Cybersecurity compliance
Scope of Law No. 7545, governance, management responsibility, policy and Cyber Incident Response Team (SOME) obligations.
Review the scopeCybersecurity is directly linked to business continuity, personal data, trade secrets, payment flows, contracts and management responsibility. Güneş & Güneş Law Firm helps organizations assess their cyber risks in advance, manage legal decisions and notifications during an incident, and address liability and disputes after an incident.
Cybersecurity Law No. 7545, the Personal Data Protection Law No. 6698 (KVKK), electronic communications, payment services, banking, capital markets, energy and other sector-specific regulations may impose different obligations on the same incident. For this reason, the analysis focuses not on the name of the incident but on the affected system, the service provided, the data processed, the organization’s status, the impact of the attack, the network of contracts and the current regulation of the relevant authority.
The work brings together the duties of management, legal, information security, human resources, procurement and, where necessary, external technical teams. Technical determination, security testing and system recovery are carried out by competent technical teams; the firm manages the legal authority, confidentiality, notification and liability aspects of this work.
IF THERE IS AN ACTIVE CYBER INCIDENT
If an ongoing cyber incident, payment fraud or service outage is taking place, inform the responsible technical team and decision-maker through a secure channel. Coordinate before making any ad hoc reset, record deletion, payment or public statement. Do not delay urgent technical measures or statutory notifications; contact the firm by phone without waiting for a reply to a message.
Phone and contact detailsPreventive compliance, active incident management and post-incident liability work are carried out together, as needed.
Scope of Law No. 7545, governance, management responsibility, policy and Cyber Incident Response Team (SOME) obligations.
Review the scopeAuthority, secure communication, incident plan, record preservation and the legal decision flow.
Review the scopeSeparate management of notifications to the Board, data subjects, sectors, contract parties and insurers.
Review the scopeCloud, SaaS, security services, penetration testing and supplier liabilities.
Review the scopePolicies, claim notices, defense, compensation and judicial remedies.
Review the scopeForeign systems and teams, data transfers, and scope analysis under NIS2, DORA and CRA.
Review the scopeA single incident may trigger several areas of law at once; however, confusing these concepts creates a risk of incorrect notification, incomplete review or unnecessary disclosure.
| Concept | Core focus | Typical example | Separate assessment |
|---|---|---|---|
| Cyber vulnerability | Technical or managerial weakness that can be exploited | Unpatched service, faulty access authorization | Notification, remediation and responsible disclosure |
| Cyber incident | Event affecting the security of an information system or cyberspace | Malware, unauthorized access, DDoS | Law No. 7545 and sector-specific processes |
| Personal data breach | Unlawful acquisition of personal data or compromise of its security | Leak of customer data, file sent to a wrong recipient | KVKK notification and data subject process |
| Cybercrime | Act defined as a crime in criminal law | Accessing a system, disrupting a system, aggravated fraud | Investigation, complaint and defense |
| Business continuity incident | Unacceptable interruption of a critical service | Data center going offline | Continuity, contract and sector obligations |
| Insider threat incident | Misuse or negligence by an employee or authorized person | Unauthorized query, data copying | Employment law, internal review and data protection |
There is no single deadline applicable to every cyber incident. Under KVKK, notification to the Personal Data Protection Board (Kişisel Verileri Koruma Kurulu) applies the criterion of without delay and at the latest within 72 hours of learning of the breach. This period is not a general waiting period for notifications under Law No. 7545 or for notifications to other addressees.

The services are arranged under 12 headings. The company’s activity, the nature of the incident and the scope of the engagement are assessed together.
The organization’s business model, critical services, data types, information assets, suppliers and applicable regulations are examined together. Existing controls are assessed not only by the existence of documents but by actual practice and allocation of responsibility; a priority and responsibility matrix is prepared for high-impact weaknesses.
The duties of the board of directors, senior management, legal, information security, information technology, risk, internal audit, human resources and communications units are defined in writing. Decision, reporting and escalation flows are adapted to the organization’s existing management structure.
Cyber risk is brought onto the management agenda; a periodic indicator set, critical incident thresholds, a record of investment decisions and follow-up of corrective actions are structured. Oversight responsibility is examined in terms of the Turkish Commercial Code, sector regulations and the internal authority structure of the company.
