An investment in nature accommodation should be planned by first determining the legal type of the facility. Choosing the name “agritourism,” “bungalow,” “tiny house” or “retreat” does not permit that activity on a particular piece of land. The feasibility of the investment becomes clear only when the land-use decision, the physical characteristics of the facility, the services to be offered and the documents that can be obtained are examined together.
This guide compares facility models for landowners, operators and investors who want to make a rural tourism investment in Türkiye. The research and legislation check date is October 11, 2026. Plan notes specific to the parcel, allocation conditions and administrative acts must be assessed separately.
The first question in rural tourism investment: Which business are you setting up?
The experience a facility offers visitors and its class under the legislation may differ. A business that offers participation in the olive harvest may be described in its commercial promotion as an agritourism facility, while the certification of its accommodation section is carried out as a rural tourism facility, a guesthouse or another type whose conditions are met. Additional obligations may arise for the same business’s restaurant, event area and unit providing health services.
The right method is to describe the business through three questions: Where will the guest stay? Which activities and services will the guest purchase? Within which real estate and structures will these be offered? An architectural project prepared without answers to these questions may not fit the facility type chosen later. For example, a project designed with four accommodation units cannot be certified as a mobile home facility, which requires at least five units. [1][2]
Difference between trade name, facility type and plan land-use decision
| Name used | Legal counterpart | First check |
|---|---|---|
| Rural tourism facility | A facility type defined in the tourism legislation | Number of rooms, architectural qualities, rural experience and conformity with the plan |
| Agritourism / farm tourism | A tourism experience connected with agricultural production | In which type the accommodation will be separately certified |
| Bungalow / wooden house | Generally a building form | Building permit, intended use and integrity of the facility |
| Mobile home / tiny house facility | A tourism facility with defined technical conditions | Category O2 status, registration, plan decision, number of units and layout |
| Glamping / luxury tent | A commercial concept and a facility regulated under a special regulation | Luxury tent conditions and the distinction between private and public land |
| Camping / caravan campground | A camping type or the relevant special area regime | Camper unit, shared services, construction and right of operation |
| Retreat / wellness retreat | A trade name describing a program and experience | The accommodation certificate and the health legislation scope of the service offered |
| Well-being center / unit | A licensed service unit subject to the 2026 Regulation | Provincial health directorate (İl Sağlık Müdürlüğü) license, area and personnel conditions |
The matching in the table is not a guarantee of a license. A plan decision such as “ecotourism area” likewise does not mean that every type of accommodation is free on that parcel. The implementation zoning plan, the plan note and the facility’s characteristics are read together. [1][2][3]
How are a rural tourism facility and agritourism distinguished?
Farmhouse, village house, country house, highland house and mountain house
Article 35 of the Regulation on the Qualifications of Tourism Facilities (Turizm Tesislerinin Niteliklerine İlişkin Yönetmelik) governs rural tourism facilities. These facilities, connected with farm, village, country, highland or mountain life, are not merely small hotels located outside the city. The relationship established with local architecture, the natural environment, local ways of life and rural activities is part of the facility model. [1]
Room capacity in this type is set at at least five and at most thirty. Conditions such as the buildings being no more than two stories when viewed from all facades and conforming to local characteristics are taken into account at the project stage. In allocations of public real estate, special limitations on accommodation units apply separately. These numbers do not increase the parcel’s development rights; if the building area and capacity permitted by the plan are lower, the investment stays within that limit. [1, Art. 35]
The fact that a village house exists and is lawful also does not by itself prove that it has the character of a tourism facility. Changing the way the residence is used, fire safety, accessibility, the wastewater solution and operating documents must be addressed together. Operating the existing building while preserving it may be more favorable than new construction in some projects; however, this is the result of a technical and legal review.
Offering harvest, gardening and farm experiences
In agritourism, agricultural production is a genuine part of the visitor experience. A harvest workshop, grape harvest, olive processing, animal care or local product preparation activities are examples. If the whole of an agricultural area is turned into accommodation, parking or an event area, the name “farm tourism” does not eliminate the problem of non-agricultural use.
