Summary

Detection, evidence, notification and recourse for marine pollution fines imposed on ships and yachts. Documents to review and legal distinctions when preparing an objection.

Under Environmental Law No. 2872, the basic time limit for bringing an action against a marine pollution administrative sanction is 30 days from the notification of the decision, and the competent branch of the judiciary is the administrative judiciary. Bringing an action does not automatically stop collection. For this reason, when a penalty record is issued, not only the pollution allegation but also the notification, the correct respondent, the security and the navigation ban (seyrüseferden men) measure should be examined together.

Success against a marine pollution fine does not depend on a single defense sentence such as “no sample was taken” or “the boat was for private use.” The evidence showing from which vessel, where and when the act originated is examined, together with whether the sub-paragraph of the Law that was applied matches that evidence.

Which Fine Has Been Applied for Which Act

Article 20/ı of the Environmental Law regulates different categories for tankers, ships and other marine vessels, such as petroleum and its derivatives, dirty ballast, domestic wastewater, washing water and solid waste. Bilge water and detergent-containing deck washing water should not be assessed under the same sub-paragraph or with the same calculation method. Writing “dirty water” in everyday language in the record does not remove the need to make the legal classification separately.

For small marine vessels, there are fixed tonnage bands for some discharges, while a graduated gross tonnage (groston) calculation applies to other categories. Boat length in meters and gross tonnage are different measures. The correct data in the vessel license (ruhsatname) or the tonnage certificate (tonilato belgesi) should be used. It is wrong to use the historical base amount in the Law directly as the current fine.

For 2026, Communiqué No. 2026/1, published in the Official Gazette (Resmî Gazete) No. 33123 dated December 30, 2025, is used as the basis. The calculation should be made from the correct row of the supplementary table for the relevant year. It is not possible to state the fine amount as a single “per boat” figure; the act, tonnage, addressee, area and grounds for increase change the result.

Increases and Reductions Are Reviewed Separately

The relevant sub-paragraphs of the Law provide for a triple amount for institutions, organizations and enterprises. The double amount provision for Special Environmental Protection Areas (Özel Çevre Koruma Bölgeleri) is also significant. These provisions should be assessed according to the place of the event and its addressee; whether the boat is used for a private purpose and whether the owner is a company are different questions.

Repeat offense (tekerrür), discharge of hazardous substances and the special provisions on remediation of the pollution are also examined separately. For a ship that remediates the pollution with its own means, under the conditions stated in the Law, application of the fine at one-third may come into question. Presenting a general cleaning invoice afterwards does not, by itself, prove that these conditions were met. The relationship between the detection and the cleaning must be documented.

Assessment of the Record and the Evidence

In the inspection record, the date, time, coordinates, identity of the ship, form of observation and the act detected are examined. Which boat the photograph shows, the source of the flow seen in the image and the other vessels present at the time of the event are significant. Wind and current may make it necessary to distinguish between the spread of the pollution and the source boat.

Sampling and laboratory analysis may be important in determining the type of pollution. However, it is not correct to say that the absence of a sample is an automatic ground for annulment in every event. The observable nature of the act, video, official records and other evidence are assessed together. On the other hand, relying only on abstract observation on a matter that requires technical detection can be argued concretely.

The boat’s waste delivery documents, tank capacity, pump records, maintenance status and navigation data can support the defense. Waste having been delivered beforehand does not by itself refute all later discharge allegations. The defense should be tied to the time of the event and the act alleged. Where it is claimed that the boat was not at the scene, the accuracy of the position records and the time zone are checked. For the environmental obligations at shipyards and haul-out yards, see our separate review.

September 2026 Update on Waste Delivery Records

Maritime Waste Practice Circular No. 2026/12 dated September 9, 2026 updated the waste delivery arrangement within the scope of the Mavi Kart (Blue Card) System. In the official announcement of the İMEAK Chamber of Shipping (İMEAK Deniz Ticaret Odası) dated September 10, 2026, it is stated that an 80% tank fill level is the priority criterion for delivery; when this level is not reached, periods of 20 days for vessels with a capacity of fewer than 12 persons and 15 days for those with a capacity of 12 persons or more apply. The obligation is related to the time spent under way in maritime jurisdiction areas; the former rule of delivery before the voyage has been abolished.

For foreign-flagged boats, the stay and use regime should also be taken into account. If the date of the event is after September 2026, assessments that apply the old periods unchanged should be examined separately. An allegation of violating the waste delivery calendar remains separate from an allegation that a discharge into the sea actually took place. A violation of the current recording obligation does not, in every case, by itself prove from which boat a particular discharge was made.

