FOREIGNERS LAW

Entry Bans to Türkiye, Restriction Codes and Visa Disputes

Legal support in entry bans, restriction records, refusals of entry at border gates and visa denials. Review of the basis of the act, and follow-up of administrative applications and annulment actions.

LEGAL ASSESSMENT

First, the basis of the restriction and the type of act are determined

An entry ban to Türkiye, a restriction record, a visa denial, a refusal of entry at a border gate, a deportation and administrative detention are not the same act. Several of them may be present in one person’s file. The name or letter of a code alone is not sufficient to determine the route of application and the time limit for bringing an action.

Güneş & Güneş Law Firm provides legal support in reviewing the grounds of the decision, the notification and learning-of-the-act information, and the person’s family, work, education and investment ties in Türkiye. The administrative application, the lawsuit and, where needed, urgent protection are assessed separately for each act.

SCOPE OF SERVICES

Our Services in Entry Ban and Visa Matters

Review the heading that fits your needs. The acts to be undertaken are determined by assessing the documents and the conditions of the file.

Review of the decision and the restriction record

It is determined which authority’s act the restriction rests on and what its practical effect is.

  • Obtaining the decision, notice and file information within the scope of the authority granted
  • Comparing the code, the date of the decision, the time limit and the notification information
  • Examining the possibility of more than one act or of different identity records

Application to lift an entry ban

An application to the competent authority is prepared in light of the grounds of the ban and the current conditions.

  • Documenting family life, health, work and other concrete ties
  • Assessment in terms of erroneous information, changed conditions and proportionality
  • Separate check of the effect of the application on the time limit for bringing an action

Annulment action and stay of execution

The lawfulness of the act is addressed in terms of competence, form, grounds, subject matter and purpose.

  • Determining subject-matter and territorial jurisdiction, the act that is the subject of the action and the defendant authority
  • Examining the bases of the file, the grounds and the defense documents
  • Where the conditions are met, a stay of execution and steps in legal remedies

Visa denial and visa cancellation

The purpose of the visa request, the documents submitted and the stated reason for the denial or cancellation are compared.

  • Examining the acts and correspondence of the consulate and the relevant authority
  • Determining the appropriate route for missing or contradictory information
  • Separate assessment of an annulment action and a new visa application

Refusal of entry at a border gate

The act of non-admission to the country and the related records and notifications are examined.

  • Comparing passport, visa, permit and travel-purpose documents
  • Notification of the refusal-of-entry decision and assessment of the rights to apply
  • Identifying any separate entry ban or deportation decision

Prior permission and entry for a limited period

Special entry possibilities allowed by law are addressed in light of the type of ban and the assessment of the competent authority.

  • The possibility of lifting the ban or entering for a limited period under Article 9 of Law No. 6458
  • Conducting the visa and prior-permission process through the relevant diplomatic mission
  • Not guaranteeing the outcome of travel before permission is granted

Violation, penalty and payment records

The separate effects of a violation of the lawful period of stay, a fine and an entry restriction are examined.

  • Listing entry–exit dates, the permit period and earlier applications
  • Matching penalty and payment receipts to the relevant file
  • Avoiding the assumption that payment alone removes all restrictions

Family, work and education ties

Real ties to Türkiye are presented in a manner suited to the file, in the application and in judicial review.

  • Explaining spouse, child and care relationships with concrete documents
  • Assessing the legal significance of employer, school and treatment documents
  • A flow of information consistent with residence and work permit files

Checking the record and the entry conditions after the decision

The scope and implementation of a favorable decision are monitored separately from other existing restrictions.

  • Forwarding the court or administrative decision to the relevant authority
  • Checking the scope of application of the decision and of any separate ongoing acts
  • Taking into account that a new passport or visa does not remove the earlier record automatically

BEFORE YOU DECIDE

How Are Restriction, Visa and Deportation Acts Distinguished?

Without determining the nature of the act, no single time limit or single method of application can be recommended.

Restriction record and entry ban

A restriction record may express information or a restriction concerning a person’s status in the administrative record system. Not every record gives rise to an entry ban of the same scope. Code lists on the internet cannot be used in place of the current decision in the file and its grounds.

Duration of an entry ban

Under Article 9 of Law No. 6458, an entry ban is set at a maximum of five years; where there is a serious threat to public order or public security, it may be extended by the competent authority by up to ten more years. These upper limits are not fixed periods that apply automatically to every foreign national. The basis and duration of the decision are examined separately.