A hierarchy is established among the top-level policy, acceptable use, access, log management, incident response, backup, supplier security, vulnerability management and business continuity documents. It is ensured that the documents do not contradict each other or actual technical practice.
Overlapping or unassigned duties among the information security manager, technical operations, data protection officers, legal and internal audit are identified. The role matrix, job descriptions and incident response plan use the same terminology.

The organization’s position under the Law is determined by criteria such as service provision, data processing, connection to critical infrastructure, activity in the field of cybersecurity and supply of products. Information provision, taking measures, incident notification, inspection, certification and transitional provisions are reviewed together with current regulations.
The corporate or sector-based SOME obligation, contact persons, notification procedure and internal authority flow are examined. It is clearly set out that the technical team and the legal unit bear different responsibilities for the content of a notification. Taking into account that reports and security content submitted through USOM are being transferred to the Cyber Security Presidency (Siber Güvenlik Başkanlığı) address, the current addressee and channel are verified.
Services, assets and supply dependencies that are considered critical are identified. A compliance plan is prepared for continuity, testing, audit, product procurement, incident reporting and access authorizations under the specific regulations.
Information system provisions in electronic communications, banking, payment and electronic money, capital markets, energy, health, insurance and other regulated activities are recorded in a separate obligations table. A general cybersecurity plan cannot make a sector’s specific rule invisible.

The intake, classification, technical containment, decision authority, notification, communication, record keeping and closing stages of an incident are reviewed. The plan is structured to cover weekend, night, supplier-caused incident and unreachable-manager scenarios.
Vulnerability, suspicious activity, confirmed incident, personal data breach and critical service interruption are defined with separate thresholds. A repeatable decision structure is built on criteria such as confidentiality, integrity, availability, number of persons, nature of data, spread and reputational impact.
During an active incident, the legal decision flow, meeting minutes, notification timeline, contract review and management reporting are managed in a single file. A legal opinion does not replace technical findings; decisions are based on verified technical data.
Through engagement and availability confirmation, the incident owner, authorized decision-maker, technical team and secure communication channel are identified. Urgent measures, preservation of records, notification deadlines, calls to external service providers and the initial management note are tracked on the same checklist. Planning for the first 24 hours of an incident does not mean round-the-clock on-duty service by the firm or a commitment to intervene at a specific time.

Separate assessment columns are set up for the Cyber Security Presidency, the relevant sector regulator, the Personal Data Protection Board, judicial authorities, insurers, contract parties and data subjects. The deadline, starting point, responsible person, approving authority and channel to be used are recorded.
The effect of the cyber incident on personal data, the roles of data controller and data processor, and the conditions for notifying the Board and data subjects are assessed separately. The moment of learning is recorded; the notification deadline is not postponed while awaiting a final digital forensics report. The processor’s duty to inform the data controller without delay is also monitored separately.
The relationship of access control, log monitoring, authorization review, backup, encryption, staff training, supplier audits and retention practices with the legislation is assessed. Technical adequacy testing is carried out by the competent technical team; the firm manages the obligation, liability and record aspects.
Whether a notification obligation has arisen, the start of the deadline, minimum content and the possibility of phased information are verified. Definitive results not yet verified are avoided in the initial notification; responsibility and a calendar are set for follow-up notifications and the closing report.
The legal basis, target audience, content and timing of communication are determined according to the risk of the incident. The statement provides the information needed for individuals to protect themselves without unnecessarily disclosing the investigation, system security or trade secrets. Notification to the Board, notification to affected persons and contractual notification to customers are recorded as separate procedures.

It is determined which team will preserve logs, disk images, emails, authentication records, alarms, tickets and communication records and how. Written instructions are prepared to ensure the original source is not altered, accesses are recorded and technical examination copies are separated.
The scope, authority, confidentiality, output format and delivery method of the competent technical service provider are determined by contract. The impact of the examination on personal data, employee privacy, trade secrets and possible criminal investigations is managed from a legal perspective.
While examining the cause of the incident, control weaknesses, neglect of duties, misuse of authority and supplier impact, fair process, confidentiality and purpose limitation are protected. Interviews, minutes, technical findings and management decisions are managed as separate types of records.
