The route of appeal against a tax court decision is determined by the nature of the decision, the amount in dispute, the date the case was filed and the transitional provisions that apply. The general period for an appeal (istinaf) and for an appeal on points of law (temyiz) is thirty days from service of the decision. Not every tax case reaches the Council of State (Danıştay), and filing a remedy does not by itself stop the decision from being enforced. 1 2 For the related process, see how a tax lawsuit is filed.
An effective petition cannot be prepared by merely changing the heading of the earlier lawsuit petition. It must show which finding the first-instance court made, which piece of evidence it did not assess, and which legal error led it to its operative conclusion. An appeal and an appeal on points of law serve different review functions, and the claims and grounds must be framed around that distinction.
What is the difference between an appeal and an appeal on points of law?
An appeal (istinaf) is the review of a tax court decision by the relevant tax chamber of the regional administrative court. Within the statutory framework, both the facts and the legal assessment are examined. If the decision is found to be unlawful, it may be set aside and a new decision on the merits may be given. For certain procedural defects, the law provides different decision and remittal mechanisms. 1
An appeal on points of law (temyiz) is the review by the Council of State (Danıştay) of decisions that the law makes open to that remedy. The petition must show the unlawful points that affected the outcome and the grounds for setting the decision aside. An abstract repetition that “the tax is unfair” does not replace concrete objections such as a wrong application of the law, an incomplete examination or a failure to discuss a decisive piece of evidence. The review framework of Article 49 of the Administrative Procedure Law No. 2577 (İYUK) is taken into account. 1
Can every tax court decision be appealed?
No. Decisions that fall within the monetary threshold for finality, or that the law expressly declares final, may have no ordinary remedy. Not every decision reviewed on appeal is open to an appeal on points of law either. The statement of remedies at the end of a decision should be read carefully, but it should not be treated as the sole determining factor without comparing it with the statutory provisions.
Filing a remedy against a decision thought to be final wastes time and money. Conversely, an incorrect assessment of finality can cost the right to a remedy. For this reason, the amount in dispute, the date the action was filed, the type of decision and any statutory exception should be recorded together in a single checklist note.
Which year applies to the monetary threshold?
Article 7 of Law No. 7550 amended Supplementary Article 1, paragraph 2 of Law No. 2577. It provides that the monetary threshold on the date the action was filed determines which decisions may be appealed or taken to an appeal on points of law. Therefore, a current assessment that looks only at the monetary table for the year of the decision is not sufficient. Earlier final decisions and transitional provisions should also be reviewed. 2
Monetary thresholds may change from year to year because of the revaluation mechanism. The file should state the amount applicable in the year the action was filed and explain which amount was taken into account for the nature of the dispute. The main tax, penalties, different periods and multiple transactions challenged in the same petition do not mean that a single combined total is used in every case.
Is the appeal on points of law tied only to the highest monetary threshold?
No. The relevant subparagraphs of Article 46 of Law No. 2577 and their exceptions must be read together. The law also contains a special rule for disputes within a certain monetary range where a decision is given again after the appeal court has set aside an earlier decision. A conclusion of finality cannot be reached merely because the amount is below the general threshold for an appeal on points of law, without considering the type of decision and the statutory exceptions. The amount in dispute and the way the appellate decision changed the first-instance judgment should both be recorded. 1
The reason no single monetary figure is given for all years is that the filing date and the transitional regime are decisive. The source of the threshold and its year should be stated clearly in the petition preparation note. A table published online under a current-year heading should not be applied automatically to a case filed in the past.
How is the period for an appeal and an appeal on points of law calculated?
The general period under Articles 45 and 46 of Law No. 2577 is thirty days. The service record of the decision, electronic service, the legal date of service and the rules affecting the last day should be assessed together. Viewing the decision on UYAP, service on the attorney and the client's becoming aware of it may be different dates; the start of the period must be determined for each file. 1
The record confirming that the petition was registered should be kept. Completing the petition on a computer, signing it electronically or attempting to upload it to the system does not by itself show that the filing succeeded. Deficiencies notified in respect of fees, costs and enclosures must be remedied in time, and the current status of the filing should be monitored.
If the notice of remedies appears to have been incorrect or incomplete, this must be raised concretely. It does not follow that every such error creates an unlimited period for filing. Where the route to a remedy is unclear, what matters is to act within the period that is running and to justify the uncertainty.
How is a strong appeal petition structured?
First, separate the operative part of the decision from its reasons. Did the court dismiss the case as time-barred, did it decide on the merits, or did it annul only some tax periods? Against a dismissal on procedural grounds, arguing only that the assessment was wrong leaves the actual ground for dismissal unanswered.
Each section should bring together four elements: the specific finding of the court, the counter-evidence in the file, the legal rule that should apply, and the effect of the error on the judgment. The title of the document, the date on which it was placed in the file and its page should also be shown. If new evidence is submitted, explain why it could not have been submitted earlier and how it affects the outcome. For more detail, see evidence and proof in tax cases.
Which objections should be addressed first?
- Errors affecting the outcome concerning jurisdiction, subject-matter competence, time limits and standing.
- Shortcomings concerning service, access to the expert report and the right to respond to decisive documents.
- The taxable event, the burden of proof and errors of legal characterization.
- Concrete contradictions in the inspection report, the bank record or the expert's calculation.
- Errors concerning periods, tax base, rate, penalties and duplicated calculations.
- Inconsistencies between the reasoning of the decision and its operative part.
Where part of the decision is favourable, preserving that part should also be considered. The opposing party's appeal, the amounts accepted and rejected, interest and litigation costs are examined separately. The request should state clearly which part of the decision is to be set aside or reversed.
Does filing an appeal stop collection?
Under Article 52 of Law No. 2577, an appeal or an appeal on points of law does not by itself stop the decision from being enforced. The effect of bringing the action on collection at first instance must be distinguished from the legal position at the remedy stage. Where necessary, a stay of execution is requested from the competent remedy body. 1
The request should explain the concrete harm that enforcement of the decision would cause, the unlawfulness relied on and any security, if applicable. After the dismissal of an annulment action, the conditions in Article 27 of Law No. 2577 also matter for a stay of execution of the challenged act. The position “we have appealed, so we will not pay” does not by itself provide legal protection.
The option of withdrawing from a remedy under Article 379 of Tax Procedure Law No. 213 (VUK) differs from an ordinary appeal. Its applicability, the payment conditions and the consequences of withdrawal should be assessed separately; the choice should not be made solely on the expectation of a reduction. 3
Conclusion
A remedy strategy in a tax case rests on identifying together the correct forum, the correct period, the correct monetary regime and the objections that affect the outcome. The petition must address the court's reasoning with concrete evidence and legal rules. After filing, the request for a stay of execution, the other party's response and the subsequent decision must be followed separately.
Frequently Asked Questions
Must every tax case go to the Council of State?
No. Whether each tax court decision can be appealed depends on the finality and remedy conditions explained in the section “Can every tax court decision be appealed?”, and these are examined file by file. Back to the related explanation
Should the monetary threshold be taken from the year of the decision?
The current basic rule is the threshold on the date the action was filed. The change and transitional conditions explained in “Which year applies to the monetary threshold?” must be taken into account. Back to the related explanation
Can I submit my earlier lawsuit petition unchanged?
Repetition may not be enough to show that the decision was wrong. The link between decision, evidence, rule and result described in “How is a strong appeal petition structured?” must be established. Back to the related explanation
Does an appeal automatically stop an attachment?
No. A separate assessment of a stay of execution is required, as explained in “Does filing an appeal stop collection?” Back to the related explanation
