CAMPAIGNS, COLLABORATIONS AND ADVERTISING COMPLIANCE

Advertising, Social Media and Content Creator Law

Legal support in brand and content creator agreements, advertising review, content usage rights and Advertising Board (Reklam Kurulu) proceedings.

LEGAL ASSESSMENT

The commercial relationship matters as much as the text of the advertisement

Advertising law considers together what the brand says, how it proves it and whether the consumer understands the commercial relationship. A visible advertising disclosure on a social media post does not by itself make a misleading claim or the unauthorized use of an image lawful. The contract, the content and the manner of publication must be reviewed together.

Güneş & Güneş Law Firm provides support to advertisers, agencies, social media influencers and content creators in pre-campaign review, collaboration agreements, payment and usage disputes, and administrative application proceedings. The advertising regulations that entered into force on August 1, 2026 are included in the assessment.

SCOPE OF SERVICES

Legal Advisory in Advertising and Content Production

Review the heading that fits your needs. The work to be undertaken is determined by assessing the documents and the circumstances of the file.

Brand and content creator agreements

We clarify the number of posts, the content type, the publication schedule, revisions, approval and the payment arrangement. We set the parties’ delivery and acceptance criteria through enforceable provisions instead of vague general wording.

  • Collaboration, sponsorship and product-in-exchange agreements
  • Conditions for termination, cancellation and content removal

Pre-publication review of advertising content

We assess text, images, audio, price, links and footnotes within the campaign as a whole. We separate provable claims from subjective statements and examine the impression that may arise in the consumer.

  • Product claims and supporting documents
  • Campaign terms and visible disclosures

Social media advertising disclosures

We assess the disclosures that make the benefit relationship and the advertiser understood according to the format: post, short video, story, live broadcast and audio content.

  • Template check under the 2026 regulations
  • Legibility, placement and the post as a whole

Agency and advertiser relationships

We match the campaign instruction known as a brief, the limits of authority and the approval records to the contract. We arrange subcontractors, the use of the budget and the allocation of responsibility.

  • Content approval and authority to make changes
  • Reporting, rendering of accounts and expenses

Permissions for content, images and music

We review the authorizations needed for a post to be republished on the brand’s account or used in a paid advertisement. We separate copyright from the permissions concerning a person’s name, voice and image.

  • Medium, term, country and limit on modifications
  • Raw files, sublicensing and third-party permissions

Discounts, promotions and consumer reviews

We review price history, conditional discounts, loyalty practices and campaign terms. The verification of user reviews and their transfer into advertising are assessed separately.

  • Price records appropriate to the sales channel
  • Permit and scope review for prize draws

Environmental and sector-specific advertising claims

We address promotions in the fields of sustainability, health, food, tourism and finance together with the relevant special rules. We identify the risk of undocumented claims or claims of unclear scope.

  • Scope and basis of the environmental claim
  • Advertising ban or restriction depending on the sector

Targeted and AI-assisted advertising

We review targeting criteria, the use of personal data, profiling aimed at children and the disclosure of content created with artificial intelligence.

  • Accessible information about targeting
  • Digital characters and copies of real persons

Advertising Board applications and defenses

We assess the post under review with its published state and its supporting documents. We prepare responses to information requests, defenses and complaint files, and we review the judicial route according to the nature of the decision.

  • Organizing publication and approval records
  • Review of notification, sanctions and the route to court

Fee, performance and termination disputes

We compare unpaid content fees, missing publications, unauthorized reuse and the early termination of the agreement with the contract and the performances actually rendered.

  • Delivery, acceptance and performance records
  • Negotiation, receivable and compensation options

BEFORE YOU DECIDE

What should be clarified before a campaign

Disclosure, permission, accuracy and responsibility are not substitutes for one another. In particular, old campaign templates should be compared again with the current regulations.