Excess of authority, data copying, account sharing, use of personal devices or claims of intentional harm are examined within the limits of labor law, personal data and criminal law. The scope of the review is kept proportionate, and any disciplinary decision is based on verified records.
Basis: Law No. 7545 · KVKK data security
In incidents where there is a suspicion of crime, applications, record submissions, representation, seizure or examination requests are managed together with the criminal law team. Criminal proceedings do not automatically halt regulatory notifications or internal improvement work.
Encryption, threats to leak data, payment demands and pressure to disclose publicly are assessed together. No payment or communication decision is made on its own without considering sanctions, proceeds of crime, insurance, payment, personal data, service continuity and record preservation aspects.
In incidents involving fake instructions, account changes, impersonation of executives and unauthorized transfers, the processes of the bank, supplier, insurer, technical team and judicial authorities are planned simultaneously. The contract, authorization procedure and employee conduct are examined separately after the incident.
The affected accounts, privileged authorizations, sessions, accessed data and transactions performed are identified. Once account security is rebuilt, legal classification is made for notifications to individuals, the organization and contract parties.
The attribution, scope and currency of records published or offered for sale are technically verified. Options for content removal, access restriction, platform notification, personal data, trade secrets and judicial process are considered together. Content removal or access restriction options are determined based on the nature of the content, the competent authority and the current application route.
In denial-of-service attacks or long outages, independently of any data leak, service level commitments, customer communication, business loss, sector notifications and compensation claims are examined. The impact of the incident, its duration and the measures taken by the parties are recorded; an outage is not automatically assumed to constitute force majeure.

Risks arising from a software manufacturer, maintenance company, call center, accounting service, payment provider or other supplier are mapped. Audit, incident notification, subcontractors, data access, business continuity and contract termination provisions are arranged together.
The shared responsibility model, administrator access, log availability, backup, data location, sub-processors, incident notification and exit plan are examined. A provider’s standard security documentation does not remove the organization’s own obligations. The transfer basis, scope of access and sharing of records for remote access and examination from abroad are assessed separately.
The scope of SOC, monitoring, incident response, penetration testing, vulnerability scanning and digital forensics services is clearly written. Service levels, emergency calls, record ownership, confidentiality, limits of authority, report delivery and liability provisions are tested against incident scenarios.
Minimum controls, compliance statements, incident notification period, cooperation, audits, cost sharing, liability caps and termination rights are arranged according to processing. A general sentence such as “necessary security measures will be taken” does not provide measurable allocation of responsibility.

The critical service, maximum tolerable downtime, alternative working method, customer commitment and regulatory thresholds are assessed together with contracts. It is ensured that the plan covers not only technical restoration but also continuity of decisions and communication.
Incident scenarios are prepared involving management, legal, technical team, communications and business units. During the exercise, decision time, notification content, authority gaps and supplier access are measured; the results are turned into a corrective action plan.
General employee training, privileged user training and board briefings are designed with different content. Phishing, passwords, portable devices, incident reporting, confidentiality and record preservation obligations are explained by role.
The impact of a cyber incident on human safety and service continuity is assessed in production lines, energy facilities, medical devices or other operational technology (OT) and Internet of Things (IoT) systems. The authority, remote access, records and responsibility arrangements between the manufacturer, maintenance contractor, operator and technical team are established. Decisions on safe shutdown and return to operation rely on the assessment of the competent technical and operations teams.

A secure channel and authority flow are established for receiving, verifying, responding to and remediating a vulnerability reported by a researcher or third party. Good-faith disclosure and claims of unauthorized access are separated on the basis of concrete acts and legal limits.
The system, account, time frame, permitted methods, stop condition and third-party approval for any test are defined in writing. The protection of data accessed during testing, delivery of the report and disclosure of the vulnerability are arranged. The existence of a research or bug bounty program is not accepted as authorization to access systems outside the scope.

The target company’s critical assets, past incidents, vulnerabilities, suppliers, insurance, notifications and ongoing corrective actions are subjected to legal review. Pre-closing and post-closing risks are reflected in the contract, the price mechanism and the integration plan.
