What Stage Is Your Insurance Claim At?

LOSS HAS JUST OCCURRED

Preserve the evidence and the notice

Gather the event details, the policy, photographs and reports. Do not delay the required notice; keep the delivery record.

DENIAL OR UNDERPAYMENT

Compare the grounds

Compare the denial letter with the policy terms and the expert appraisal. Have the effect of a release, settlement or assignment of receivable reviewed before signing.

ARBITRATION OR LITIGATION

Choose the right route of application

Membership in the arbitration system, the type of insurance, prior applications and the capacity of the parties are determined. The conditions of the court and mediation are reviewed separately.

Our Approach from Policy to Compensation

  1. Reviewing the file

We verify the policy, the capacity of the parties, the loss and the dates; we identify urgent steps and missing documents.

  2. Preparing the claim

We assess coverage, liability, the items of loss and the necessary technical review together.

  3. Application and representation

Within the agreed scope, we conduct the application to the insurer, negotiation, arbitration or litigation process.

  4. Decision and collection

We follow the decision, legal remedies, payment and, where necessary, enforcement stages according to the circumstances of the file.

What becomes clear in the first consultation?

The counterparty to your claim, the time-limit risk, the document needs and the recommended legal work are explained. The expert appraisal, medical report and actuarial calculation are separate from the attorney’s legal review. The attorney’s fee and the application and litigation costs are determined separately. A conflict-of-interest check is carried out before a matter is accepted; the result or payment date is not guaranteed.

Preparing for the First Consultation on an Insurance File

Basic documents first

  • The policy, endorsements, special conditions and premium records.
  • Date of the event, claim number, reports and photographs.
  • The expert appraisal, loss calculation and existing payment documents.
  • The application to the insurer, its attachments, proof of delivery and the denial response.
  • The release or settlement text; if any, the litigation, arbitration and service documents.

In corporate files, the relevant contracts, financial records and reinsurance documents are requested separately.

Frequently Asked Questions About Insurance Arbitration and Compensation

What can be done if the insurance company denies compensation?

The grounds for denial, the policy and the evidence are reviewed together. After the required preliminary application, the arbitration or litigation route may be considered depending on the file. Not every denial means that the claim is unjustified or that it will necessarily be accepted.

Can I apply directly to the Insurance Arbitration Commission (Sigorta Tahkim Komisyonu)?

First, the requirement of a written application to the insurer is checked. The non-satisfaction of the claim, the response period, membership and the risk date are assessed, as is whether the same dispute has been taken to another authority. The details are in the arbitration guide.

Is every dispute heard by the Insurance Arbitration Commission?

No. The type of insurance, the parties, membership and statutory exceptions matter. Commercial arbitration between reinsurance parties must be distinguished from the Insurance Arbitration Commission route.

Are diminished value and loss of use of a vehicle the same?

No. The decrease in the vehicle’s value, repair costs and damage arising from being unable to use the vehicle are different items. The counterparty, the scope of the policy and the calculation method are determined separately for each claim.

Does DASK cover all losses at a workplace?

No. The Compulsory Earthquake Insurance (Zorunlu Deprem Sigortası) has building and coverage limits. For contents, loss of profit and business interruption losses, the scope of other policies, if any, is reviewed.

I received a payment; can I claim my remaining loss?

It must be examined which item of loss the payment relates to and what effect any signed release, settlement or assignment document has. The same conclusion cannot be reached on all claims in the file merely because a payment was made.

How long does the file take, and how is the total cost determined?

The state of the documents, the loss calculation, the route of application, and the court-appointed expert and legal remedies stages affect the duration. The attorney’s fee and external costs are explained when the scope is determined; no definite end or collection date is promised.

Must the reinsurer pay my compensation directly?

Reinsurance is the insurer’s reinsuring of the risk it has assumed. The existence of this relationship alone does not give the policyholder a direct right of claim against the reinsurer. The original policy and the reinsurance contract are examined separately.
