Winning a title cancellation and registration case does not mean the judgment can be applied at the land registry on the same day. The order to register the in rem right must become final, a finality endorsement must be issued, and the operative part must be clear enough to apply at the registry. By contrast, where a case brought as a title claim has resulted only in a monetary award, whether finality is required is examined separately. The 2026 decisions show that this distinction cannot be made by looking only at the name of the case. 1256
Work after the judgment should follow three separate outcomes: correction of the register, actual delivery of the property, and collection of any monetary award. Completing one of these does not mean the others have happened automatically. The operative part, the status of legal remedies and the current land registry record should be assessed together. 13
What should be checked first after the judgment?
The entire operative part of the reasoned judgment should be read, not only its concluding sentence. The entry to be cancelled, the person or company to be registered, the share ratio, the block and parcel, the independent unit and any technical sketch on which the judgment relies should all be clear. Whether the court has decided on costs, litigation expenses, attorney's fees, interest and the continuation of any injunction should be marked separately. HMK 297/2 requires that rights and obligations be stated clearly and without ambiguity. 1
Next, determine on which party and on what date the judgment was served, and which legal remedy is open. A UYAP screen showing the file as “decided” (karara çıkmış) does not by itself prove that the judgment has become final. The reasoned judgment, service records, appeal or cassation steps and the finality endorsement should be checked together. 1 For a similar dispute, the article if the developer does not hand over the title deed: registration and compensation may also be read.
How are appeal and cassation deadlines calculated?
The general period is two weeks from service
Under HMK 345, the period for appeal (istinaf) is, as a rule, two weeks from formal service of the judgment. For decisions of the regional courts of appeal that are open to cassation (temyiz), the general period under HMK 361 is also two weeks from service. Where special provisions or a different procedural regime apply, those rules are applied separately. The start of the period is not in every case the same as the moment the judgment was learned of at the hearing. 1
Irregular service, the death of a party, proceedings through counsel, public holidays and the effect of the judicial recess should be examined in the concrete file. Counting fourteen calendar days alone may miss the triggering event and the relevant procedural rules. An application for correction or explanation of the judgment should also not be assumed to preserve the period for a legal remedy automatically. 1 For comparison, the explanations in appeal in a civil lawsuit may also be useful.
Which year is used for the monetary threshold?
Not every title deed file will necessarily go through appeal and cassation. Whether a legal remedy is open depends on the type of decision, the value of the dispute and the applicable rules on finality. Under the second paragraph of Annex 1 of HMK, as amended on June 4, 2025, the monetary thresholds in Articles 341, 362 and 369 are measured by the amount on the date the action was filed. Automatically repeating the decision-date criterion of the former text is no longer current. 1
For this reason, looking only at the figure for the “2026 cassation threshold” is not enough. The date the case was opened, the value of the claim and of the judgment, the transitional rules that apply and the type of legal remedy must be determined together. A nominal value stated in the petition does not by itself resolve the real value of the case concerning the property. 1
Are finality and registration in the land registry the same thing?
Article 705 of the Civil Code (TMK) provides that a court judgment may create ownership before registration; however, registration is required for disposition transactions. In a title cancellation and registration judgment, finality is the essential stage in applying this acquisition. Updating the registry record corrects how the right appears in the land registry. 12
HMK 350/2 and 367/2 provide that decisions concerning in rem rights in immovable property cannot be carried out before they become final. The general rule that an appeal or cassation does not stay enforcement does not remove this specific finality requirement. Article 20/1-e of the Land Registry Regulation (Tapu Sicili Tüzüğü) likewise requires a final decision for registration based on a court judgment. 14
The finality endorsement (kesinleşme şerhi) is issued by the court of first instance; for judgments that pass through legal remedies, the necessary notifications are made under HMK 302/5. Following the file separately allows a party to see at what stage it is and whether the document sent to the land registry directorate is complete. Completion of the transaction on the same day cannot be assumed in every file. 1 Further details are available in the article registration based on a sale promise contract.
Which documents are prepared for implementation at the land registry?
