Imposing a penalty on a foreign-plated vehicle, placing the vehicle under customs supervision and seizing the vehicle in a criminal investigation are different measures. The correct route of challenge is determined not by what the report is called in everyday language but by the authority that issued the decision, its legal basis and the result sought. In most files, the objection to the monetary penalty and the request for the vehicle’s release should be pursued together but on separate grounds. [1, 2, 3]
The first task is to collect all decisions and service records. The time limit should not be calculated from a parking receipt or an oral statement by law enforcement alone. A penalty, a tax assessment, customs custody, judicial seizure and disposal proceedings may all be present in the same file; the effect of each must be examined separately.
The difference between administrative detention, judicial seizure and confiscation
Because of a breach of the temporary import conditions, a vehicle may be placed under supervision until customs formalities are completed. This does not mean that ownership of the car has definitively passed to the State. The relevant administrative procedure is carried out for the release of the vehicle, its re-export or its subjection to another customs procedure. [1, 4]
Judicial seizure, on the other hand, is a protective measure applied within a criminal investigation or prosecution. Article 127 of the Code of Criminal Procedure (CMK) governs the authority competent to order seizure and judicial supervision; Article 131 governs the return of property that no longer needs to be kept or that turns out not to be subject to confiscation. An objection may be lodged against the refusal of a request for return. [3]
Confiscation is a legal consequence separate from seizure as a protective measure. Moreover, the disposal of a vehicle does not always show that a criminal court has issued a final confiscation order. The specific legal basis of the disposal, its service and any possibility of providing security must be examined separately. It also cannot be accepted that the same provisions automatically apply to a car alleged to be the subject of an offense and to a vehicle used to carry other smuggled goods.
This distinction directly affects the competent authority. Requesting the lifting of a judicial seizure order from the customs directorate, or objecting to a customs tax penalty only in the prosecutor’s file, does not replace the other application that is required.
What should be checked in the report and the penalty decision?
First, the alleged act must be identified: Is it a failure to leave within the period, use by an unauthorized person, departure abroad leaving the vehicle behind without notification, or an allegation of a deceptive act at entry? The basis and proof for each differ.
The date, place, driver, permit holder, plate and chassis details in the report should be compared. The vehicle’s first entry date, extension decisions, the recorded final date and the manner of use at the time of detection should be added to the file. There may be a difference in terms of evidence between a vehicle found parked and a vehicle stopped while actually being driven.
In the penalty decision, the article and subparagraph applied, the person to whom the penalty is addressed, the calculation base, the amount and the route of appeal must be identified. If action has been taken against more than one person for the same incident, or for more than one act, each decision is examined separately. In files where the owner, the permit holder and the driver are different persons, liability must be individualized; not everyone connected with the vehicle automatically becomes the addressee of the same penalty.
For use violations, the date of the act is also important. Because the use rules changed on August 14, 2026, the list of drivers in an old internet article cannot be made the sole basis for a current incident. Conditions such as the presence of the permit holder in the vehicle and the residence abroad of the other driver should be compared with the current text. [4, 5]
Which penalty amounts may apply in 2026?
The basic irregularity amount in the first paragraph of Article 241 of Law No. 4458 is TL 1,494 for 2026. At certain levels of overstay, multiples of this amount apply. The table below gives only a calculation summary for personal vehicles that meet the relevant conditions of the stated acts; it is not the tariff for all customs violations. [1, 6]
| Situation | Basis | Calculation for 2026 |
|---|---|---|
| Departure with a delay not exceeding one month after the end of the permit | Art. 241/3-l | 2 × 1,494 = TL 2,988 |
| Departure with a delay exceeding one month but not exceeding two months | Art. 241/4-g | 4 × 1,494 = TL 5,976 |
| Departure with a delay exceeding two months but not exceeding three months | Art. 241/5-b | 6 × 1,494 = TL 8,964 |
| Departure abroad without the required notification while the vehicle is left in Türkiye | Art. 241/6-e | 8 × 1,494 = TL 11,952 |
| Regime violation under Art. 238/1-b for a personal vehicle | Arts. 238/1-b and 238/3 | One quarter of the customs duties; the statutory lower limit applies separately |
In the penalty for a vehicle for private use under Article 238 of the Law, “one quarter of the customs duties” and “one quarter of the value of the vehicle” are not the same. The duties taken as the basis of the calculation and their legal basis must be examined. Because the lower limit in Article 238/3 of the Law is tied to the Article 241/6 amount, it is TL 11,952 in 2026. [1, 6]
For an overstay of more than three months, the relevant provision of Article 238 may come into play. However, no conclusion should be drawn from the number of days alone without examining the permit period, any proper extension, the date of the act, and the dates of detection and departure. Treating a calendar “month” as always equal to a fixed thirty days is also not a correct method of calculating a period.