In investment and corporate transactions, the knowledge level, period and materiality threshold of cybersecurity representations are clearly written. Special provisions are prepared for known incidents, ongoing reviews, third-party impact and post-closing notification obligations.
It is examined under current regulations whether the product, service or activity is subject to certification, documentation, approval or export license. Notification and approval requirements for share transfers, mergers, demergers and changes of control of cybersecurity companies are assessed separately. A permit or compliance date is not calculated solely from the Law’s first publication date; the relevant secondary regulation and transitional provision are checked on the date of the transaction.
Basis: Law No. 7545 · 2026 duty amendments
The policy’s definition of an incident, waiting period, exclusions, approved service provider, ransom, business interruption, data breach and defense cost provisions are reviewed. At the time of an incident, notice to the insurer and the engagement of technical and legal services are carried out in line with the policy conditions.
Internal audit, independent technical assessment or public audit findings are recorded in a common risk register. For each finding, a responsible person, deadline, acceptance criteria and closing record are determined; a technical vulnerability is not treated as closed merely by updating documents.
Options under contract breach, compensation, insurance, employee, executive, supplier and criminal liability are reviewed based on incident records. Root causes and lessons learned are linked to changes in policy, contracts, training, budget and technical controls, and a closing report is prepared.
Audit findings, information requests, requests for defense, administrative fines or administrative acts related to the activity are examined file by file. Authority, reasoning, proportionality, service, remedy route and time limits are verified, and a defense and, where necessary, a litigation strategy are prepared. Whether filing an application automatically suspends the act is assessed separately.

Parallel obligations arising from systems, data subjects, group companies, customers or service providers in different countries are mapped country by country. Foreign legal opinions are obtained through an attorney authorized in the relevant country, and notifications are kept consistent with one another. In relation to the EU, NIS2, DORA and product-specific CRA obligations are examined separately in terms of activity, addressee and the relevant country. Serving EU customers does not automatically make all of these regimes apply in the same way.
For digital-element products placed on the EU market, manufacturer and other economic operator roles, exemptions, vulnerability management and product security incidents are examined under the CRA. The application of notification provisions as of September 11, 2026 and of the core obligations as of December 11, 2027 is distinguished. A notification and compliance plan is prepared with a foreign attorney and technical team after verifying the scope of the product and incident.

Who will make decisions, when each deadline starts and which record must be preserved should be determined in advance.
The Cybersecurity Law No. 7545 establishes a broad framework for persons and entities that provide services, collect data, process data or carry out similar activities using information systems. The Law imposes duties such as timely provision of requested information and records, taking the measures required by legislation, prompt notification of vulnerabilities or cyber incidents identified in the service area, and compliance with published policies and regulatory acts. Critical infrastructure, public service, product or service providers and sector classification may give rise to additional rules.
| Area of review | Key question to ask | Legal outcome |
|---|---|---|
| Corporate status | Which service does the organization provide, to whom and through which systems? | General or sector-specific set of obligations |
| Information assets | Which networks, applications, databases and external services are critical? | Priority for measures, records and continuity |
| Data types | Is there personal data, trade secrets, financial data or public data? | Separate protection and notification regimes |
| Sector | Is there electronic communications, finance, energy, health or another regulated field? | Special authority and technical criteria |
| Supply structure | From whom are cloud, data center, software and security services procured? | Contractual notification and audit rights |
| Cross-border connection | Is a system, team, data or customer located in another country? | Foreign law analysis and multiple notification analysis |
| Incident impact | Were confidentiality, integrity, availability or service continuity affected? | Incident class, urgency and responsibility |
Scope under the Law is not determined solely by company size or number of employees. Concrete obligations are verified on a current basis through the organization’s status, criticality, activity, decisions of the Presidency and secondary regulations.
