Summary

Routes after the annulment of a zoning implementation: return to the original parcel, a new implementation, allocation of a suitable site and compensation, under current Article 18 of Zoning Law No. 3194 and Court of Cassation decisions.

Annulment of a parcelling (parselasyon) procedure in administrative court does not mean that the land registry automatically returns to its former state on the same day. The reasoning and scope of the decision, the current parcels, any structures built later and the current text of Article 18 of Zoning Law No. 3194 must be assessed together. For the owner, the right course is to ask for enforcement of the court decision, to determine technically what can be reversed, and to bring the appropriate claim in the correct judicial branch. 12

Describing the regulation introduced in 2020 in this area is not enough on its own. The stages added to Article 18 by Law No. 7534 of 5 December 2024 affect the steps to be taken in files where a return to the original parcel is factually or legally impossible. A solution from an earlier decision should not be applied to every present-day case without checking the later change in legislation. 1

Is annulment of a plan the same as annulment of a parcelling?

A zoning plan determines the use of a property, its density and the planning principles that apply to it. Parcelling, by contrast, concerns the division of properties in the implementation area into parcels that comply with the zoning plan, their distribution and the registry procedures. It must be determined which operation was annulled, which parcels it covers and which unlawfulness the decision addresses.

However, annulment of a higher-level plan alone does not mean that a particular distribution schedule and all land registry entries automatically follow the same outcome. The reasoning of the annulment decision may affect the legal position of later operations, but which operation is the subject of the case and how it is to be applied must be examined separately. A decision to stay execution is also not the same stage as an annulment ruling on the merits. 12

In one file there may first be the former cadastral parcel, then the zoning parcel created by a first parcelling and later the new parcel created by a second implementation. Filing an action based only on the current title deed copy may overlook this chain. The date, legal basis, registration and litigation outcome of each implementation should be recorded separately. A separate assessment of the subject is in the article objection to and annulment action against a zoning plan amendment.

What does restoration of the original parcel mean?

The original parcel (kök parsel) is the property as it existed before the zoning implementation. A revival (ihya) claim aims to correct the records created by an implementation whose legal basis has ceased, and to re-establish the earlier legal position. The technical meaning of this differs from file to file: the parcel may have been divided, merged with other parcels or turned into public land, or new structures may have been built on it.

For this reason, the claim “the zoning implementation was annulled, so give me my old title deed directly” is as inadequate as the approach “time has passed, so nothing can be done any more.” Whether a return is possible must be determined on concrete evidence. A simple area comparison cannot be made without taking into account the readjustment share (düzenleme ortaklık payı), distribution amounts, public areas and new rights holders. 1 A separate guide, objection to and annulment action against parcelling, is also useful.

What stages does the current Article 18 provide for?

First, factual or legal impossibility is investigated

The current provision is based on a determination by the authority competent to approve parcelling plans that, after a zoning implementation has been annulled by a final court decision, a return of the parcel is impossible for reasons such as the parcel lying in public areas, its having been built on, or other legal or factual impossibilities. These conditions must be explained before any exceptional solution is considered. 1

New implementation, consented allocation and compensation sequence

The current text provides that, in this situation, a new zoning implementation may first be carried out over registered zoning parcels to give effect to the court decision. If that is not possible, the consent of the claimant rights holder is obtained and a new parcelling is carried out over registered zoning parcels, allocating a suitable site within the implementation area. If no agreement is reached, a payment is arranged based on the market value (rayiç değer) of the property after deduction of the readjustment share, taking into account the position of the claimant rights holder on the original parcel. 1

These stages do not give the administration authority to postpone a court decision indefinitely. The obligation to explain the required conditions, the transactions carried out, why the alternatives could not be applied and the value calculation remains. Consent required at the stage where it is needed must not be inferred from a general application petition or from silence.

Review stageQuestion to answerDocument to look for in the file
Scope of the annulment decisionWhich transactions and parcels are affected?Reasoned decision and finality information
ReturnCan the original parcel be re-established technically and legally?Current plan, structures and rights-holder information
New zoning implementationCan the decision be applied over registered parcels?New implementation file and distribution schedule
Consented allocation of a suitable siteCan another site be allocated under the conditions set by law?Explicit consent and allocation transaction
CompensationWhy did the earlier stages produce no result?Reasoned assessment and market value report

The order in the table explains the special situation in the law. It does not mean that every zoning annulment file will end in compensation.

How do Court of Cassation decisions explain the importance of the administrative process?

Decision of 20 November 2024

Decision E.2024/3962, K.2024/5125 of the 7th Civil Chamber of the Court of Cassation (Yargıtay 7. Hukuk Dairesi) concerns the revival of the original parcel after annulment of a zoning implementation, and an alternative compensation claim. The Chamber upheld the judgment rejecting the claim, which took into account the administrative remedy introduced by Law No. 7221 in line with the earlier remand. The decision shows that the annulment of an implementation does not, in every file, lead directly to a land registry outcome before the civil courts. 3

The date of this ruling predates the amendment by Law No. 7534. When the administrative process indicated by the decision is considered in the present application, the new implementation stage in the current Article 18 must also be applied. Presenting the former text of the provision as if it were current leads to an incomplete assessment.

