What Do Refusal, Cancellation and Non-Extension of a Residence Permit Mean?
Refusal of a residence permit application
Refusal means that the administration does not grant the residence permit requested by the foreign national. An initial application, a change to a different purpose of stay, or an application for a particular type of permit may end negatively. The examination is conducted on the conditions of the requested permit type, the documents submitted and the foreign national's legal situation in Türkiye. Creating the application form, paying the fee or attending the appointment does not mean that the application will necessarily be accepted. [1, Arts. 21-25][4]
Cancellation of a residence permit already granted
In a cancellation, a permit has previously been granted; the administration terminates it on the ground that a reason provided by law has arisen or that the conditions have been lost. Forged documents, use of the permit outside its purpose, or the disappearance of conditions specific to the permit type may come into play in this examination. It cannot be assumed that the same grounds for cancellation apply to every type of permit. [1, Arts. 33, 36, 40, 45, 47 and 49]
Cancellation of a permit by the administration differs from annulment of the act by the court
Cancellation by the administration is an act that removes the foreign national's residence permit. A court's annulment decision, on the other hand, removes an administrative act found to be unlawful. The mere use of the word "cancellation" in a petition or a summary of a decision is therefore not sufficient; it must be clearly stated which act was cancelled by which authority.
Non-extension of a residence permit
Non-extension means that a request for the period following the end of a fixed-term residence permit is not accepted. That a permit was granted in previous years does not ensure that a later application is automatically accepted. Nevertheless, earlier permits, settled life in Türkiye and whether the circumstances have changed carry weight in the administration's reasoned assessment. A long-term residence permit, on the other hand, is by law indefinite; it should not be described as if it were subject to the same regime as the extension of fixed-term permits at the end of the period. [1, Arts. 24-25 and 42]
| Procedure | Basic question | Main record to be examined |
|---|---|---|
| Refusal of application | Why was the permit not granted | The application, the reasons for refusal and the documents delivered |
| Cancellation of permit | On what ground was the permit already granted terminated | The earlier permit, the ground for cancellation and the date of finding |
| Non-extension | Why was the request for the next period not accepted | The old card, the extension application and the changed conditions |
| Deportation decision | On what ground was removal from Türkiye decided | The separate decision and the service relating to it |
Legal Limits of the Administration's Assessment
The basic framework for residence permits is Law No. 6458 on Foreigners and International Protection (Yabancılar ve Uluslararası Koruma Kanunu, YUKK) and the Regulation on its implementation. For the litigation process, the Law on Administrative Procedure No. 2577 (İdari Yargılama Usulü Kanunu, İYUK) applies. In residence procedures carried out from within Türkiye, decisions of refusal, non-extension and cancellation are taken by governorships. The lawfulness of the act is reviewed in terms of competence, form, ground, subject and purpose. [1, Art. 25][2, Art. 2][3]
The administration's discretion neither requires every application to be accepted nor confers a power of refusal that is groundless or cannot be reviewed. The connection of the facts stated in the decision with the applicant, the sufficiency of the supporting documents and the relevance of the applied provision of law to the case must be examined. The use of a general expression does not remove the need to investigate how that expression materialized in the specific file.
Family ties and the best interests of the child
Article 25 of Law No. 6458 provides that matters such as the foreign national's family ties in Türkiye, length of residence, situation in the country of origin and the best interests of the child be taken into account in the assessment. These elements may affect the basis and the proportionality of the decision. However, stating that there are family ties does not by itself show that all the conditions of a particular type of permit are met. Cohabitation, care relationships, the education of children and the concrete difficulties of continuing family life in another country must be explained with documents. [1, Art. 25][10]
Public order or public security ground
In an assessment of public order or security, the nature of the information and documents used, their connection with the applicant and the concrete facts that can be made the subject of a defense are important. Where a restriction code (tahdit kodu) is found in the file, one should not be content with the name of the code; it must be examined by what act it was imposed, when it became known, and whether it also needs to be challenged separately. A refusal of residence, a restriction record and an entry ban are not always the same administrative act. [1, Arts. 7, 9, 33 and 43-45]
Because the Law does not make the permit conditions concerning public order and security depend on a criminal conviction, the absence of a conviction does not by itself render the administrative act void. This requires the different conditions of the administrative assessment and of criminal proceedings to be examined together. Nevertheless, the concrete basis of the act, the connection of the information with the person concerned and its effect on family life must be set out in a manner suitable for judicial review. If a name similarity or an identity-matching error is alleged, passport and foreign ID numbers, birth details and the relevant records should be compared and an investigation of this objection requested. [1, Arts. 7, 15/1-c and 32/1-b][12]
Academic assessment: why should the situation of family members be examined separately?
The discussion in the scholarly literature draws attention to the problems arising from the residence status of family members depending on the sponsor's status. Şule Arslan, in her study comparing Turkish law with European Union regulations, argues that clearer provisions are needed to protect the child's education and care arrangements in situations such as divorce proceedings and the sponsor's departure from the country. This view helps explain why custody and the actual care relationship must be made concrete in the file. However, a proposal for legislative change does not mean that, under current law, a child's school enrollment automatically gives a parent a right of residence; nor can European Union rules be cited as a direct basis for a permit in Türkiye. In a specific application, the relevant permit conditions of Law No. 6458, the assessment criteria in Article 25 and, if their conditions are met, the humanitarian residence provisions are examined together. [18, pp. 343-346 and 356][1, Arts. 25, 38/3 and 46]
On What Grounds Can a Residence Permit Application Be Refused?