Visa and admission to the country

A visa does not provide an absolute right of entry into Türkiye. Visa exemption likewise does not remove the other conditions of entry. A valid visa, an entry ban, prior permission and the examination at the border gate are assessed together.

Special-purpose visa and lifting of the ban

The existence of a family, work, education or treatment purpose does not by itself lift the ban. An entry ban may be lifted, or entry for a limited period may be permitted while the ban is maintained; the necessary permit and visa conditions are assessed by the competent authority. An annotated visa (meşruhatlı vize) is not an automatic solution for all restrictions.

Family life and the assessment of the administration

The presence of a spouse or child in Türkiye may be significant in the examination of family life and proportionality. However, this does not by itself mean that every application will be accepted. The genuineness of the family tie, the child’s situation, the grounds of the administration and the specific circumstances are presented together.

More than one decision in the same file

An application against an entry ban does not replace a separate application against a deportation or administrative detention decision. A court’s annulment of one act also does not in every case automatically remove other acts with different bases.

ADMINISTRATIVE APPLICATION AND JUDICIAL REVIEW

Application Time Limits and Judicial Protection

The date and method of notification are determined at the first review. The dates on which the decision was first learned of, on which written notification was given and of subsequent administrative replies are recorded separately.

General time limit for administrative actions

For administrative acts without a special time limit, the general time limit for bringing an action under Article 7 of the Administrative Procedure Law (İYUK) is sixty days; as a rule, it starts on the day after written notification. The absence or irregularity of notification should not be treated on the assumption that the time limit never starts; the specific act and the conditions of learning of it must be examined.

Effect of an administrative application on the time limit

An application that meets the conditions of Article 11 of İYUK and is made within the time limit for bringing an action suspends the time that is running. If no reply is given within thirty days, the implied rejection and the calculation of the remaining time are assessed. A new application does not in every case restart a time limit that has already run.

Separate time limit for a deportation decision

Against a deportation decision, Article 53 of Law No. 6458 provides a special time limit for bringing an action of seven days from notification. The general time limit applicable to an entry ban does not apply to this decision. Notifying the authority of the application and its effect on the implementation of the decision are also taken into account.

Stay of execution and administrative detention

Bringing an action against an entry ban or a visa act does not, as a rule, stop the act automatically. The conditions of Article 27 of İYUK are assessed separately. The review of an administrative detention decision, on the other hand, is carried out separately before the criminal judgeship of peace (sulh ceza hâkimliği).

Time-sensitive actions

If there is an approaching trip, notification or deprivation of liberty, do not wait only for a reply to the form. Notify us of the decision in your hands and the date of notification through our official communication channels; the type of act and the time limit must be assessed without delay.

OUR APPROACH

Our Approach in an Entry Restriction File

We first compare the account given by the person with the official file of the acts. Instead of relying only on the name of a code, we identify the grounds of the decision, the time limit, the notification and the person’s real ties to Türkiye. By explaining the purposes of the administrative application and of the judicial route, we plan which act will be challenged with which document.

  1. Separating the acts and the dates

Entry ban, visa act, refusal of entry, deportation and detention decisions are listed separately; the dates of notification and of approaching acts are identified.

  2. Review of records and documents

Records obtained within the scope of authority are compared with passport, entry–exit, family, work, education and payment documents. Missing information and, where applicable, errors in the record are identified.

  3. Application and protection plan

The competent authority, the court with subject-matter jurisdiction, the time limit, the request and the evidence are identified. The necessary permission, annulment action or interim protection route is selected according to the file.

  4. Carrying out the act and keeping you informed

After acceptance of the matter and the power of attorney, the application or action is followed; the authority’s reply, interim decisions and the documents the client must prepare are explained.

  5. Monitoring the implementation of the decision

The outcome is assessed in terms of the act the decision covers. Other ongoing records, and visa and entry conditions, are checked separately before travel.

PREPARING FOR THE FIRST CONSULTATION

Preparing for an Entry Ban and Visa File

A short summary of the matter is enough for the first application. Detailed documents are requested through a secure channel after the scope of the review has been determined.