Basis: Law No. 7545 · 2026 duty amendments
There is no single notification deadline for all cyber incidents. Notifications to authorities, individuals, contract parties and insurers are assessed separately. A notification made to one addressee does not replace other obligations.
| Possible addressee | Trigger question | Deadline approach | Core output |
|---|---|---|---|
| Cyber Security Presidency | Has a vulnerability or cyber incident been detected in the service field; which class does the organization fall into? | The “without delay” rule and the current procedure are verified separately | Technical-legal initial incident notification |
| Sector regulator | Is a special information system or incident notification rule applicable? | Sector-specific start and channel apply | Sector notification and follow-up report |
| Personal Data Protection Board | Has personal data been obtained by others through unlawful means? | Without delay and at the latest within 72 hours of learning of the breach; a reasoned explanation for any delay | Breach notification form and phased update |
| Data controller (for the data processor) | Has personal data processed by the processor been obtained by others through unlawful means? | Notification to the data controller without any delay | Initial incident information and follow-up updates |
| Data subjects | Who are the persons affected by the breach; what data and effects are involved? | Reasonable as soon as possible after the affected persons are identified | Clear, plain and directive notice |
| Prosecutor or police | Is there suspicion of crime, ongoing harm or urgent protection need? | Assessed on the basis of the act, complaint and urgency | Application and record submission package |
| Insurer | Did an event or expense covered by the policy arise? | Notice and pre-approval periods in the policy apply | Claim notice and service approval |
| Customer and contract party | Does the contract contain provisions on incidents, interruptions or data notification? | Hours or days and content provisions in the contract | Contractual notification |
| Foreign authority | Are data subjects, organizations or services affected in another country? | Separate verification with an attorney in that country | Country-based notification |
The notification matrix is not a static table. It must be updated when there is a transfer of authority, a secondary regulation, an institutional decision, a reassessment or a contract change. In an active incident, the first task is to start all deadlines separately on the same incident timeline and record them.
Basis: Law No. 7545 · KVKK breach notification · Notification to data subjects · Current reporting and information channel
These time intervals are a sample work organization; they are not a statutory waiting period or a commitment by the firm to intervene. Actions and notifications that must be carried out without delay are started without waiting for the relevant stage. Completion of a definitive technical report does not postpone the notification of a known breach.
This flow is not a ready-made template for every incident. In the first hours, human safety, critical public service or ongoing financial loss may require faster action. Legal processes are not used to delay technical response; they are used to ensure that the response is carried out by authorized, proportionate and documented means consistent with multiple obligations.
Basis: Law No. 7545 · KVKK breach notification
Duties may be combined depending on the size of the organization; decision authority and the record-keeping lead must be clear.
| Role | Primary duty | Decision and record responsibility |
|---|---|---|
| Senior management | Decision on business impact, resources, service and public statement | Authority and final decision record |
| Information security / technical team | Detection, containment, remediation and restoration | Technical timeline and findings record |
| Legal | Analysis of obligations, notifications, contracts and liability | Legal decision and deadline matrix |
| Business continuity | Critical operations and alternative workflow | Interruption and recovery record |
| Personal data protection officers (KVKK) | Personal data and data subject impact | Data breach assessment record |
| Human resources | Employee, insider threat and communication process | Proportionate review and disciplinary record |
| Corporate communications | Consistency of internal and external messages | Approved statement and version record |
| Supplier management | Calling external service providers | Contractual notification and response record |
| External technical service provider | Technical review within the scope of the contract | Method, access and delivery record |
The same person may assume several roles; however, technical findings, legal assessment and management decisions must be kept as separate records. Final authority must not be left unclear.
An effective legal structure is established before an incident. An organization that does not know its information assets and critical services, has not specified decision authority between management and technical teams, has supplier contracts without notification and cooperation provisions, or has not set record retention periods faces both technical and legal uncertainty at the time of an incident.
The answers to these questions must be confirmed not only in a policy document but also in contracts, job descriptions, technical procedures, training plans, the notification matrix and exercise records.
A general security commitment alone does not determine who will do what during an incident.
Basis: KVKK data security · KVKK cross-border transfer · Payment services regulations
Carrying out a sector-specific activity does not mean that every organization is automatically in the same critical infrastructure or notification category. Special regulations and the concrete activity are assessed together.

Review the Tourism and Accommodation sectorEngagement, communication arrangements, responsible persons and the scope of work are determined in writing.
At first contact, the incident or compliance need, the organization’s status, urgency, critical services and decision authority are understood. At this stage, no extensive document package is requested; in an active incident, only the minimum information necessary for a secure assessment is collected.
