1. What Is Double Taxation and Why Does It Arise?
1.1. Can the Same Income Be Taxed in Two Countries?
International legal double taxation arises, as a rule, where the same taxpayer’s same income is subjected to similar taxes by two different States in the same period. For example, where a person who is a full taxpayer in Türkiye receives rent from real estate in Germany, Germany may assert the power to tax as the country where the property is located, and Türkiye as the country of which the person is a tax resident. Which State will tax, and to what extent, is determined by the domestic law provisions on the relevant category of income and by the treaty article in force.
A ÇVÖA does not in every case mean that tax is paid in only one country. Sometimes a treaty gives authority only to the State of residence, sometimes it grants the source State a limited right to tax, and sometimes it gives authority to both States and provides the credit or exemption method in the State of residence. The absence of a treaty also does not mean that the income will automatically bear a final tax burden twice; the credit provisions in domestic law are examined separately. [1], [3], [7]
1.2. The Distinction Between Legal Double Taxation and Economic Double Taxation
The taxation of the earnings of the same legal entity at the company level and of dividends distributed afterwards at the level of the natural person shareholder can be cited as an example of economic double taxation. The taxation by two States of the same natural person’s same rental income is the typical example of the legal double taxation debate. The taxes, definitions and relevant articles within the scope of a ÇVÖA should be read with this distinction in mind.
1.3. Is the Definition of "Duplicate Tax" in the VUK the Same as International Double Taxation?
No. Article 117/3 of the VUK regulates, in the context of calculation errors, the demand of more than one tax from the same tax base for a given period while applying the same tax law. International double taxation, by contrast, is a matter of the overlap of the taxing powers of two separate States. The use in the earlier article of the VUK definition directly as if it were an explanation of an international ÇVÖA carries the risk of confusing the application methods. Error-correction provisions and treaty/credit mechanisms are examined on different legal bases. [2]
2. The Taxable Event: When Does a Tax Debt Arise?
2.1. The Taxable Event, Assessment, Accrual and Payment Are Different
Under Article 19 of the Tax Procedure Law No. 213 (VUK), the tax claim arises when the event to which the tax law attaches the tax occurs or the legal situation is completed. Following this, the assessment (tarh) (determination of the amount), notification, accrual (tahakkuk) (coming to the payable stage) and collection of the tax are treated as separate stages. For this reason, saying "I have not yet filed a return" or "I have not yet brought the money to Türkiye" does not by itself show that the taxable event has not occurred. [2]
2.2. Occurrence of the Event by Type of Income and the Typical Time of Taxation
| Income or transaction | Fact that generally gives rise to taxation | Matter to be checked |
|---|---|---|
| Employment income | Legal receipt of wages in return for services | Country actually worked in, employer, payment and treaty conditions |
| Self-employment income | Receipt of the relevant earnings for income tax purposes | Where the service is performed, collection and documentation, treaty |
| Business income | Arising of business income as a result of the activity | Place of business/permanent representative, periodic income, accrual and recording principles |
| Rental income from real estate | Receipt of rent under the relevant income tax provisions | Location of the property, state of collection, exemption and declaration limits |
| Interest income | Receipt of income from movable capital under the relevant provisions | Accrual/payment conditions of the interest, withholding, bank and country |
| Dividends | Receipt of income arising from profit distribution | Distribution decision and payment, foreign withholding, residence |
| Gain on sale of shares/real estate | Realization of the taxable increase in value arising from transfer/sale | Acquisition and sale dates, cost, exemption, treaty, nature of the asset |
| Turkish company’s income from a foreign participation | Arising of the relevant corporate income for tax purposes | Participation exemption, controlled foreign corporation, credit |
| Delivery of goods or services in Türkiye | Delivery of goods, performance of services or other taxable event provided in the VAT Law | VAT territoriality and exemption provisions; analyzed separately from income tax |
The statements in the table are a general framework; there is no single "day the money reaches the account" rule for all income items. In particular, the accrual basis applies to business income, the collection basis in some cases of self-employment and real estate capital income, and special provisions according to the nature of the income for income from movable capital. For income in foreign currency, the valuation rate and the taxable year are determined separately. [1], [2], [4]
2.3. Does Sending Money from Abroad to a Bank Account in Türkiye Give Rise to Tax?
The mere transfer of existing money from one account to another is not, by itself, an event giving rise to income tax. Indeed, in the example in the Revenue Administration’s (GİB) Communiqué Series No. 333, it was explained that a transfer made from abroad to a Turkish bank account by a person who is not resident in Türkiye, and the rental income earned abroad, will not be taxed in Türkiye merely because of the transfer. However, if the amount transferred belongs to a commercial activity or self-employment activity carried out in Türkiye, interest of Turkish source or another taxable transaction, the "transfer" appearance of the money does not remove the legal nature of the income. The bank’s requests for information and documents, explanation of the source of the money and financial compliance checks are also matters separate from an income tax debt. [5]