The regulations of August 1, 2026 must be taken as the basis

The amendment published in the Official Gazette (Resmî Gazete) No. 33297 of July 1, 2026 introduced new rules on social media advertising, targeted advertising, artificial intelligence and other areas. In an advertising disclosure, the wording “Advertisement” (Reklam) or “Promotion” (Tanıtım), the information on the advertiser and the visibility of the post must be assessed together. Reliance should not be placed solely on a list of labels taken from an earlier guide.

A benefit is not only a payment of money

Free accommodation, a product, a service, a discount or participation in an event is also relevant in assessing the commercial relationship. That a content creator describes a product they genuinely like does not remove the need to disclose the benefit provided. The context and direction of the post are examined separately.

A label does not make a misleading claim lawful

The advertiser is obliged to prove the accuracy of the claims in its advertisement. Claims about product experience, scientific results, price advantages and environmental benefit are assessed together with their supporting basis. A general “this is an advertisement” disclosure does not remedy a statement contrary to the facts, a special advertising ban or a presentation that misleads the consumer.

A contract does not remove obligations arising from public law

Brand, agency and content creator may set the division of work among themselves; however, a clause such as “all responsibility belongs to the other party” does not remove administrative oversight. Recourse and compensation claims that the parties may direct at one another are examined separately within the framework of the contract, fault, damage and the provisions to be applied.

The use of artificial intelligence is assessed separately

In advertisements that use a digital character indistinguishable from a human, there is an obligation to disclose. Creating the impression of a false experience or recommendation through a digital copy of a real person falls under a separate prohibition. Making a disclosure does not replace permission to use a person’s image or other rights.

Protection of children in targeted advertising is a separate matter

Targeted advertising based on profiling with personal data cannot be carried out if it is known, or reasonably expected to be known, that the consumer is a child. Accessible information on the criteria used in targeted advertising and on changing them is also important. Cookies, data processing and platform settings are assessed separately; a general consent box does not by itself make every operation lawful.

OUR APPROACH

Our Approach in Advertising and Content Production

We do not reduce the review to the signature of the contract or to the label under a post. We work on who puts forward which claim in the campaign, with which document that claim is supported and who approved the final published version. In particular for short-lived stories and posts that can be edited, we plan for the preservation of publication records.

Besides the collaboration fee, we clarify the reuse of the content in advertising, restrictions on working with competing brands, the person’s image, account access and removal obligations after the campaign. The aim is thus for a contract and approval arrangement that the marketing team can apply to be established. An advertising review does not mean that the administrative authorities have given prior permission or that no sanction will be applied.

  1. Identifying the campaign and the parties

The product, target audience, medium, country, publication schedule and the brand–agency–creator relationship are clarified. If there is an existing publication or notification, it is given priority.

  2. Review of claims and permissions

Advertising statements are matched with their supporting documents; price, images, music, permissions of persons and sector-specific restrictions are checked.

  3. Preparing the contract and publication terms

Delivery, approval, payment, term of use and advertising disclosures are arranged. The authority of the persons who will make changes is determined.

  4. Conducting the application or dispute

After the matter is accepted, the agreed advisory work, negotiation, administrative application or litigation is carried out in accordance with the relevant procedure and time limits.

  5. Records, implementation and information

Differences between the approved version and the published content are assessed; decisions, the payment arrangement and the effects on subsequent campaigns are explained.

REPRESENTATION AND COMMUNICATION

Advertising and Social Media Services Based in Antalya and Serving All of Türkiye

Our firm, founded in Kemer on March 18, 1999 and operating from its base in Antalya since 2007, assesses campaigns and contracts directed at Türkiye by tourism businesses, brands, agencies and content creators. The sector of the product or service, the target audience, the medium used and the roles of the parties are examined together; related applications and disputes across the country are followed according to the scope of the work.

In work with foreign brands, agencies and platforms, communication directed at Türkiye is separated from the rules that may apply to campaigns in other countries. Matters that require local foreign-law representation are coordinated with counsel authorized in that country. Multilingual work is supported by communication in Turkish, English, German and Russian.