For details on the subject, see the section on yacht law in Türkiye, flag, taxes and import transactions.

Time Limit for the Action, Notification and the Correct Respondent

The special 30-day period in Article 25 of the Environmental Law applies; the general time limit for administrative actions or the time limits for applications before the criminal judgeship of peace (sulh ceza hâkimliği) cannot be used in its place. In electronic notification, the date on which notification is legally deemed made and the date on which the message was actually seen may differ. The calculation of the time limit should be made from the notification file.

Article 24 of the Law provides that actions against administrative fines imposed under this Law are to be directed at the Ministry; the special exceptions in the Law are also reserved. The fact that the marine pollution fine was issued by another institution to which inspection authority has been delegated does not make the review of the respondent unnecessary. The scope of the delegation of authority and the authority that signed the sanction must also be checked.

In the petition, concrete unlawfulness is shown in terms of competence, form, reason, subject matter and purpose. Differences between the record and the decision, a wrong addressee, a wrong tonnage, a source of pollution that was not sufficiently determined and an erroneous calculation can be explained under separate headings. It should not be assumed that the time limit for the action is automatically extended because of an information request or discussions with the administration.

Collection and the Navigation Ban

Bringing an action does not stop the collection of the fine. If a stay of execution is requested under Article 27 of the Administrative Procedure Law (İYUK), manifest unlawfulness and damage that is difficult or impossible to remedy must be substantiated together. Instead of the mere statement that the fine is high, documents showing the financial and operational impact should be submitted.

Article 20/ı of the Environmental Law provides for a ban on navigation and activity where there is no immediate payment in full or sufficient security. The provision on a bank letter of guarantee or the letter of the relevant club insurer is significant in this administrative process. This measure differs from the precautionary attachment ordered by a court for a private-law claim under the Turkish Commercial Code (TTK).

The conditions and period for discounted payment are also checked separately. Within the framework of Article 17/6 of the Misdemeanors Law, payment does not remove the right to apply to a legal remedy. However, the action or the follow-up of the security file should not be abandoned on the assumption that a bank transaction has been made. In the event of annulment, a claim for refund and, where applicable, interest is assessed separately.

The Safeguard of a Reasoned Decision from the Constitutional Court’s Perspective

In the Constitutional Court’s (Anayasa Mahkemesi, AYM) decision Düzgit Yalova Gemi İnşa Sanayi A.Ş., Application No. 2013/8756, April 15, 2015, a violation was found because the main defenses raised against a zoning sanction concerning a shipyard were not answered with sufficient reasoning. This decision does not concern a marine pollution fine and does not change the competent court in environmental cases.

The aspect of the decision that can be transferred to this field is the need for technical and legal claims that may change the result to be answered in the judicial reasoning. Leaving essential claims, such as the source of the pollution or a wrong tonnage, unanswered can, if the conditions are met, be examined from the standpoint of the right to a fair trial. An individual application does not replace the ordinary legal remedies; the admissibility conditions and the time limit after the final decision must also be protected.

For details on the subject, see the section on the yacht maintenance and refit contract.

What the Initial Application File Should Contain

  • The decision imposing the fine, the inspection record and the notification documents.
  • Photographs, videos, position and weather records, and a chronology of the event.
  • The registry record or vessel license, the tonnage certificate and the documents of the owner or operator.
  • Waste delivery, tank, pump and maintenance records and, where available, laboratory records.
  • A calculation of the fine compared with the 2026 tariff, and the grounds for the increases.
  • Payment, security and navigation ban documents.

When preparing the file, the originals of the records should be preserved, and an explanation created afterwards should be kept separate from the records dated at the time of the event. If an insurance notification exists, the exclusions for administrative fines in the policy should also be examined separately; it cannot be assumed that yacht insurance covers all fines.

For details on the subject, see the section on permits, environmental impact assessment (ÇED) and operation process in establishing a marina and yacht harbor.

Conclusion

An effective application against a marine pollution fine is a file that protects the time limit and examines the act and the calculation together. The identity of the boat, the source of the pollution, the correct tariff and the competent authority should be examined with concrete evidence. The action, the payment and the boat’s continued navigation are separate but coordinated steps.

Frequently Asked Questions

Is an Application Against a Marine Pollution Fine Made Before the Criminal Judgeship of Peace

An action is brought before the administrative court within 30 days against a sanction within the scope of Article 25 of Law No. 2872.

If No Sample Was Taken, Is the Fine Certain to Be Annulled

No. The nature of the act and all the evidence are assessed together.
