Summary

Does a land allocation certificate (tapu tahsis belgesi) replace title? Review older rights, the repeal of Law No. 2981, the competent court and price claims through court decisions.

A land allocation certificate (tapu tahsis belgesi) does not by itself make the person named in it the owner of the property. The document relates to a process of entitlement and allocation carried out under specific conditions; it does not produce the same legal result as a title deed. Before registration can be requested, the validity of the document, the legal status of the property, the zoning arrangement that applies, and the payment and allocation conditions must be examined together.

Current files also present a date problem. Law No. 2981, on which a significant part of land allocation certificates is based, has been repealed. This does not mean that every legal situation formed under it has automatically disappeared, nor does it mean that the former regime remains fully open to every new application. The review must be made by reference to the period in which the document was issued and to the subsequent acts. 12

What does a land allocation certificate show?

Under the regime of Law No. 2981, for buildings and immovable property within its scope, the law brought together administrative identification, entitlement, allocation and zoning procedures. Under the legal conditions of that period, the document shows a personal position that could form the basis for registration in the land registry. Completion of planning and parcelling at the location of the property, its suitability for allocation and other conditions remain important. 1

An area stated in the document does not mean that the boundaries of an area of that size will in every case be registered in the person’s name without change. The transformation of the former parcel into a new zoning parcel, public service areas, land readjustment partnership shares and the records of other rights holders may affect the result. The area stated in the document and the area that can be transferred to title today must be calculated separately.

The original document, a verified copy from the administrative file and the grounds on which it was issued should be requested together. A photocopy alone, a property tax declaration or a municipal receipt does not establish that all conditions of entitlement have been met. Tax payment and the fact of use may be supporting data; they do not replace the conditions for registration. For a similar dispute, the article cancellation and registration of title in a housing cooperative may also be reviewed.

How does the repeal of Law No. 2981 affect old documents?

Law No. 2981 was repealed by Article 23 of Law No. 6306. As amended later, the provision on entry into force in Article 24 set the period at eleven years from publication. Taking the publication dated May 31, 2012 as the basis, the repeal took effect on May 31, 2023. For that reason, in a current account, Law No. 2981 should not be presented as a general application law still in force. 2

However, the legal effects of past applications, documents, payments and allocation acts may still be examined in a concrete dispute. Later court decisions assessing claims relating to old documents also show this. But the fact that a document was obtained in the past is not a presumption that all conditions were met or that a definitively acquired ownership right exists.

The file should be organised around the following questions: Under which legislative period was the document issued? Had the conditions of entitlement arisen by that date? Has the document been cancelled? At what stage are the plan and the allocation process? Has the property later passed to another administration? Which act supports the claim for registration, an alternative location or payment? Each question may have its own date and document.

Which conditions are examined for registration?

Entitled person, document and payment

The valid issue of the document, the identity of the entitled person and any inheritance or transfer relationship are examined. Where it is claimed that the document was transferred, it cannot be assumed that an ordinary private contract removes all administrative conditions. Application and transfer acts are examined under the legislation of the relevant period.

The purpose of the payment is also important. An application fee, an instalment of the land price, construction costs and a usage fee are not the same. Without establishing who received the payment and for what reason, the conclusion that “the full price has been paid” cannot be reached. It should be checked whether the administrative file records that the debt was closed.

Plan, parcelling and public service area

It is checked whether the property lies in a residential area or in a road, park or school area. The zoning plan and the allocation document may not show the same parcel; a technical matching of old and new numbers is required. If registration of the location stated in the document is not possible, it is also examined separately whether an alternative allocation route exists, both in law and in fact.

If the zoning implementation has been cancelled, that is a separate problem. A registration claim must not be resolved by disregarding a parcelling whose legal basis is disputed. For this connection, the article title after the cancellation of a zoning implementation and, for obstacles based on public property, the article title cancellation based on a Treasury and public property claim may be read together. Further details can be found in the article objection to and action for annulment of a parcelling act.

Is the action brought in a civil court of first instance or an administrative court?

It is not enough to answer this question only by saying that, because registration is requested, the civil court of first instance is competent. If the administration does not recognise entitlement under Law No. 2981 or rejects the registration application, a claim for rectification of the register based on an independent private-law relationship is a different matter. Jurisdiction is determined according to the true legal nature of the claim.

In the decision of the Court of Jurisdictional Disputes (Uyuşmazlık Mahkemesi) dated May 3, 2021, no. E.2021/240, K.2021/296, registration was requested on the basis of a land allocation certificate and, after the application for registration was rejected, claims for cancellation and registration of title, an alternative location and payment were raised. The Court found that the dispute arose from the administrative entitlement and the process under Law No. 2981, and held that the administrative courts had jurisdiction. The request for registration or an alternative price in the petition did not change this assessment. 1

The decision should not be used to say that all files concerning land allocation certificates belong, without exception, to a single branch of jurisdiction. But it clearly shows that the jurisdictional assessment cannot be skipped in a file that disputes the rejection of an administrative application. The existence of another private-law file examined by the Court of Cassation does not in itself prove that the present case is of the same type. In this respect, the article objection to and action for annulment of a zoning plan amendment may also be read alongside this one.