Scope of services and expenses

A single campaign review, a contract, ongoing advice and dispute follow-up are determined with separate scopes. The attorney’s fee is explained separately from court fees, translation, notary, court-appointed expert and other external expenses.

Account Access and Campaign Data

A follower list, an account password or unnecessary customer data is not needed for the initial assessment. The campaign draft, the contract and the publication records are received to the extent necessary for the review and by an appropriate sharing method.

Publication Schedule and Response Deadlines

If there is a planned publication date, a campaign period or an official response period, it should be stated clearly in the application. The schedule for pre-publication text review and for the defense or removal work concerning content already published is determined separately.

FREQUENTLY ASKED QUESTIONS

Questions About Advertising and Social Media

The answers are general information. The route and conditions that apply to your request are assessed on the basis of specific information and documents.

Can a post made in exchange for a free hotel stay be an advertisement?

Yes. The absence of a payment of money is not decisive on its own. The accommodation or service benefit, the promotional purpose and the post as a whole are assessed. If there is an advertising relationship, the current disclosure conditions that make it understood apply.

Is the platform’s “paid collaboration” tool sufficient on its own?

The appearance of the platform tool and the disclosure required by the legislation must be checked together. The label being visible, the advertiser being understandable and the presentation being appropriate to the type of post are important. It would not be correct to accept a single technical tool as sufficient for every campaign.

Can the brand use my video in its own advertisements indefinitely?

This right does not arise merely because a collaboration took place or a fee was paid. The permitted rights, medium, term, country, modifications and the conditions concerning the person’s image are examined. Use in paid advertising may be regulated separately.

Could I also be subject to a review because of text the agency approved?

The approval record is important, but it does not by itself remove the parties’ statutory obligations. The concrete roles of the person who made the post, the advertiser and the agency are assessed. The sharing of loss among the parties is treated separately from the administrative process.

Which records should I keep when a letter from the Advertising Board arrives?

Keep, together with the notification and its attachments, the post as it was published, the publication dates, the contract, the approval correspondence and the basis for the claims. Because a later change to the content may prevent examination of the first version, the integrity of the records is important.

Does deleting a post end the administrative review?

Removal of the content does not by itself end the review relating to the period in which it was published. The time and reason for removal are assessed together with the defense and, if any, corrective steps. First, the record of the current state of the publication and of the change made should be preserved.

What is needed to say “eco-friendly” or “sustainable”?

Such general environmental statements should not be left vague. Which product, part or process the statement concerns, and its basis, should be explained. The existence of a certificate also does not automatically form a basis for an advertising claim that goes beyond the scope of the certificate.

Can the same influencer agreement be used in every sector?

No. In health, finance, food, tourism and other fields subject to special regulation, the subject and target audience of the advertisement call for different checks. That a contract was used in another campaign does not show current compliance.

Is it enough to write only the participation conditions in order to run a prize draw?

The structure of the draw, its prize, whether it is based on chance or skill, and the permit regime that may apply are examined separately. Clear participation conditions are important, but they do not replace administrative permits that may be required. The scope should be determined before the campaign is announced.

Can I receive compensation through an Advertising Board application?

An application to the Board is for the administrative oversight of the advertisement. A separate application or judicial route may be needed for the contract price, a consumer claim or compensation. An administrative decision does not by itself satisfy the conditions of a private-law claim.

Is a low view count enough to avoid paying the content fee?

What result or performance was undertaken in the contract is examined. An obligation to publish and a measurable performance commitment are different. Without seeing the measurement method, period, data source and the parties’ approvals, no conclusion of an automatic fee deduction can be reached.

Can a Türkiye campaign be run with a foreign content creator?

The target audience of the work, its orientation toward Türkiye, the language of publication, the applicable law and the jurisdiction terms in the contract are assessed. Entering into a contract with a foreign person does not by itself remove the advertising obligations toward consumers in Türkiye.
