Summary

In an irregular tax notification: wrong address, delivery to an unauthorized person, the distinction between a company and its representative, the date of learning, the payment order and the time limit to sue.

Notification of a tax act to the wrong address or to an unauthorized person matters for when the time limit to sue starts running and when the tax debt becomes enforceable. However, an allegation of irregularity does not erase the debt by itself. First, the act that was notified, the addressee, the notification method that applies and the date of learning must be determined. The general time limit to sue against tax and penalty assessment notices (ihbarname) is 30 days; the special time limit to sue against a payment order under Law No. 6183 is 15 days. These time limits must not be overlooked when an irregularity is alleged.

Why is a tax notification examined together with the act itself?

Notification is the communication of an administrative act to the person concerned. The computation of the tax, the imposition of a penalty, the issuance of a payment order and the notification of each of these are different legal stages. For example, there may be an error in the delivery of a notice of assessment directed at the right person; in another case, the notice of assessment may have been issued in the name of the wrong taxpayer from the outset. The first concerns the notification method, the second concerns the addressee of the act. Although both problems can be raised in the same petition, their legal consequences are not the same.

Articles 93 and following of the Tax Procedure Law (VUK) are the special rules on the notification of tax acts. Article 8 of Law No. 6183 also refers to the VUK provisions for notification unless there is a provision to the contrary. For this reason, a rule of the general Notification Law should not be carried over to tax acts without assessing its scope. In particular, the approach that “the date I say I learned of it is valid in every case” is not safe.

Determine the legal nature before looking at the title of the document

A debt statement, an account statement, an information letter, a notice of assessment and a payment order are not substitutes for one another. A person who encounters a bank block should first find out which debt and which payment order the attachment is based on. A copy of the act obtained from the tax office does not by itself prove that an earlier notification was valid; however, it can constitute evidence of the date on which the person became aware of the act.

In which cases is notification to the wrong address disputed?

Articles 101 and 102 of the VUK are assessed together. The business addresses declared, the inspection or change-of-address records and the residence address in the address registration system do not serve the same function. The records on the date of notification and the order set out by the law matter. A present-day address document cannot be expected, on its own, to show the address situation in the past.

The notice of change of address, the tax office receipt, the trade registry record, the lease agreement and the inspection report for the relevant date should be kept together. A notification to the trade registry should not be assumed in every case to fulfill the obligation to notify the tax office. The defenses are different where the administration went to an old address although a newer address was in its file, and where the taxpayer failed to declare a change of address.

Is leaving a notice slip on the door invalid in every case?

No. Once the conditions in the law are met, there is a notification mechanism based on affixing a notice slip to the door. In the relevant situation under VUK Article 102, if the document is collected within 15 days of the slip being affixed, notification is deemed made on the day it is collected; if it is not collected, notification is deemed made on the fifteenth day. This rule does not mean that every door slip is valid. It is first examined whether the necessary address and notification attempts were made.

An addressee’s avoiding the signature and the addressee’s not being at the address are also different matters. The delivery document must state which event occurred, and the necessary findings and the date must be present. A definitive conclusion cannot be drawn by assessing the absence of a signature alone.

What happens if the person who received the notification is not authorized?

Under VUK Article 94, the conditions are examined with respect to the taxpayer, the legal representative and the other persons authorized to receive notification. Where the addressee is not found, the possibility of delivery to persons at the residence or workplace is not unlimited. The capacity of the recipient at that address, the statutory conditions as to age, the apparent capacity of the person and the content of the record matter. The signature of a neighbor, a former employee or the staff of another business in the same building is not automatically treated as a valid delivery.

Collection against the company and against the manager personally are separate

A notice of assessment or payment order belonging to the company and a payment order issued on the basis of the manager’s personal liability are separate acts. A notification made to the company file does not show that the manager’s personal payment order was also notified. Nor does the manager’s receiving a document in his or her own name cure all the notification deficiencies in the collection proceedings against the company.

For this distinction, the addressee field of the document, the tax identification number, the basis of liability, the period of the debt and the capacity in which the recipient acted are compared. The start and end dates of the authority of representation should be documented with the trade registry and the company resolutions.

