Bringing cash into Türkiye and taking cash out of Türkiye are not subject to the same rules. A cash declaration is required for foreign currency exceeding EUR 10,000 or its equivalent carried by a traveler on departure, for Turkish currency exceeding 185,000 Turkish lira (TL), and for the related payment instruments. In addition, a full and accurate explanation must be given on entry and departure at the request of customs. The source or intended use of the money may give rise to an obligation to transfer it through the banking system. [1, 2]
This article deals with cash carried by a traveler. A declaration is not a document that makes the source of the money lawful; bank transfer and taxation obligations are not satisfied merely by the cash form either. In a concrete assessment, the direction of travel, the value carried and the economic purpose of the transaction are examined together.
What distinction must be made between entry and departure?
In a cash inspection, it must first be established which country’s border procedure is being carried out. The rule in Türkiye may differ from the rule of the country of departure or transit. A form submitted in one country does not by itself satisfy the obligation in another.
| Situation | Basic assessment | Common mistake |
|---|---|---|
| Cash entering Türkiye | Explanation of source and purpose on request | Applying the departure euro threshold to entry as is |
| Foreign currency leaving Türkiye | Declaration of amounts exceeding EUR 10,000; also the nature of the transfer | Treating the threshold as a tax exemption or as permission for any money |
| Turkish currency leaving Türkiye | Declaration of amounts exceeding TL 185,000; also special restrictions | Using the old TL 25,000 figure |
| Carrying on behalf of another | True owner, authority of representation, source and purpose | Assuming that the person carrying the money is necessarily the owner |
The amounts in the table relate to a declaration on departure with cash carried by the traveler. A transaction that must specifically be carried out through a bank is assessed separately even if the amount is below the threshold. Currency types and payment instruments must also be shown correctly. [1, 2]
Is there an automatic declaration requirement above EUR 10,000 on entry into Türkiye?
As regards entry into Türkiye, the same automatic obligation cannot be imposed on all travelers on the basis of the EUR 10,000 threshold applicable on departure. On entry, the nature of the cash and the customs administration’s request for an explanation are what matter. Article 16 of Law No. 5549 regulates a full and accurate explanation at the request of the administration. A traveler may also make a cash declaration of his or her own accord. [2, 3]
This distinction does not mean that money may be concealed or that questions may be left unanswered. In an inspection, the owner, source, amount and intended use of the cash must corroborate one another. If there are several currencies, each must be counted separately; the actual amount, not an estimated total, must be stated.
Money that must come through a bank because of its source or purpose
Circular No. 2024/1 on Cash Controls (Nakit Kontrolleri Genelgesi) points to the banking system for certain items such as certain loans, gifts, inheritances and similar transfers counted as personal capital movements, and foreign credits. Therefore, the statement “the money is mine” does not by itself determine the method of carrying. It must be examined which category the transaction falls into. [2, 4]
For example, carrying into Türkiye a loan given by a foreign relative does not raise the same legal question as a person’s own money taken along for travel expenses. The real transaction matters as much as the name of the contract. Splitting a transfer that must be made through a bank among family members’ luggage does not change its nature.
Which amounts are declared on departure from Türkiye?
The current thresholds in Articles 3 and 4 of Communiqué No. 2008-32/34 (Tebliğ) are TL 185,000 for Turkish currency and amounts exceeding EUR 10,000 or its equivalent for foreign currency. The Turkish currency threshold was updated by an amendment dated 28 March 2025. The figure of TL 25,000 seen in the old circular or on old web pages must not be used as the current amount. [1]
These thresholds should also not be read as an absolute upper limit for any money that may be carried freely. The declaration obligation and the requirement to use the banking channel are two separate matters. For example, a foreign person’s taking abroad the proceeds of the sale of real estate in Türkiye cannot be assessed by looking only at the amount of cash. The special provisions on capital and sale-proceeds transfers are examined. [2, 4]
Before travel, it should be documented what transaction the amount corresponds to, and then the transfer route that may be used should be determined. Trying to complete a banking transaction after arriving at the customs area may lead to a missed flight and the cash being held.
Is the Cash Declaration Form different from the Cash Explanation Record?
Yes. A Cash Declaration Form (Nakit Beyan Formu) is used when the traveler makes a notification of his or her own accord; a Cash Explanation Record (Nakit Açıklama Tutanağı) is drawn up when customs asks for an explanation. The Circular also regulates taking a preliminary declaration, counting the cash and adding documents supporting the source to the case file. The traveler should keep a copy of the document.
The sequence of events recorded in the document may become important later. When and what question did the officer ask? Was an explanation about cash requested before the money was found? What amount did the traveler declare? How did the difference between the count and the first explanation arise? The answers to these questions can be compared with the record and camera footage.
If a foreign traveler does not understand the question, the language problem should be stated expressly. A document signed without its content being understood may later make it difficult to give an explanation by means of a general denial alone. A request to correct an incorrect entry should be made specific; existing documents should be preserved. The form-correction route in the Circular and a statutory appeal against the sanction do not replace each other.
Can cash be carried on behalf of another person or a company?
It is first examined whether the transaction may be carried out with the traveler at all. Even in a permitted transaction, the true owner of the money and the authority of representation must be explained. For a cash declaration on behalf of another natural or legal person, the Circular provides for checking the suitability of a notarized power of attorney. Being a company employee does not mean having sufficient authority for all cash transactions. [2]
The document of representation must be adequate to explain the amount and the purpose of the transaction. If the company’s invoice, the payment relationship and the accounting entry differ from the traveler’s explanation, the examination may be prolonged. A friend’s saying “you will only hand it over” does not remove the carrier’s obligation to answer questions fully.