The Regulation on the Protection and Use of Agricultural Land (Tarım Arazilerinin Korunması ve Kullanılması Hakkında Yönetmelik) dated April 4, 2026 is based on agricultural structures being used in accordance with the approved project and purpose. Obtaining an agricultural storage permit and converting the structure into guest accommodation cannot be legitimized by keeping the name on the permit document. Which regulation applies to applications filed earlier is also important; the August 4, 2026 amendment introduced a transitional provision for certain applications filed before April 4. [4]
A visitor working on the farm should also be distinguished from taking part in an experience activity. Continuous and dependent work in production activity cannot be taken outside employment and social security obligations under the label of “volunteer guest.” In activities in which children take part, supervision, contact with animals, the tools used and food hygiene should be planned in advance.
Bungalow, mobile home, camping and glamping models
Why does the name “bungalow” not determine the license type?
“Bungalow” is not a standalone zoning exemption. The use of wood, prefabricated or steel material does not by itself change the legal character of the building. The way the accommodation units are placed, the continuity of their use, their infrastructure and their ancillary structures are examined. The condition of the reception, restaurant, storage, terrace and pool that make up the whole facility is also part of the assessment.
The main risk for the investor is that, while the seller speaks only of the product’s portability, the business is set up within a permanent layout. A product invoice or an assembly contract is not an administrative permit stating that a tourism business may be opened on the parcel. The details of the land and building review are explained in the article titled Land, Zoning and Construction Guide in the series.
Key measures for a mobile home facility
The mobile home facility in Article 35/A of the Regulation is a model consisting entirely of mobile homes and comprising at least five and at most forty-nine accommodation units. The provision, while reserving the distinction relating to allocated public real estate, takes as its basis the areas designated in zoning plans for camping or rural/ecotourism use. Each accommodation unit is positioned within an area of at least 250 m². [1, Art. 35/A]
This measure cannot be applied in the form “a 1,250 m² field is enough for five houses.” The area needed for shared units, access, parking, setback distances, infrastructure and plan conditions is calculated separately. The area of shared units such as a restaurant cannot be arbitrarily added to the area allotted to the units.
The mobile home definition in the tourism regulation is connected to category O2 type approval and road traffic legislation. Operation-specific conditions, such as the unit’s registration being in the name of the facility’s certificate holder or operator, are especially important for models that want to do joint marketing by lining up vehicles owned by others. Establishing a “tiny house cooperative” or a “joint investment venture” does not remove these certification conditions. [1]
The fact that no tourism investment certificate is issued for mobile home facilities also affects the financing and transaction timeline. An investment certificate and an operation certificate are not the same document; a loan or incentive file that assumes an investment certificate will be obtained in this model may be structured incorrectly. [1, Art. 6/2]
Business integrity in camping and caravan campgrounds
Campgrounds, in the tourism regulation, are facilities consisting of at least ten camper units. Tents, caravans and other permitted units are assessed together with shared uses, sanitary installations, water, energy and waste management. Special provisions may apply to models such as campgrounds operated by the public sector and forest parks with accommodation. The same building ratio and operation transfer rule is not applied to every caravan parking area. [1, Art. 36]
A guest arriving with their own caravan does not mean that a commercial area can be operated without a license. On the other hand, lawfully parking a vehicle and operating a facility that provides continuous accommodation services for a fee are not the same fact either. The revenue model and the actual scope of services must be shown clearly in the investment file.