3. Taxpayer Status Is Determined First: Are You a Full or Limited Taxpayer in Türkiye?
3.1. Full-Taxpayer Natural Person: Türkiye and Foreign Income
Under Articles 3 and 4 of Income Tax Law No. 193 (GVK), persons whose domicile is in Türkiye or who reside in Türkiye continuously for more than six months in a calendar year are considered resident in Türkiye, taking into account the relevant conditions and exceptions. The general consequence of full tax liability is that taxable earnings and receipts derived within and outside Türkiye are taken into account in Türkiye. This consequence does not mean that all foreign income is necessarily taxable: the statutory exemption, the ÇVÖA, the declaration exemption and credit may each apply separately. The special provision in Article 3/2 of the GVK concerning certain Turkish citizens and the exemption for income taxed in a foreign country contained there are also taken into account separately. [1]
3.2. Limited-Taxpayer Natural Person: Only Türkiye-Source Income
Natural persons not considered resident in Türkiye are, as a rule, taxed under Articles 6–7 of the GVK only on income they earn in Türkiye. For example, limited tax liability in respect of Türkiye may arise for a person who is a tax resident of Germany and earns income from a residence let in Türkiye. On the other hand, the fact that this person’s salary in Germany has been sent to an account in Türkiye does not by itself give rise to income tax in Türkiye on that salary. [1], [5]
3.3. Why Should the Six-Month Rule, 183 Days and Temporary Presence Not Be Confused?
The residence of more than six months in a calendar year criterion in Article 4 of the GVK and the 183-day condition that can be seen in the employment articles of certain ÇVÖAs are different legal tests. The first is used in domestic law to determine residence; the second may be used, depending on the treaty, in sharing the power to tax employment income. For certain foreigners present in Türkiye for temporary assignment, study, medical treatment and similar reasons, Article 5 of the GVK regulates cases that are not considered residence. Counting only days of travel also does not replace the assessment of domicile and residence in the other country in the specific case. [1]
3.4. What Happens If You Appear to Be Resident in Both Countries?
The domestic law of both States may regard the person as a tax resident. If applied in the "resident" article of the relevant treaty, tie-breaker rules may come into play, in order, such as permanent home, center of vital interests, habitual abode, nationality and mutual agreement of the competent authorities. Because there may be differences from treaty to treaty, one cannot automatically reach the result that "tax is paid to whichever country the passport belongs to." The residence certificate establishing treaty residence is assessed together with date, family, workplace, housing and residence data. Indeed, the Revenue Administration’s ruling dated 13 October 2026 separately discussed the importance of domicile, the actual center of life, the intention to settle and concrete evidence in determining the date of residence for repeated Article 20/D. [7], [10], [13]
4. Which Income Is Taxed Where? Sixteen Concrete Situations
4.1. A Person Living in Türkiye Receives Rent from a House in Germany
Taxable event: receipt of rental income, as a result of letting the property in Germany, under the income tax provisions. Germany’s authority: as the State where the property is located, it may have the right to tax within the framework of the article of the treaty in force on income from immovable property. Türkiye’s authority: if the person is a full taxpayer in Türkiye, the rental income may also be taken into account for Türkiye; the applicable treaty and the credit provisions of Article 123 of the GVK are examined. Element that may change the result: if there is an exemption certificate valid under repeated Article 20/D and the foreign rental income complies with the exemption conditions, non-declaration in Türkiye comes into question. [1], [5], [6]
4.2. A Person Resident in Germany Lets Out a Residence in Antalya
Taxable event: receipt of rental income from immovable property located in Türkiye. Even if the person is a limited taxpayer in Türkiye, rental income of Turkish source may be subject to taxation in Türkiye. Whether the residential exemption, the declaration conditions and the monetary limits of the relevant year apply is determined separately. For Germany, taxation by the State of residence and the method of avoiding double taxation should be examined according to the treaty in force between the two countries. Opening a bank account in Türkiye or holding a foreign passport does not by itself change the result. [1], [7]
4.3. Software or Consulting Services Are Provided Remotely from Türkiye to a Foreign Company
Taxable event: the fulfillment of the relevant conditions for the earning of business or self-employment income as a result of the activity carried out in Türkiye. The customer’s being in America, Germany or another country and the payment being made in foreign currency do not make a service provided in Türkiye "income derived abroad." The exemption in repeated Article 20/D of the GVK therefore does not apply automatically; the example in Communiqué Series No. 333 on engineering-consulting services performed in Türkiye also explains this distinction. The income tax nature of the income, any export/service exemptions, the separate assessment of VAT and, if withholding has been deducted in the foreign country, the relationship with the treaty/credit are examined. [1], [4], [5]
