We explain developments, their legal meaning and the next step together.

The purpose of keeping you informed is not only to share a date or a document. It is to explain what has happened in the file, what it means for you and which step will be taken in an understandable way. This guide explains the communication and preparation process in the files handled by our firm.

PREPARING FOR HEARINGS AT GÜNEŞ & GÜNEŞ

Preparing for hearings thoroughly and carefully is a basic rule of our firm.

This preparation is a regular working practice that our firm follows every week. The hearing files for the following week are placed on the preparation agenda one week in advance. The files are reviewed and the steps to be taken are planned together with the attorneys who will attend the hearings under the leadership of our founding attorney Umut Güneş. For time-limited steps and urgent developments, we do not wait for the week of the hearing; the weekly preparation is part of the ongoing follow-up of the file.

01 · FILE REVIEW

Documents are reviewed and steps are completed.

All documents received in the file and the latest developments are reviewed. The work and steps that need to be done are completed; the petitions that must be filed are submitted to the court before the hearing, taking the relevant procedure and deadlines into account.

02 · HEARING PLAN

Our attorney attends the hearing prepared.

For the attorney who will attend the hearing, hearing notes covering the current status of the file, the points to be emphasized and our requests are prepared. Attending the hearing prepared, defending our client’s rights and interests with care, and presenting statements and requests clearly and effectively are the basic duty and responsibility that each of our attorneys undertakes.

03 · CLIENT AND WITNESS ATTENDANCE

We let you know in advance when attendance is needed.

If our client’s attendance is required, the client is informed in advance. If a witness is to be heard, our client is informed; witnesses receive an explanation of the hearing date, place, attendance and procedure. It is essential that witnesses describe truthfully what they themselves saw and know; the content of their statements is not directed.

04 · FOLLOW-UP AFTER THE HEARING

We share the record and follow up on what needs to be done.

Hearing records are sent to our clients through suitable communication channels, including, in particular, clients who did not attend the hearing. Assignments are made for the steps required by interim decisions, and the steps are carried out within the deadlines. The documents needed from our client are stated clearly; obtaining them and submitting them to the file is followed up.

For clients who will attend the hearing

When your attendance is needed, we inform you in advance and explain the place and time of the hearing and the necessary preparations.

Our firm’s briefing

  • Date, time and place: The court, file number, courthouse and, if any, courtroom details are confirmed.
  • Purpose of the hearing: Whether it is a preliminary examination, witness hearing, report review or decision stage is explained.
  • Your attendance: Whether you need to come in person, and any special summons, are assessed together.
  • What to prepare: The documents requested, statements, any costs and steps that need to be completed are communicated.

Keep your contact details up to date. Notify us of any change of telephone, email or address. Tell your attorney without delay about any payment, settlement offer, correspondence with the other party or new event that occurs before the hearing.

Do you need to attend the hearing?

Having an attorney present does not, in every case, remove your obligation to attend. The summons and the court’s decision are what count.

In civil cases

In many hearings followed through a representative, you may not need to be present in person. However, you may be summoned personally for steps such as questioning of a party (isticvap), the oath or being heard in person. Pass the warning in the summons on to your attorney; do not decide not to attend without confirmation.

In criminal cases

Attendance rules differ depending on whether you are the defendant, complainant, victim or intervening party (katılan). A defendant’s presence at the hearing and exemption from attending the hearing are subject to separate procedures. Do not assume that you are automatically exempt from attending because you are represented by an attorney.

If you have been summoned as a witness

Send us the summons and the information about the call. Describe truthfully the events you saw and know; do not guess about matters you do not remember. If you have an excuse or need to refuse to testify, ask for a legal assessment in advance.

Do not wait if you will be unable to attend. Send us your reason and any supporting document. Notifying an excuse does not mean it has been accepted or that the hearing has been postponed; the court decides.

Hearing day

  1. Be at the courthouse with enough time to spare.Allow time for security screening and for finding the building and courtroom; bring your ID with you.
  2. Confirm the contact and meeting details of the attorney attending your hearing. There may be delays at the hearing time. Follow changes in the order and courtroom; do not leave without telling us.
  3. Answer openly and truthfully when you are given the floor.Ask for any question you do not understand to be explained. Do not argue with other people; follow the court’s order.
  4. Do not take photographs or audio or video recordings.Do not share hearing recordings or personal information about the file on social media.

Tell us about your special needs in advance.

Interpreter, hearing or mobility support, health condition and security concerns should not be left to the last day. Let us assess together how the need will be conveyed to the court.