Deficiencies concerning the application and documents
An application date inconsistent with the lawful period of stay, insufficient validity of the passport, failure to submit documents showing the purpose of the application, inability to verify the address or lack of the required health insurance may affect the examination negatively. However, a missing document and the applicant's failure to meet the substantive conditions are separate matters. Completion of a missing document, removal of the application from the docket and refusal on the merits must not be confused with one another. [1, Art. 21][3, Art. 22]
There must be consistency among the passport number, name and surname, entry information, address and insurance record in the application file. For documents obtained from a foreign country, an apostille or consular authentication and a Turkish translation may be required depending on the applicable international agreement and the type of document. The list of documents, which varies according to the type of application, should be checked on the date of the transaction through the e-İkamet system and the guidance of the competent provincial migration office. [4][5][6]
Inability to explain the purpose of stay or use outside the purpose of the permit
A residence permit request must be consistent with the foreign national's real purpose of stay. Tourism, study, family unity, treatment or ownership of real estate are not abstract labels that can be used interchangeably. If there is a contradiction between the account presented and actual life, previous applications, or education or employment records, it needs to be explained. An allegation of use outside the purpose of the permit must also be assessed on concrete facts and the rules of the relevant permit type. [1, Arts. 31-40]
Financial sufficiency and health insurance
What matters is the source from which subsistence will be provided, the continuity of that source and whether it covers the requested period of stay. Bank statements, pension documents, rental income, scholarships or appropriate support documents may be used depending on the specific situation. Having money in an account on a particular day is not the same as demonstrating a regular source of subsistence. In applications other than family and long-term permits, the Regulation's rule based on the declaration and the possibility that supplementary documents may be requested when necessary must be considered together. [3, Art. 22]
The scope and duration of health insurance must be consistent with the type of permit applied for. In files involving a social security entitlement, a bilateral agreement, general health insurance or special exceptions in the legislation, one should not proceed solely from the absence of a private policy. It cannot be said that the same insurance document and the same financial sufficiency criterion are mandatory for every applicant. [4][5]
Address, false declaration and forged documents
Declaring an address where one does not actually live, a rental contract contrary to the facts or the use of a forged income document creates not only the risk of refusal; depending on the case, there may also be administrative and criminal consequences. Current practice should be checked as regards the registration status of the address, the genuineness of its use, the persons living together and the province of application. That a property is located in a particular region or that an address record has been made does not mean that the other permit conditions are met. [1, Art. 54][6]
If it is noticed that incorrect information was given to the administration earlier, one should not try to complete the file with a new and contradictory document. The source of the error and the method of correction should be explained; the difference between the earlier records and the new declaration should be documented. This approach matters both for the credibility of the application and for later judicial review.
Examination of Refusal and Cancellation by Permit Type
Short-term residence permit
In short-term permits, the grounds of stay in Article 31 of Law No. 6458 and the conditions in Article 32 are assessed together. Failure to meet the conditions or their disappearance, use of the permit outside its purpose, or the existence of a valid deportation or entry ban decision matters under Article 33. The sub-paragraph chosen at the time of application must be consistent with the actual content of the file. [1, Arts. 31-33]
Tourism applications and extension requests
In a tourism application, the plan of stay, accommodation and means of subsistence must be explained together with the requested period. The permit or lease agreement of the previous period does not, by itself, prove that the tourism purpose continues in the following period. By contrast, where a refusal decision contains only general expressions, it may be investigated whether the documents in the file were assessed and whether the alleged deficiencies were made concrete. The Antalya decisions discussed below are a file-specific example of this examination. [9]
Ownership of real estate and commercial connection
Owning real estate in Türkiye or being connected with a company does not, by itself, entitle a person to every type of residence permit. The nature of the real estate, the ground applied for, entitlement and the relevant application conditions are examined; in commercial applications, actual activity, the business plan and documents showing the connection are examined. A residence permit and a work permit are also not the same permit; the existence of a residence card should not be interpreted as providing a right to work by itself. [1, Arts. 27 and 31][4]
Family residence permit
In family residence, the conditions of the sponsor and of the applicant are assessed separately. Documents showing the family relationship, cohabitation or intention to cohabit, the sponsor's income and housing conditions and the required insurance coverage should be in the file. Subject to the exceptions in the Law, the criterion that the sponsor's total income must be not less than the minimum wage, and that there must be income of not less than one third of the minimum wage per family member, is important; the current amount is calculated according to the minimum wage on the date of the transaction. [1, Arts. 34-36]
Genuineness of the marriage and termination of the family relationship
If there is reasonable suspicion that the marriage was entered into solely to obtain a permit, the administration may carry out an investigation. The investigation must be based on concrete data. In case of divorce, death or a change in family circumstances, the possibility of transition from the existing permit to another type of permit is assessed separately. The legal importance of facts such as domestic violence or the situation of children cannot be disregarded with a general approach of "the marriage is over, all rights are over." [1, Arts. 34-37][11]
Student residence permit
Failure to meet or loss of the student requirements, evidence emerging that the studies cannot be continued, use of the permit for another purpose, and a valid deportation or entry ban decision matter for a student permit. Freezing of enrollment, change of school, graduation and disenrollment may not produce the same legal consequence. University records and e-İkamet information must be examined together. [1, Arts. 38-40]
In the current official announcement, higher education students are expected to deliver their documents to their university's international student office after the online application. The notification of missing documents and the delivery channel should be followed consistently with this process. Keeping the correspondence with the university in a student's file helps determine from whom or at what stage a deficiency arose. [5]
Long-term residence permit
For a long-term permit, as a rule, at least eight years of uninterrupted residence and the other conditions in Article 43 of the Law are required; special statutory provisions are reserved. This permit is indefinite. As regards cancellation, posing a serious threat to public order or security, and staying outside Türkiye for more than one uninterrupted year for a reason other than health, education or compulsory public service in the foreign national's own country, are of particular importance. The provisions on staying abroad for each permit type should be examined within their own framework; the period belonging to another permit type should not be applied to a long-term permit. [1, Arts. 42-45]
Humanitarian residence and residence permit for victims of human trafficking
These permits rest on their own statutory purposes and conditions. Humanitarian residence is not a general alternative that can be used automatically after every refusal decision. The cases in the Law, such as the best interests of the child, the impossibility or unreasonableness of leaving the country, and urgent or exceptional circumstances, are examined concretely. In the permit for victims of human trafficking, victimization and the need for protection are the basis. The grant, extension or cancellation of these two permit types cannot be explained by the conditions of an ordinary tourism application. [1, Arts. 46-49]
File Preparation That Reduces the Risk of Refusal at the Application Stage
Timely application and consistent submission of documents
An extension application must be made starting from 60 days before the expiry of the current residence period and, in any event, before the period expires. The rule that the passport or a document replacing the passport be valid for at least 60 days longer than the requested residence period must be checked separately. Creating an application in the system, attending the appointment and delivering the documents are different stages; the record of each stage should be kept. [1, Arts. 21 and 24][4]
The application certificate given to a foreign national who applies for an extension within the time limit allows him or her to stay in Türkiye until a decision on the application is made, even if the current permit has expired. This is a separate arrangement applicable while the application is being evaluated. The stay and departure situation after an extension request has been refused is reassessed on the basis of the refusal decision and other legal bases. [1, Art. 24/2]
The file should consist of a short, consistent account explaining the purpose of the application and the documents supporting that account. Submitting many documents is not sufficient by itself. It should be clear which condition each document proves; outdated, contradictory or third-party records should not be left unexplained. A final check among the online form, passport, financial documents and address information is useful.