When can notification by public announcement be used?

Notification by announcement (ilanen tebliğ) is not a free route that the administration may choose because it is easier than the other methods. The conditions in VUK Article 103 must be met and the announcement procedure in Articles 104–106 must be applied. Moving directly to announcement without an address search, or where a usable address exists in the file, gives rise to dispute.

Depending on the amount and the applicable regulation, the announcement method may involve different publicity obligations. A printout of an announcement seen on the internet may not show that all steps were completed. The text of the announcement, the posting and publication records, the address searches and any earlier returned envelopes should be requested together. The effect on the date of notification of applying in response to the announcement or declaring an address, and of not applying at all, is determined separately within the framework of VUK Article 106.

How are the time limit to sue and the date of learning documented?

İYUK Articles 7 and 8 are the basis, and for the payment order, Article 58 of Law No. 6183. The starting day, the days included in the period and the last day falling on a holiday are calculated separately. The allegation of irregularity must be set out clearly in the petition; it must be explained why the date of notification put forward by the administration is not accepted.

Act examinedGeneral approachPriority document
Tax or penalty assessment notice30-day time limit to sue unless there is a special provisionThe notice of assessment and the notification document
Tax payment order15-day special time limit to sueThe payment order and the underlying collection file
Attachment actIts own notice and the learning of it are examined separatelyAttachment notice, bank record
Allegation of irregular notificationThe time of learning and the evidence of earlier awareness are comparedFirst application, document delivery record, electronic record

As an example, a person who says he or she first saw the payment order because of an attachment at the bank may have filed a petition about the same payment order months earlier. That petition strengthens the allegation of earlier learning. On the other hand, merely seeing the total debt amount does not mean in every file that all the essential elements of the act subject to the lawsuit were learned. The assessment depends on the content of the document. The example is hypothetical; it is not a firm file.

How are the application and the lawsuit file prepared?

First, all pages of the document, the envelope and the delivery receipt are preserved. Then a chronology is prepared from the address and representation records on the date of notification. The petition sets out the date and number of the act, the date of notification accepted by the administration, the actual date of learning that is alleged, and the basis for each date. Instead of just the statement “the notification is irregular,” it should explain which condition was not met.

In a tax dispute, the competent court and jurisdiction are determined by the type of act; in collection disputes, İYUK Article 37 is also taken into account. An application to the administration does not stop the time limit in every case. A timely application meeting the conditions of İYUK Article 11 should be distinguished from a mere request for documents. The calculation of the time limit must not be abandoned while waiting for a copy of the file.

In payment order and attachment lawsuits, filing the suit does not, as a rule, stop collection by itself. If necessary, a stay of execution is requested; the clear unlawfulness and the damage that would be difficult to remedy are made concrete. If it is alleged that a business account has been closed, the effects on wages, production and mandatory payments are documented. A court’s annulment decision may cure the notification problem; it does not in every case prevent new acts that are legally possible for the administration.

Conclusion

In an irregular tax notification, the right method is not to disregard the document but to examine together the type of act, the addressee, and the address and delivery records. The date of learning should be supported with evidence, the short time limit to sue should be protected, and, where there is a risk to collection, interim legal protection should be assessed separately. An error of notification does not replace all the objections concerning the merits of the debt.

Frequently Asked Questions

If the tax notification went to an old address, is the debt erased?

No. As explained in the section “In which cases is notification to the wrong address disputed?”, the address records and the order that applies are examined. An irregularity does not have the result of automatically erasing the debt. Related explanation

Is a company employee’s signature always sufficient?

No. The capacity, the conditions of delivery and the review of the record in the section “What happens if the person who received the notification is not authorized?” must be examined. Being an employee does not confer unlimited authority of representation for all documents. Related explanation

Is it enough to say that I learned of the document later?

It may not be considered sufficient on its own. The records in the section “How are the time limit to sue and the date of learning documented?”, earlier petitions and electronic data are assessed together. Related explanation

Does a lawsuit over irregular notification stop a bank attachment?

It should not be assumed to stop it by itself. As explained in the section “How are the application and the lawsuit file prepared?”, a stay of execution comes up separately in payment order and attachment disputes. Related explanation