Luxury tent facilities and the special regulation
The Regulation on the Qualifications of Luxury Tent Facilities (Lüks Çadır Tesisleri Nitelikler Yönetmeliği) does not automatically cover every mixed facility marketed as glamping. The regulation contains conditions such as at most forty-nine accommodation units, a distance of at least twenty meters between units, and a layout that is in harmony with the natural environment and contains no permanent structures. The approach of a wooden platform without a foundation and the limits of the permitted service units should be examined together. [5]
For immovable property in private ownership, the zoning plan and the settlement design and management plan come into question together. The special planning regime regulated for certain public real estate cannot be applied to every field in private ownership. Where conservation site (sit), national park or coastal status exists, the relevant protection provisions also come into play. Accordingly, the glamping model should not be treated as a method that eliminates the permit process relating to the land.
How should a retreat, wellness and well-being investment be positioned?
Distinction between a rest program and a licensed service
A retreat describes programs focused, for a certain period, on rest, time in nature, exercise or similar activities. This trade name does not replace an independent tourism or health license. The type in which the accommodation service will be provided and the professional authority that each activity in the program requires are determined separately.
The Well-Being Services Regulation (Esenlik Hizmetleri Yönetmeliği) dated July 4, 2026 defines well-being services broadly. The regulation is not limited to activities that claim medical treatment; the definition also includes meditation, exercise, nutrition, sauna, physiotherapy and various supportive practices. For this reason, the statement “we do not provide treatment” is not enough on its own to show that one falls outside the scope. The actual organization of the service and the center/unit model in the legislation must be assessed together. [3]
Well-being center, well-being unit and healthy living facility
A well-being center is a model that can be established within an accommodation facility holding a tourism operation certificate with at least ten rooms, or within other establishments listed in the regulation, or in a detached building with at least 500 m² of enclosed area. For a well-being unit, the room limit within an accommodation facility is different; the independent model requires at least 300 m² of enclosed area and a separate entrance. Options within an establishment and detached building options must not be confused with each other. [3, Art. 4]
A healthy living facility in the tourism legislation, by contrast, is a different provision. Article 28 of the Regulation addresses a health center and a four- or five-star hotel element together. A small yoga camp calling itself by this name does not show that it meets the conditions of that facility type. It is possible for tourism and health documents to be required together in the same project. [1][3]
The investment cost of a well-being model does not consist only of service rooms. A responsible manager, authorized personnel, emergency organization, a record system and inspection obligations create continuing expenses. For this reason, the goal of running a few periods of programs and the goal of operating a licensed center year-round require different feasibility studies. The detailed application procedure is set out in the article Licenses, Documents and Operating Conditions.
Which investment model is more suitable?
Buying land, leasing, or operating an existing facility
Buying land provides long-term control; on the other hand, there is a risk that zoning and permit uncertainty ties up capital. Leasing can reduce the initial cost, but the lease term, the condition of the buildings and facilities at the end of the term, recovery of renovation investments and the possibility that a license cannot be obtained must be resolved in the contract.
Taking over an existing certified facility also does not mean that all problems are solved. The actual capacity may have exceeded the capacity in the certificate; some units may be outside the license; an allocation contract or loan collateral may restrict the transfer of the business. The transfer of the documents and the transfer of the commercial business, the real estate or the company shares are not the same transaction.
| Model | Initial advantage | Main risk to examine | Evidence to request before deciding |
|---|---|---|---|
| Land purchase and new facility | Control of design and ownership | Failure to obtain permits, infrastructure cost | Current title deed, plan and agency opinions |
| Long-term lease | Less real estate capital | Term, early termination, fate of the structures | A contract conditional on the permit and the owner’s authority |
| Taking over an existing facility | A ready-made operating organization | Mismatch between documents and actual situation | License file, inspections, review of debts and contracts |
| Management / operating contract | Working with an expert operator | Conflict over revenue, expenses and authority of representation | Budget, audit of accounts and authority matrix |
| Allocation of public real estate | Access to a specific investment area | Allocation term, price and purpose limitation | Notice, specification, preliminary permit and allocation contract |
Company, shareholding and foreign investor
When choosing the company type, not only the cost of establishment but also the shareholders’ funding obligations, management authority, share transfer and the possibility of exiting the project should be assessed. In projects in which one shareholder contributes the land and the other the working capital, it must be clear whether the real estate is transferred to the company. A shareholding does not by itself confer ownership of a particular accommodation unit.