Distinguishing 30 days for missing documents from 90 days for evaluation
According to Article 22 of the Regulation, missing or supplementary information and documents are notified to the applicant; if they are not completed within 30 days of the notification, the application is to be removed from the docket. The 90-day period for evaluating a residence application, on the other hand, starts from the delivery of the information and documents to the competent authority in complete form. If the period is extended, the applicant is to be informed. These two periods are not two different concluding periods set for the same procedure. [3, Art. 22][4][5]
The passing of 90 days does not result in the permit being deemed granted. The stage the application has reached, whether additional documents have been requested, and the legal route to which the administration's silence may be subjected must be examined separately. The route against an express refusal decision and the route against the administration's silence in an application on which no decision has yet been made do not have the same legal starting point. [2, Arts. 10-11]
Official channels and current delivery methods
The official online channel for residence applications is the e-İkamet system. YİMER 157 is the official source of information on the application process. According to current announcements, foreign nationals who wish may use the option of delivering their files through notaries in the province in which they applied; the availability of the notary route does not mean that delivery through a notary is mandatory for all applications. The system's current guidance should be followed. [5][6]
Handling the procedure through a statutory representative or a lawyer within the framework of the Law and practice is different from unauthorized intermediaries presenting themselves as the administration's contracted organizations. A lawyer's following of the file does not guarantee a result; the administration may require the foreign national to be personally present when necessary. [3, Art. 21][4]
First Steps When a Refusal Decision Is Served
Not only the conclusion section of the refusal decision but all its pages and annexes should be obtained. The authority that made the decision, the date and number of the decision, the applied article of law, the concrete reasoning, the route of appeal and the date of service must be established. Article 25 of Law No. 6458 regulates the service of the decision on the foreign national, his or her statutory representative or lawyer, and the provision of information on remedies and other rights and obligations. [1, Art. 25]
- Determine whether the decision is a refusal of an initial application, a refusal of an extension, or a cancellation of a permit.
- Obtain the physical service document or the UETS evidence record and note the dates.
- Establish the expiry date of the current visa, visa exemption, residence permit or work permit.
- Check whether there is a separate deportation, entry ban or administrative detention decision.
- Collect the evidence of delivery of the application and additional documents in a single file.
- Calculate separately the time limits for the administrative application, the lawsuit and, if any, those relating to departure.
- If there is an urgent effect on family, children, education or health, prepare current documents supporting it.
UETS record and electronic service
In electronic service, the date on which a document reaches the UETS (National Electronic Notification System) account and the date on which it is legally deemed served may differ. Under Article 7/a of the Notification Law No. 7201, electronic service is deemed made at the end of the fifth day following the date it reaches the addressee's electronic address. The time limit for filing suit is calculated from this date of service in accordance with the relevant procedural rules. Reading the document later does not by itself postpone the time limit. [7]
Official announcements state that a UETS information form is requested in extension applications. One should therefore not rely on an e-mail or SMS alert; the UETS account and the evidence record must be checked. Where irregular service is alleged, the legal effect of actual knowledge, representation and service records is assessed separately; one should not act on the assumption that "service was defective, so no time limit begins." [5][7]
Time Limits for Objection, Suit and Application
| Procedure or stage | Basic time limit | Point to note in practice |
|---|---|---|
| Suit against refusal, cancellation or non-extension of residence | Generally 60 days | Calculated from the day following written notification; special situations are checked separately. |
| Suit against a deportation decision | 7 days | The service of the separate decision is the basis; the application is also notified to the authority that made the decision. |
| Reply to an administrative application under İYUK Art. 11 | 30 days | If there is no reply, implied refusal; the remaining part of the time limit for suit runs. |
| Missing or supplementary documents | 30 days from notification | If not completed in time, the application is to be removed from the docket. |
| Concluding a residence application | At most 90 days | Starts from the delivery of complete information and documents; does not result in automatic acceptance. |
| Opening of the extension application | 60 days before expiry | The application is made before the current permit period expires. |
| Reapplication after refusal or cancellation | New request ground in the first 6 months | Does not necessarily mean a different permit type; a genuine new ground is required. |
| Departure after refusal or documented temporary stay | 10 days may come into question depending on the specific status | No generalization can be made without examining the current visa/exemption and separate decisions. |
| Objection to a decision on a request for stay of execution (YD) | 7 days from the day following service | A one-time objection before the regional administrative court against the administrative court's YD decision; separate from the deportation action. [2, Art. 27/7] |
| Appeal (istinaf) in a residence action | Generally 30 days from the day following service | Special finality provisions and the statement of remedies in the decision are checked separately. [2, Art. 45][14] |
The bases of the table are Articles 21, 24, 53 and 54 of Law No. 6458; Articles 7, 8 and 11 of the İYUK; and Articles 21 and 22 of the Regulation. Matters such as weekends, official holidays, judicial recess and irregular service are assessed separately in the specific calculation of time. It should not be assumed that the special short time limit in a deportation action is preserved by an application made for another procedure. [1][2][3]
How Is an Administrative Objection Made and What Is Its Effect on the Time Limit for Suit?
Application under İYUK Article 11
Article 11 of the İYUK allows, before an administrative action is filed, the removal, withdrawal, amendment of the act or the making of a new act to be requested from the superior authority; if there is no superior authority, from the authority that made the act. This application must be made within the time limit for filing suit. In a residence dispute, filing suit directly is also, as a rule, possible; an administrative application is not a mandatory preliminary stage in every file. [2, Art. 11]
The petition must clearly show the date and number of the decision, the date of service, the ground objected to, the matter requested to be corrected and the supporting documents. The registry number or a reliable delivery record showing that the application reached the competent authority should be kept. A mere oral meeting, a telephone inquiry or making a new appointment should not be used on the assumption that they replace this legal application.
