Summary

The differences between the forest cadastre, the 2/B user annotation, sale and free return, reviewed together with limitation periods and current decisions.

A claim that a land registered in a person's name lies within forest boundaries and a claim that a user registration in the 2/B area is wrong are not the same dispute. The first asks whether the land has forest character and is suitable for private ownership. The second asks about use of the area removed from the forest, rights of possession, and the conditions for sale or return. The correct cause of action can be determined only after this distinction is drawn.

A title registration alone does not transfer state forest land into private ownership. Conversely, not every 2/B registration means that a person's title will necessarily be cancelled. Law No. 6292 contains separate provisions for protecting certain registrations and for returning certain land. The file must be built by examining the forest cadastre, the use cadastre and property transactions separately. 123

Why are forest land and 2/B land assessed differently?

Forest character does not depend solely on today's tree cover

The absence of trees on a parcel today does not mean that it was never forest or is not legally treated as forest. The final forest cadastre, old state maps, aerial photographs, management plans and the applicable legislation are considered together. A place that has been converted to farmland or built upon may still remain under the forest regime in law.

Article 169 of the Constitution gives special protection to the ownership and preservation of state forests, and state forests cannot be acquired by prescription. Because a separate regime exists for private forests, the unqualified statement that "no land with forest character in Türkiye can be subject to private ownership" is also not accurate. The specific file must establish which type of forest and which record is at issue. For comparison, the explanations in the article Treasury and public property claims for title cancellation may be used.

A 2/B procedure does not create a title in a person's name

Article 2/B of Forest Law No. 6831 regulates the areas that may be removed from the forest boundary, subject to the date and nature conditions set out in the law. Removal from the forest boundary is not a direct registration of the land in the name of the user. The Treasury record, the determination of the user and the acquisition procedures under Law No. 6292 are separate stages.

The phrase "has lost its forest character" is also not a status decision that individuals can give to every empty or farmed plot. The competent administrative and cadastral acts, and whether they have become final, must be examined. A user's good faith or long occupation does not replace these procedures.

Which record is wrong: the forest boundary, the user, or the title?

DisputeCore questionMain record
Objection to the forest cadastreWas the parcel placed correctly within the forest boundary?Forest cadastre minutes and maps
Cancellation of title due to forest statusIs the registration located in an area suitable for private ownership?Chain of title and final forest records
Use cadastre / declarations sectionWho was using the land at the relevant date?Use record, update list
2/B sale transactionDoes a statutory right holder exist and are the application conditions met?Milli Emlak (state property directorate) file, notification, payment
Free returnDoes an earlier record within the scope of Article 7 exist?Cancellation decision, registration date and return application
Compensation for loss of titleWhich record or transaction caused the loss?Finality, loss and valuation documents

Trying to solve a problem in one row with the name of a lawsuit that belongs to another row can lead to errors of jurisdiction, parties and time limits. For example, a person who wants to change a user annotation and a person who directly requests private ownership registration are not making the same claim, and neither is equivalent to challenging a rejection of a sale application. In connection with this heading, the article Cancellation of title to land left on the coast may also be reviewed.

Time limit and parties for objecting to the forest cadastre

Under Article 11 of Forest Law No. 6831, the minutes and maps of the forest cadastre commissions are publicly posted (askı ilanı) for thirty days; the posting is equivalent to personal notification. Those who object may bring an action within the posting period before the cadastral court or, where there is no such court, before the court with jurisdiction over cadastral actions. Decisions for which no action is brought within the time limit become final. 2

Under the current provision, after ten years have passed from finality, objections and actions based on pre-cadastral grounds cannot be brought, except by the Treasury. Old texts' time limits or exceptions should not be presented as the current rule in this provision. The date of the specific act, the law applied and the transitional provisions of the past may also be important.

In an objection to the delimitation, the General Directorate of Forestry is named as the opposing party. In an objection to the removal from the forest boundary, the Treasury and the General Directorate of Forestry are named as opposing parties. Later disputes over title cancellation, user registration or sale may not have the same parties. Listing the names of the public bodies in general terms does not replace correct joinder of the parties. For detailed information, the article Objection to a cadastral determination and title cancellation may also be read.

Time distinction in correcting a user annotation

The user and structure information entered in the declarations section during use cadastre is intended to document the factual situation at a given period. These entries are not ownership itself. It is particularly important whether an objection relies on a claimed use before the survey or on a transfer after the survey. If the administration demands compensation for unjust occupation from a user, the article Objection to an ecrimisil notice may be consulted.

Pre-survey use claim: the 2026 reversal

In its decision of January 21, 2026, E.2025/3585, K.2026/360, the 8th Civil Chamber of the Court of Cassation (Yargıtay 8. Hukuk Dairesi) examined an action brought in 2018 against a use record that had become final in 2000. The claimants relied on their use before the cadastral survey. The Chamber held that the ten-year preclusive period under Article 12(3) of Cadastre Law No. 3402 had expired and reversed the judgment allowing the claim. 4

The practical value of this decision is that the existence of actual use does not by itself remove the time-limit problem. Being in occupation today is not the same as having objected in due time to the earlier record.

