Enforcement Proceedings and Debt Collection Process

Starting proceedings as a creditor and taking action against a payment order or enforcement order as a debtor require different routes. Enforcement under a judgment, without a judgment and special enforcement procedures are not subject to the same rules.

Review the steps, the necessary preparation and the key distinctions together.

ENFORCEMENT AND DEBT COLLECTION / PROCESS GUIDE

How do enforcement proceedings and the collection process proceed?

The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.

  1. Choosing the claim and the enforcement route

The underlying document, the debtor, whether the debt is due, and the nature of the judgment or instrument are examined. Enforcement under a judgment, enforcement without a judgment through general attachment, negotiable instruments, eviction or another special enforcement route is distinguished.

  2. Enforcement request and official notification (tebligat)

The appropriate enforcement is initiated. The payment order or enforcement order and the service record are examined; the debtor’s authority of application and time limit are determined according to the enforcement route.

  3. Objection, complaint and interim protection

The effect of an objection on the proceedings is not the same in every proceeding. Where necessary, routes such as removal/annulment of the objection, a complaint or a stay of enforcement are assessed.

  4. Attachment or carrying out what the decision requires

Once the conditions of the proceedings are met, attachment, delivery, eviction or the step the judgment requires is carried out. Exemption from attachment and the rights of third parties are handled separately.

  5. Sale and distribution, if necessary

If the claim is not satisfied by payment and the conditions are met, the stages of valuation, sale and distribution of the proceeds may arise. A sale is not made in every proceeding.

  6. Collection, accounting and closing

The amounts collected, enforcement expenses, the remaining balance and attachments that must be lifted are checked. The closing of the enforcement file and, if any, other obligations are followed.

THIS DISTINCTION MATTERS

Do not overlook the conditions specific to your matter.

A payment order, an enforcement order, an objection to the debt and a complaint are not the same thing. Send all pages of the document and the service record without delay; a general seven-day period does not apply to all proceedings.
