Operators and infrastructure providers
Internet access, fixed and mobile communications, fiber infrastructure and wholesale service projects. Authorization and obligations are assessed by the type of activity and the resources used.
From infrastructure to service
A communications project may cover building the network, access to sites, relationships between operators and the service delivered to the end user. The responsibilities of the investor, operator, contractor, supplier and subscriber differ from one another. The first step is to define the service offered and each party’s actual role in the project.
Güneş & Güneş Law Firm provides legal support for contract drafting, regulatory compliance, administrative procedures and dispute follow-up in electronic communications investments and existing service relationships. Based in Antalya and handling matters across Türkiye, we determine, for projects with foreign links, which law and jurisdiction will apply and whether work with a lawyer in the relevant country is needed.
Internet access, fixed and mobile communications, fiber infrastructure and wholesale service projects. Authorization and obligations are assessed by the type of activity and the resources used.
Installation and maintenance companies, equipment and software suppliers, and persons who are parties to the use of buildings, roofs, facilities and routes. Scope of work, access conditions and delivery responsibilities.
Companies, hotels, production facilities and individual users. Subscription, commitment, billing and service continuity for internet, data line and communication services.
Legal services
The scope of the service is determined by the project’s stage, the parties’ capacity and the transaction or dispute at hand.
Business model and regulatory framework
Review of whether the planned service falls within the authorization scope, and separation of notification and right-of-use processes. Legal assessment of application files, scope of activity and continuing obligations. Not every technology supplier or in-house network is treated as an operator solely because of that status.
Administrative proceduresRoute, site and field use
Contracts on fiber routes, base station sites, roof and facility use, covering rent, access, energy, maintenance and removal terms. Authorization, real estate use and related permits are assessed separately, and the parties’ handover and reinstatement obligations at the end of the work are arranged.
Contract LawFrom installation to acceptance
Preparation and negotiation of equipment, software, installation, integration and maintenance contracts. Alignment of technical annexes with legal obligations; determination of delivery, testing, acceptance, warranty, service level and subcontractor liabilities. Handling of change requests and the effect of delays on cost and schedule.
Contract drafting and negotiationRelations between operators
Review of wholesale access, interconnection, colocation and facility sharing relationships. Access requests, offer conditions and contract disputes under the applicable decisions of the Information and Communication Technologies Authority (BTK) and the obligations of the relevant operator. The same access obligation is not assumed to apply to every operator.
Competition LawFrom service to end user
Review of subscription agreements, tariffs and commitment documents, pricing, termination and service interruptions. Application and dispute follow-up for the operator or the subscriber. For corporate subscriptions, consumer status is examined separately; the same application route is not applied to every contract.
Consumer LawSubscriber, traffic and location data
Legal compliance on the processing, access authorizations, retention and transfer of subscriber, traffic and location data. Privacy notices and the determination of the roles of data controller and service provider; joint assessment of sector-specific confidentiality rules and personal data protection legislation.
Personal data and technology lawInvestment and corporate structure
Review of contracts and existing obligations in investment, partnership, share transfer and restructuring processes. Depending on the nature of the transaction, examination of whether notification or approval is required under BTK rules and competition law; assessment of transfer and change-of-control clauses in the contracts.
Companies and PartnershipsInformation requests and administrative actions
Assessment of agency letters and notifications, preparation of information and document submissions, and defense and legal remedy processes. The route to follow is determined on the basis of the nature of the action, the date of notification and the specific facts; litigation and other application deadlines are tracked separately.
Administrative Law and CourtsOutages, incident logs and liability
Assessment of evidence and notification obligations in claims of service outage, security incident, data breach and breach of contract. Follow-up of liability, compensation and termination claims between the parties; where necessary, an independent technical expert opinion is brought into the legal process.
Cybersecurity LawInvestment and contract review
A single contract or permit may not meet all of a project’s legal needs. We assess the interdependent documents within the same workflow.
Who provides the service, who operates the network, and who concludes the contract with the user? The authorization review starts with these questions. Exceptions, such as in-house use, are assessed against all relevant conditions; the project name or the organization being a technology company alone is not decisive.
