Filing a tax action does not automatically stop collection in every tax matter. Article 27 of the Administrative Procedure Law No. 2577 (İYUK) contains a special regime for actions filed before the Tax Court (Vergi Mahkemesi) against assessed taxes, duties, fees and similar financial liabilities, together with surcharges and penalties. In the case of a payment order, an attachment and acts carried out on a return filed with a reservation of rights (ihtirazi kayıt), the same automatic result does not apply. Depending on the type of act, a stay of execution must be requested separately. 1
A stay of execution is a judicial protection that can temporarily suspend the application of an act until the case is concluded. As a rule, the court requires that manifest unlawfulness and damage that is difficult or impossible to remedy both exist together. This article explains when a request is necessary, how it should be substantiated, and how to challenge a rejection decision. For details on this subject, see interim injunction and precautionary attachment.
In which tax cases does collection stop automatically?
Under Article 27/4 of the Administrative Procedure Law, filing an action before the Tax Courts arising from tax disputes stops the collection proceedings for the part under dispute of the assessed taxes, duties and fees and similar financial liabilities, and of their surcharges and penalties. Both the contested act and the limit of the amount in dispute matter here. If an action has been filed against only part of the debt, it should not be assumed that collection of the entire debt has stopped.
This result essentially concerns an action against a tax assessment. Actions filed on account of returns filed with a reservation of rights and on account of collection proceedings do not stop collection automatically. The special regime for files removed from the active docket (işlemden kaldırma) under Article 26 of the Administrative Procedure Law is also taken into account separately. Submitting any tax-related petition to the court is not a general protection that stops all financial acts.
Why are the payment order and electronic attachment different?
A payment order and an attachment are acts of the collection stage. Filing an action for their annulment does not automatically lift a freeze on a bank account or other enforcement measures. If only annulment is requested in the petition and the need for interim protection is omitted, collection proceedings may continue while the case is pending. 1 2
It also matters which act the court decision covers. A decision on a notice or a payment order is not assumed to lift all attachments relating to different periods or based on a different legal ground. The chain of acts and the debt items must be matched.
The two conditions for a stay of execution
How is manifest unlawfulness explained?
The unlawfulness of the act in terms of competence, form, cause, subject matter or purpose must be made concrete. Pursuing a debt that has been paid, issuing a payment order to a person who is not liable, applying the share ratio incorrectly or the absence of the conditions required for enforcement may be the subject of this discussion. Each claim must be tied to the relevant statutory provision and a document in the file.
A general sentence such as “It is contrary to the Constitution and to the law” does not show which element is unlawful or why. For example, if it is claimed that the debt has been paid, it should be explained how the bank receipt (dekont) matches the tax type, period and debt number. The administration’s defense that the payment belonged to another debt can be answered with an account statement.
How is damage that is difficult or impossible to remedy shown?
The damage that will arise from the application of the act is described together with why the remedy obtainable at the end of the case would not be sufficient. Depending on the specific circumstances, the halt of a business’s compulsory payments, the inability to pay wages, or the inability to meet basic living or health expenses may be significant. The high amount of the dispute alone is not sufficient in every case.
Cash flow, bank movements, approaching maturities, payroll records and documents of compulsory expenses make the claim visible. The administration may argue that other accounts or sources of payment exist. For this reason, the accounts as a whole and why alternative sources are not sufficient should be explained honestly. Unnecessary personal data should be removed from the documents, and the parts that must be submitted to the court should be protected.
Both conditions are required together. A severe economic impact does not replace the explanation of manifest unlawfulness; nor does manifest unlawfulness automatically prove the damage condition in every case. It is therefore useful to use two separate assessment headings in the request.
When and how is the request made?
A stay of execution can be requested in the petition initiating the action. A separate petition can also be filed when the need arises or becomes clear while the case is pending. However, a request for interim protection does not cure a missed time limit for the main action. The 15-day period against a payment order and the general 30-day period against an ordinary attachment should not be confused with each other; special act and time-limit provisions are reserved. 1 2 For details on this subject, see tax notification and prevention of loss of rights.
The request should include the date and number of the contested act, the scope whose suspension is sought, the grounds of unlawfulness, the explanation of damage and the evidence. If the objection is not to the whole act but to specific debt items, the limit of the interim protection should also be written clearly. Annexes should be numbered, and the annex on which each ground relies should be indicated.
Can a decision be made without obtaining the administration’s defense?
The rule is that a decision is made after the defendant administration’s defense has been obtained or the defense period has passed. For administrative acts whose effect would be exhausted by their application, a stay of execution is possible without waiting for the defense, with a new decision to be made after the defense is obtained. This possibility does not mean that a decision will be made without a defense in every attachment file. Urgency and the nature of the act must be made concrete. 1 For details on this subject, see objection to a demolition order and annulment action.