4.4. A Türkiye-Resident Employee Receives a Salary from an Employer Abroad
Taxable event: receipt of employment income in return for services. Where the work is actually performed is decisive. The fact that the employee works in Türkiye although the salary is paid by a foreign employer does not by itself create foreign-source wages. If work is actually performed abroad, the authority of the source country may come into play. In some treaties, taxation only in the State of residence on account of short-term work is subject to conditions that must be met together, such as the 183-day limit, the residence of the employer and whether the wages are borne by a workplace in the source country. Certain wage exemptions in Article 23 of the GVK are also assessed separately and narrowly. [1], [7]
4.5. A Turkish Citizen Lives in Germany and Works Only in Germany
A person’s being a Turkish citizen does not by itself mean that all of the German wages will be taxed in Türkiye. Not being considered resident in Türkiye, whether the special cases in Article 3/2 of the GVK exist, actual work and treaty provisions are important. Wages earned by a limited taxpayer solely in Germany and not of Turkish source are not subject to income tax in Türkiye merely because of a Turkish passport. [1], [7]
4.6. A Türkiye-Resident Person Receives Interest from a Foreign Bank
Taxable event: receipt of interest income arising from a bank deposit or another receivable under the relevant provisions. A deduction made by the bank abroad does not automatically remove the declaration review in respect of Türkiye. The interest article of the ÇVÖA, the nature of foreign withholding, the declaration conditions in the GVK, credit for foreign tax and a possible repeated Article 20/D exemption are assessed together. The deposit of the interest into a foreign account and its later transfer to Türkiye are different events. [1], [5], [6]
4.7. A Türkiye-Resident Person Receives Dividends from a Foreign Company
Taxable event: the legal receipt of dividend income. The source country may apply withholding within the limits in accordance with the dividend article of the applicable treaty; Türkiye may separately make a taxation assessment by virtue of full tax liability. The exemptions specific to distributions by domestic companies in Türkiye should not be automatically carried over to foreign company dividends. The domestic law exemptions, declaration limits and credit conditions of foreign dividends are checked against the specific company, shareholding ratio and income year. If the conditions of repeated Article 20/D are present, a different result may arise. [1], [5], [7]
4.8. A Türkiye-Resident Person Buys and Sells Shares on a Foreign Stock Exchange
Taxable event: the realization by sale of a taxable capital gain; merely holding the shares does not always give rise to a gain on sale. It cannot be assumed that shares on a foreign exchange are subject to the same withholding or exemption regime as securities on the Turkish exchange. The conversion of purchase and sale amounts into Turkish lira, the cost and indexation conditions, commissions, the income year and, where applicable, the capital gains article of the treaty are examined. The GİB ruling on the sale of shares of a US company shows that the details in the capital gains article of the treaty may change the result. [1], [11]
4.9. A Türkiye-Resident Person Sells Real Estate Abroad
Taxable event: the capital gain realized by transfer of the property and taxable under domestic law. The taxing authority in the source country, the holding period in Türkiye and the conditions for exemption from tax, the purchase price/cost, the sale date and, where applicable, the ÇVÖA are assessed separately. The fact that the property is in a foreign country does not provide an automatic tax exemption for Türkiye, nor does never bringing the sale proceeds to Türkiye by itself remove the declaration obligation. [1], [7]
4.10. A Foreign Person Who Is a Limited Taxpayer in Türkiye Receives a Pension from Abroad
For a pension paid solely from a foreign country, if the person is not resident in Türkiye and there is no income derived in Türkiye, there may as a rule be no subject for Turkish income tax. However, if the person is a full taxpayer in Türkiye, or if the payment is subject to separate treaty articles such as public service pension / private sector pension, the tax result may change. There is no general rule that all pensions are exempt in every country. [1], [7]
4.11. A Foreign Company Operates in Türkiye Through a Branch, Workplace or Permanent Representative
Taxable event: the arising of profit attributable to the commercial activity in Türkiye. Under Article 3 of the Corporate Tax Law (KVK), institutions whose legal and business centers are both outside Türkiye are limited taxpayers in respect of the income they earn in Türkiye. The permanent establishment and business profits articles of the ÇVÖA may limit Türkiye’s taxation of the profit or restrict it to the profit attributed to the permanent establishment. The mere presence of customers in Türkiye does not constitute a permanent establishment in every specific case; on the other hand, actual management, authority to conclude contracts, a fixed place and the duration of the activity may matter. [3], [7]
