Annulment of a Deportation Decision and Deportation Procedures
A deportation decision is an administrative act, issued by governorates, that results in a foreign national being removed from Türkiye. It may not be enough for the decision merely to name its legal basis; the specific reasoning, the information and documents used in the file, the person’s particular circumstances and the risks within the scope of the non-refoulement principle should be examined together.
The main areas of work in an annulment action against a deportation decision are as follows:
- Reviewing the decision and the notification record
- Evaluating the legal and factual grounds stated in the decision
- Establishing the foreign national’s lawful stay, family, work, education and health situation
- Setting out the risks the person may face in the country to which they would be returned
- Reviewing the matter in terms of the appropriate country, safe third country and non-refoulement
- Preparing the annulment action and, where necessary, requests for interim protection
- Notifying the application to the authority that issued the decision
- Following the file before the administrative court
The time limit for applying against a deportation decision is seven days from notification. Bringing an action and objecting to an administrative detention decision are different applications. Where the foreign national is held in a removal center, the deportation decision and the administrative detention decision should be examined separately.
Non-Refoulement and the Risks in the Country of Return
The existence of a ground for deportation against a person does not mean that the person can in every case actually be deported. The right to life; the risk of torture and inhuman or degrading treatment; serious illness, age, pregnancy, access to treatment, victimization by human trafficking and certain situations of violence are assessed separately with respect to the removal itself.
This review does not rest only on the foreign national’s general statement; personal history, country-of-origin information, family ties, health documents, earlier applications, national and international reports and the person-specific nature of the risk are considered together. Depending on the circumstances of the file, claims relating to non-refoulement may be raised in the deportation action, in the international protection process or in an individual application.
Immigration Procedures Following a Criminal Investigation or Enforcement of a Sentence
A criminal investigation or prosecution concerning a foreign national, a conviction or the enforcement of a sentence may also lead to a deportation decision, administrative detention or an entry ban. A decision in the criminal proceedings and an immigration-law act do not take each other’s place, and each is subject to separate review before the competent authority.
In such files, the criminal defense, release or enforcement procedures and the timing of the migration authority’s decisions are followed together. Extradition and surrender proceedings are assessed separately under criminal and international law.

Critical Distinctions Before and After Filing the Action
Seven days is the time limit for bringing the action
Under Art. 53/3 of Law No. 6458, the application is made to the administrative court within seven days of notification of the decision. In calculating the time limit, the day following notification and the applicable procedural rules are taken into account. It should not be assumed that a petition to the administration, a telephone call or a general complaint record protects this special time limit for bringing an action.
Safeguard and notification during the proceedings
Unless the foreign national consents, the statutory safeguard against deportation during the period for bringing an action, and from the filing of the action until the proceedings conclude, is taken into account. It is important to notify the application to the authority that issued the decision and to keep the case number and the receipt record. This does not by itself lift a detention decision.
The court’s review and the time limit to apply are different things
Under Art. 53/3 as amended by Law No. 7533, the timetable of the proceedings depends on the completeness of the file, any interim decision or the need for a hearing. A service promise such as “a final result is obtained exactly fifteen days after the action is filed” is not correct. The special provision on the finality of the court’s decision in a deportation action is also taken into account separately.
How are family and risk documents prepared?
Marriage or having a child in Türkiye is not in every case an automatic exception that prevents a deportation decision. The reality of family life, the best interests of the child, the relationship of dependency and the individual’s health are established with concrete documents. A country-of-origin report is considered together with records showing the personal threat; general country information alone is not relied upon.
Invitation to leave and voluntary return
If the statutory conditions are met, an invitation to leave Türkiye may grant a period of not less than fifteen and up to thirty days; there are exceptions. This period does not replace the seven-day time limit for bringing an action. Before signing a return or consent document, understand its content and its effect on your status; state your need for translation.
Implementation of the decision and the legal position afterwards
After an annulment decision, the administration’s implementation, detention, entry records and permit status are followed separately. Constitutional Court or international application routes are examined separately in terms of admissibility requirements and the conditions for urgent interim measures; it is not assumed that every application has an automatic suspensive effect.
Information Needed for the First Consultation
Prepare all pages of the decision, the notification record, your current status, earlier applications and a short chronology of events. If a transfer or application deadline is approaching, mention it in your first message. The file-specific document list and the method of representation are settled in the consultation.