The judgment bearing the finality endorsement, the required court letter, the applicant's identity and representation documents, and the technical annexes referred to in the judgment must be consistent with one another. Technical annexes are especially important in judgments providing for partial registration, subdivision (ifraz) or boundary determination. The land registry directorate cannot itself determine a new distribution of shares, or a different property, that is not contained in the judgment. 124
| Check | Why it is needed |
|---|---|
| Finality endorsement | To show that the in rem right judgment is enforceable |
| Block, parcel and independent unit | To match the judgment with the current record |
| Right holder and share ratio | To determine in whose favor the registration is made |
| Technical annexes included in the judgment | To apply a partial area or boundary without doubt |
| Identity and representation documents | To show the applicant's authority to act |
Under Article 1013 of the Civil Code, the declaration of registration by the previous owner is not required for an acquisition based on a final court judgment. Therefore, the losing party not coming to the land registry does not by itself prevent the implementation of a final and enforceable registration judgment. Existing rights, annotations and the scope of the judgment may still raise issues that need separate review. 2 From this angle, the article the land registry after cancellation of a zoning implementation may also be read together with this one.
What route applies if the judgment contains an error or gap?
Correction (tashih): clear wording and calculation errors
HMK 304 regulates the correction of wording and calculation errors and similar clear mistakes. Correcting a typing error where the property ruled on is clearly identified is not the same as adding to the judgment a new property on which the court never ruled. Correction must not be used as a means of changing the outcome on the merits. 1
Clarification (tavzih): explanation and removal of doubt
Under HMK 305, a judgment that is not sufficiently clear, that raises doubt in its application, or that contains contradictory parts may be clarified. However, rights granted to the parties and obligations imposed cannot be extended, narrowed or changed through clarification. A notice of uncertainty from the land registry directorate does not mean that the court will accept any new claim by way of clarification. 1
Completion of the judgment: a claim on which no decision was given
HMK 305/A provides for an additional decision where matters that were raised, or that the court should have taken up of its own motion, were wholly or partly not decided. The application must be made within one month of service of the final judgment. This route cannot be used to have an adverse judgment reviewed again, or to replace a missed legal remedy. 1
Can a monetary or compensation award be enforced before finality?
The name of the case must be distinguished from the nature of the judgment
Two extreme generalizations should be avoided: that “no monetary claim in a title case can be demanded before finality”, and that “where the judgment states money, finality is never required”. What matters is what the operative part decides and whether enforcing it would change the land registry record. Current case law should be compared with the facts and dates of the concrete case. 56
In its decision of March 11, 2026 (E. 2026/921, K. 2026/1772), the 12th Civil Chamber of the Court of Cassation (Yargıtay 12. Hukuk Dairesi) examined a file in which a title registration claim and monetary claims were raised in the alternative (terditli), and the order of the claims was changed during the proceedings. Treating the dispute as one that fundamentally concerns the in rem right, the Chamber held that finality was also required for the monetary award and quashed the judgment of the regional court of appeal. 6 For more detail, the article judgments that can be enforced before finality may also be read.
What did the June 24, 2026 Civil General Assembly decision address differently?
In its decision of June 24, 2026 (E. 2025/654, K. 2026/406), the Civil General Assembly of the Court of Cassation (Yargıtay Hukuk Genel Kurulu) dealt with a case in which cancellation of title and registration, or compensation if that was not possible, was sought, and the property changed hands through forced sale during the proceedings. The title claim was rejected and a monetary award was made. The majority of the Assembly took as its basis the part of the judgment to be enforced. Noting that carrying it out would not change the land registry record, it did not require finality. The decision of persistence (direnme kararı) was affirmed. 5
The minority view argued that, since an in rem right was in dispute, the compensation award should also become final; the majority did not adopt this view. Consequently, the March 2026 Chamber decision and the June 2026 majority approach of the Civil General Assembly should be read together. The Civil General Assembly decision should be presented as the reasoning and outcome of a concrete dispute, not as a unifying case-law decision (içtihadı birleştirme kararı) that removes every other possibility. 56
| Appearance of the judgment | Approach to implementation |
|---|---|
| Direct title cancellation and registration | The in rem right judgment must become final. |
| Title claim rejected, only a monetary award made | Assessed separately by the operative part and current case law. |
| Monetary ancillary items alongside registration | The connection between the judgments and the enforceable part is examined separately. |
Collection of the fee as a public receivable is not the same question as enforcement of litigation costs or of the attorney's fee payable to the opposing party on the basis of a judgment. Under HMK 302, non-payment of the balance of the decision and judgment fee expressly does not prevent the judgment from being issued, served or appealed. 1
Does a registration judgment secure the eviction of the property?