The time limit is suspended; a new 60 days does not start from zero
An Article 11 application that meets the statutory conditions and is made in time suspends the running time limit for filing suit. In the case of an express refusal, the remaining time limit for suit runs from the day following service of the refusal reply; where no reply is given within 30 days, from the day following the end of the implied refusal period. The days that elapsed before the application are counted. For example, if 20 days of the time limit for suit had elapsed by the time of a proper application, the remaining 40-day portion is, as a rule, taken into account. This hypothetical example shows the logic of the time limit, provided that concrete variables such as holidays and service are calculated separately. It should not be assumed that correspondence after the implied refusal has arisen restarts the time limit. [2, Arts. 8 and 11]
CİMER, an information request and a new residence application are not the same procedure
That an application was sent through CİMER (the Presidential Communication Center) or another channel does not by itself show that it suspended the time limit for suit. What matters is whether its content contains a request within the scope of Article 11, its timing and whether it was addressed to the competent authority. Making a new residence application also does not automatically suspend the time limit for suit against the earlier refusal decision. The administrative objection and the new application plan should therefore be tracked with separate records.
Does an administrative application extend the period of stay in Türkiye
The effect of an Article 11 application on the time limit for filing suit is different from the foreign national's stay status in Türkiye. Making an administrative application does not automatically extend the current visa or residence permit. Whether a risk arises, while awaiting the outcome of the application, in terms of departure, deportation or an entry ban must be assessed separately. [1, Arts. 53-54][2, Arts. 11 and 27]
Annulment Action Against Refusal of a Residence Permit
Competent court and venue
The lawfulness of an administrative act concerning a residence permit is reviewed by the administrative court. The court with territorial jurisdiction is, as a rule, determined by the location of the administrative authority that made the act. For example, for an act established by the Antalya Governorship, jurisdiction is assessed in respect of the Antalya administrative courts after examining the act and special provisions. It cannot be said that every foreigners' law case will be filed in Ankara. The defendant administration must also be correctly identified according to the legal position of the authority that established the act. [1, Art. 25][2, Art. 32]
What information the petition should contain
The petition must contain the plaintiff's identity and contact details, the act in dispute, the date of service, the facts, the allegations of unlawfulness, the evidence and a clear statement of the relief sought. If annulment of the act is sought, it should leave no doubt as to which refusal or cancellation decision it is requested for. If a stay of execution is to be requested, its grounds must be explained separately. Spelling differences in passport and foreign ID details must be resolved in the file. [2, Arts. 3 and 27]
Each ground in the refusal letter must be compared with the application file. Instead of a general statement such as "my documents are complete," it should be shown which document was delivered when, which assessment of the administration it refutes and, where applicable, what result an incomplete examination led to. The relation of new facts that arose after the application to the review of the lawfulness of the earlier act must also be explained separately.
How allegations of unlawfulness are made concrete
In a specific file, allegations may arise of an act by an incompetent authority, a deficiency in service or procedure, an erroneous material fact, failure to assess documents, erroneous application of law or a disproportionate result. For each allegation, the relevant document, date and the reasoning of the decision should be shown. If family life or the child's education is relied on, one should not be content with an emotional account alone; the concrete effect that would arise if the applicant were to leave must be demonstrated.
Obtaining the administrative case file
The documents in the applicant's possession may not show the administration's entire case file. Review forms, interview records, address investigations, institutional letters, the basis of the restriction record and notifications of missing documents may be important. The petition may state which records are requested to be obtained. The court's power to investigate of its own motion does not remove the applicant's obligation to present the evidence in his or her possession in an orderly manner. [2, Art. 20]
Special procedure in short-term permit actions
Paragraph seven, added to Article 31 of Law No. 6458 in 2024, introduced certain special procedural rules for actions concerning the refusal of a short-term residence application and the cancellation of a short-term permit. The file is deemed complete (tekemmül) once the administration submits its defense or the period for its defense has passed. If service cannot be made to the address given by the plaintiff, the two-month period under İYUK Art. 26/3 applies; whether to hold a hearing is at the court's discretion. [1, Art. 31/7][8]
This provision does not mean that short-term residence refusal actions are to be filed within 7 days or that every action is subject to expedited proceedings within the meaning of İYUK Art. 20/A. Because the file may be completed earlier, it becomes important to submit the basic allegations and evidence in full in the first petition and to keep up with address and electronic service on a regular basis.
Fees, Costs and Legal Aid in a Residence Permit Action
What are the financial consequences of filing suit?
In an annulment action, application and decision fees, service and postage costs and other litigation costs required by the file come into question. If the action is lost, subject to statutory exceptions, litigation costs and, if the conditions are met, the opposing party's attorney's fee may be imposed; partial success may affect the sharing of costs. The opposing attorney's fee ordered by the court is separate from the legal fee agreed between a person and his or her own lawyer. The initial budget is determined on the basis of the fees on the date of application and the costs required by the file. For the opposing attorney's fee, on the other hand, the tariff on the date of judgment is the basis; the fee agreement with one's own lawyer is assessed separately. [2, Art. 31][15, Arts. 323, 326 and 330][16]
Can foreign nationals benefit from legal aid?
A person who cannot pay litigation costs without significantly impairing the subsistence of himself or herself and family may request legal aid from the court if the claim is not manifestly without basis; the person must submit documents showing his or her financial situation and the basis of the claim. Article 334/3 of the HMK (Code of Civil Procedure No. 6100) additionally requires reciprocity for foreigners; for holders of international protection status and holders of the Stateless Person Identity Document, the exemptions in Law No. 6458 are assessed separately. Depending on its scope, a legal aid decision provides facilities such as temporary exemption from costs and the advance payment of costs by the State; it does not mean that all costs are definitively written off. An application to the bar association's legal aid office for the assignment of a lawyer and a request to the court for legal aid for litigation costs are separate processes. [15, Arts. 334-336][1, Arts. 51/1-c and 88/1][17]
Stay of Execution and Its Effect on Stay in Türkiye
The difference between a request and a court decision
Under İYUK Art. 27, filing suit does not automatically stay the execution of the administrative act. Nor does the mere fact that a stay of execution was requested in the petition produce this result. A stay of execution is decided by the court, not the administration. Whether there is a decision in the file, which act it concerns and its notification to the administration must be tracked separately. [2, Art. 27]
Two conditions are assessed together
For a stay of execution, the conditions that the act is manifestly unlawful and that its implementation would cause damage that is difficult or impossible to compensate are required together. Merely saying "I will be aggrieved" is therefore not sufficient file preparation. Why the ground for refusal is manifestly unlawful and what serious consequence implementation would entail must be set out in related but separate explanations. [2, Art. 27]
Documenting the damage
Matters such as the child's school and care arrangements, ongoing treatment, a relationship of disability or dependency, and the consequences of the actual separation of family members may matter in a specific file. Not only the existence of a health or education document but its connection with the applicant's departure must be explained. An allegation of general economic loss and a personal or family impact that is difficult to reverse may not be assessed with the same weight.
