CIVIL LAWSUITS / PROCESS GUIDE

How does it proceed, step by step?

The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.

  1. The consumer transaction, the value of the claim and the jurisdictional limit of the arbitration committee on the date of application are determined.

  2. If the arbitration committee has jurisdiction, the application and evidence are submitted; the other party’s response and, if needed, an expert examination are assessed.

  3. The committee decision is served; the possibility of objecting to the court within the time limit and the enforcement of the decision are examined.

  4. Where the court route is required, mediation as a condition precedent to litigation is assessed, subject to exceptions.

  5. If no agreement is reached, the proceedings before the consumer court under simplified procedure, the decision and the available legal remedy are followed.

THIS DISTINCTION MATTERS

Do not overlook the conditions specific to your matter.

The arbitration committee and the court are two alternative starting routes; not every consumer file passes through both in sequence. Mediation is not a condition of suit for an objection to an arbitration committee decision.
