The statute of limitations for a tax debt is not determined merely by checking whether five years have passed since the debt arose. The assessment and service of the tax, the imposition of penalties and the collection of a final receivable are subject to different time-limit regimes. Start dates may change, and so may the referral to the assessment commission, payment, attachment, service of a payment order, asset declaration and the statutory grounds for suspension. A sound defense therefore requires a separate table of actions and dates for each debt item. 1 2
An old debt appearing on the tax office screen does not mean that it is necessarily collectible. Likewise, an old date does not prove that the limitation period has definitely expired. Rather than relying on a screen record, the assessment, notification, due-date and collection file and the underlying actions should be examined.
What is the difference between assessment limitation and collection limitation?
The assessment limitation period concerns whether the tax is assessed within the statutory period and served on the taxpayer. The collection limitation period concerns whether a receivable that remains unpaid after its due date is collected within the statutory period, together with the enforcement steps that affect that period. The main basis of the former is Articles 113–114 of the Tax Procedure Law No. 213 (Vergi Usul Kanunu, VUK); the basis of the latter is Articles 102–104 of Law No. 6183 on the Collection of Public Receivables (Amme Alacaklarının Tahsil Usulü Hakkında Kanun). 1 2
For example, the taxable event may have occurred in 2020, while the payment due date may fall in a later year. The start of the assessment limitation period and the start of the collection limitation period therefore cannot be treated as the same. Whether there was a lawsuit, a new calculation or a special arrangement of the due date must also be examined separately.
The limitation period for imposing penalties is a third heading. It should not be assumed that the tax itself and each penalty are subject to the same period. For the tax loss penalty, for procedural violations and for special procedural penalties, the statutory period and the starting point are determined separately. The limitation periods for the tax fraud case heard in a criminal court, both for prosecution and for punishment, are not the same as these administrative tax periods.
How is the assessment limitation period calculated?
The general rule in Article 114 of the VUK is that taxes not assessed and served on the taxpayer within five years from the beginning of the calendar year following the year in which the tax receivable arose are time-barred. It is not enough that the notice was issued within the period; the requirement of valid service is also assessed. Starting dates and periods in special tax laws are reserved. 1
To illustrate the method, assume that no special provision or event affects the period, and that a tax receivable arose in 2020. The general period then begins on January 1, 2021 and ends on December 31, 2025. This example does not mean that every 2020 period debt ends on the same date. The date on which the receivable arose, the special tax period and the specific provisions of the relevant tax must be verified.
Is a notice issued in the last year sufficient?
Completing the assessment and valid service to the taxpayer are separate conditions under the law. If the notice was issued on the last day of the period but served later, it must be checked whether another provision changes the period. The date on which a notice reaches the electronic system should not be confused with the legal service date, which arises at the end of the fifth day under electronic notification. 1
For this reason, it is not enough to look only at the date of the document in year-end files. Electronic event records, the physical service certificate, the addressee and any re-service procedures should be brought together. An argument that a service was irregular or invalid must explain why the document did not produce legal effect.
How does referral to the assessment commission affect the period?
VUK Article 114 provides that an application to the assessment commission for the determination of the tax base suspends the limitation period. The period resumes from the day following the delivery of the commission's decision to the tax office. The suspended period cannot exceed one year, as set by the statutory upper limit. The period does not restart from five years from the beginning. 1 3
The file should separately show the date of referral, the subject of the referral, the date of the commission's decision and the date on which the decision reached the tax office. The date on which the decision was made and the date of delivery to the tax office may not be the same. The phrase "sent to the commission" alone is not suitable for calculating the actual suspension period.
The function of the assessment commission, the legal nature of the referral and the actual content of the procedure may also be debated in a concrete case. However, generalizations that a referral is always ineffective, or that it always creates a new five-year period, are not correct. The objection should cover both the date calculation and the statutory conditions of the procedure.
Is the limitation period the same for tax penalties?
VUK Article 374 provides a five-year period for the tax loss penalty and for certain procedural penalties, and a two-year period for general procedural violations. For the tax loss penalty, the calendar year in which the related tax receivable arose is the reference, while for procedural violations it is the year in which the act was committed; the calculation starts from the beginning of the following year. Combined acts, special provisions and the link with Article 114(2) are assessed separately. 1
The type of penalty should be determined by the provision actually applied, not only from the general heading of the penalty notice. Applying the two-year general procedural period directly to a special procedural penalty based on VUK Article 353 or the repeated Article 355 is incorrect. The service of the penalty notice and the provision of the law on interruption of the limitation period are also reviewed.