Later transfer of use: a different legal basis

In its decision of November 26, 2025, E.2023/5331, K.2025/6986, the 8th Civil Chamber of the Court of Cassation assessed a claim based on a possession transfer that took place after the cadastral survey, together with the related update. Following the earlier reversal, the merits were examined; the judgment that amended the user and building records was upheld in corrected form, with the parcel and sketch made clear. 5

The two decisions should not be read as contradictory general rules. The decisive difference is the date of the event on which the right is based and the transaction under dispute. The existence of a later sale document does not give a new time limit to every file that is based on a claim predating the survey. The transfer and the use must be proven separately.

Ownership entitlement and time limits in a 2/B sale

Article 6 of Law No. 6292 establishes an entitlement system based on user and structure ownership, as recorded in the declarations section of the land registry, in update lists or in finalized court decisions. The user connection before December 31, 2011 under the law, a timely application and the other related conditions are assessed together. The transmission of the right to statutory or contractual successors also requires documents. 3

As regards application periods, records existing on the date the law entered into force and records that became final later are regulated differently. It is incorrect to present old extensions of time as a new, open application period for everyone. The file must set out the first finality date, the application, the sale notification, the payments and any applicable extension provision, if any.

In 2026, the provisional Article 10 added to Law No. 6292 concerns 2/A areas relating to specific settlements. No general new application period for all 2/B entitlement holders can be derived from this special provision. It is more important to check the current text than to see only the last amendment date of the law and assume that the change applies to all files.

The calculation of the sale price, the payment options and the judicial review of the administrative decision on the application must also be examined separately. Winning a user annotation case does not show that the sale price has been paid or that the transfer has been completed.

Is free return open to every former titleholder?

Article 7 of Law No. 6292 regulates the protection of certain land registry records, the removal of 2/A or 2/B designations, and return to former owners under specific conditions. The sub-paragraphs differ for records created through land registry, cadastral or zoning law and for records which the State transferred, distributed or conveyed under special laws. The circle of successors who may benefit from the return may also vary according to these sub-paragraphs. 3

A record that still stands in a person's name, a record for which a cancellation decision has been given but not applied in the land registry, and a record for which registration in the Treasury's name has been completed are not at the same procedural stage. It cannot be said that "the former owner will certainly get it back" without looking at the nature of the earlier title, the reason for cancellation and the application period.

Under Article 7(4), there are return obstacles in the same form for land that is factually of forest character, for registration in the Treasury as forest, for allocation to public service, and for the other situations specified. If the conditions are met, compensation or replacement with other land may come into question. The fact that the earlier title has been cancelled for any reason is also not by itself enough to enter this special return regime. A separate assessment of the subject is given in the article Procedures after a title cancellation and registration decision becomes final.

If the title is cancelled, compensation is assessed separately

The fact that a title could not be protected because of forest status does not end the question of how the holder's loss is to be remedied. Liability arising from the keeping of the land registry under Article 1007 of the Turkish Civil Code (TMK), the special return provisions and any other available routes to compensation are examined separately. The date on which the loss became final, the chain of title, and whether a price or other land has already been given are important. The same loss cannot be recovered twice.

This article does not cover all the details of calculating compensation. The correct order is first to determine the forest status, then whether return in kind or registration is possible, and finally how any remaining loss can be compensated. A bare explanation that "I relied on my title" does not automatically guarantee either the protection of the title or a specific amount of compensation. The article State liability arising from the land registry is also useful as a separate guide.

What to look for in the site inspection and expert review

The forest boundary, the cadastral boundary and the use boundary should be shown as separate layers. The scale and coordinate system of old maps and how they are applied to the ground should be explained; the report should not consist of a coloured image alone. The necessary expertise is determined by the nature of the problem: forestry, mapping and agricultural character are not the same expertise.

In a user dispute, documentation should show to whom the building belongs, when use began, and how any transfer took place. Dated building records, contracts, payments, witnesses and images should check one another. The judgment to be applied to the title must state clearly the section, area, parcel and sketch. For the general conditions of possession, the acquisitive prescription guide may be read together with this article. For details on the subject, the article Objecting to an expert report may be consulted.

Conclusion

Outcomes in forest and 2/B disputes cannot be derived from the present appearance of the land or from a single title record. The forest cadastre, the user registration, the right of sale and the return condition are separate reviews. Separating a claim based on pre-survey use from a later transfer of use, and establishing with documents the dates of posting, finality and application, is the foundation of the correct legal route.

Frequently Asked Questions

Can the land be forest even if I hold a title?

Yes. A conflict may arise between the title record and the legal forest status. The record chain and the forest cadastre are examined together.

Is land without trees not considered forest?

Today's tree cover alone is not decisive. Historical character, legislation and final administrative acts are important.

Does a 2/B user annotation replace a title?

No. The user record matters in the entitlement and acquisition process; it is not, by itself, a registration of private ownership.

How much time do I have to object to the forest cadastre?

Under the current Article 11, the public posting period is thirty days. After finality, there is a separate time limit and a Treasury exception for actions based on pre-cadastral grounds; the date of the act must also be checked.

If I have used it for twenty years, do I get a 2/B title for free?

No. Special sale and return conditions apply to 2/B areas. Length of use alone does not give free ownership.

Did the 2026 amendment open all 2/B application periods?

Provisional Article 10 of Law No. 6292 concerns the 2/A areas in specific settlements. No general 2/B application period can be derived from it.

Because I was a former owner, will the land definitely be returned?

No. The type of the earlier record, the reason for cancellation, the application and time-limit conditions, and the obstacles to return in kind under Article 7 are all examined.