The scope of the service, the responsible team, the communication channel, a power of attorney where necessary, and the limit of authority of external technical support are determined. Sensitive records are ensured not to be sent through a standard message to the firm or via insecure email.
Law No. 7545, KVKK, sector rules, policies and commercial contracts are reviewed together. The internal decision-maker, the data controller and data processor roles, the supplier and any possible foreign country connection are clarified.
In an active incident, a deadline and notification matrix is prepared; in preventive work, a risk and corrective action plan is prepared. The responsible person, target date, dependency and acceptance criterion are determined for each task.
Technical detection and testing are carried out by competent service providers. The firm manages legally authorized access, personal data, confidentiality, contracts, notifications, liability and institutional relations; it does not issue a technical competence report.
Notifications, management decisions, contract changes and corrective actions are monitored. At closing, open items, retesting, training, policy updates and the date of the next review are recorded.
Güneş & Güneş Law Firm, founded in Kemer on March 18, 1999 by Attorney Umut Güneş and based in Antalya since 2007, provides remote or, depending on the needs of the file, on-site legal services and coordination for matters across Türkiye. Where necessary, cooperation is established with local colleagues and technical service providers.
The speed of response during an incident depends on the role and record arrangements that exist before it. For this reason, the policy, contracts, notification matrix and exercises are structured with incident management and the possibility of post-incident disputes in view.
In every incident, verified information, assumptions and unknown matters are kept separate. Notifications and statements avoid more certainty than the facts allow and are versioned as new information arrives. Variable deadlines and institutional procedures are checked against the official source on the date of the incident.
Communication is available in Turkish, English, German and Russian. For cases abroad, the selection of an attorney authorized in the relevant country, the scope of engagement, document flow, process tracking and information are coordinated. Foreign legal opinions and local representation are carried out by an attorney authorized in that country; the scope of coordination, liability and fees are determined separately.
All records do not need to be ready for the first consultation. After the engagement and a secure sharing channel are established, the following information may be requested depending on the nature of the file:
Sharing is limited to its purpose and carried out in stages. Do not include passwords, private keys, full logs, system backups, attacker messages or unnecessary personal data in the first message to the firm. Records are requested only for legal assessment, to the extent necessary, after the scope and secure sharing method have been determined. Review our approach to confidentiality and information security. Learn about secure document sharing.
Fees are determined according to the organization’s activity, the systems and contracts to be examined, the scope of the incident, the countries affected, notifications and the stage of any dispute. The scope and fee of preventive advisory, incident support and litigation follow-up are agreed in writing. Technical service providers, digital forensics, translation, court fees and other third-party costs are disclosed separately.
You will receive an initial response to your consultation request within 48 hours. This is not the time for responding to or resolving an active cyber incident. In emergencies, confirm availability and engagement by telephone. Technical protective measures and notifications must not be postponed while awaiting this response. Sending a message to the firm alone does not establish an attorney–client relationship.
It is the body of law, sector regulations, contracts, management and dispute rules concerning the prevention of cyber risks, the management of incidents and the determination of post-incident responsibilities. It does not replace technical security services; it provides the legal framework for technical processes.
The Law contains provisions for a broad group that provides services using information systems, collects and processes data, and carries out similar activities. Specific duties are determined by the organization’s activity, classification, connection to critical infrastructure and current secondary regulations.
No. In addition to general principles, the sector, the criticality of the service, the type of data, public connection, product or service activity and regulatory decisions may give rise to different obligations.
No. Technical measures are carried out by technical teams, but management oversight, budget, procurement, contracts, personal data, employee and notification decisions fall under the responsibility of different units.
A cyber incident is a broader concept affecting an information system and its security. A personal data breach concerns the unlawful acquisition of personal data by others or the compromise of its security under the relevant law; the same event may have both characteristics.
No. A DDoS attack or system incident without any personal data impact may not give rise to a KVKK notification; nevertheless, notification under Law No. 7545 or a sector-specific notification may be required. The technical scope and the data impact are verified separately.
No. Sending an email to the wrong person, the loss of a document or unauthorized sharing by an employee may constitute a personal data breach without any external attack.
