An inheritance transfer that cannot be completed often does not rest on a single cause. A missing identity link, an incorrect inheritance share, an insufficient power of attorney, a tax transaction, a lack of shared intent or a restriction on the asset may combine in the same file. The solution is to determine the legal cause of the obstacle before preparing all the paperwork again.
Missing documents must be distinguished from a dispute over rights
A missing apostille or translation can be completed. However, two people claiming the same inheritance share, or a document lacking the character of res judicata, cannot be resolved with a new apostille. An institution’s failure to act sometimes results from insufficient documents and sometimes from the fact that the authority to decide lies with the court. [1] [2]
The date of the first application, the documents submitted and the result requested are recorded. Instead of an oral “it can’t be done” statement, a reasoned written reply is requested. If the reply shows which document fails to meet which condition, the correction can be more targeted.
Common obstacles
| Obstacle | Preliminary review | Likely solution |
|---|---|---|
| Name or date mismatch | Original records and translations | Record correction or identity link |
| Missing heir | Family chain | New document or annulment/correction |
| Effect of a foreign document | Issuing authority and finality | Application to the appropriate court |
| Insufficient power of attorney | Comparison of the transaction with the authority | New or supplementary power of attorney |
| Tax obstacle | Declaration, assessment, payment | The relevant tax procedure |
| Disagreement among heirs | Ownership and type of claim | Representation, mediation or lawsuit |
| Attachment, pledge, injunction | Record and basis | Process with the creditor or the court |
Not every solution applies to the whole file. For example, obtaining a new certificate of inheritance does not remove a mortgage; and the signature of all heirs does not remove the restriction on acquisition that applies to a foreign national.
Bank, land registry and notary refusals are not resolved in the same way
At a bank, payment may be held up because of documents or joint entitlement; a dispute over the bank contract may be a matter for private-law remedies. At the land registry, an administrative refusal differs from an ownership dispute over who the immovable property belongs to. A notary’s inability to draw up a document requires, in some cases, an application to the civil court of peace. [3] [4]
The court with subject-matter jurisdiction, the application period and the condition precedent to litigation are determined by the type of refusal letter. The same action cannot be filed directly before the civil court of first instance for every institutional refusal. A renewed application does not stop the running of the existing objection or litigation period in every case; the date of notification must always be recorded.
How are assets and time limits protected during the delay?
While waiting for the transfer, rent, tax, insurance, company payments or investment risk may continue. Transactions that are necessary for protection must not be confused with partition or personal disposition. If the estate may be indebted, the time limits for disclaimer and for the official estate inventory are tracked separately. [6]
If there is a concrete risk of loss of assets, an interim injunction, preservation of evidence or measures to protect the estate are considered. The request explains which asset the risk concerns and what harm the delay would cause. Instead of the general statement “the assets may be spirited away”, evidence such as records, transactions or correspondence is submitted. [1]
Scope of the written reply to be obtained from the institution
The reply should be requested to contain the application number, the missing document, the legal basis, the manner of completion and, if any, the avenue of recourse. If the institution asks for the same document again, proof of the earlier delivery is submitted. If the translation is said to be incomplete, the institution is asked to explain which page or point is missing.
If the representative has changed, the entire file history is handed over. Several applications made to the same institution without knowledge of one another may create conflicting instructions. Communication and responsibility should be kept in a single tracking chart; however, the personal information of all heirs must not be sent to unauthorized persons.
Five questions are answered in the initial review
Which institution stopped the transaction, which asset is affected, which document is regarded as missing, the date of refusal or notification, and the desired final result are recorded together. The statement “the inheritance transaction cannot be carried out” is not enough on its own to choose the right application. The bank may not be giving information; it may be giving information but not paying; the land registry, on the other hand, may accept heirship but see an obstacle to the sale of the immovable property. In each case the legal problem to be resolved is different.
Proof of delivery of the application file is important. The list of enclosures, the application number and the reply received are kept. If the institution later claims that it never received the document, the delivery record is relied on; if it claims that the document is insufficient, the content of the document is discussed. These two responses are not answered in the same way.
Is it necessary to complete a document or to obtain a court decision?
A wrong date in the translation of a death certificate is a correctable document problem. The absence of a child from the certificate of inheritance, on the other hand, may require the circle of heirs and the shares to be determined anew. A dispute over whether the immovable property actually belonged to the decedent is something different again. Trying to resolve a question of right that falls outside the institution’s authority with a new notarial approval wastes time. [6] [3]
That a foreign document bears an apostille may satisfy only the certification aspect. The res judicata character of the document, the usability of its content in Türkiye and any special regulation for the land registry are examined separately. If the court considers it necessary, the content in force of the foreign law and the way it is applied are investigated. The system in Article 2 of the Law on Private International and Procedural Law (MÖHUK) does not require a short internet printout submitted by a party to be accepted as sufficient in every case. [2]
How is the reply to the institution’s objection prepared?