Which procedures should be followed when a decision is obtained
If a stay of execution decision is obtained, the notification of the decision to the administration, the manner of its implementation in the file and the foreign national's status in the records should be monitored. This decision does not mean that a new plastic residence card is automatically issued. If there is a separate deportation or entry ban act, the legal position of those is also handled separately. A general conclusion cannot be drawn from a stay of execution of one act that no deportation decision can ever be made in the future.
If the request for a stay of execution is rejected
Against the administrative court's decision on a request for a stay of execution, a one-time objection may be made before the regional administrative court within 7 days from the day following service of the decision. The decision given on the objection is final. The rejection of a YD request does not mean that the annulment action on the merits has also ended; the action on the merits and the interim protection review are tracked separately. The 7-day period here relates to a different remedy from the 7-day period for an action against a deportation decision. [2, Art. 27/7]
Staying in Türkiye and the Obligation to Leave After a Refusal Decision
The same 10-day calculation cannot be made for everyone
In determining the obligation to leave, the current visa or visa exemption, the residence or work permit, the type of refusal or cancellation decision and the document served are examined. Paragraph eleven of Article 22 of the Regulation provides that a foreign national whose expired residence permit is not extended or whose residence permit request is refused is given a document that is not subject to fee and allows a stay in Türkiye of at most 10 days. This statement in the paragraph should not be generalized to the same extent for a cancellation of the permit. In addition, there is a special provision on the use of the existing visa or exemption periods by those who came with a visa or visa exemption and whose residence request was refused. It therefore cannot be said that service of a refusal ends the remaining visa period in every case. [3, Arts. 22/11 and 52/1-c]
Article 54 of Law No. 6458 deals in separate sub-paragraphs with those whose residence permit has been cancelled and those whose extension application has been refused and who have not left within 10 days. Misclassifying the type of act may affect both the stay and the litigation strategy. A decision on travel or stay should not be made without assessing together the period granted in the decision and any other lawful basis of stay. [1, Art. 54/1-f and j]
The period for leaving Türkiye in a deportation decision
Some foreign nationals against whom a deportation decision has been made may, under the conditions in the Law, be granted a period of not less than 15 days and not more than 30 days to leave Türkiye. It cannot be said that this period will be granted in every case; there are statutory exceptions. This period is not the same as the 10-day arrangement after a residence refusal and does not change the 7-day time limit for filing suit against the deportation decision. [1, Arts. 53 and 56]
Departing and re-entering
Leaving Türkiye does not mean that re-entry will necessarily be accepted. Visa conditions, entry bans, earlier violations of stay, unpaid obligations and border control are assessed together. Payment of an administrative fine or fee does not in every case automatically remove an existing entry ban. Before travel, it is important to obtain copies of the relevant decisions and verify the entry conditions. [1, Arts. 7, 9 and 15]
The application certificate used while the application is pending
While a residence application is being evaluated, there is an official practice under which a person may leave and return within 15 days with an application certificate meeting the required conditions and the fee receipt. This facility cannot automatically be applied in the same way to a person whose application has been refused. The validity of the certificate, the current status of the application and the requested permit period should be checked. [4][5]
Can the administration postpone implementation of the decision?
Article 25 of Law No. 6458 and Article 22/18 of the Regulation allow the execution of a decision of refusal, non-extension or cancellation to be postponed in procedures carried out from within Türkiye, taking into account family ties, length of residence, the situation in the country of origin and the best interests of the child. A document, not subject to fee, giving the right to stay in Türkiye for one month is issued to the foreign national within the scope of postponement. At the end of the month, the governorship makes a reassessment; if the situation requiring the stay continues, the document may be extended for one-month periods, and the fee for the extended stay is collected. This route requires a concrete administrative assessment and the issuance of a document; it should be handled separately from a request to the court for a stay of execution. [1, Art. 25][3, Art. 22/18]
Deportation, Entry Ban and Administrative Detention Decisions
A separate action against the deportation decision
If a deportation decision has also been served, an application to the administrative court within 7 days comes into question under Article 53/3 of Law No. 6458. The person applying to the court also notifies the authority that made the decision of the application. Subject to the foreign national's consent, the guarantee of not being deported until the proceedings are concluded, provided the application is made within the time limit for filing suit and recourse to the courts has been made, arises from this special provision. The same effect cannot automatically be assumed for a residence refusal action. [1, Art. 53/3]
After the 2024 amendment, completion of the file upon submission of the defense or expiry of its period, certain service situations, and the holding of a hearing being at the court's discretion were also regulated for deportation actions. The 15-day period for decision in the Law is calculated from the completion of the file or from the completion of the necessary interim decision or hearing procedures. It is not correct to present this period as an unconditional guarantee of conclusion starting from the date the action was filed. The court's decision on this matter is regulated by the Law as final. [1, Art. 53/3][8]
Entry ban and restriction record
An entry ban may be an act separate from the residence refusal. By which authority, on what ground and for what period it was imposed must be established. Lifting of the ban, or the possibility of entry under certain conditions, and judicial recourse are assessed separately. Family life, the situation of the children and ties with Türkiye may also matter for this act; however, their existence does not by itself remove all obstacles to entry. [1, Art. 9][12]
Administrative detention
Administrative detention, concerning the holding of a foreign national in a removal center, is not the same legal act as a residence refusal or a deportation decision. An application to the criminal judgeship of peace against administrative detention and alternative obligations other than administrative detention are examined within the framework of their own provisions. The mere fact that a residence action has been filed does not take the place of applications concerning this separate restriction of liberty. The principle of non-refoulement and the protections for persons who cannot be deported must also be assessed separately in the specific case. [1, Arts. 4, 55, 57 and 57/A]
Reapplication for Residence After Refusal or Cancellation
A new request ground within six months
According to paragraph ten of Article 21 of the Regulation, foreign nationals whose applications have been refused or whose permits have been cancelled are required to present a new residence permit request ground when reapplying within 6 months. The wording here is not "necessarily a different permit type." The new ground must be genuine, documentable and consistent with the statutory framework applied for. Repeating the same account in different words or changing the option in the form does not by itself constitute a new ground. [3, Art. 21/10]
For example, a genuine family relationship, education or another lawful reason for stay that arose later may be examined in the new application. Whether they meet the permit conditions and by what procedure the application can be made are assessed separately. The passing of six months also does not automatically remove the earlier grounds of refusal and does not guarantee acceptance of the new application.