In an investment with foreign capital, the freedom to establish a company and the rights to acquire real estate and to work are separate reviews. Direct acquisition of real estate by a foreign individual, acquisition by a Turkish company with foreign capital, security zones and sector-specific permits are subject to different rules. If the foreign shareholder will actually work at the facility, the work permit dimension is resolved separately. [8]
Feasibility: Investment budget and operating cash must be calculated together
Which expenses go into the initial investment cost?
A real investment budget covers real estate or the right of use, plan and project work, surveys, construction, accommodation units, access, electrical capacity, water and wastewater infrastructure, fire precautions, furniture, kitchen, software and pre-opening personnel costs. Fees, taxes, financing costs and unforeseen work items should be tracked separately.
Calculating the total investment by obtaining only “the price of a bungalow” from the supplier is misleading. In some projects, widening the road, installing a treatment plant or extending the electrical connection may matter more than the unit cost. A delay in the licensing process increases interest and pre-opening costs even if it does not change the construction cost.
How can an occupancy and break-even calculation be set up?
In a simplified operating calculation, the number of rooms or units open for sale, the number of days open, occupancy, average sales revenue excluding tax and variable costs are written separately. After deducting platform commission, cleaning, laundry, energy and costs tied to each person taking part in the program, the contribution that covers fixed operating costs is found.
An entirely hypothetical example: In a facility where ten units are open for sale 240 days a year, there is a capacity of 2,400 unit-nights. If the contribution per unit-night sold is accepted as 2,000 Turkish lira (TL) and the annual fixed operating cost as 2,400,000 TL, the operating break-even point is 1,200 unit-nights, that is, 50% occupancy. This calculation is not the payback period of the investment; loan principal payments, tax, renewal expenditure and the cost of capital are assessed separately.
| Scenario | Assumption | Check question |
|---|---|---|
| Base case | Planned season and occupancy | What data is the sales assumption based on? |
| Opening delay | Partly missing a season | Does the cash reserve cover fixed costs? |
| Low occupancy | A fall in nights sold and in additional service revenue | How flexible are personnel and rent costs? |
| Cost increase | An increase in energy, personnel or financing costs | Can the sales price be updated at the same speed? |
| License constraint | Less capacity than anticipated | Can a smaller project survive economically? |
Incentives, grants and 2026 tax changes
Being within IPARD does not mean a call is open
Support frameworks for rural tourism and recreational activities may exist in TKDK/IPARD programs. However, the sector definition in the program does not show that applications can be made on every date or that every expenditure is supported. The investment location, the applicant’s qualifications, capacity, eligible expenditure and the conditions for continuing the activity are examined according to the relevant call.
The announcement of TKDK dated September 30, 2026 explains that the M7 call indicated was postponed and that the scope of the call was set as “excluding open-field crop production, beekeeping and rural tourism.” For this reason, the announcement in question cannot be presented as a new application call open to rural tourism investments. It is not correct to count the grant rate of an old call as the definite financing source of a new investment. [6]
In grant feasibility, eligible expenditure and total investment should be separated; whether items such as VAT, land price or working capital fall within scope should be checked in the call document. The timing of the grant payment also matters. A payment to be made afterwards does not by itself meet the cash need during the construction period.
Investment incentive and employment support are different
An investment incentive certificate, a tourism investment certificate and a tourism operation certificate have different legal functions. Having one does not mean the other will be granted. A general incentive rate should not be promised without assessing capacity, investment type, region, minimum investment amount and the timing of the application.