4.12. A Company in Türkiye Opens a Branch Abroad and Earns Business Income
Taxable event: the arising of the foreign branch’s period profit within the framework of the relevant law and accounting/taxation rules. The worldwide income of an institution whose legal or business center is in Türkiye is generally assessed under the KVK. All the conditions of the statutory exemption for foreign workplace profit, the credit of tax paid in the foreign country under Article 33 of the KVK, the position of losses and the treaty articles are examined separately. The payment of tax in the country where the workplace is located does not reduce Turkish corporate tax to zero in every case. [3]
4.13. A Company in Türkiye Receives Dividends from Its Foreign Participation
Foreign participation earnings may be exempt under Article 5 of the KVK if the conditions are met; otherwise, inclusion in general corporate income and credit of foreign taxes come into play. The existence of the exemption cannot be decided without checking the concrete conditions provided in the law, such as the participation ratio, the holding period, the nature of the investee institution, the foreign tax burden and the transfer of the income to Türkiye. In addition, the controlled foreign corporation (CFC) provisions may in some cases lead to a tax result in Türkiye even without actual profit distribution. [3]
4.14. If You Manage Real Estate in Türkiye from Abroad and Let It on a Short-Term Basis
Calling the income "rent" does not always determine the result. Continuous short-term accommodation, and the organization of cleaning, handover and re-use between customers, may turn into a commercial activity. In the GİB ruling dated 18 December 2025, this distinction was explained with respect to the short-term and organized letting of real estate abroad. The same method should be assessed separately, according to the specific activity conditions, for real estate in Türkiye and limited tax liability. [12]
4.15. If You Transfer Your Own Savings or Inheritance from Abroad to Türkiye
The bank transfer itself is not an event giving rise to income tax. On the other hand, if the amount transferred is in reality wages, interest, rent, dividends, a gain on sale, an inheritance or a gift, it may give rise to a different type of tax and a different legal consequence. In particular, for inheritance or gifts, inheritance and transfer tax is examined separately on the basis of the event of succession, not the transfer. The explanations of this article on ÇVÖAs, which are centered on income and corporate tax, do not apply automatically to inheritance and transfer tax. It is important to preserve records showing the source of the income or succession. [2], [5]
4.16. If You Are a Freelancer or Digital Entrepreneur Working in More Than One Country
In which country the income is derived is assessed according to where the work is actually carried out, the fixed base for independent professional activity, whether it is a company/sole proprietorship, actual business management, the contract and invoicing arrangement, the formation of a permanent establishment and the business profits or independent personal services article of the relevant ÇVÖA. That the invoice address is abroad, or that there is a foreign bank account or the formation of a foreign company, does not on its own move all taxing authority abroad. In unsuitable arrangements, VAT, transfer pricing or disguised-establishment risks may also arise. [1], [3], [4], [5]
5. The 20-Year Foreign-Source Income Tax Exemption Introduced in 2026 (GVK Repeated Article 20/D)
5.1. Who Can Benefit?
The basic framework of the exemption, added by Law No. 7582 of 21 May 2026 and applicable to those who are considered resident in Türkiye as of 1 January 2026 under repeated Article 20/D of the GVK, is as follows: the beneficiary must be a natural person; in the last three calendar years before being considered resident in Türkiye, he or she must have had no domicile or (apart from the exceptions in the law) tax liability in Türkiye; the earnings and receipts subject to the exemption must have been derived outside Türkiye; and an application must be made and an exemption certificate obtained. Turkish or foreign citizenship is not by itself a reason for being able or unable to benefit. Companies cannot benefit from this personal exemption for corporate tax purposes. [1], [5], [6]
5.2. Does Earning Income in Türkiye in the Previous Three Years Completely Bar the Exemption?
Not every type of income produces the same result. Having had a tax liability before entering the exemption on account of rental income from real estate, income from movable capital or capital gains derived in Türkiye is not by itself an obstacle under the article. By contrast, in situations such as a tax liability in Türkiye in the previous three calendar years on account of business income or wages, an exemption certificate may not be issued. Communiqué Series No. 333 contains separate examples showing both possibilities. In calculating the previous three years, it is not the year in which one is first considered resident in Türkiye but the three calendar years before that year that are examined. [5]
5.3. Why Are the Application Date and the Exemption Certificate Decisive?
5.3.1. The General Application Period and Where to Apply
According to Communiqué Series No. 333, the application must, as a rule, be made to the tax office competent to assess by the end of the calendar year in which one is considered resident in Türkiye.