Assessing the new application and the annulment action together
The allegation that the earlier act was unlawful and a request for a permit based on a new legal or factual situation have different aims. While the new application is being prepared, the time limit for suit against the earlier refusal decision must be preserved. Acceptance of the new application may not necessarily mean that all disputes arising from the earlier act have automatically ended; the subject matter of the action and the continued legal interest are examined in the specific file.
Transition to another permit type and the genuine purpose of stay
If the basis of the existing permit has ended or a new purpose of stay has arisen, transition provisions may come into play. The dates of facts such as studentship, family unity, treatment or an employment relationship are important. Instead of creating a purpose of stay contrary to the facts, it should be determined which permit type the current situation fits; the necessary documents and the time of application should be planned accordingly. [3, Art. 26]
A fact that existed on the date of the refusal but could not be presented in the application file must be distinguished from a new fact that genuinely arose after the refusal decision. The first may affect the assessment of the earlier act in terms of evidence and examination, and the second the conditions of the new application. This distinction does not mean that a new document is in every case regarded as a new ground of stay. [2, Art. 2][3, Art. 21/10]
What Happens When the Action Is Won or Rejected?
Implementation of the annulment decision
The court's annulment of the refusal act requires the administration to act in accordance with the reasoning of the decision. Under the general rule of İYUK Art. 28 applicable to residence disputes, decisions on the merits and on stay of execution are complied with without delay; the period may not exceed 30 days from the notification of the decision to the administration. It cannot be said that finality will be awaited in every case before the decision is implemented. [2, Art. 28][13]
The reasoning of the annulment decision is decisive. The court may have found an incomplete examination, an erroneous material assumption or a procedural error; the new assessment to be made by the administration must be consistent with this reasoning. The issuing of an annulment judgment does not mean that, in every case, the court directly issues a new fixed-term residence card. The date on which the decision reached the administration and the subsequent procedures should be tracked with documents.
Rejection of the action and the appeal route
If the action is rejected, the reasoning of the decision, the date of service and the express route of appeal are examined. Against administrative court decisions on the refusal, cancellation or non-extension of a residence permit, unless there is a special finality provision, appeal (istinaf) may be lodged before the regional administrative court within 30 days from the day following service of the decision. In deportation actions, on the other hand, the special finality provision in Article 53 of Law No. 6458 applies. The old statement of remedies in a decision in another file should not be copied. [1, Art. 53][2, Arts. 8 and 45]
Law No. 6458 actions under the 2026 amendment
Law No. 7589, which entered into force on 31 July 2026, introduced the possibility of appeal on points of law (temyiz) in certain disputes where the regional administrative court sets aside the first-instance decision and gives a new decision. However, İYUK Art. 46/2-d leaves actions arising from the application of Law No. 6458 outside this new possibility. The mere fact that the appellate authority set aside the decision and gave a new decision therefore does not create a right of appeal to the Council of State in a residence dispute. The route of appeal for a specific decision is determined by examining İYUK Arts. 45-46 and the transitional provisions together. [2, Arts. 45-46][14] The transitional provision ties the new regulation to regional administrative court decisions given after its entry into force; the route of appeal should not be determined by looking only at the date the action was filed. [14]
After a refusal decision, merely lengthening the text of the application may not be sufficient. Which fact the court regarded as unproven, which legal allegation it did not accept and why, and whether there is genuinely a new condition should be assessed. Remedies such as individual application are also subject to their own admissibility conditions and time limits; they cannot be used like an ordinary additional objection petition.
What Do Judicial Decisions Show About File Preparation?
Decisions of the Antalya 1st Administrative Court dated 6 April 2023
The decisions of the Antalya 1st Administrative Court dated 6 April 2023, E.2022/1572, K.2023/469 and E.2022/1573, K.2023/470, which were included in our firm's earlier publication, concern the non-extension of a tourism-purpose short-term residence permit. In these files, the court annulled the acts, having assessed that sufficient concrete findings and documents supporting the grounds of refusal asserted as to the purpose of stay and financial sufficiency had not been presented. [9]
The court focused, in addition to the application file and financial documents, on the interview record, the notification of additional documents and the concrete findings on which the ground of refusal was based. In file E.2022/1573, the examination was made in connection with file E.2022/1572 of the spouse who applied jointly. Both decisions concern annulment of the refusal acts on the merits.
Because the published examples contain no finality annotation or appeal outcome, the decisions are not presented as final case law. The point the decisions show is the need to compare the ground of refusal with the specific application file. No unlimited conclusion can be drawn that an interview must be held in every application or that every kind of deficiency must be completed before every refusal.
The Council of State's approach to concrete investigation in family residence
In the decision of the 10th Chamber of the Council of State dated 10 June 2021, E.2016/2192, K.2021/3234, a refusal of family residence based on an allegation of a marriage of convenience was examined. The Council of State upheld the annulment decision with reasons, having assessed the absence of sufficient investigation and documents that would make the administration's suspicion concrete. The decision shows the importance of assessing cohabitation and the address investigation in light of all the circumstances of the case. [11]
This approach does not mean that an address investigation is of no importance. The applicant's explanation of being elsewhere, the pattern of life and the interview records are considered together. It should be clear in the file which allegation is confirmed or refuted by which document.
Concrete impact and proportionality in Constitutional Court decisions
In the Constitutional Court decision Betoul Faıkoglu, App. No: 2020/37084, 11 December 2024, the concrete effects on the applicant's life of the refusal of a long-term residence request were examined. It was assessed that the adult applicant had not sufficiently demonstrated dependence on her mother and father; the complaint was dealt with under the right to respect for private life. In view of the educational obstacle and hardship alleged also not being made concrete, this complaint was found manifestly ill-founded and declared inadmissible. The decision shows the importance of explaining family- and education-related allegations with the specific case and documents. [10]
In the decision Bılal Padalı Chasanoglou, App. No: 2021/14332, 28 January 2026, however, the subject is not a residence refusal but an entry ban to Türkiye. The Constitutional Court found the balancing between family life and the public interest and the judicial reasoning insufficient and, by majority, reached a finding of violation and a retrial. A retrial does not mean that the underlying case will necessarily be accepted. The decision is important in that, in files where a separate entry ban accompanies a residence dispute, the effects of this act on family life are also assessed within its own reasoning and remedy. [12]
File-Specific Evidence and Defense Preparation
Legal preparation rests less on using the same petition in all files than on establishing the facts on which the ground of refusal is based. The matching below is a practical working framework showing which document may clarify which discussion; it does not mean that all documents are mandatory in every application.