If there is an imminent transfer or sale, its date and document are submitted. Merely writing “it is urgent” is not sufficient. No definite date of conclusion that is not found in the law should be promised regarding the court’s process.
Which evidence is more useful?
The value of evidence depends on whether it actually shows the claim put forward. Instead of many irrelevant documents, an explained file in chronological order should be prepared.
- The act itself and legally valid notification records.
- Payment, offset, cancellation and the current debt statement.
- Documents of authority and period in a dispute over shareholding and legal representation.
- Account freezes, transfer information and letters obtained from the bank.
- Income, wage, compulsory expense and cash flow records.
- Earlier court decisions and documents of their implementation.
As an original assessment tool, a four-column worksheet can be used for each claim: the legal unlawfulness, the document showing it, the damage that implementation would cause, and the document of the damage. It should not be assumed that the same document proves both conditions. While a bank receipt supports unlawfulness, a wage payroll and a freeze record can explain the dimension of the damage.
Is it mandatory to provide security?
Article 27 of the Administrative Procedure Law provides the principle that decisions for a stay of execution are issued against security; depending on the requirements of the situation, security may not be required. Persons benefiting from legal aid and the exceptions specified in the article are assessed separately. If it is requested that security not be required, a justification must be submitted; it cannot be said that the court will decide without security in every tax file. 1
The special provision on mandatory security at 50 percent of the amount in dispute in tax refund cases was annulled by the Constitutional Court (Anayasa Mahkemesi) in its decision of June 1, 2022, E.2022/14, K.2022/70. This annulment does not mean that the entire general security regime has been abolished. In a current application, a mandatory automatic 50 percent security should not be explained on the basis of old texts. 3
How can a decision granting or rejecting a stay be challenged?
Against decisions for a stay of execution within the scope of Article 27 of the Administrative Procedure Law, a single objection is possible within seven days from the day following notification. In a Tax Court decision, the authority for the objection is, as a rule, the regional administrative court. The correct authority must be determined by taking into account the level of the court and the special provisions. 1
In an objection to a rejection decision, the court’s reasoning as to which condition was not met and why is addressed. Instead of repeating the initial petition verbatim, an overlooked document, an erroneous legal assessment or a newly arisen situation is shown. The rule that a stay of execution cannot be requested a second time on the same grounds is also taken into account; the claim of a new fact must genuinely be new.
Does the same objection rule apply at appeal and further appeal?
No. At the stage of appeal, Article 52 of the Administrative Procedure Law is assessed separately. An appeal (istinaf) or a further appeal (temyiz) does not automatically stop the execution of the decision. The regime on the finality of stay-of-execution decisions at this stage should not be confused with the seven-day objection against the Article 27 decisions of the court of first instance.
What is done after the decision is obtained?
It is checked which act and amount the decision concerns, and its notification to the administration and the implementing acts are monitored. Under Article 28 of the Administrative Procedure Law, the administration is obliged to act without delay; the maximum period of 30 days in the law does not, in every case, allow waiting until the last day. In the case of a bank account attachment, the collection office’s lifting or implementation instruction is compared with the actual situation at the bank. 1
A stay of execution does not definitively eliminate the debt and does not mean that the main case has been won. If the decision is lifted or a different result arises on the merits, the enforcement position may change again. For this reason, the follow-up of the case file should not be abandoned merely because interim protection has been obtained. For details on this subject, see deferral and installment payment of tax debts.
Conclusion
In tax cases, interim protection first requires correctly determining the type of act. In files where there is no automatic stop of collection, unlawfulness and damage must be documented separately. The request, the objection and the implementation of the decision are successive stages; each requires its own documents and time-limit monitoring.
Frequently Asked Questions
Does collection stop when a tax action is filed?
It does not stop in every case. Assessment, reservation of rights and collection proceedings must be distinguished. The first section explains this distinction. Back to the related explanation
Is material damage alone sufficient for a stay of execution?
No. Manifest unlawfulness and damage that is difficult or impossible to remedy are shown together. See the section “The two conditions for a stay of execution”. Back to the related explanation
Within how many days can a rejection decision be challenged?
For decisions within the scope of Article 27 of the Administrative Procedure Law, the basic period is seven days from the day following notification. The appellate stage is different. See the section on objection. Back to the related explanation
Is 50 percent security provided in every file?
No. The special 50 percent rule on tax refunds has been annulled; the general security provisions apply separately. See the section on security. Back to the related explanation
Does a stay of execution mean the case has been won?
No. Interim protection and the decision on the merits are different. See the section “What is done after the decision is obtained?”. Back to the related explanation
Can the administration always wait 30 days to implement the decision?