5.3.2. The Special Period for Those Who Become Resident in the Last Two Months of the Year
For persons who are considered resident in the last two months of the year, the application period is until the end of the second month of the following calendar year. The tax office issues the certificate after checking the relevant conditions. In the example in the communiqué, it is expressly stated that an exemption certificate is not issued if a person presumed to meet the statutory conditions misses the period. For this reason, the information that "there is a 20-year exemption" does not on its own replace the application and certificate obligation. [5]
5.4. Which Earnings Fall Outside the Exemption? The Importance of Work Done in Türkiye
The exemption relates to earnings and receipts derived outside Türkiye. For example, dividends that a person holding a valid exemption certificate derives from a company in Spain, or rent from a house in Monaco, may fall within the scope of the exemption under the example conditions in the Communiqué. However, if the same person receives rent from a property in Türkiye or provides consulting services to a foreign customer while residing in Türkiye, the tax liability continues in respect of Türkiye-source income. Resolving the matter solely by the foreign address of the payer, instead of the actual place of performance of the service, is legally wrong. [5]
5.5. The Effect on the Return, Expenses and Tax Paid in a Foreign Country
No annual income tax return is filed for foreign earnings and receipts within scope; if a return is filed because of other income, exempt earnings are not included in that return. Expenses and costs relating to the exempt earnings cannot be deducted in calculating other earnings taxable in Türkiye. Tax paid abroad on account of exempt earnings also cannot be credited against other income tax in Türkiye. The taxation of that income by the foreign State is a separate matter; the exemption relates only to Turkish income tax. [1], [5]
5.6. If the Conditions Are Later Lost or Misdeclared
If it is later established that the conditions of the exemption did not exist from the outset, the certificate may be cancelled under the communiqué and a tax loss penalty and late-payment interest may be applied to the tax that was accrued short. In addition, if the person later ceases to be considered resident in Türkiye, the position of non-Turkish income with respect to Türkiye changes within the general rules of full tax liability. For this reason, the three-year tax history before the exemption, the source of income, the place of actual work and residence data should be documented. [5]
5.7. Three Short Practical Examples of the Exemption
Example A — The exemption may come into play: A person considered resident in Türkiye for the first time in 2026, who had no domicile and no obstructing tax liability in Türkiye in 2023–2025, obtained an exemption certificate on time. Rent derived from his or her residence abroad may, if the other conditions are also met, be exempt from income tax in Türkiye under repeated Article 20/D.
Example B — The exemption does not apply to work done in Türkiye: The same person provides consulting services to a foreign customer while working in Antalya. Because the service is provided in Türkiye, the income cannot be treated as exempt merely on the basis of the customer’s being abroad.
Example C — If the application period is missed: A person who applies in the years following the year of residence may, even if he or she satisfies the substantive conditions, be unable to benefit from the exemption certificate because of the time condition in Communiqué Series No. 333. [5]
6. How Are Double Taxation Treaties Applied?
6.1. First, Entry into Force, Date, Scope and Contracting Countries Must Be Determined
A tax treaty with a country having been signed is different from its having entered into force. According to the Revenue Administration’s announcement of 30 September 2026, 93 of the 108 ÇVÖAs concluded by Türkiye are in force. These figures are the administration’s statement as of the date of publication; the final text of the relevant treaty in force in the period in which the person’s income was derived is the basis. The information in the earlier article that "49 of 60 treaties are in force" and the description that a uniform result arises for all countries are neither current nor legally reliable. [8]
6.2. Which Articles of the Treaty Are Looked At, in Order?
The general order of review is the persons and taxes within the treaty’s scope; residence; permanent establishment; the article specific to the type of income; the article on elimination of double taxation; exchange of information and the mutual agreement procedure. For example, income from immovable property, business profits, dividends, interest, royalties, capital gains, employment income, income of artistes/sportspersons, pensions and income from government service may be regulated in different articles. Rates, definitions and limitations may vary from country to country. [7]
6.3. Taxation Only in the Source Country, Only in the Residence Country or in Both Countries
A treaty rule of the form "shall be taxable only in ... State" often limits the other State’s treaty-based power to tax that income. A rule of the form "may also be taxed in the other State" generally indicates that both countries may have the power to tax under certain conditions. In that case the scope of the residence State’s credit/exemption obligation is determined separately. For a transaction with no domestic law tax, a treaty does not by itself impose a new tax; treaties essentially limit and allocate powers that exist in domestic law. [1], [7]
6.4. Residence Certificate, Beneficial Ownership and Documentation
To benefit from a treaty, the source country’s administration may request a residence certificate, an explanation concerning the beneficial owner of the relevant income, company and workplace records or other supporting documents. In Türkiye, an application for a residence certificate can be made through the GİB’s digital services. If ordinary statutory withholding has been applied in the source country, the procedures and time limits provided by the relevant country for using the lower treaty rate or recovering over-withheld tax should be researched separately. [10], [11]
7. What Is Done If Tax Arises in Two Countries? Exemption, Credit and Refund
7.1. The Credit Method: How Is Tax You Paid Abroad Taken into Account in Türkiye?
7.1.1. Credit Can Be Linked Only to the Same Foreign Income
Under Article 123 of the GVK, similar taxes levied on income and paid in a foreign country on the earnings and receipts derived abroad by full-taxpayer natural persons may be credited up to, but not exceeding, the income tax in Türkiye attributable to that foreign income. Proof that the tax was actually paid is required by the official documents the law specifies. If the foreign tax is higher than the tax in Türkiye attributable to that income, the excess amount cannot, as a rule, be deducted from Turkish income tax. The special method provided by the relevant treaty is assessed separately. [1]
