Summary

Assessing together the blocking of access to assets, waiver under pressure, secure communication, lawful collection of evidence and protective measures.

Blocking access to bank information, preventing work through pressure, forcing someone into debt and compelling someone to give up property rights can, in some events, be part of economic violence. Not every financial dispute is of the same nature; the form of the conduct, its continuity, the pressure it creates and its effect on the person’s safety must be assessed together. In these situations, preparing for property division cannot be limited to drawing up a list of assets.

Which Need Should Be Determined First?

If there is an urgent danger or a need for safe housing and communication, these are addressed first. In an emergency, help can be sought through 112 and the competent law enforcement units. Returning to a dangerous environment to collect documents, confronting the other party or making contact that would violate a protection order is not recommended. A person’s safety should not be postponed for the sake of completing economic evidence.

Law No. 6284 defines violence within a framework that also covers forms of economic harm and pressure. Depending on the circumstances of the specific case, avenues such as protective and preventive measures, temporary financial assistance, suitable housing, and restrictions on communication and approach are assessed. Which measure is to be requested from which authority must be determined separately. [5]

How Are Asset Protection and Personal Safety Measures Addressed Together?

Protecting the person, protecting the family’s economy and securing the liquidation claim are different legal purposes. The limitation of the power of disposition under Article 199 of the Turkish Civil Code, separation of property on a valid ground under Article 206 and the interim injunction in procedural law do not automatically replace one another. The request must clearly show the risk, the asset or transaction, and the measure sought. [1, 3]

ProblemMatter to be assessed first
Threat or imminent dangerPersonal safety and applicable protective measures
Disposition endangering the family’s economic assetsStatutory protection conditions over specific assets
Continuous concealment of income and debt informationReview of information, evidence, inventory and change of regime on a valid ground
Having a protocol signed under pressureFree will, the scope of the document and the time limits for application
Emptying of accountsPurpose of the transaction, evidence, value to be added back and suitable interim protection

Which Documents Can Be Preserved Safely and Lawfully?

Bank documents in the person’s own possession, correspondence sent to the person, contracts the person signed, official application records and documents on the payments made can be organized. The original of the document, its date and how it was obtained should be preserved. No cutting or addition that changes the meaning should be made to a record; if necessary, explanations should be kept separately.

Is Entering a Spouse’s Account or Phone Without Permission a Solution?

No. A property division claim does not make unauthorized access to a personal account or uncontrolled data collection permissible. Article 189 of the Code of Civil Procedure imposes a limitation on evidence obtained unlawfully. Requesting from the court the relevant records held by banks, the land registry, companies and other institutions may, depending on the circumstances of the case, be the appropriate route. [3]

The lawfulness of a secret audio or video recording is also not the same in every case. No general permission to record should be inferred from the article. The circumstances of a suddenly developing event, other possibilities of proof and personality rights are assessed separately.

How Is Secure Communication Planned?

At the first consultation, the person should be asked from which phone or email address they can safely communicate, whether a message can be left, and whether the other party has access to shared devices. The secure communication preference should be recorded in the file; document submissions should be carried out in line with this preference. If there is a shared cloud account or automatic document syncing on a family device, it should be assessed whether this puts the person at risk.

A web form should not ask for an account password, a recovery phrase, or unnecessary identity and child information. The initial form should collect only the information necessary for the review; detailed documents should be received through an appropriate and secure channel. The information and documents shared should be kept confidential, personal data should be protected, and they should be used only for the legal assessment and the service within the scope of the authorization.

Does a Protocol Signed Under Pressure Always Produce a Final Result?

The nature of the document, the conditions in which it was signed, the statements in court, the scope of the judgment and any defect of intent that can be raised are examined together. That it was signed does not remove every objection; nor does a later allegation of pressure render the document invalid by itself. The provisions of the Turkish Code of Obligations on defects of intent and the procedural rules applicable to the specific transaction are assessed. [2, 3]

Threatening messages, earlier protection applications, the conditions to which payment or the handing over of documents was made subject, and information on the signing process may be important. The time limits and the correct avenue of application should be examined without delay; a general approach of “we will have it cancelled later” is not safe.

How Is a Mediation or Settlement Meeting Assessed?

Under Article 1 of Law No. 6325, disputes involving an allegation of domestic violence are not suitable for mediation. This rule should not be disregarded by using the heading of assets. The safety of any other meeting to be conducted through attorneys and the person’s free will must also be considered separately. A joint meeting or direct confrontation should not be imposed as an automatic solution. [4]

Which Avenues Are Considered for a Person Without Financial Means?

Legal aid in court and the bar association’s legal aid mechanism for attorney services are separate applications. The ability to pay litigation costs, the person’s income and expenses, the assets the person can access and the conditions of the request should be explained with the relevant documents. The difference between apparently owning an asset and actually being able to access it can be shown concretely. The conditions and scope of legal aid are assessed according to the authority to which the application is made. [3]

Which Information Should Be Shared First at the Initial Consultation?

  • The secure method of communication and whether there is an urgent danger.
  • Protection orders, alleged violations and earlier applications.
  • An upcoming sale, money transfer or pressure to sign.
  • The documents in hand and the records that cannot be accessed.
  • Any signed protocol, waiver or debt documents.
  • Income, livelihood and the need for legal aid.

The aim of legal preparation is to protect the person’s rights and evidence without putting the person in further danger. The property division strategy should be built together with safety and confidentiality needs.

Frequently Asked Questions

Is My Spouse Hiding Asset Information Economic Violence?

Not every information dispute is of the same nature on its own. The effect of the conduct on pressure, control, economic harm and safety is examined. In addition, the consequences under property regime law of refusing to give asset information are assessed separately.

Should I Return to a Dangerous Environment to Get My Documents?

No. In imminent danger, safety comes first; for urgent help, 112 and the competent law enforcement may be contacted. Obtaining missing records through institutions or the court should be considered.

What Should I Do if I Signed a Property Division Protocol Under Pressure?

The document, the conditions of signing, the statements in court and the time limits should be examined without delay. Lawful records showing the pressure should be preserved. A signature does not prevent every objection; nor does an allegation of pressure render the document void by itself.

Can a Dispute Involving an Allegation of Domestic Violence Be Taken to Mediation?

Under Law No. 6325, disputes involving an allegation of domestic violence are not suitable for mediation. Using the heading of assets does not remove this limit. The person’s safety and free will should be considered in other meetings as well.

Which Information Should I Not Share When Sending Documents to the Office?

Account passwords, private keys and recovery phrases should not be written into general communication channels. The documents necessary for the review should be shared by a secure method; unnecessary personal data and child information should not be added to the initial form.

Documents for Preparing for the Consultation

To record your assets and debts separately, organize the dates of events and identify missing documents, you can use the asset and debt inventory, the timeline of events and payment dates, and the preparation form for the first attorney consultation. These working documents do not by themselves constitute an action or a calculation of a legal time limit.

This article is for general legal information. In a specific dispute, the dates of the events, the documents, the type of claim and the time limits are assessed together.