The technical lead, the legal lead and the authorized senior manager named in the organization’s internal incident plan should be informed through a secure channel. The order of external notifications is determined by the incident and the organization’s obligation matrix.
No. The 72 hours applies to notifications of certain personal data breaches to the Personal Data Protection Board under Board Decision No. 2019/10. Other authorities and contracts may use a different period or the criterion of without delay.
The period starts when the data controller learns of the personal data breach. The first technical alarm and the moment of learning may not be the same; both, and the assessment made, should be recorded. Preparing a definitive report or obtaining management approval does not restart the period for a breach already learned of.
Under KVKK practice, where all information cannot be provided at the same time, the information may be provided in phases without delay. For other notifications too, the current procedure of the relevant body is checked; unverified information is not written as established fact.
Not in every case. Stopping ongoing harm is the priority; however, an ad hoc reset may destroy technical traces and records. Containment and restoration must be carried out by the competent technical team under the incident plan.
There is no single general answer. Payment must be assessed in terms of sanctions, proceeds of crime, insurance, criminal law, contracts, data security and whether payment will actually solve the problem. The organization should not rely solely on the attacker’s demand as the basis for a decision.
Not every technical error is a crime. Where there is a suspicion of crime, ongoing harm, account takeover, blackmail or fraud, options for an application and urgent protection are assessed; complaint dependence and time limits are checked against the specific act.
USOM is the National Cyber Incident Response Center, and SOME is the Cyber Incident Response Team. For reports and security content on USOM, the Cyber Security Presidency address is used. The organization’s SOME obligation, addressee and notification channel are determined according to the current regulation.
A uniform establishment obligation cannot be assumed for every company. The SOME obligation is determined by sector, the decision of the competent authority and the nature of the organization. Even where there is no establishment obligation, it is useful to determine authority, communication and record arrangements in advance for an incident.
The organization’s technical authorities or a technical service provider assigned in writing carry out the preservation, in a way that does not compromise integrity. Access, copying, transfer and review steps should be recorded.
The examination must be carried out within the framework of the employer’s legitimate purpose, prior information, workplace policy, proportionality, private life and personal data rules. Unlimited and out-of-purpose examination is not appropriate.
Responsibility does not automatically pass entirely to the provider. Data roles, contracts, the organization’s selection and oversight of the supplier, the shared technical structure and sector rules are examined together.
Minimum controls, access, logs, the incident notification period, cooperation, subcontractors, audits, continuity, data return, liability and termination provisions should be written according to processing. The provisions must be measurable and enforceable.
Non-delegable duties of the board, the duty of oversight, awareness of the risk, the decisions taken and, depending on the company’s sector, liability may arise. Liability is assessed not merely on whether the incident occurred, but on reasonable governance and response steps.
No. A policy may contain an incident definition, exclusions, a deductible, a waiting period, security representations, pre-approval requirements and sub-limits. Scope before an incident and notice conditions during an incident must be checked.
No. Technical testing, monitoring, system recovery and digital forensics are carried out in this area by competent service providers. The firm manages the legal framework of the engagement and the notification, liability and dispute aspects of the results.
The organization’s activity, when the incident was detected, the system or service believed to be affected, the ongoing risk, the technical contact and the person authorized to decide are usually sufficient for an initial assessment. Detailed records are requested in stages after the engagement and secure sharing arrangements are established.
No. The plan is a sample sequence of work. Notifications and protective steps that must be carried out without delay are not held back. Under KVKK too, 72 hours is an upper limit; it is not a requirement that all information or the definitive technical report be ready.
Where personal data processed by the processor has been obtained by others through unlawful means, the data controller must be informed without any delay. Contractual urgent notification and cooperation provisions also apply.
No. The type of activity, the products or services placed on the EU market, the role of the organization, exemptions and the regulation of the relevant country are assessed. Supply contracts may also create separate obligations. For the CRA, the notification start date of September 11, 2026 and the general application date of December 11, 2027 are distinguished.
No. At first contact, the organization, the time the incident was detected, the affected service, the ongoing risk and a secure contact are sufficient. Do not send passwords, keys, full logs or backups. The scope of the required records and the secure sharing method are determined after engagement.