Decision of 18 September 2024 and dissenting opinion

Decision E.2024/3452, K.2024/3906 of the 7th Civil Chamber of the Court of Cassation (Yargıtay 7. Hukuk Dairesi): the majority, taking into account the regulation introduced after Law No. 7221, reversed the judgment that had accepted the claim. The dissenting opinion objected to applying the regulation in a way that would conclude every file directly by rejection, without adequately establishing the factual or legal impossibility and the relevant administrative process. 4

This disagreement shows the importance of the concrete facts that must be investigated. No general one-sentence rule such as “all revival actions are dismissed” or “an administrative application is never required” should be drawn from these decisions. Both the characteristics of the file and the legislative change after the decision must be taken into account.

How to apply for enforcement of an annulment decision?

Under Article 28 of the Administrative Procedure Law No. 2577 (İYUK), the administration must comply with a court decision without delay; as a rule, this period may not exceed thirty days from notification of the decision to the administration. This provision is the basis of the statutory duty to act in zoning disputes. It should not be confused with the final-decision condition of the special solution in Article 18. The effect of an appeal or cassation on enforcement is examined under the relevant procedural provisions. 12

For the application, rather than submitting only a copy of the decision, the old and new parcel numbers, the implementation requested, the affected share, any new transaction and the technical annexes should be clearly stated. The response expected from the administration must be specific. If the administration does not respond, Article 10 of the Administrative Procedure Law may apply; if removal or amendment of an existing transaction is requested, the conditions of Article 11 may arise differently. Under current rules, these applications are subject to a thirty-day implied rejection period, and the limitation period for an action is calculated according to the type of application. 2

A failure to enforce a court decision, a new transaction that continues the same unlawfulness, or a proposed solution that does not comply with the law are separate subjects of legal review. Repeated petitions should not be assumed to restart a past limitation period each time. For details, see the article implementation in the land registry after a registration decision becomes final.

Jurisdiction, parties and third-party records

Review of the lawfulness of the parcelling operation and of the administration's implementation decisions is carried out by the administrative courts. Private-law claims seeking correction of a land registry record may be assessed by the civil courts, depending on their legal basis. Not every claim pursuing the same economic result must be heard by the same court. Jurisdiction is determined by the real legal nature of the claim rather than by the heading of the petition. 25

If a title action is brought, the current owners of the records sought to be annulled, the co-owners and any transfers made during the proceedings must be identified. In a claim affecting more than one zoning parcel, naming only the municipality or only the first purchaser may not be sufficient. Article 125 of the Code of Civil Procedure and the rules protecting the acquisition of ownership must be assessed against the concrete chain of transactions. 56

Interim injunctions, annotations of pending litigation and stays of execution are different instruments. It should not be assumed that a measure in the civil courts automatically suspends an administrative act, or that filing an action in the administrative courts alone prevents all transfers. The claim must be framed according to the type of risk and the competent court. This subject is also addressed separately in the article state liability arising from the land registry.

Which errors should be avoided when calculating compensation?

Multiplying the area of the original parcel by any sale price in the vicinity is not sufficient. The calculation must explain the effect of the readjustment share, the location of the original parcel, comparable sales and the legal basis of the valuation. If the owner has obtained more than one new parcel or payment, it must be checked whether these cover the same loss a second time.

A claim that the land registry's keeping of records caused damage and a claim that an unlawful zoning act or the failure to enforce a decision caused damage may not rest on the same basis of liability. The correct defendant, the judicial branch, the date of the damage and the form of the claim are affected by this distinction. A compensation claim is not an unlimited alternative that the court would calculate on its own if the title claim were rejected; the claim and its reasoning must be stated expressly.

If the original basis of the first registration comes from the cadastral survey, the distinctions discussed in the articles on objection to a cadastral determination and registration on the basis of a title allocation document may also be relevant to file preparation. For a similar dispute, the article on objection to an expert report may be examined.

Conclusion

After the annulment of a zoning implementation, the essential aim is that the decision is applied in accordance with law and that the ownership position is clarified. The way to achieve this is not always a direct return to the former title deed or immediate payment of compensation. The current Article 18 regulates new implementation, consented allocation and compensation options in specific cases where a return is impossible. The scope of the decision, technical possibilities and the correct route of application must be assessed together.

Frequently Asked Questions

Does a zoning annulment decision automatically restore the title deed?

The necessary steps must be taken in the land registry and in the implementation file. Automatic reversal should not be assumed without evaluating the scope of the decision, the current records and the conditions of Article 18.

Is a return to the original parcel always possible?

No. Public areas, construction and other legal or factual circumstances may affect a return. The impossibility must be determined concretely, and the statutory solution process must be carried out.

Can the administration allocate another plot without my consent?

The consented allocation stage and the general zoning implementation rules are separate. The current Article 18 provides for the rights holder's consent at the relevant stage, and not every new implementation is the same transaction.

What is the administration's deadline for enforcing a court decision?

Under Article 28 of the Administrative Procedure Law, the administration must generally comply within thirty days of notification of the decision. The action required depends on the type of decision and the relevant special provisions.

What happens if an application to the municipality remains unanswered?

Depending on the nature of the application, Article 10 or Article 11 of the Administrative Procedure Law may apply. The thirty-day implied rejection period and the subsequent limitation period are calculated according to the legal type of the application.

Are all compensation claims arising from a zoning annulment directed against the Treasury?

No. The zoning act, non-enforcement of the decision and the keeping of the land registry are different grounds of liability. The act that caused the damage and the correct respondent must be identified.

Can older Court of Cassation decisions still be used?

They can be used, but the date and facts of the decision and any later legislative changes must be explained. In particular, the text of Article 18 as amended at the end of 2024 must be checked again in the current application.