Being the owner in the land registry and actually taking possession of the property are different things. It should be examined whether the judgment contains an enforceable decision for delivery, eviction or prevention of interference. Article 26 of the Enforcement and Bankruptcy Law (İcra ve İflas Kanunu, İİK) regulates the enforcement of judgments for eviction and delivery of property; the enforcement office cannot itself create an obligation that is not in the judgment. 35
The status of the occupant, whether a tenant, a former owner or a third party, can also affect the outcome. A registration judgment alone does not mean that every existing use relationship has ended automatically. If payment for use for a past period or compensation for unjust occupation (ecrimisil) is claimed, the legal basis, the period, bad faith and the other required conditions are examined separately. 23
What if a new transfer, mortgage or attachment appears?
Land registry transactions before and after the judgment should be compared. A transfer during the lawsuit is governed by HMK 125; the effect of res judicata on subsequent acquirers of rights by HMK 303; and good-faith acquisition within the framework of TMK 1023–1024. The date of an entry alone may not resolve every conflict. Whether the cancellation of a mortgage or attachment falls within the scope of the judgment is also determined separately. 12
The period for which an interim injunction (ihtiyati tedbir) remains in force should also be followed. The general provision of HMK 397/2 and the court's specific decision are read together. The existence of an injunction does not mean that every limited in rem right or attachment is erased automatically. For this reason, checking the current encumbrance record (takyidat) after registration is part of the final stage. 1 This subject is treated separately in the article interim injunction and precautionary attachment.
What route is followed if the land registry refuses the transaction?
First, establish whether the deficiency relates to a document, to the technical implementation or to the scope of the judgment. Oral explanations should not be relied on; a reasoned refusal and its date of service should be established. Under Article 26 of the Land Registry Regulation, an objection may be made to the regional directorate within fifteen days of service of the refusal, and to the General Directorate against the regional directorate's decision, also within fifteen days of service. 4
This administrative objection is not a legal remedy that alters the court judgment. Where the judgment is uncertain, the court may need to be approached; for a dispute over in rem rights, the appropriate judicial route may be required. It should not be assumed that the administrative objection suspends every litigation deadline that may arise. Submitting the same document again and again without identifying the source of the problem only wastes time. 124
For applications to be carried out from abroad, the guide for foreigners and persons living abroad is a useful complement; for judgments in favor of a company, see company property review.
Conclusion
Applying a title judgment correctly is a separate follow-up task after winning the case. Service and legal remedies, the finality endorsement, technical annexes, registration and actual delivery must be linked together. Enforcement of any monetary award should be examined separately in light of current case law. Once the transaction is complete, comparing the new title deed and encumbrance record with the judgment ensures that the right that was won is correctly shown in the register.
Frequently Asked Questions
I won the case; can I take the title deed the same day?
For a direct registration judgment, finality and the enforceable documents for registration are required as a rule. The issuance of a first-instance judgment alone is not enough. 14
If the losing party does not come to the land registry, can registration not be done?
For an acquisition based on a final court judgment, the declaration of registration by the previous owner is not required. The documents and the scope of the judgment must nevertheless be appropriate. 2
How many days are the appeal and cassation periods?
The general period in HMK is two weeks from service of the relevant judgment. Whether a legal remedy is open and the special procedural rules are assessed separately. 1
If the wrong parcel is written in the judgment, can it be changed by clarification?
A clear typing error, real uncertainty and a substantive change to the judgment are distinct matters. Correction or clarification is not a route for adding to the judgment a different property on which no ruling was made. 1
If the title claim was rejected and a monetary award was made, is finality required?
No single automatic answer can be given. The Civil General Assembly decision of June 24, 2026 did not require finality on the ground that the monetary award did not change the land registry record; decisions reflecting a different approach should be compared with the context of the file. 56
If the title passes into my name, do the occupants leave automatically?
Registration and actual delivery are different. It should be examined whether the judgment contains an enforceable decision on delivery or eviction, and what the legal position of the occupant is. 35
Within what period can an objection be made to a land registry refusal?
Under Article 26 of the Regulation, an objection may be made to the regional directorate within fifteen days of service, and against the regional directorate's decision to the General Directorate, also within fifteen days of service. 4