If action is taken before the penalty limitation period expires, this does not mean that the receivable can be collected indefinitely. When the collection stage is reached, the due date and the period under Law No. 6183 must be examined separately. These two defenses are not necessarily alternatives to each other; each can be raised in the file under its own conditions.
When does the collection limitation period start?
Under Article 102 of Law No. 6183, the general period is five years from the beginning of the calendar year following the year in which the due date of the public receivable falls. Special law provisions are reserved for monetary penalties. For the collection limitation period, the due date is the reference, not the taxable event. 2
For example, for a receivable whose due date falls in 2021, and assuming there is no interruption or suspension, the period runs from January 1, 2022 to December 31, 2026. Where there are installment debts, different due dates, restructuring or a payment schedule following a court decision, a single-date example is not sufficient. Each due date must be determined on its own legal basis. The article on deferral and installment payment of tax debts examines this subject under a separate heading.
Which actions interrupt the collection limitation period?
Article 103 of Law No. 6183 provides for interruption in respect of payment, the execution of attachment, service of a payment order, asset declaration and the other actions listed in the article. Under a special law, an application for payment or the linking of a debt to a payment plan is also assessed in terms of its legal scope. Where interruption occurs, the limitation period starts to run again from the beginning of the calendar year following the year in which the interruption occurred. 2
Any correspondence or internal record of the tax office that is not on the list of actions is not a ground for interruption. The administration must show the date of the action on which it relies and its connection with the debt. Preparing a payment order is not the same as its valid service. For attachment, a mere inquiry letter is also distinguished from an attachment actually carried out. This heading is also addressed separately in the article on removal of electronic attachment for tax debts.
Does a small payment change the whole calculation?
Payment is listed in the law as a ground for interruption, but who made the payment, under what authority and against which debt matters. For a small collection entry on the accounting screen, the receipt and the source of the transaction should be requested. It cannot be said that every small payment is invalid or that every record interrupts the limitation period.
A transaction carried out after the limitation period has expired must be distinguished from one carried out before it expired. A receivable whose period has already run cannot be revived on its own by a payment order issued later. However, since Article 102 contains a provision on voluntary payments made after the limitation period, the legal status of the file should be examined before a payment decision is made. 2
In which cases does the limitation period not run?
Article 104 of Law No. 6183 regulates situations such as the debtor being abroad, fraudulent bankruptcy, or the impossibility of enforcement because the estate is being liquidated. The link between the statutory cause and the impossibility of enforcement must be assessed. The mere fact that a person was outside Türkiye for a period does not by itself show that the period stopped for all debts. 2
Force majeure and special legal arrangements for periods are also reviewed for the relevant period. Suspension and interruption are not the same: in the former, the remaining part of the elapsed period is relevant, while in the latter, the start point set by the law applies anew. A table prepared without this distinction may reach a different result by several years.
Which documents are needed to prepare a limitation defense?
- Records showing the taxable event, the period and the type of receivable.
- The assessment, the penalty notice and the service documents.
- The referral to the assessment commission and the records of delivery of the decision to the tax office.
- A breakdown of due dates, collections and offsets for each debt.
- Payment order, attachment, asset declaration and payment plan documents.
- Concrete records showing the grounds for suspension or non-running, where those grounds are relied on.
A limitation objection to a payment order may be raised under Article 58 of Law No. 6183; the fifteen-day lawsuit period must be preserved. The stage at which, and the action against which, the assessment limitation argument may be raised should also be assessed. While waiting for the administration to provide a copy of the file, the right to sue must not be lost; the request should be that the missing records be obtained by the court. 2
Conclusion
The strength of a limitation defense in tax debts comes not from emphasizing an old date, but from a calendar of actions verified for each debt. Assessment, penalty and collection periods must be separated, and every claim of interruption and suspension must be tested against the supporting document. When the legal nature of the action and the date calculation are considered together, it can be determined whether a debt that appears to be ongoing can in fact still be pursued.