| Subject of dispute | Documents that may be examined | Connection to be explained |
|---|---|---|
| Financial sufficiency | Account activity, income, pension, scholarship or support record | Genuineness and continuity of the source and consistency with the stay |
| Purpose of stay | Program, contract, education or treatment document | Consistency between the chosen ground of permit and the actual situation |
| Family unity | Marriage, birth, shared address and care records | Actual cohabitation and the concrete effect of separation |
| Situation of the child | School, custody, health and care documents | The effect of the decision on the child's way of life |
| Allegation of missing documents | Delivery record, registry number, notification and correspondence | What was requested, and when and how it was delivered |
| Address or interview | Address investigation, record, explanation and supporting records | The relation of the apparently contradictory finding to actual life |
| Separate restrictive act | Deportation, entry ban and service copies | The separate ground, time limit and remedy for each act |
Chronology and organization of documents
Dates of entry into the country, previous permits, application, appointment, document delivery, additional-document notification, refusal and service should be entered into a single chronology. Documents should be arranged in date order; each allegation should refer to the relevant annex number. In this way the differences between the applicant's account and the administration's file become visible. Sensitive records such as passport and health records should be shared through a secure channel, and unnecessary personal data should not be spread indiscriminately.
Approach in hypothetical situations
Insufficiency given as the ground although an income document was delivered
If the applicant says that bank and income documents were submitted while the administration says financial sufficiency was not proved, the proof of delivery and the content of the document are first compared. Whether the account belongs to the applicant, and the relation between the period and the source of funds and the requested length of stay, are examined. The outcome of the file cannot be determined merely by saying "there is a bank statement."
Refusal of one spouse's application while the family remains in Türkiye
The status of the spouses and children is recorded separately; the shared life, the duty of care and the effect of separation are documented. The other spouse's holding a permit does not automatically remove the refusal act. Nevertheless, whether family ties were properly assessed in the decision-making process may be examined in respect of both the merits and interim legal protection.
Dispute arising because the student record changed
In case of change of school, freezing of enrollment or graduation, the relevant date and whether the notification was made are determined. If the problem is merely a delay in the system record, evidence for correcting the record; if the studies have genuinely ended, an appropriate new purpose of stay and application conditions are addressed. These examples are intended to explain the method of assessment; they do not predict the outcome of a particular action.
How the administration's strong counter-arguments are assessed
The administration may argue not merely that a document is missing but that the substantive conditions of the permit type applied for are not met. In that case, submitting the missing document afterwards may not by itself be a sufficient answer. For example, if it is argued that the real purpose of stay does not match the ground chosen in the application, the applicant must explain this discrepancy with records of life and activity. That a permit was previously granted also does not by itself show that all conditions continue in the later period. [1, Arts. 25, 32-33, 35-36 and 39-40]
Another argument of the administration may be that the alleged family, education or health impact has not been sufficiently made concrete. The answer to this allegation should not be limited to a document showing the existence of the relationship; the consequence the refusal decision would have for the person and family, the care or dependency relationship and, where applicable, the concrete difficulties of living together in another country should be explained. By contrast, where there is a genuine and sufficient ground of refusal in the file, the use of general proportionality statements alone does not take the place of the permit conditions. [1, Art. 25][10][12]
A new situation that arises after the application must also be carefully distinguished. A new fact may support a different permit request going forward, but may not by itself prove why the earlier act was unlawful on the date it was established. The grounds relied on for annulment of the old decision and the basis of the new application should therefore be explained separately, and both processes should be followed within their own time limits. [2, Arts. 2 and 7][3, Art. 21/10]
Practical Errors That Can Cause Loss of Rights
- Planning legal action only on the basis of an SMS or screenshot without obtaining the refusal decision.
- Mistaking the 60-day time limit for suit for the period during which one may stay in Türkiye.
- Treating a request for a stay of execution as if a court decision had been given.
- Thinking that a residence action will also be deemed filed against a separately served deportation decision.
- Assuming that a full new 60-day period starts after an administrative application.
- Accepting that a new residence application suspends the time limit for suit against the old refusal decision.
- Interpreting the six-month rule as an obligation to move to a different permit type in every case or as an absolute entry ban.
- Regarding earlier favorable permits, real estate or marriage as a guarantee of acceptance on their own.
- Failing to follow address and UETS changes; not keeping a reachable address up to date during the litigation.
- Applying the result and the old procedural statement of a decision in another file directly to one's own file.
Legal Assessment and Follow-Up of the File
In a residence dispute, the scope of the legal work includes examining the decision and service, calculating time limits, assessing the application file, determining the administrative application or litigation route and, where necessary, preparing a request for a stay of execution. In addition, if there is a deportation, entry ban or administrative detention decision, these are handled through their own remedies. In the continuation of the process, court decisions, administrative acts and notifications are tracked together.
For an initial assessment, the full decision, the service record and documents showing the current stay status are important. The outcome of each file depends on its own facts, evidence and legal assessment. After the preparation of the application, not only the initial decision but also interim decisions, the appeal route and the implementation of the decision should be monitored regularly.

Conclusion
When confronted with a refusal, cancellation or non-extension of a residence permit, the right starting point is to establish the type of act and the date of service. Then the current lawful stay status, the time limit for suit, any administrative application and any accompanying deportation or entry ban decisions should be assessed separately. The effect of an objection or action cannot be assumed as if a decision had been given.
Strong preparation of the file depends on a consistent explanation of the purpose of the application, comparing the ground of refusal with concrete evidence, documenting the effects on family and children, and regular monitoring of all time limits. The possibility of a new application and judicial review of the earlier act should be planned together; after the court decision, the implementation process should also be followed.
Frequently Asked Questions
Within how many days is suit filed against a residence permit refusal?
The general time limit for filing suit against the refusal, cancellation and non-extension of a residence permit is 60 days. The time limit, as a rule, starts from the day following written notification. The form of service, an administrative application made in time and the relevant procedural rules are examined separately in the specific file. [2, Arts. 7-8 and 11] Details: Time limits and their starting points
Does the 60-day period also apply to a deportation decision?
No. Article 53/3 of Law No. 6458 provides a special 7-day time limit for filing suit against a deportation decision. Separate service and litigation follow-up are required for this act; the application to the court is also notified to the authority that made the decision. [1] Details: Separate deportation action
Can I stay in Türkiye once I file suit?