For departures without the vehicle and without notification, Article 27 of the Communiqué provides that departures made until detection are treated as a single act. This provision does not mean that all new violations after detection will also be covered by a single penalty. The tax assessment and the administrative fine are also separate financial measures. [1, 4]
How is an administrative objection to a customs penalty made?
Under Article 242 of the Customs Law, customs duties, penalties and administrative decisions that have been served may be objected to within fifteen days of service before a higher authority, or, if there is none, before the same authority. There is a protective provision on forwarding to the competent authority a petition submitted to the wrong authority within the period. Even so, the application must be made to the right authority and in a provable manner. [1]
The objection should include the date and number of the decision, the date of service, why the act did not occur or why the calculation is wrong, the supporting documents and a clear request. A petition limited to the statement “I do not accept the penalty” may fail to set out the concrete errors on residence, use and period calculation.
Objections are decided and served within thirty days after reaching the administration. If no reply is given, or if only a notice that the review is continuing is given, the implied rejection and the time limit for filing suit must be assessed separately. Waiting for a letter from the administration should not be regarded as an unlimited right to wait. [1, 2]
When objecting to the penalty decision, a separate request may also be needed concerning the vehicle’s current status. Questions should be put in writing: Where is the vehicle being kept, once which procedure is completed will it be delivered, how will it leave the country, and is there a risk of disposal? Filing an objection petition does not by itself create authority to take the car back.
Which court and within what period should the application be made?
For customs duties and the related monetary penalties, the competent administrative court is approached after the administrative application under Article 242. In disputes within the jurisdiction of the tax court, the general time limit for filing suit is thirty days. If a separate administrative act that is not of a tax nature is involved, the competent court and the time limit may be assessed differently; the general time limit for administrative courts is sixty days. Special provisions are reserved. [1, 2]
| Subject of the application | Basic route | Starting check for the general time limit |
|---|---|---|
| Customs duty, penalty or administrative decision | Objection under Customs Law Art. 242 | 15 days from service |
| Act within the jurisdiction of the tax court | Suit after administrative objection | As a rule, 30 days starting from the day after service of the rejection decision |
| Separate administrative act | Administrative suit according to jurisdiction and special application provisions | Where there is no special provision, the general 60-day period is examined separately |
| Judicial seizure order of a judge or court | CMK objection | Where there is no special provision, two weeks from learning of the decision |
The table should not be used to determine the last application day without seeing the actual service. The effect of electronic service, holidays, settlement, silence and earlier applications should be entered into the file’s calendar. The administrative and judicial routes may proceed together for the same vehicle.
The decision of the 7th Chamber of the Council of State (Danıştay) dated March 13, 2025, E.2023/1907, K.2025/1150, shows the importance of the time limit for filing suit in a dispute arising from the use of a foreign-plated vehicle. The decision is a rejection on the time-limit point under review; it should not be presented as a general endorsement on the merits of a use violation. [7]
Does filing suit stop collection and the holding of the vehicle?
Under Article 27(4) of the Administrative Procedure Law (İYUK), as a rule, filing suit in disputes arising from tax matters stops the collection proceedings for the part under dispute of the assessed tax and of the surcharges and penalties on the related financial obligations. The law provides exceptions for returns filed with a reservation of rights, collection proceedings and other stated cases. Generalizations such as “a tax suit never stops any collection” or “in every suit all proceedings stop” are therefore incorrect. [2]
The stopping of collection proceedings is not the same result as the release of the vehicle from customs. For the separate administrative act concerning the vehicle, it may be necessary to request a stay of execution. In administrative litigation, the conditions of manifest unlawfulness and of damage that is difficult or impossible to remedy are assessed together. Where there is a judicial seizure, recourse must also be had to criminal procedure for that measure. [2, 3]
How to choose between settlement and objection
For receivables falling within Article 244 of the Customs Law, a settlement application may be considered. The current provision allows a settlement request, within a fifteen-day period from service, for taxes and penalties that have not yet been objected to or whose objection has not yet been concluded. The application affects the time limits; how the remaining period will run if the settlement is not reached is calculated separately. [1]
The statutory exclusion for acts connected with smuggling offenses should be kept in mind. A settlement record has final consequences; the possibility of suit and complaint against the matters agreed upon does not continue in the same way. Moreover, settling on a monetary penalty does not show that the delivery of the vehicle, the closing of its record or its departure abroad has been completed. [1]
The decision should therefore not be made solely on the basis of the rate of reduction. The basis of the penalty, a concrete legal assessment of the chances of winning or losing, the time limits and the procedure to be followed for the vehicle should be considered together. The effect of making a payment on the rights of application should also be checked according to the payment and remedy used.
