
For details, see the article Environmental Obligations at Shipyards and Slipways.

How does implementation change in Antalya and similar coastal provinces?
In Antalya, coastal, forest, agricultural, site and tourism centre statuses may appear on different parcels within the same district. The duties of the metropolitan and district municipalities, the special powers of the Ministry and the decisions of protection authorities must be assessed together. A favourable opinion given in one district is not a precedent guaranteeing a licence for another parcel in a different district or even in the same neighbourhood.
In a practical file, what matters is not only that documents exist, but that they relate to the same investment scenario. An opinion obtained for five units cannot be compared with a 21-unit project; a permit for day-use cannot be compared with an accommodation facility; and an agricultural building project cannot be compared with a restaurant operation. The capacity, layout and service definition presented to the competent authority must be consistent across all applications.
Conclusion
Suitable land for a tourism facility is not merely land in a good location or at an affordable price. It is land that can legally and technically carry the intended facility model, with its plan, agricultural character, protection status, building conditions and infrastructure.
A parcel file prepared before purchase or a long-term lease should show which permits can be obtained, which conditions are still uncertain, and at what stage the investment must be halted. Keeping the farmland, village settlement, coastal and forest regimes separate is decisive in preventing site selection errors that cannot later be corrected.
Frequently Asked Questions
Can a tourism facility not be built on land recorded as a field in the title deed?
The title deed category alone cannot give a definitive answer. The agricultural land class, the plan decision, the conditions for non-agricultural use, the protection status and the building permits are assessed together.
Is no permit needed at all for a wheeled tiny house?
The technical nature of a vehicle and the operation of a commercial facility on land are different matters. Permanent settlement, additional structures, infrastructure, plan use and operating documents are assessed separately.
Can a bungalow facility be opened with the village headman's permission?
Procedures involving the village headman may form part of the limited village-structure arrangement set out in the law. There is no general headman's permission that replaces the building and operating permits required for each commercial tourism facility.
Is a tourism investment certificate enough to change a zoning plan?
No. The Regulation states that a tourism investment certificate does not constitute a basis for amending a zoning plan. Planning and certification processes are subject to separate conditions.
Does glamping on private ownership require a zoning plan?
The provision of the Regulation on the Qualifications of Luxury Tent Facilities for private ownership requires a zoning plan together with a settlement design and management plan. The special rules for public property cannot be applied to all private land.
Does the 2026 agricultural regulation also apply to earlier applications?
The transitional provision in the 4 August 2026 amendment provides that certain applications made to the Ministry's relevant units before 4 April 2026 are assessed under the former regulation. The date and scope of the application must be proven from the file.
Does an electricity and water subscription make an unlawful structure lawful?
No. A subscription does not replace a building permit, an occupancy permit or an operating licence. The legal function of each document is assessed separately.
Is renting an existing facility in a protected area safer?
Existence alone is not sufficient. The allocation or lease right, the permitted purpose, the actual construction, the authority to transfer and any ongoing sanctions must be reviewed. A lease agreement cannot create a right that the lessor does not hold.