7.2. A Numerical Example: Exactly How Much Credit Is Applied?
On an entirely hypothetical basis, where the total income tax calculated in Türkiye is TRY 300,000, the portion attributable to foreign rental income is TRY 80,000, and the tax properly paid abroad on the same rental income is TRY 50,000, a credit of TRY 50,000 may come into play if the other conditions are met. If the foreign tax were TRY 110,000, the TRY 30,000 amount exceeding the TRY 80,000 limit attributable to Turkish tax in the example cannot be automatically deducted from the tax on other income in Türkiye. This example is not an actual tariff, tax rate or calculated taxpayer liability; it is only to explain the upper limit of the credit. For exempt income under repeated Article 20/D of the GVK, foreign tax is not credited in Türkiye. [1], [5]
7.3. The Exemption Method and the Risks of Incorrect Credit
Under some treaties and domestic law provisions, income may be exempted in the State of residence entirely or under certain conditions. Exemption and credit cannot be used in place of one another. For example, it may not be possible to deduct tax withheld in a foreign country on foreign income exempted from tax in Türkiye from the tax on other rental or wage income in Türkiye. It must be clearly shown to which income and period the documents relate. [1], [3], [5]
7.4. Credit for Foreign Tax in Corporate Tax
Article 33 of the KVK regulates, within its conditions, the credit against the tax calculated in Türkiye of corporate tax and similar taxes paid at source on income earned in a foreign country and transferred to the general result accounts of the institution in Türkiye. This credit must be assessed together with the exemption for foreign participation earnings, controlled foreign corporation or ÇVÖA provisions. For a natural person Article 123 of the GVK, and for a company Article 33 of the KVK, is the basis. [3]
8. What Documents Are Needed to Prove Tax Residence and Foreign-Source Income?
8.1. Groups of Documents for Natural Persons
- Residence certificates in Türkiye and the foreign country, the date range and the periods they cover.
- Domicile records, entry-exit data, residence records in the foreign country; information on actual housing, family and center of life.
- Employment contract, the employer’s residence, place of duty, travel/working days and payrolls.
- Title deed of the property, lease agreement, collection/account movements, expense invoices.
- Bank interest and dividend statements, foreign withholding and tax payment documents.
- Purchase/sale documents for shares or real estate, cost and exchange rate records.
- The text of the relevant ÇVÖA, the treaty scope, the rate applied and, if any, the refund/application file.
- If a repeated Article 20/D claim is made, records for the previous three calendar years, a timely application and the exemption certificate.
8.2. Additional Groups of Documents for Companies
The company’s legal and business center, trade registry, management decisions, contracts concerning the workplace and permanent representative status, foreign branch/participation information, financial statements, foreign tax accrual/payment documents, distribution decisions, transfer pricing documents and records showing where actual management decisions are taken should be assessed. [3]
8.3. Is Tax Withheld in a Foreign Country Sufficient Evidence on Its Own?
A bank movement showing that a deduction was made is not the same as an official document showing what tax was actually paid to the foreign State. Article 123 of the GVK provides for proof of foreign tax by documents obtained from the competent authorities and certified in the manner the law requires for the credit. The relevant ÇVÖA and administrative practice may affect the form in which the document is presented. A document list should be prepared transaction by transaction and application periods should not be missed. [1]
9. Can VAT, Withholding and Other Taxes Arise Separately from Income Tax?
9.1. Income Tax and VAT Are Not the Same Tax
A transaction’s being exempt for income tax or corporate tax purposes does not automatically remove the VAT, withholding tax, stamp tax or another tax relating to that transaction. VAT Law No. 3065 separately regulates the taxation of deliveries and services made in Türkiye, whether the service is regarded as performed or utilized in Türkiye, imports and the service export exemption. For consulting services provided abroad, an automatic result of the form "the customer is foreign, so all taxes are zero" cannot be built. [4]
9.2. Withholding and Final Tax Must Be Distinguished
Withholding made in the source country may in some cases be the final taxation of the income; sometimes it is linked to the annual return. Application of a lower rate under a treaty and the refund procedures in the country’s domestic law are different. The fact that withholding has been made in Türkiye does not in every case make a declaration or treaty review unnecessary in respect of a foreign resident. [1], [3], [7]
9.3. Automatic Financial Information Exchange Is Not "Automatic Taxation"
Foreign account information may be obtained within the framework of tax administrations’ information exchange obligations; this flow of information does not mean that all money entering the account is regarded as taxable income. The legal nature of the income, the taxable event, tax liability and the documents are examined. The risks relating to money movements whose source cannot be explained should be assessed separately in terms of compliance and tax audit.