What you can prepare at the start

  • Citizenship, the country you are currently in and the purpose of coming to Türkiye
  • A current copy of the restriction, denial or refusal-of-entry decision
  • The date on which the decision was notified or learned of, and the record showing it
  • Latest entry–exit dates and information on visa, residence or work permit
  • If any, the date of an approaching trip, treatment, education or judicial act

What may be requested depending on the file

  • The relevant pages of the passport and earlier application documents
  • Documents on family ties, children, work, education or treatment, as needed
  • Notification of a violation or fine and payment receipts
  • Earlier lawsuits, administrative applications, decisions and the authority’s replies
  • Power of attorney to be executed abroad and necessary translation documents

Confidentiality of your information

The information and documents you share are used, within the framework of the attorney’s professional secrecy and the principles of personal data protection, only for legal assessment and for carrying out the work undertaken. REPRESENTATION AND COMMUNICATION

Following Entry and Visa Procedures Across Türkiye from Antalya

Güneş & Güneş Law Firm, founded in Kemer on March 18, 1999 and based in Antalya since 2007, conducts entry ban, visa and related foreigners law matters before the competent authorities and courts across Türkiye, in accordance with the subject-matter and territorial jurisdiction requirements of the file.

Communication with clients abroad is possible in Turkish, English, German and Russian. The flow of consulate documents and representation in Türkiye are planned together; where a separate legal act is needed in a foreign country, the role of authorized counsel in that country is determined separately.

Scope of the fee

It is determined which of the application, lawsuit, legal remedies and follow-up of implementation are included in the engagement. Court fees, translation, notary/consulate and other expenses are separated from the attorney’s fee.

Representation and access

Access to the restriction record is carried out within the framework of authority and legislation. No promise is made that an attorney has unlimited access to all public records or that a code will definitely be removed.

Communication and urgent acts

Information on the decision and time limits should be stated during the first contact. A consultation request is not, by itself, acceptance of the matter or monitoring of time limits; the necessary engagement is clarified separately.

FREQUENTLY ASKED QUESTIONS

Questions About Entry Bans, Restriction Codes and Visas

The answers are general information. The route and conditions that apply to your request are assessed on the basis of specific information and documents.

Can a review be done if I do not know my restriction code?

We can start with the denial, refusal-of-entry or application records you have. Within the limits of authority, an effort is made to identify the decision and the record; no definite outcome or route of action is stated without knowing the code.

I paid the fine; can I enter again?

The payment document is important, but there may be a separate entry ban or prior-permission condition. Which debt the payment settled and the status of the other records are examined separately.

Does getting a new passport remove the restriction?

No. A restriction concerning a person does not disappear automatically merely because the passport document is renewed. Identity and passport records must be matched correctly.

Is being married to a Turkish citizen enough?

Marriage is an important family tie; however, it does not make the examination of entry, visa and, where applicable, public order grounds unnecessary. Acceptance of the application is not automatic.

Does owning a company or real estate give a right of entry?

Investment or ownership alone does not resolve visa, residence or entry ban problems. These acts are subject to their own legal conditions; economic ties are assessed in the file to the extent they are relevant.

Does obtaining an e-visa show that all checks have been completed?

No. An e-visa is different from the other conditions of entry and from the admission examination at the border. The validity of the document and its conformity with the purpose of the application must also be checked.

Can a lawsuit be conducted while I am outside Türkiye?

Once the necessary power of attorney and documents are provided, many acts can be carried out without coming to Türkiye. Any additional participation or document formalities the file requires are communicated separately.

Does requesting the visa again preserve the time limit for bringing an action?

Not every new application suspends or restarts the time limit for bringing an action against the earlier denial. The type of application and its effect under İYUK must be assessed on the basis of the specific dates.

Are the explanations of codes on the internet definitive?

The current meaning of a code, the basis of the act and its personal effect must be checked from the official file. Time limits or outcomes in lists of unclear origin cannot be applied directly to a personal file.

Should I buy a plane ticket right after a court decision?

The scope of the decision, its implementation by the authority and any other conditions of entry should be confirmed. The annulment of one act does not in every case remove a separate restriction or the required visa.

Is being turned back at the border the same as deportation?

No. Non-admission to the country and the deportation of a person who is in Türkiye are different acts. Even if they affect the same person, their routes of application, time limits and documents are examined separately.

Is it known how long an application will take to conclude?

The type of act, obtaining the records, the review by the authority and the court, and the need for additional documents are decisive. Entry, a visa or the outcome of a lawsuit on a particular date cannot be guaranteed.