Is every regime violation a smuggling offense?
No. The elements of an administrative regime violation and of the offense of smuggling are assessed separately. In the decision of the 11th Criminal Chamber of the Gaziantep Regional Court of Appeal dated June 2, 2020, E.2019/3112, K.2020/685, the acquittal was upheld on the finding that there was no evidence in the specific case showing intent to smuggle. As to the vehicle, the judgment was corrected so that it would be delivered to the registered owner on the condition that it be taken out of the country after customs formalities are completed. [8]
This result does not mean that unauthorized use is without sanction or that every criminal file will end in acquittal. Acts and conduct that mislead the customs administration from the outset should not be treated as the same as a use or period violation that emerges later. The old penalty calculations in the decision likewise cannot be used in place of the 2026 amounts.
In the decision of the 7th Criminal Chamber of the Court of Cassation (Yargıtay 7. Ceza Dairesi) dated April 29, 2025, E.2021/3574, K.2025/6072, the majority ruled that the public prosecution be dropped because of the statute of limitations and that the vehicle be handed over to customs so that it could be returned to its owner through an administrative procedure under customs legislation. The detailed assessment in the decision on confiscation is the dissenting opinion. It would be wrong to present the reasoning of the dissent as the definitive result of the majority. [9]
These decisions show that the end of criminal proceedings does not always end customs formalities at the same time. In the specific file, the administrative sanction, the tax and the conditions of delivery must be addressed separately.
Which steps are needed to recover the vehicle?
In a request for return or delivery, a list of all the obstacles on the vehicle should be drawn up. The penalty decision, customs supervision, judicial measure, disposal proceedings, proof of ownership and the authority of the person taking delivery are each checked separately. The removal of one obstacle may not automatically remove another.
Delivery from customs does not always mean free use in Türkiye. The vehicle may be delivered only to be taken out of the country or for certain customs formalities to be completed. The special periods that may be granted for transfer from an inland customs office to a border customs office should not be construed as a general, automatically arising right to additional stay. [4]
For storage and warehouse costs, an itemized calculation and a legal or contractual basis should be requested. The customs penalty, towing fee, parking fee and tax should not be confused with one another. When the vehicle is taken back, the state of damage, mileage, keys and documents should be checked against a record.
If the vehicle must be removed by transport, the deregistration plan in the article on sending a vehicle out by transport should be applied. Along with the delivery document, verifying that the actual departure has occurred and that the tracking record is closed is also the criterion for the file’s completion.
Conclusion
An effective application in a foreign-plated vehicle file begins with correctly separating the penalty from the grounds on which the vehicle is held. The service dates, the specific act, the penalty calculation and the relevant authorities must be determined; the application against the financial measure and the steps needed for the vehicle’s delivery must be planned together. A recovery result cannot be promised in every file; however, correct documents and time-limit tracking prevent the loss of the legal remedies that can be used.

Frequently Asked Questions
Within how many days can a customs penalty be objected to?
For an objection under Article 242 of Law No. 4458, there is a fifteen-day period from service. The nature of the service and the effect of other applications must be checked in the specific file. [1]
Is a customs penalty taken directly to the criminal judgeship of peace?
The same route is not used for every customs act. For customs duties and related penalties, the special administrative application and the administrative judicial route are assessed; for judicial seizure, the CMK route is assessed separately. [1, 2, 3]
If I pay the penalty, will the vehicle be released immediately?
This result is not automatic. There may be other administrative or judicial obstacles on the vehicle; delivery may be conditional solely on taking it out of the country or on a certain procedure. [3, 4]
Is the Article 238 penalty one quarter of the vehicle’s value?
For vehicles for private use temporarily imported with full exemption, the relevant provision takes as its basis one quarter of the amount of the customs duties. The statutory lower limit and the tax calculation are checked separately. [1]
Does filing a tax suit secure the delivery of the car?
No. The stopping of collection proceedings and the delivery of the vehicle are different matters. A stay of execution for the separate administrative act, or an objection and a return request for the judicial measure, may be needed. [2, 3]
Is unauthorized use a smuggling offense in every case?
No. The elements of an administrative regime violation and of the offense are examined separately. That said, facts such as deceptive acts and the initial purpose may matter for the criminal investigation. [8, 9]
Does an acquittal or a dismissal decision also close the customs record?
No such result can be drawn automatically. The ruling of the decision on the vehicle and the customs formalities that are still pending are examined separately; the delivery and departure records must be completed. [8, 9]
Which documents are needed first for an application?
The penalty and other decisions, service records, reports, the registration certificate, the permit record, the person’s and vehicle’s entry and exit records, power of attorney or rental documents and any court decisions should be collected first. A separate time-limit schedule should be prepared for each act.