Provisional Article 36, added to Law No. 4447 by Law No. 7590, regulates employment support for the May–December 2026 period for private-sector accommodation establishments holding a tourism operation certificate that meet the conditions. Notifications, premium and debt conditions and the calculation of the benefit require separate review. This temporary provision is not a grant that covers the whole investment cost of a new facility. [7]
Applying the temporary rate correctly in accommodation tax
Under Presidential Decision No. 11263, accommodation tax is applied at 1% between May 1 and December 31, 2026. The statutory rate and this temporary application must be distinguished; when preparing prices and contracts for the period after year-end, the entry into force should be checked again. The 2026 guide of the Revenue Administration (Gelir İdaresi Başkanlığı) states this date range explicitly. [9]
Accommodation tax, VAT and the tourism share are not the same obligation. In packages in which food and beverage, accommodation, day programs, product sales and health services are priced together, the nature of the service and the taxable event must be examined separately. Using the name “agritourism” does not provide a common tax exemption for all of the business’s revenue. Tax planning should be carried out on the basis of a lawful documentation system and a distinction between the actual services.
Effect of case law on the investment decision
The decision of the 4th Chamber of the Council of State (Danıştay) dated December 2, 2025, E. 2023/13548, K. 2025/6337 concerns the review of certain provisions of the Regulation on the Qualifications of Luxury Tent Facilities. While addressing whether the phrase “unless otherwise stated” in the old text conflicts with a higher norm, the decision reached different results with respect to the other provisions at issue. This decision cannot be read as “all glamping investments were annulled.” Because the decision text consulted indicates an avenue of appeal, it has not been assumed to be final. [10]
The decision of the Constitutional Court (Anayasa Mahkemesi) numbered E. 2021/100, K. 2024/174 also annulled certain sanction provisions tied to tourism certification. However, the obligation to obtain a certificate and the statutory basis of a particular sanction are different subjects. An investor should not commit capital on the assumption that “there is an annulment decision, so no certificate is needed.” The effect of the decision on the date of the transaction is examined in the series article Contracts, Liability and Legal Disputes. [11]
Conclusion
A sustainable investment in rural tourism depends on the commercial concept and a legally workable facility model coming together in the same project. The name agritourism, retreat or glamping describes the starting idea; the investment decision requires the land, plan, building, license, personnel and financing files to be assessed together.
The strongest starting file contains the correct facility type, the documents showing that this type can be implemented on the parcel, the actual capacity and a cash plan that covers the possibility of delay. A purchase, lease or supply commitment should be built on this file. If it is determined from the outset at what stage and at what cost the investment can be stopped in case permits cannot be obtained, legal uncertainty turns into a manageable investment risk.
Frequently Asked Questions
Is there a separate license for agritourism?
Agritourism describes an experience connected with agricultural production. Accommodation, food and beverage, events and, if any, well-being services are assessed under their own legislation. A single trade name does not cover the permit for all activities.
Is buying five tiny houses enough to open a facility?
No. The minimum number of units is only one of the conditions. The plan decision, the layout area, technical qualities, registration, shared units and operating documents must also be suitable.
Are a bungalow and a mobile home the same investment model?
They are not. A bungalow mostly describes a building form; a mobile home describes a separate model with a technical definition and facility conditions. The actual characteristics and the manner of use are decisive.
Can a small retreat facility be a well-being center?
The center and unit options within an accommodation facility are different. The number of rooms, enclosed area, the service to be offered and personnel conditions are examined together. The small size of a concept does not by itself exclude the health legislation.
Is the IPARD grant open to all rural tourism projects?
No. Rural tourism must be covered in the relevant call, and the investment must meet the conditions of the call. The call indicated in the postponement announcement dated September 30, 2026 excludes rural tourism.
What is the accommodation tax rate in 2026?
For the period May 1 to December 31, 2026, the rate is 1%. For services outside this temporary period, the rate in force must be checked separately; VAT and the tourism share are assessed separately.
Is it safe to buy the land first and complete the permits later?
Land bought without researching the likelihood of a permit may turn out to be unsuitable for the targeted business. A preliminary review, a contract conditional on the permit and documented decision stages reduce investment risk; no preliminary opinion is, on its own, a guarantee of a final license.
