ENFORCEMENT AND DEBT COLLECTION / PROCESS GUIDE

How does it proceed, step by step?

The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.

  1. The enforceability of the judgment and, if necessary, whether it has become final are checked.

  2. The enforcement request and enforcement order are prepared; notification is made.

  3. A complaint, a stay of enforcement or other appropriate applications are assessed according to the specific ground.

  4. What the judgment requires is carried out; accounting and closing procedures are completed.

THIS DISTINCTION MATTERS

Do not overlook the conditions specific to your matter.

As in general enforcement without a judgment, an automatic stay is not to be expected by filing an objection to the debt with the enforcement office. The authority under Enforcement and Bankruptcy Law (İİK) Art. 36 is assessed according to the current provision.
