The Legal Route Suited to the Activity in Tourism Law

Tourism law requires the real estate and permit structure of an investment, operating contracts, guest relations and disputes to be assessed together. Hotels, travel agencies and housing rented for tourism purposes are not subject to the same permit model. The first step is to determine the status of the parties, the facility’s documents and the nature of the request.

Critical Distinctions in Time Limits and Routes of Application

Package tour: the 30-day distinction

No deduction is made, other than mandatory taxes and similar expenses, when a termination notice is properly given at least 30 days before the tour begins. For later notice, the contract and the reason for termination matter.

Administrative action: the general rule is 60 days

The general time limit for filing an action before the administrative court is 60 days unless a special time limit applies. The competent authority and the time limit for an administrative fine are determined separately; this rule cannot be applied to every tourism sanction.

Hotel reservation: a different rule

For accommodation on a specific date or in a specific period, buying online does not by itself give a 14-day right of withdrawal. The cancellation condition, any defect in the service and the provider’s commitment are examined separately.

Termination of a package tour, cancellation of a hotel reservation and an action against an administrative decision are different procedures. Time limits are calculated on the basis of the contract, the decision, the form of notification and the request.

Do not neglect UETS tracking in businesses.

A notification served through UETS (National Electronic Notification System) is deemed to have been served at the end of the fifth day following the date it reaches the address. The absence of an SMS or e-mail alert does not affect its validity. In companies, regular tracking and designating a responsible person are important. Registered Electronic Mail (KEP) correspondence, platform messages and physical service are assessed under their own rules.

Review the routes for documents, inspections and applications

Documents, Licenses and Contracts Must Be Reviewed Together

From the investment and operations perspective

The title deed or allocation, zoning, construction, license and tourism certificate must be consistent with one another. In a hotel transfer, management or franchise agreement, permits, debts and continuity of operations are assessed before closing.

Investment and contract guide

From the guest and service perspective

A package tour, a single accommodation stay and a timeshare do not give rise to the same rights. The chain of contracts, the promised service, the reason for cancellation and the evidence are examined. An administrative complaint and a claim for a refund of the price or for compensation are handled separately.

Our Approach to Tourism Law Files

  1. Activity and time limit

The type of facility, location, status of the parties, notification and contract are reviewed; the need for urgent applications and protection is identified.

  2. Documents and risk

The title deed, zoning, license, tourism certificate and actual use are matched. The contract and responsibilities are assessed.

  3. Action and representation

Permit applications, contracts, negotiation, mediation, litigation or arbitration are carried out according to the determined subject-matter and territorial jurisdiction.

  4. Follow-up and compliance

Implementation of the decision, handover and continuity of operations are monitored. Necessary changes to contracts and internal procedures are identified.

What becomes clear in the first consultation?

Your request, the competent authority, the time limits to be protected, missing documents and the need for interim protection are assessed. The conflict-of-interest check, the scope of services, the attorney’s fee and separate expenses are explained. The method of providing information is determined; the scope of any written report or later follow-up is agreed separately.

Frequently Asked Questions About Tourism Law

Does a tourism operation certificate replace the municipal license?

No. The business license, the tourism certificate, and the zoning and construction documents serve different functions. The type of facility, the status of past documents and actual use must be reviewed together. A single document does not make all activities lawful.

If I buy the hotel or the company shares, do all the permits transfer?

The conditions for transfer and change of control may vary by permit, allocation, license and contract. Before closing, the necessary approvals, notifications, security and operator-change procedures must be identified.

Do I need a permit to rent out my home short-term?

For rentals of 100 days or less at a time, the permit regime for tourism-purpose rentals must be taken into account. The nature of the home, entitlement to it and the required decisions are examined. Posting a listing on the internet does not replace a permit.

Can I get my money back for a package tour canceled by the agency?

In the case of a cancellation or material change not caused by the consumer, the contract can be rescinded without accepting an alternative. In this case, a 14-day rule applies to the refund of the price without deduction. Claims for additional loss are subject to separate conditions.

Does the hotel’s “non-refundable” clause remove all my rights?

No. An agreed cancellation condition is distinct from a service that is not provided at all or is provided defectively. The contract, the pre-contractual information and the review of unfair terms are assessed together. Keep your reservation and payment documents.

Is a complaint to the Ministry enough to obtain compensation?

The inspection and sanction process is separate from a personal claim or a claim for compensation. Depending on the nature and amount of the claim, an arbitration committee (hakem heyeti), mediation, litigation or other routes are assessed. It should not be assumed that a complaint stops all time limits.

Can my file in Türkiye be handled while I am abroad?

Depending on the nature of the file, online consultation and representation are possible. The power of attorney, certification of foreign documents, translation and, where necessary, the need to attend in person are identified in advance. Local procedures in a foreign country are assessed separately.

How are the attorney’s fee and other expenses determined?

The scope of document review, applications, contracts, litigation and later follow-up is explained separately. Court fees and expert, translation, travel and arbitration expenses are distinct from the attorney’s fee. The scope of a written report or ongoing advisory services is agreed separately.

This content is general information. Information and documents you share are kept confidential and used for legal assessment and within the agreed scope of service. An inquiry alone does not create an attorney–client relationship and does not stop time limits. The legal conditions of the specific matter are reviewed separately.