Filing suit against a residence refusal does not by itself give a new lawful right of stay and does not stay the execution of the act. The current visas or permits, the court decision and any separate deportation act must be assessed together. [1][2, Art. 27] Details: Effect of the action on stay
Is it enough to request a stay of execution?
Requesting and the court's granting are different. For a stay of execution, the court must decide; the conditions of manifest unlawfulness and damage that is difficult or impossible to compensate are assessed together. [2, Art. 27] Details: Stay of execution
Must everyone leave within 10 days after a refusal?
A single rule cannot be applied to all situations. The type of decision, the document served, the current visa or exemption period and other lawful bases of stay are examined. The Regulation's provision on using the visa/exemption period must be assessed together with the 10-day document arrangement. [3, Arts. 22/11 and 52/1-c] Details: Obligation to stay and leave
Is an administrative objection mandatory?
In a residence dispute, an annulment action can, as a rule, be filed directly. An İYUK Art. 11 application is not a mandatory precondition in every file. Which route to follow is determined taking into account the time limit, the stay status and the needs of the file. [2, Art. 11] Details: Administrative application route
How does an administrative application affect the time limit for suit?
An application that meets the statutory conditions and is made in time suspends the time limit for suit. The remaining time runs from the day following service of the express refusal reply or the end of the 30-day silence period, taking into account the days that elapsed earlier. A new 60-day period does not begin from the start; it should not be assumed that correspondence after the implied refusal renews the time limit. [2, Arts. 8 and 11] Details: Suspension of the time limit
Is the time limit for suit preserved if I write to CİMER?
The channel of the application alone is not sufficient. The content of the petition, its timing and whether it was addressed to the competent authority must be examined. It should not be assumed that an information request or a general complaint will necessarily be treated as an İYUK Art. 11 application. Details: Nature of the application
Can no application be made for 6 months after a refusal?
The Regulation requires a new residence permit request ground to be presented in an application made within 6 months after the refusal or cancellation. This provision does not mean that all new applications are absolutely prohibited. The ground must be genuine and documentable. [3, Art. 21/10] Details: Reapplication
Does a new ground necessarily mean a different permit type?
No. The concept used by the legislation is a new request ground. Whether a different and genuine statutory ground of stay exists, even within the same permit type, is assessed concretely. Remedying a deficiency in the earlier application does not, by itself, mean that a new ground of stay has arisen; merely changing a name or an option in the form is also not sufficient. The procedural conditions of the new application and the foreign national's current stay status are examined separately. [3, Art. 21/10] Details: New request ground
Does a new application suspend the time limit for suit against the old refusal decision?
A new residence application does not automatically suspend the time limit for suit against the earlier refusal decision. The legal application against the earlier act and the new permit request must be tracked separately. [2, Arts. 7 and 11] Details: Old action and new application
Is a residence application concluded in 30 days or 90 days?
The concluding period, which starts from the delivery of complete information and documents, is at most 90 days. The 30 days in the Regulation concern the submission of missing or supplementary documents that have been notified. The passing of 90 days does not mean an automatic permit. [3, Art. 22][5] Details: Distinction between 30 days and 90 days
What happens if the application is removed from the docket because of a missing document?
How the deficiency was notified, the period given, whether the document was delivered and the nature of the act are investigated. By distinguishing removal from the docket from refusal on the merits, the legal consequence of the specific decision and the appropriate route of application are determined. [3, Art. 22] Details: Notification of missing documents
Does owning a home guarantee a residence permit?
No. Ownership of real estate may be a ground for a particular short-term application; the relevant permit conditions, application procedure and current practice are sought together. A title deed alone does not show that all conditions are met. [1, Arts. 31-33] Details: Conditions by permit type
Does marriage to a Turkish citizen automatically remove a refusal decision?
Marriage is one of the basic facts assessed in family residence; however, the other conditions of the family permit and the genuineness of the marriage are also examined. A marriage entered into later does not automatically remove the earlier refusal act. [1, Arts. 34-37] Details: Family residence
How is a child's schooling in Türkiye assessed?
The best interests of the child and the education and care arrangements matter in the specific file. Together with the school record, the effect of the decision on the child's life, the care relationship and the consequences of separation should be explained. A school record alone does not satisfy the conditions of every permit type. [1, Art. 25] Details: Best interests of the child
Does having a student certificate prevent a refusal decision?
Although a student certificate is important, active study status and the other conditions of the student permit are also examined. In a change of school or an enrollment problem, university records and the notifications made should be assessed together. [1, Arts. 38-40][5] Details: Student permit
Is a long-term residence permit extended every year?
No. A long-term residence permit is by law indefinite. The conditions for its grant and cancellation are examined; it is not subject to the same regime as the extension of fixed-term residence permits at the end of the period. [1, Arts. 42-45] Details: Long-term permit
If I have a residence card, is a work permit also required?
A residence permit does not by itself provide a general right to work. For work, the relevant permit or exemption regime must be examined. By contrast, a work permit meeting the statutory conditions taking the place of a residence permit is a separate arrangement. [1, Art. 27][4] Details: Distinction between residence and work permits
Can the action be pursued from abroad after a refusal decision?
Leaving the country does not, as a rule, prevent the pursuit of the action provided that proper representation and a service arrangement are established. The form of the power of attorney, the need for translation and authentication, and the current address and electronic service records are determined according to the file. Departure does not automatically ensure the right to re-enter. Details: Leaving the country and follow-up
How long does an annulment action take?
No definite conclusion period valid for every file can be given. The court's workload, the obtaining of the case file, interim decisions and the relevant special procedural provisions affect the process. The special completion rule in short-term permit actions is also not a guarantee of a result on a particular date. [1, Art. 31/7][2] Details: Litigation process and special procedure
If the action is won, is a residence card automatically issued?
The administration must act on the basis of the reasoning and judgment of the court decision. An annulment decision does not mean that a fixed-term card is directly issued in every case; the notification of the decision to the administration and its implementation should be followed. [2, Art. 28] Details: Implementation of the court decision
Will an earlier favorable court decision also win my file?
A precedent helps in assessing a similar legal question. However, the type of application, the state of documents, the date of the act and the reasoning may differ. It cannot be said that the same result will follow without examining the finality of the decision and its relation to current legislation. Details: Limits of decision examples
Which documents should be prepared for the initial review?
The full decision, the service or UETS record, the passport, current and previous residence cards, the application form, evidence of delivery and documents relating to the ground of refusal should be prepared. If there is a separate deportation, entry ban or administrative detention decision, these should also be added to the file. Details: Evidence and document preparation