In the reply petition, each of the institution’s grounds is addressed separately. If it is said that “the power of attorney is insufficient”, the requested transaction is compared with the relevant authority in the power of attorney. If it is said that “there is no tax clearance”, the institution is asked which statutory condition is being applied to the registration of the transfer, a subsequent sale or a cash payment. Articles 17 and 19 of the Inheritance and Transfer Tax Law (VİVK) regulate different types of transactions; a single payment precondition cannot be imposed on all transactions. [7]
The institution may have grounds relating to security or to protecting the rights of third parties. If, on the other hand, the relationship between the requested document and the transaction cannot be explained, it is requested that the ground be made concrete. The applicant’s aim is not merely to have the refusal letter lifted but to obtain a workable route for the transaction. For this reason it should also be asked to which stage one will proceed after the document proposed for completion.
Urgent protection and the dispute on the merits can be pursued together
While the correction of the certificate of inheritance is under way, if there is a risk that money will be withdrawn from the bank account or the immovable property will be transferred, an appropriate protective measure may be considered separately. With regard to the conditions for an interim injunction under Article 389 et seq. of the Code of Civil Procedure (HMK), the claim to a right and the danger are made concrete. A precautionary attachment for a monetary claim and the protection of the property in dispute are not the same legal institution; the route suited to the type of request is chosen. [1] [8]
If there is a risk of loss of evidence, preservation of evidence may come onto the agenda for account movements, contracts or digital records. Appointment of an estate representative is also a separate route to be considered where the heirs cannot act together. The appointment of a representative does not mean that the sale of all the assets is automatically permitted; the limits of duty and authority matter. [6]
Sample resolution chart
Suppose that the surname of one of three heirs abroad is written differently in the documents, that payment has stopped at the bank because of a missing identity link, and that in the same file there is a mortgage on the house. Completing the identity link may advance the bank’s review. But this step does not remove the mortgage. The debt and the conditions for deletion (terkin) are discussed separately with the mortgage creditor. If an heir does not consent to the sale, a representation or partition dispute is assessed separately.
In this example, managing the file under a single “missing paperwork” label hides three different problems. For each obstacle the responsible person, the required document, the authority to apply to and the expected result should be written down. The final check does not consist merely of whether a new court decision or a refusal reply has been obtained: it is made by confirming the payment of the money, the updating of the land registry and the status of the outstanding debt.
Implementation of the solution and closing
When the obstacle is removed, it is verified that the institution has actually completed the transaction. The issuance of a court decision, the correction of the land registry record, the lifting of a block or the payment may not occur at the same time. A new record, a bank receipt (dekont) or a proof of delivery is obtained. If there is a claim of loss arising from the delay, separate evidence and legal grounds are assessed.
How is a land registry directorate’s refusal decision objected to?
Article 26 of the Land Registry Regulation (Tapu Sicili Tüzüğü) provides that, where a request is refused for reasons such as non-conformity with the legislation, the ground and the avenue of recourse must be stated in the decision. An objection may be filed against the refusal decision with the relevant regional directorate within 15 days of notification, and against that decision with the General Directorate within 15 days of notification. The notification dates of the two stages must be recorded separately. TKGM, Land Registry Regulation.
This administrative objection regime does not replace all the lawsuits that may be filed to determine to whom the immovable property belongs. Review of the refusal act and a claim concerning heirship, share or cancellation of title are different legal problems. The competent judicial branch, the type of action and the time limit cannot be determined solely from the information that “the land registry refused”. It should not be assumed that submitting documents to the institution again automatically stops all judicial time limits.
What details should be sought in the refusal letter?
The block/parcel and independent unit details of the immovable property, the application number, the requested transaction and the document on which the refusal is based must be clear. A request for registration of the transfer is not the same as a request for a sale. In a tax-based ground too, it must be determined which transaction cannot be carried out because of which provision. When replying to the ground for refusal, instead of repeating the whole family history, the relevant document and provision are matched to each ground.
Oral guidance is distinguished from a refusal decision that has been duly notified. If there is doubt as to the time limit, the effect of the existing notification or of learning of the decision is assessed separately while awaiting the written reply. A conversation for which there is no application record may not suffice to show the content of the act in an objection made later.
Does a notary’s inability to issue a certificate of inheritance remove the inheritance right?
No. Article 71/B of the Notaries Law (Noterlik Kanunu) regulates the cases in which a notary cannot issue the document, such as where population records are insufficient, where the certificate of inheritance is requested by foreign nationals, or where adjudication through means such as experts or witnesses is required. This is not a judgment that the person is not an heir. An application to the appropriate court is prepared. Notaries Law.