9.4. If a Person Benefiting from the 20/D Exemption Acquires Property by Inheritance, Does Inheritance Tax Arise?
Yes, the income tax exemption does not automatically remove inheritance and transfer tax. Under the provision added to Article 16 of Inheritance and Transfer Tax Law No. 7338 by Article 2 of Law No. 7582, a rate of 1% tax applies to the transfer of property by inheritance, within the period provided for the exemption, to persons benefiting from the income tax exemption under repeated Article 20/D of the GVK. This provision is not an exemption that removes the tax altogether but a special rate rule for certain persons and for transfers by inheritance; gratuitous gifts, different dates, exemption amounts, territoriality and declaration obligations are assessed separately. The existence of an income tax exemption does not mean that ownership or inheritance does not require tax review. [6]
10. Returns, Time Limits, Criminal Risk and Remedies in Double Taxation
10.1. Income of Which Year Is Declared, and on What Date?
As a rule, the principles relating to the calendar year apply to income tax and those relating to the accounting period to corporate tax. The obligation to file an annual return, withholding, special taxation, monetary limits and exemptions may vary for different income items. The year in which income is earned and the year of declaration and payment do not have to be the same. While the 2026 rules apply to income earned in 2026, the declaration calendar should be determined according to the provisions for the relevant type of income and the later period. In this article, instead of generalizing fixed monetary thresholds that have become outdated, the official limits of each specific year are the basis. [1], [3]
10.2. What Can Incomplete Declaration or Incorrect Application of an Exemption Lead To?
Where income actually earned in Türkiye is presented as "foreign," foreign tax is credited without documentary proof, or the application conditions of repeated Article 20/D are wrongly asserted, a risk of additional assessment, a tax loss penalty, late-payment interest and dispute may arise. In each case, the administration’s findings, limitation periods, proper notification, material basis and defense opportunities should be assessed separately. If there are separate conditions constituting a criminal allegation, they are examined separately. [2], [5]
10.3. When Does the Mutual Agreement Procedure (MAP) Come into Play?
10.3.1. The Legal Basis and Timing of the Application
If it is asserted that taxation contrary to a ÇVÖA has been or will be carried out, or that there are strong indications of this, an application for the mutual agreement procedure may come into play under additional Article 14 and following of the VUK. The application period is first of all the period determined in the relevant treaty; if the treaty contains no period or refers to domestic law, the general three-year criterion in the law is important. The effect of a MAP application on the time limit for filing suit and its other procedural consequences should be separately assessed within the framework of additional Article 15 and following of the VUK; it should not be thought that this route will provide an automatic solution in all tax and penalty disputes. [2], [7]
10.3.2. Assessing MAP and the National Time Limit for Suit Together
The effect of a MAP application on domestic remedies should be checked from the file at every stage; the periods arising when the dispute is resolved, the request is rejected, or no agreement is reached between the competent authorities should be separately monitored.
10.4. Assessment in Türkiye and Refund Routes in the Foreign Country
For an assessment made in Türkiye, options such as an administrative application, correction of a tax error, settlement (uzlaşma) or the tax court route each have their own conditions and periods. For withholding in a foreign State that exceeds the treaty, it may be necessary to apply to that country’s refund and objection procedure. Which authority the documents will be submitted to, on what date and on what legal ground should be planned case by case. Periods that may lead to loss of rights should not be determined by relying on a general article alone. [2], [7]
11. Taxation Checklist: How Do You Reach a Definitive Result for an Item of Income?
11.1. Questions to Ask in Order in the Preliminary Assessment
- Is the person who earns the income a natural person or a company; to which tax period does the income belong?
- Under which country’s law is the person or company a tax resident / full or limited taxpayer?
- Is the income wages, self-employment, business income, rent, interest, dividends, a gain on sale or another item?
- In which country, and by reason of which concrete activity or asset, did the taxable event occur?
- Is the bank where the payment is made the same as the country in which the activity/property/workplace is located?
- Is there a ÇVÖA in force and applicable between the relevant countries for the income year?
- Does the treaty grant the power to tax to one State, to the source State in a limited manner, or to both States together?
- Is there repeated Article 20/D of the GVK, a special income/corporate tax exemption or a condition of leaving out of the declaration?
- Is the tax paid in the foreign country eligible for credit and is the proof available?
- Does VAT, withholding, inheritance and transfer tax or another separate obligation arise?
- Which period is running for the declaration, exemption certificate, refund, correction, suit or MAP application?
- Are the contracts, tax documents, residence, payment and work records that will support the result of the review complete in the file?
12. Conclusion: The Right Question on Foreign-Source Income Is Not "Where Is the Money?" but "Why Does Tax Arise?"
The starting point of a double taxation review in Türkiye is the country in which the taxpayer is resident and the legal nature of the income. Tax does not arise merely because of a remittance from a foreign bank to Türkiye or because a person carries a Turkish or foreign passport. Once the income item, the taxable event and the territorial connection are established, the domestic law exemptions, the relevant ÇVÖA and the credit provisions are applied. It is possible for two States to have the power to tax the same income; the treaty may share these powers and provide mechanisms that reduce the duplicate burden.
