Summary

How long a foreign-flagged yacht may stay in Türkiye and who may use it. A guide explaining the distinctions between the customs regime, residency and the navigation permit.

The length of stay of a foreign-flagged private yacht in Türkiye, the validity period of its navigation permit and the yacht owner’s right of residence are three separate matters. The validity of one does not cure a deficiency in another. Nor does a yacht’s presence in a marina create a status independent of the customs or commercial-use rules.

Under Article 29 of Tourism Promotion Law No. 2634, foreign-flagged private yachts used for touring, sports and recreation may stay in Türkiye for up to five years for touring, maintenance, repair, slipping or winter storage. If the conditions are met, the Ministry may extend the period by a further five years. This article is based on the private yacht regime; the different permit model for commercial yachts is explained separately.

Flag, the owner’s nationality and residency

That a vessel is foreign-flagged does not necessarily mean that the person using it is a foreign national. A Turkish citizen may also be the owner of a foreign-flagged vessel or a shareholder in the company that owns it. On the other hand, citizenship, residency and the conditions for benefiting from the customs regime are different concepts. Assessing the matter solely on the basis of a passport or solely on the basis of the flag produces an incomplete result.

For a vessel registered in a company’s name, the fact that an individual is a shareholder or manager of the company does not mean that the individual may use the vessel for every purpose and without permission. The company documents, the authority to use, the owner’s instructions, the private or commercial status of the vessel and its record with the customs administration must be examined together. Holding the necessary document of representation and holding a permission to use arising from public law do not substitute for one another.

Entry into Türkiye and the navigation permit

Under Article 28 of Law No. 2634, entry and exit formalities are carried out at maritime border gates. Declarations concerning the vessel, personnel, passengers and voyages are handled on the navigation permit (seyir izin belgesi). Although there is a practice of issuing the document electronically, the procedures of the relevant authorities must still be completed upon entry. If the vessel arrives overland or aboard a carrier ship, the first launching and the customs formalities are planned separately.

In the statements of the Ministry of Trade (Ticaret Bakanlığı), the general validity period of the navigation permit is given as one year; the special situation of a vessel left in winter storage is regulated separately. Events such as a change of owner or ship operator and departure from the Customs Territory of Türkiye may affect the validity of the document. Recording a change of captain in the register and renewing the document in its entirety are not the same procedure.

The navigation permit should not be used as the sole document proving the owner’s title. The registry certificate, insurance, captain’s qualification and the vessel’s other technical documents must also be carried and kept up to date. Completing entry into Türkiye does not confer permission to anchor or navigate in prohibited or restricted areas.

For details on this subject, see the section on legal checks when buying a yacht or boat.

Five-year stay and extension

The five-year period in the law cannot be read as an unconditional and unqualified ten-year right. The start of the first period, the entry records, the purpose for which the vessel is present and the winter storage procedures are checked from the file. For an extension, the conditions in the Maritime Tourism Regulation and in the relevant Ministry practice must be met. Preparing the application before the period expires prevents a dispute over a violation of the regime.

It should not be assumed that all periods are automatically reset because the vessel has minor maintenance done or briefly leaves the country. The records of the customs and tourism administrations are assessed together. In particular, in the case of a change of owner and a transition to commercial use, it should not be assumed that the former status continues automatically for the new person.

Use without the owner on board

The captain of a yacht should not assume that, in the absence of the owner, any touring and recreational voyage may be made solely on the basis of a power of attorney. In the statements of the Ministry of Trade, in situations such as picking up or dropping off the owner or the owner’s family at another port, use is described as limited to instructions and the voyage permit of the harbor master’s office. The purpose of the specific voyage and the permit record are important.

Use by a family member, a company employee or a friend should likewise not be treated as one generic category. The person and purpose for which the vessel was declared at entry, and the current regulation and customs conditions, must be examined. Being on board a vessel and legally operating or managing it are different things. Even use without charge does not automatically eliminate every permit problem.

Transfers to another facility for maintenance, trial voyages and emergency movements are assessed separately. For such voyages, rather than relying on the day-to-day practice of the agent or the captain, it is useful to have the necessary administrative record completed in writing or electronically. A power of attorney granted under private law does not substitute for the voyage permit that the administration requires.

Winter storage, maintenance and customs supervision

Leaving a yacht in winter storage at a facility licensed by the Ministry of Culture and Tourism (Kültür ve Turizm Bakanlığı) requires that the procedures be recorded. The marina or boatyard agreement should regulate the protection of the vessel, the authority to carry out maintenance, moving the vessel in an emergency, staff access and continuity of insurance. The owner’s departure from the country does not give the facility unlimited authority to use the vessel.

The maintenance and repair of a foreign yacht are connected with customs supervision and control. The legal status of imported spare parts, a replaced engine, dismantled equipment and waste is determined separately. Selling goods on the yacht in Türkiye or leaving them with third parties may have customs consequences separate from the vessel’s temporary-presence regime. Before a major refit, a plan for the entry and exit of parts should be prepared.

In waste delivery records, the Maritime Waste Practice Circular No. 2026/12 dated September 9, 2026 should be taken into account. A foreign flag does not remove the environmental and waste delivery obligations in Türkiye.

Commercial yachts and cabotage

The ease of movement and stay granted in Türkiye to private yachts cannot be converted into authority to provide paid domestic route services or to charter. Cabotage Law No. 815 and the tourism legislation are assessed together. The fact that a contract is signed in a foreign country or that payment is made abroad does not, on its own, change the legal nature of an activity actually carried out in Türkiye.

Article 29 of Law No. 2634 provides for a temporary permit for foreign-flagged commercial yachts that are over 39 meters in length and that the Ministry assesses as contributing to the country’s tourism and promotion. A contribution fee is charged and the permit cannot exceed the same calendar year. This is not a freedom to operate automatically granted to all foreign commercial yachts. The annual contribution amount must be taken from the official tariff in effect on the date of application.

Sale and change of status

When the sale of a foreign-flagged yacht in Türkiye is planned, the closing or change of the customs regime must be considered as much as the transfer of ownership. Whether the new owner can benefit from the same facility, whether the vessel will be imported definitively and the change of registration are investigated. Payment of the sale price does not prove that the existing temporary regime has ended.

For a change of flag, the deregistration and new registration documents are matched. Whether a vessel is tax-free cannot be settled by observing that no tax was paid upon entry into the country. Tax not collected under a temporary regime and a permanent tax exemption are different things. Export or re-exit must be completed with administrative documents.

Application file in case of a violation

Exceeding the period, unauthorized use, a false declaration or leaving goods without permission are different grounds for sanctions. Whether the action taken is a customs penalty, a port measure, a tourism sanction or another action changes the competent authority and the time limit. A single “objection period” should not be given for all yacht procedures.

As soon as a notice is received, the legal basis of the decision, the date of notification and the route of application should be determined. The entry and exit record, the navigation permit, the owner’s and captain’s authority, the marina agreement and the maintenance documents are brought together. When corresponding with the administration, the protection of time limits is tracked separately; an informal conversation does not replace a statutory application.

For details on this subject, see the section on permits, environmental impact assessment (ÇED) and the operating process in establishing a marina and yacht harbor.

Conclusion

Proper management of a foreign-flagged yacht begins with tracking the periods that belong to the vessel and those that belong to the person separately. The distinction between private use and commercial activity must be preserved, and a change of owner and maintenance work must be carried out in line with the customs status. The five-year stay arrangement is not an exemption that gathers all permits into a single document.
