LEGAL STATUS IN TÜRKİYE · APPLICATION · LITIGATION

First, We Identify the Decision, the Time Limit and the Right That Must Be Protected

Immigration law covers procedures relating to entry into Türkiye, residence in the country, work and protection statuses. A deportation decision, administrative detention and an entry ban are separate procedures. That they are applied together to the same person does not mean that a single application will remove all of their consequences.

Time Limits in Deportation, Administrative Detention and Protection Decisions

7 days · Deportation action

This is the period, counted from notification of the deportation decision, for applying to the administrative court. The application to the court is also notified to the authority that issued the decision. Basis: Art. 53/3 of Law No. 6458.

Administrative detention · Separate application

An application is made to the criminal judgeship of peace. The 5 days in the law is the judge’s review period; it should not be read as an objection period granted to the foreign national. Basis: Art. 57/6 and Art. 68/7 of Law No. 6458.

15 / 30 days · Protection actions

In decisions on inadmissible applications and accelerated assessment, 15 days apply; in other administrative decisions and acts under Art. 80, a 30-day time limit for bringing an action is provided. The nature of the act is decisive.

In the international protection decisions for which it is available, the period for objecting to the Commission is 10 days; this route does not apply to decisions on administrative detention, inadmissibility and accelerated assessment. An objection to the Commission does not stop the time limit for bringing an action (Implementing Regulation Arts. 99–101). The current approach of the Council of State (Danıştay) to the special 30-day period in cases of cancellation of temporary protection status or identity document is also taken into account separately.

Check the date of notification, the translation and the notice procedure.

In calculating the time limit, the day the decision was issued and the day of notification may not be the same. For notification by hand or by post, the notification record and the procedure are examined; for electronic notification, the UETS evidence record is examined. Time limits for administrative actions as a rule begin on the day following notification. If the translation or the notice is deficient, document it; do not wait on the assumption that the time limit never began.

Residence, Citizenship and Work Permits Are Assessed Separately

Stay and citizenship in Türkiye

A protection request, a residence permit and Turkish citizenship are different legal processes. An existing permit or family tie does not by itself invalidate a deportation decision. For related applications, the status and earlier decisions are examined together.

Residence Permit Applications and Appeals

Foreign employees and employers

Work permits and exemptions, the Turquoise Card, foreign students, persons with protection status, employer notifications and social security obligations are handled under their own special conditions. The routes for permit refusals and administrative sanctions are separate.

How Do We Assess Your File?

  1. Decision and time limit

The type, basis and notification of each decision and the competent authority are determined separately.

  2. Status and evidence

The history of stay and the risks relating to family, health and country of origin are compared with the documents.

  3. Application and representation

Actions, objections and protection requests are handled together with the necessary notifications.

  4. Follow-up after the decision

The implementation of the decision, detention, entry records and subsequent status procedures are monitored.

Issues we will clarify in the initial assessment

Which remedy applies against which decision, the time limit, personal risks, missing documents and the need for urgent protection are determined. The work to be undertaken, the fee and expenses, and the method of communication through which developments will be reported are explained. If there is more than one procedure, the status of each is followed separately.

Antalya-Based Legal Representation Across Türkiye

Güneş & Güneş Law Firm was founded in Kemer in 1999 and has carried on its professional practice based in Antalya since 2007. In immigration law files across Türkiye, the competent authority, attorney consultation, application and representation plan are arranged according to where the file is located.

Communication in Turkish, English, German and Russian supports understanding the decision, document preparation and follow-up of the process. Communication support and official interpreting are different things. Online meetings from abroad, power of attorney, apostille/certification and translation requirements can be planned in advance; procedures that must be performed in person are indicated separately.

Frequently Asked Questions About Immigration Law

Does the deportation stop if an action is filed against a deportation decision?

Art. 53/3 of Law No. 6458 provides a safeguard against deportation during the period for filing an action and until the end of the proceedings, unless the foreign national consents. The application must be notified to the authority that issued the decision. This safeguard does not mean that administrative detention ends automatically or that a residence permit is granted.

What should I share if my relative is in a removal center?

Share the identity details, the center where the person is held, the decisions, the dates of notification, a person who can be reached and any urgent health or transfer information. A family relationship alone does not confer authority to represent; attorney consultation, access to the file and the method of power of attorney are arranged separately.

Does leaving administrative detention cancel the deportation decision?

No. Administrative detention, which restricts liberty, and the deportation procedure are different. Ending the detention or applying an alternative obligation does not take the place of annulling the deportation decision.

Once a restriction code is removed, is entry into Türkiye assured?

The basis of the code, the entry ban, the visa and the other conditions of entry are assessed together. The removal of one record does not show that all restrictions or permit conditions have ceased.

Can an attorney file the international protection application on my behalf?

As a rule, the application is personal. The attorney provides support in preparing for the application, legal explanation, submission of documents and representation against negative decisions; the exceptions in the law are reserved. A protection application is not an ordinary permit route used to extend the period of residence.

Which time limit should I watch if my temporary protection identity document has been cancelled?

In actions on the cancellation of the status or the identity document linked to it, the decision of the Plenary Session of the Administrative Chambers (İDDK) of the Council of State dated 14.05.2025, E.2025/13, K.2025/34, applies the special 30-day period. The procedure is also examined for the remedy, the time limit and comprehensible language in the notification. Do not wait in reliance on the general 60-day period.

Can I have a consultation from outside Türkiye or without knowing Turkish?

An online consultation can be arranged. Communication in Turkish, English, German and Russian is available; a different language or the need for an official interpreter should be stated in advance. For some administrative procedures, the requirement to be present in person continues.

How are attorney fees and other expenses determined?

The scope of service is determined on the basis of the number of decisions, the application routes, where the file is located and the procedures required. The attorney fee, court fees, translation, notary and other expenses are explained separately. For persons who meet the statutory conditions, bar association legal aid and legal aid for litigation costs may also be assessed separately.

This content is general information. Information and documents you share are kept confidential and used for legal assessment and within the agreed scope of service. An inquiry alone does not create an attorney–client relationship and does not stop time limits. The legal conditions of the specific matter are reviewed separately.