The repeated Article 20/D exemption of the GVK introduced by the 2026 regulation offers an important opportunity for the income that certain natural persons earn outside Türkiye. However, it should not be applied without examining the conditions of the previous three years, the date of residence, the application period, the exemption certificate and especially that the income has been actually earned outside Türkiye. Those who earn rent, interest, dividends, wages and gains on sale abroad and those who provide services to a foreign company from Türkiye are not in the same legal position. The right result can be reached only by assessing the country, type of income, period, treaty article and documents together.
13. Frequently Asked Questions
Does everyone living in Türkiye pay tax on foreign income?
No. Full tax liability is the general principle that brings worldwide income within the tax assessment; however, the type of income, declaration provisions, the ÇVÖA, domestic law exemptions and the conditions of repeated Article 20/D of the GVK in 2026 may change the tax result. [1], [5]
Does receiving dollars or euros in my bank account in Türkiye give rise to income tax?
A remittance does not by itself give rise to income tax. Whether the money is wages, rent, interest, self-employment income, a gain on sale, an inheritance or personal savings, and where it was earned, is examined. That payment for a service performed in Türkiye comes from a foreign bank does not remove the tax analysis. [5]
I stayed in Türkiye for fewer than 183 days; do I definitely not pay tax?
No. The domicile and six-month criterion in the GVK, the cases not considered residence, and the 183-day wage test, if any, in the relevant ÇVÖA are different. A short stay also does not by itself eliminate limited tax liability in respect of rent or other income earned in Türkiye. [1], [7]
If I paid tax abroad, do I have to pay again in Türkiye?
A definitive result cannot be given. Both the source State and Türkiye may have the power to tax. The relevant treaty and the exemption-credit methods under Article 123 of the GVK/Article 33 of the KVK are examined. There are situations in which the amount of credit is limited to the tax in Türkiye attributable to that income. [1], [3]
Does a double taxation treaty cover all taxes?
No. Which persons and which taxes the treaty covers is shown in its own scope articles. Provisions on income and, in some treaties, on wealth taxes do not automatically regulate VAT or inheritance and transfer tax. [7]
If there is a double taxation treaty, is tax payable in only one country?
No. For some income, authority may be given to only one State; for other income, such as dividends, interest or income from immovable property, both countries may have the power to tax within certain limits. The excess tax burden can be eliminated by exemption or credit. [7]
Will a foreign person who moves to Türkiye in 2026 pay no tax for 20 years?
No. Repeated Article 20/D is an income tax exemption only for the earnings and receipts that a natural person who meets the conditions derives outside Türkiye. Income in Türkiye, other taxes and persons who do not meet the conditions are outside its scope. An exemption certificate must be obtained on time. [5]
I had rental income in Türkiye before moving to Türkiye; can I not benefit from 20/D?
Repeated Article 20/D of the GVK expressly provides that having had a tax liability on account of rental income from real estate, income from movable capital or capital gains earned in Türkiye before coming within the scope is not by itself an obstacle. By contrast, a tax liability in the previous three years with certain other types of income may upset the conditions. [1], [5]
Does a person who provides services to a foreign customer from Türkiye benefit from 20/D?
Not merely because the customer is foreign. Self-employment or business activity actually performed in Türkiye may, according to the example in the Communiqué, be regarded as income earned in Türkiye. The conditions are examined on the basis of the specific activity. [5]
Does a Turkish citizen living in Germany file a return in Türkiye?
No general result can be built by looking at citizenship. Whether the person is resident in Türkiye, the exception in Article 3/2 of the GVK, the income earned in Türkiye and the treaty provisions are decisive. The existence of Türkiye-source income may require a declaration or withholding assessment for a limited taxpayer. [1]
If I don’t bring my company abroad’s profit to Türkiye, does no tax arise?
It should not be forgotten that the company is a separate taxable subject from the natural person shareholder’s income. For Turkish corporate tax, the company’s legal/business center, the accrual of income, receipt of dividends from a foreign participation, the participation exemption and the controlled foreign corporation rules may each produce separate results. Not physically bringing the money to Türkiye does not by itself eliminate all tax risk. [3]
Which route is taken if tax has been withheld contrary to the treaty?
The refund/correction route in the foreign source country, statutory credit or the dispute route in Türkiye and, in appropriate cases, the mutual agreement procedure (MAP) may be considered. The period, the subject of the application and its effect on the time limit for filing suit should be specially examined. [2], [7]
Does the 20/D income tax exemption also apply to property received by inheritance?
The income tax exemption and inheritance and transfer tax are separate taxes. However, Article 2 of Law No. 7582 provides that persons benefiting from the exemption under 20/D are subject to a 1% inheritance and transfer tax rate on transfers of property by inheritance during the exemption period. This provision does not make all property transfers tax-free; the scope of the specific inheritance, the exemption amounts and the declaration obligation are examined separately. [6]