In files involving the hearing of children, closed hearings or special protection, attendance and accompaniment conditions are determined separately. A relative’s coming does not mean that the relative will necessarily be admitted to the courtroom.

Tell us whether you prefer Turkish, English, German or Russian for communication. If you are abroad, share your travel plan, your time zone and the hours you can be reached. Do not confuse Türkiye time with the time in the country where you are. Do not make assumptions about travel or remote connection until the form of attendance is settled.

Where an application to the court may be needed for security or health reasons, send the relevant document in advance; what arrangement can be made is assessed according to your file.

What will you learn after the hearing?

Alongside the shared hearing record, we explain what developments mean for you and the next steps.

What happened?

The matters discussed, the people heard and the interim decisions given by the court are explained. A postponement of the hearing does not by itself mean a favorable or unfavorable outcome.

What should you do?

Any information, document, payment or approval requested from you is communicated, to the extent necessary, together with the deadline and the method of submission.

What is the next stage?

The expected step is stated, such as a new hearing, expert examination, on-site examination, response from an authority or reasoned judgment. There may be no new development in the file during each waiting period.

What happens if a decision has been given?

The outcome of the decision, its reasoning, the availability of legal remedies, deadlines and any enforcement effect are assessed together. A decision being given, becoming final and being enforceable are not the same thing.

If the record or briefing has not reached you, let our firm know. Ask for attachments you could not open to be resent and for anything you did not understand to be explained.

The date of the next hearing is not the deadline for all steps. Deadlines for submitting documents, objecting or using legal remedies may expire earlier. Send our firm all pages of the notification, the date it was delivered and its envelope, if any.

Online meeting and remote hearing

Two different arrangements, with different conditions for participation.

Video meeting with your attorney

To review your file and prepare for the hearing, a scheduled meeting via WhatsApp or Zoom can be held. The meeting method, time and documents to be shared are settled in advance.

This meeting is not a court hearing and does not replace your obligation to attend court.

Remote participation in court

e-Hearing (e-Duruşma) or the audio-visual information system (SEGBİS) is conducted within the framework of the relevant procedure and the court’s decision. An attorney’s participation by e-Hearing does not mean that the client can also connect from home.

The place and method of participation are confirmed separately for your file. If you have technical problems, tell your attorney immediately.

Ministry of Justice e-Hearing information (opens in a new tab)

In your request, state the name of the responsible attorney notified to you and your file number.

  • Court and file numberIf you do not know them, briefly write the subject and the name of the other party.
  • What you want to find outAsk clearly about the latest step, the hearing outcome, an awaited document or the decision stage.

How should you assess the UYAP record?

You can check the information you can access about files in which you are a party through the UYAP Citizen Portal. The scope of access may vary depending on the type of file and authorization.

A step name or a “closed” entry on the screen may not, by itself, explain the legal consequence of a decision. Ask your attorney what it means; checking the portal does not replace file-specific monitoring of legal deadlines.

Do not share your e-Devlet password, your electronic signature password or one-time codes.

Frequently asked questions

Do I have to attend every hearing in person?

No; but the answer depends on your capacity in the case, the step to be taken and the court’s summons. Confirm your attendance status with your attorney for your specific file.

The hearing was postponed. Is there a problem with my case?

A postponement may be due to a missing document, a witness, a report or another procedural step. It does not by itself show that the case has been lost or will be won. Find out the reason for the postponement and the new stage.

What should I do if I fall ill on the day of the hearing?

Call our firm and send the situation and any document you have without delay. Submitting a medical certificate does not by itself mean the excuse is accepted; the court’s decision and the guidance on your file are what count.

Can I learn the outcome of the hearing on the same day?

Information is provided according to the availability of the record and the decision and the necessary legal review. If an urgent step is needed, it is communicated separately. A fixed time or same-day report of the outcome cannot be guaranteed for every file.

If a decision has been issued, is the file completely over?

Not always. The reasoned judgment, notification, legal remedies, finalization and enforcement of the decision may be separate stages. Find out which step remains in your file and the deadlines.

Is it enough to bring a new document on the day of the hearing?

Send the document at the earliest possible stage. Bringing it to the hearing does not mean it has been submitted to the court within the time limit and in the proper manner. Deadlines for submitting evidence are assessed separately.

Can my family or a company employee get information about my file?

Identity, authority of representation and, if necessary, authorization are confirmed. Being a family member or an employee does not by itself give a right of access to file information. Tell our firm who you want us to communicate with.

If I have no hearing, is nothing being done on my file?

No. Petitions, notifications, reports, correspondence with authorities and review of decisions can progress outside hearings. In some files the review is conducted on the documents. You can ask about the latest step and the stage that is awaited.