Entry to the property, location of the facility, energy use, maintenance hours and emergency intervention authority are clarified. Ownership and use rights, required permits and the contract term are reviewed together. BTK authorization alone does not grant the right to install a facility on every plot of land or roof.
Conformity of the technical specification with the contract, the testing and acceptance method, remediation of outstanding work, and warranty and service level records are determined. Legal work does not replace site measurement, engineering inspection or penetration testing; where technical assessment is required, it is carried out separately with competent experts.
Fault reporting, maintenance, backup service, subcontractor changes and termination scenarios are addressed. Removal of equipment, termination of site access, data return and retention obligations are arranged. The transition process and how the parties will hand over documents and records are clarified.
Ongoing legal advisory
The scope of regular legal advisory is determined by the type of activity, transaction volume and the allocation of responsibilities within the organization. The work plan, documents to be delivered and reporting frequency are agreed at the outset.
Determining responsible persons and a monitoring system for notifications applicable to the activity, agency letters, contract renewals and permit documents.
Review of subscription, procurement and service level documents against the changing business model; legal coordination with purchasing, sales and operations teams.
Preserving records in the event of an outage, data breach or service objection, establishing the notification flow, and assessing disputes at an early stage.
Our process
The service model, the parties and the project stage are identified, together with any recent notification or filing deadline, if applicable.
Authorization, site, procurement and subscription documents are reviewed together with technical annexes and incident records.
Priorities, documents to be prepared, application options and the allocation of tasks are explained. The scope of the service and the fee terms are agreed.
The agreed contract, application or dispute steps are carried out. Developments and the decisions that are needed are shared regularly.
Preparing before the consultation
A short summary of the incident and a list of the documents you have is sufficient for first contact. Files needed for review are requested through the agreed secure channel.
Frequently asked questions
No. Supplying hardware or software and providing an electronic communications service are not the same activity. The review is based on the service offered, the network established or operated, the roles of the parties and the resources used. Exceptions for in-house networks also have their own conditions; the mere fact that a network is located within a building is not accepted as sufficient.
Not on its own. Operator authority, and the use of the property, routes, site access and related permits, are separate matters. The basis of the relationship with the owner or authorized person, the contract term, maintenance and energy conditions, and removal obligations must be reviewed separately.
No. Access and interconnection concern wholesale network, infrastructure or service relationships between operators. A subscription, on the other hand, concerns the provision of the service to the end user. Applicable BTK decisions, the obligations imposed on the relevant operator and the nature of the contract are assessed separately.
The outcome depends on the contract, the service level commitment, the cause and duration of the outage, the notification records and the legal basis of the claim. Service credit, price reduction, termination or compensation claims may not be subject to the same conditions. Technical records and written applications need to be reviewed together.
No. The subscriber’s status, the commitment document, any discounts or benefits provided, the reason for termination and the applicable rules are taken into account. Claims that the service was not provided as it should have been are assessed separately. No specific termination charge or outcome can be promised without seeing the contract and documents.
The purposes, scope and outcomes of these applications may differ. Whether the claim concerns regulatory oversight, refund of fees, compensation or annulment of an administrative act, together with the nature of the dispute and the subscriber’s consumer status, affects the route to follow. Each application has its own conditions and time limits, determined on the facts of the specific case.
A single general consent text does not make all processing activities lawful. The type of data, purpose, legal basis, persons with access, and storage and transfer conditions are assessed together. Confidentiality rules specific to electronic communications and personal data protection obligations are considered jointly; processing that requires a privacy notice and consent is separated out.
Legal services relate to contracts, legislation, liability and application processes. Site measurement, network performance review, engineering acceptance and penetration testing are separate fields of expertise. Where needed, the scope of technical expert work is determined separately and the findings are included in the legal assessment.
For transactions connected with Türkiye, the contract, authorization, liability, dispute resolution and data processes can be assessed. If foreign law or an application in another country is involved, support from a lawyer qualified in that country may be needed. Consultations can be conducted in Turkish, English, German and Russian.