In the court file, the chain of death, parentage, marriage and name change must be established without gaps. That a person’s name in a foreign passport and that person’s former record in Türkiye belong to the same person can be shown with official documents. The competent authority, the certification route and the translation of a document issued in a foreign country are checked. An apostille does not correct a gap in parentage or a record belonging to the wrong person.
How is the request made concrete in the court route?
The issuance of a certificate of inheritance, the annulment/correction of an existing document and the determination of the effect of a foreign decision are distinguished from one another. The nature of the request changes who the parties will be and which documents will be examined. The need for a document usable in Türkiye does not require the same recognition action to be filed for every foreign document. An action should not be chosen solely on the basis of a document’s title without looking at its legal nature and the relevant special regulation.
Court of Cassation example: Foreign inheritance document and review of a missing party
In its decision dated December 23, 2024, E.2024/4288, K.2024/5906, the 7th Civil Chamber of the Court of Cassation (Yargıtay 7. Hukuk Dairesi) discussed the proper composition of the parties and the legal conditions at different dates of death, in the context of the annulment of a recognition decision concerning a foreign inheritance document. The failure to carry out the necessary review with respect to all the persons concerned and the failure to sufficiently investigate the conditions to be applied according to the dates of death led to reversal. Official decision link.
The reciprocity review in the decision, tied to the 1943 and 2003 dates of death, does not mean that the same historical condition will be applied to every foreign heir today. The changes made to the Land Registry Law (Tapu Kanunu) over time and the date of transfer must be distinguished. The decision is also not a general judgment that all foreign inheritance documents are invalid. The concrete ground for the reversal is the completion of the necessary investigation of the parties and of the law.
The practical conclusion to be drawn from this example is that asking for more documents at the outset is not always an unnecessary delay. A file pursued with an incomplete circle of heirs may lead to the decision obtained being reversed later and the transactions returning to the beginning. On the other hand, not every additional document the institution requests is automatically regarded as mandatory; the legal ground of the request and its connection with the requested transaction must be shown.
Does one obstacle have to stop all the assets?
The investigation of the acquisition condition of one immovable property does not necessarily require all transactions to wait for an undisputed right at another bank. However, a partial transaction must not contravene the co-ownership rights of the other heirs or a protective order. The file is separated asset by asset; it is determined which transaction can be completed independently and which depends on a common document.
For example, if the identity link is a common obstacle for all institutions, this record is resolved first. If only the deletion of the mortgage on a single immovable property is in dispute, the information and tax procedures for the bank account may proceed in parallel. On the other hand, if an error in shares in the certificate of inheritance affects the entire distribution, making a final payment may give rise to new problems of recovery. This distinction reduces the processing time while also limiting the risk of an erroneous distribution.
A usable tracking chart
| Obstacle | Action to be taken | Success criterion |
|---|---|---|
| Identity/surname link | Official record and correct translation | The institution’s acceptance that it is the same person |
| Missing heir | Application to the appropriate court | Correct heir/share document |
| Land registry refusal decision | Reasoned objection within the time limit | Removal of the ground for refusal and registration |
| Bank payment obstacle | Entitlement and representation file | Documented payment to the correct account |
| Injunction or attachment | Supporting file and appropriate application | Lawful lifting of the relevant record |
A responsible person, a delivery date and a deadline should be added to the table for each row. Statements such as “given to the attorney” or “waiting at the institution” are not, on their own, a traceable result. Which document has been submitted and what the next step is should be visible. In the final stage, by obtaining a new land registry record, a bank receipt or a proof of delivery, it is checked whether the legal solution has actually been implemented.
Conclusion
When the transfer comes to a halt, the most effective method is to separate the obstacle under the headings of document, right, representation, tax and record. The right application route and a concrete list of deficiencies reduce unnecessary repetition and ensure that the result is actually completed.

Frequently Asked Questions
The institution refused orally; should I file a lawsuit?
If possible, a written ground and a list of deficiencies should be obtained first; urgent time limits are protected separately.
Does a renewed application stop the litigation period?
Not in every case. The effect on time limits of the relevant transaction and avenue of recourse is examined separately.
Do all obstacles disappear once a power of attorney is given to an attorney?
Representation is secured; missing entitlement, tax or acquisition conditions must still be completed.
If a decision has been issued, is the transfer finished?
The implementation of registration, payment or delivery must be checked separately.
What is the period for an administrative objection to a land registry refusal decision?
Under Article 26 of the Regulation, 15 days from notification to the regional directorate; against that decision, an objection may be filed with the General Directorate, again within 15 days of notification.
If the notary does not issue the document, am I not an heir?
That conclusion does not follow. Where the notary lacks authority or the records are insufficient, the court route is considered.
Does an apostille correct a missing heir?
No. Correcting entitlement is different from the certification procedure.
Does an obstacle on a single immovable property stop all transactions?
Not always. Transactions that can be carried out independently are separated, taking co-ownership rights and protective orders into account.