If registration is not possible, can the current value of the plot be claimed?

The fact that a land allocation certificate is not a title deed directly affects the calculation of the price. Payments made in reliance on the document, the full market value of the property, construction costs and other alleged losses must be kept separate. The basis and the correct defendant for each item must be stated.

In the decision of the 7th Civil Chamber of the Court of Cassation (Yargıtay 7. Hukuk Dairesi) dated May 15, 2025, no. E.2025/1866, K.2025/2664, a plot falling within a school area, the possibility of alternative allocation and a payment claim were examined. Within the framework of the earlier quashing and the procedural position of the file, the updating of the money paid to obtain the document, rather than the full market value of the property, was taken as the basis. The judgment under review was affirmed. The current ownership and the question of the correct party were also assessed for registration. 3

This decision does not support the view that every holder of a land allocation certificate may claim the present market value of the whole plot. Nor is it a general rule that removes all claims based on a different legal ground and proven loss. The decision shows the importance of separating the refund of the payment from compensation for loss of ownership.

When updating, it must be explained which payment date, amount and economic indicators were used. It should also be examined whether the interest claimed and the update together compensate the same loss twice. Leaving the dispute to a figure that only an expert will select does not cure the lack of a legal basis. For comparison, the explanations on state liability arising from the land registry may be used.

What happens if the property is transferred to another administration during the action?

In the decision of the 7th Civil Chamber of the Court of Cassation dated October 23, 2025, no. E.2025/707, K.2025/4532, it was found that while an action for registration based on a land allocation certificate was pending, the relevant share was transferred to the Urban Transformation Presidency (Kentsel Dönüşüm Başkanlığı). The Chamber quashed the judgment, stating that the current land registry position and the consequences of the transfer of the subject matter of the action under Article 125 of HMK must be assessed. 45 For the route of objection to a determination of a risky building at the start of an urban transformation process, the article objection to and action for annulment of a risky building determination may be consulted.

The decision is not a final acceptance that the conditions of entitlement have been definitively met. It concerns the correction of a procedural defect. In practice, this shows the importance of requesting a current land registry record before every examination and judgment stage. Continuing the proceedings in the name of the former owner institution does not, by itself, ensure the proper constitution of the parties.

A transfer of the property to a private person, to another administration or to a new institution under an urban transformation scheme may give rise to different acts. Against whom the present claim should be directed, and which payment or loss claim may be pursued against the former institution, must be explained separately.

How should time limits and the application file be managed?

The fact that a land allocation certificate is old does not mean that all claims are without time limit. The annulment of an administrative rejection act, the refund of a payment and private-law claims may be subject to different time provisions. It is examined when the rejection letter was served, whether the application went unanswered, whether the earlier act became final, and whether the new request in fact creates a new act. 6

The first working file should keep together the document, the payment statement, current and former land registry records, plan samples, application petitions, administrative replies, notifications and any earlier decisions. The value of the action and the court fees are determined by the nature of the claim. No fixed outcome can be drawn for every file from the area stated in the document or from a nominal amount paid years ago. For detailed information, the article limitation periods and preclusive periods for bringing an action may also be read.

Conclusion

In registration based on a land allocation certificate, the essential question is as much whether the document exists as what legal position it creates and whether the conditions have been completed. A current review should consider together the repeal of Law No. 2981, earlier acts, the status of the plan and the correct branch of jurisdiction. If registration is not possible, the alternative location, refund of the payment and other loss claims should be assessed on their own separate bases.

Frequently Asked Questions

Does a land allocation certificate replace the title deed?

No. It is not the same as ownership under a title deed. It relates to a position of entitlement that may become a basis for registration once the statutory conditions and subsequent acts are completed.

Is Law No. 2981 in force today?

No. As a result of the entry-into-force provision of Law No. 6306, it ceased to be in force on May 31, 2023. The status of earlier acts and claimed rights is examined separately.

Since the law was repealed, has my old document become entirely worthless?

This result cannot be drawn automatically. The date and validity of the document, the legal situation that has formed, and the conditions not yet completed are assessed together. An old document alone does not provide definitive ownership either.

Can I obtain the full area in square metres stated in the document?

A definite amount cannot be given without examining the plan, the parcelling, the public service areas and the relevant deductions. The area stated in the document and the current area that can be registered may not be the same.

Can a title action be brought directly against a municipality’s rejection act?

The jurisdiction must be assessed first. In the 2021 file reviewed, the Court of Jurisdictional Disputes held that the administrative courts have jurisdiction over claims arising from administrative entitlement and the rejection process.

If my plot falls within a school area, is the full land price paid?

Not automatically. The possibility of allocation, the refund of the payment and the legal bases of other claimed losses are kept separate. In the 2025 decision, within the terms of the file, the updating of the price paid was taken as the basis.

If the owning administration changes during the action, is the file affected?

Yes. The current land registry record and the transfer act must be examined. Steps relating to the parties and the claim may be required under Article 125 of HMK.