The file to be prepared should include in particular the following:
- A statement showing the cash amount and the currency.
- Bank withdrawal records, income, sales or transaction documents consistent with the source.
- Information explaining the owner and the recipient of the money.
- If any, the authority of representation and documents of transactions on behalf of the company.
- Entry and departure dates and previous cash declarations.
A bank withdrawal receipt shows from which account the money was taken. However, it does not in every case fully answer how the account was funded or for what purpose the money is being carried. The chain of documents should be built to the extent that it explains the economic transaction.
What is the sanction for failing to give an explanation?
Article 16 of Law No. 5549 attaches a sanction to failing to give an explanation, or giving a false or misleading explanation, although the administration requested it. An administrative fine is provided on one tenth of the value carried where no explanation is given, and on one tenth of the difference between the true amount and the amount stated where the amount is untrue. The difference exception in the law is also taken into account. Holding of the money and notification to the relevant authorities may also arise. [3]
Failure to make a required cash declaration on departure is, however, examined separately under foreign exchange legislation. It would therefore not be correct to say “a ten percent fine” in every file. The decision must determine which article of law is relied upon, which conduct is treated as the violation and the calculation base.
Holding the money in safekeeping does not mean that it has been established that it derives from proceeds of crime. A notification to MASAK is part of the examination process. For criminal liability and loss of ownership, the relevant conditions must arise separately. Conversely, payment of the fine may not secure delivery of the money at the same time if another measure exists.
Why does the Court of Cassation consider the request for an explanation important?
In its decision of 21.04.2025, E. 2025/1539, K. 2025/5663, the Court of Cassation 7th Criminal Chamber (Yargıtay 7. Ceza Dairesi) distinguished between asking the traveler whether he or she has goods subject to customs and asking for an explanation about cash. In the case examined, it accepted that the conditions for sanction for the explanation obligation had not arisen and annulled the administrative fine. [5]
The conclusion that may be drawn from the decision is that the content of the record and the sequence of events must be examined. The decision cannot be read to mean that all high-value cash may be carried without a declaration. In addition, the decision states that there is no need to rule on a second request for reversal; a ground that was not assessed should not be presented as a general principle separately accepted by the Chamber.
When preparing a defense, it should not be argued that a question that was in fact asked was never asked; the records should be examined as they are. A strong application points to the concrete contradiction. For example, if the time at which an explanation was requested in the record appears to be after the time of the search, the effect of this on the procedure may be argued.
How is an appeal made against the fine and the holding of the money?
At the outset, the penalty decision, the cash form or record, the count document, the notification record and, if any, the public prosecutor’s file should be obtained. Cancellation of the fine and lifting of the safekeeping or judicial seizure (adli elkoyma) may require separate requests.
For administrative sanctions under the Law on Misdemeanors (Kabahatler Kanunu), subject to special provisions and exceptions of jurisdiction, the general period for application is 15 days from notification or pronouncement of the decision (tefhim), and the criminal judgeship of peace (sulh ceza hâkimliği) route is considered. This period must not be confused with the two-week period provided for a subsequent objection to the judgeship’s decision. In judicial seizure, the provisions of the Criminal Procedure Code (CMK) apply. [6, 7]
It cannot be assumed that all cash penalties are to be challenged under Article 242 of the Customs Law merely because the procedure took place at customs. The application should state separately the statutory basis of the sanction, the competent authority, the date of notification and the result sought. An information request to the institution or a customer-service application does not of itself stop the statutory period.
Conclusion
In carrying cash, the direction, source, ownership and intended use matter as much as the amount. The declaration on departure from Türkiye and the obligation to give an explanation at the request of customs must be kept apart. Before the transaction, it should be determined whether the banking route is required; in a dispute, the fine and the holding decisions should be examined separately.

Frequently Asked Questions
Is any amount exceeding EUR 10,000 automatically prohibited when entering Türkiye?
No. Entry, departure and the type of transfer are subject to different rules. The source and purpose of the money and customs’ request for an explanation are assessed together.
What is the foreign currency filing threshold when leaving Türkiye?
A cash declaration is required for foreign currency exceeding EUR 10,000 or its equivalent. For transactions that must be made through a bank, a declaration alone is not sufficient.
Can the old TL 25,000 figure for Turkish lira be used?
The current departure declaration threshold is TL 185,000. The amount in the old text must not be applied without taking the 2025 amendment into account.
Does declaring the money mean paying tax?
A cash declaration is not in itself a tax. Tax or other obligations arising from the transaction through which the money was obtained are assessed separately.
If I am below the threshold, may I decline to answer questions?
No. A request for an explanation made by the customs administration in accordance with the law must be answered fully and accurately, even if the amount is below the threshold.
May I present my friend’s money as my own?
No. The true ownership and the representation relationship must be explained. For money belonging to another, the necessary authority and the conditions of transfer are checked separately.
Is a bank receipt enough on its own?
It may not be sufficient in every case. In addition to the receipt, documents explaining the source of the income or transaction and the intended use may be requested.
Is a notification to MASAK a conviction?
No. A notification relates to the examination and investigation process. The conditions of offense and sanction are assessed separately by the competent authorities.
Is the money returned immediately when the fine is paid?
If another safekeeping or judicial measure exists, payment alone may not secure delivery. The basis for the holding and the conditions for lifting it should be investigated.
Is there a 15-day period in every cash penalty?
A general misdemeanor application, a customs objection and a judicial objection are not the same procedure. A definitive last day must not be determined without seeing the basis for the decision and its notification.
