Obtaining a favorable decision from the tax court (vergi mahkemesi) does not mean that the decision has been implemented automatically in the bank, tax office and land registry records. The administration must perform the requirements of judgments on the merits and of stay-of-execution decisions without delay. The general upper limit in İYUK Article 28 is thirty days from the notification of the decision to the administration. This period does not give the administration a right to wait thirty days in every case.
In practice, it must first be determined exactly what the decision removes. The annulment of an assessment, the annulment of a payment order, the annulment of an attachment and a stay of execution may produce different results. Rather than being content with reading only the operative part of the decision, its reasoning, the period and amount it covers, the stage of the appeal and, if any, the higher court decision staying execution should be examined together.
When must a tax court decision be implemented?
The thirty days begin with notification to the administration
The date taken as the basis under İYUK Article 28(1) is not the day the decision reached the plaintiff, but the day it was notified to the administration. UYAP records and notification documents should therefore be placed in the file. Seeing the decision online or the lawyer’s learning of the outcome of the decision does not by itself replace this date. Submitting a separate implementation petition to the administration helps to make the scope of the decision concrete and to monitor the process of compliance.
The application should include the name of the court, the file (esas) and decision (karar) numbers, the date of the decision, the notification details and the acts requested. Instead of saying “let the decision be implemented,” it should explain, for example, which bank attachment is to be lifted, which accrual is to be corrected and the refund of which collection is requested. The request should not be broadened as though it created a new right unsupported by the judgment.
Finality is not awaited in every tax case
In tax disputes, as a general rule, an appeal (istinaf) or further appeal (temyiz) does not by itself stop the implementation of the decision. A decision by the appellate authority to stay execution within the framework of İYUK Article 52 is a separate situation. The administration’s merely saying “we have appealed” is therefore not the same as the existence of an enforceable stay decision.
The special exceptions in İYUK Article 28 should not be extended to every dispute. In a tax file, the type of decision, the special statutory provisions and the concrete decision of the higher court must be checked. The possibility that the first-instance decision may later be reversed also requires monitoring the process; the implementation of the first decision does not mean that the appeal proceedings have ended.
How is the scope of an annulment decision determined?
A tax assessment and a payment order are not the same act
The annulment of an assessment may require the correction of the tax and penalty records covered by the judgment. The annulment of a payment order, on the other hand, relates to the enforcement act. If the annulment rests only on a deficiency in notification or in the condition for enforcement, whether the administration can establish a new lawful act is assessed according to the reasoning and the rules on time limits. The conclusion “the payment order was annulled, the entire tax debt was definitively erased” cannot be drawn in every file.
In partially upheld cases, the distinction by amount and period is especially important. The decision may have annulled the tax of one year while dismissing the case for another year. In the implementation request, the upheld part should be clearly separated, and the tax office’s account statement should be compared with the judgment line by line.
A stay of execution is interim legal protection
A stay-of-execution decision must also be implemented; the administration cannot postpone this obligation by waiting for the judgment on the merits. However, the effect of the decision is limited to the nature of the act under challenge. Protection relating to one attachment act does not automatically remove an independent attachment placed for another debt. An objection or a judgment on the merits issued later must also be followed.
How is an attachment on a bank account, vehicle or real property lifted?
The relevant administration must carry out the act of lifting the attachment and transmit it to the institution where the record exists. A block on a bank account, an attachment annotation at the land registry and a vehicle record may involve separate implementation steps. The petition should enclose the date of the attachment, the institution concerned, the details of the account or asset and, if possible, the attachment reference.
Even if the process appears complete from the lifting letter the administration sent, the actual record must be checked. The bank should be asked from which file the block continues; whether there are other attachments on the land registry or vehicle record must be separated out. Obtaining a favorable decision in a single file does not guarantee that all restrictions will be lifted.
| Subject of the decision | Implementation to be followed | Document to check |
|---|---|---|
| Annulment of an assessment | Accrual and debt correction in line with the judgment | Current tax account |
| Annulment of an attachment | Lifting notice to the institution concerned | Bank reply or registry record |
| Refund of an amount collected | Matching of the judgment with the collection | Refund/set-off document |
| Litigation costs and attorney’s fee | Payment on written account notice | Application receipt and payment slip |
How is the money awarded by the court collected?
İYUK Article 28(2) provides that, in cases requiring the payment of a specific amount, the awarded amount together with the attorney’s fee and litigation costs is paid into the bank account notified in writing to the administration by the plaintiff or the plaintiff’s attorney. A written notice of the bank account is important for this payment. The date of receipt of the notice should be kept; the suitability of the account holder’s and the attorney’s authority to collect should be checked.
If payment is not made within the period under this paragraph, the possibility of enforcement and execution is assessed under the general provisions. However, the enforcement of a judgment for payment of money and the administration’s obligation to lift an attachment or correct an accrual are not the same act. A mere annulment decision should not be used as though it were a direct money judgment for every request whose amount is not specified.
For interest, the operative paragraph and the relevant statutory basis should be examined together. The interest scheme in İYUK Article 28(6) contains a rule that no interest accrues for the period between the notification of the decision to the plaintiff and the notice of the bank account to the administration. The refund of an excess or undue collection under VUK Article 112 may require a separate calculation. A single starting point for interest should not be applied to all types of refund.
Can compensation be requested if the decision is not implemented?
İYUK Article 28(3) allows an action for pecuniary and non-pecuniary damages against the administration where no act or action is taken in accordance with the decision. Compensation is not automatic. The failure to implement or the delay, the damage and the connection between them must be made concrete. Under the statutory provision, where a public official fails to perform the decision in time, the compensation action is brought against the administration concerned; it should not be assumed that it must be directed at the official personally.
For example, if it is alleged that a bank block that should have been lifted continues, the notification of the decision to the administration, the request for lifting, the bank’s dated reply, the financing cost incurred and its connection with the block should be shown. A hypothetical loss of profit differs from damage that can be documented. A claim for non-pecuniary damage is also not accepted automatically for every delay; the effect of the event on the person is assessed.
The annulment of a new refusal act, compensation and the enforcement of a money judgment may give rise to different problems of time limit and procedure. It should not be thought that repeated petitions continuously renew a right of action whose period has expired. The period must be calculated by determining which request rests on which act or action.
How should a file be built for tracking implementation?
Alongside the decision and notification records, it is useful to keep an implementation schedule. The schedule shows the requested act, the date of application, the administration’s reply, the relevant bank or registry reply and the outstanding point. In this way, partial implementation by the administration is distinguished from no implementation at all.
The administration’s explanations that “there is another debt,” “the decision has not become final” or “the account information is incomplete” should be examined against documents. It is checked whether another debt really supports an independent attachment; whether there is a stay decision in the case of the finality defense; and whether written notice was given in the case of an incomplete account. A concrete reply is more useful than a general objection.
Conclusion
For a favorable decision in a tax case to be effective, the scope of the decision, the date of notification to the administration and the actual result of implementation must be monitored together. Where necessary, the routes of refund, lifting of attachment, enforcement of a money judgment and compensation should be prepared as separate legal requests.
