Hearings in Tax Litigation: Requesting a Hearing, Preparation and Oral Arguments

A file, a pen and a desk microphone on a table in an empty courtroom; a scene representing preparation for a hearing in a tax case.

Summary

A hearing in a tax case allows the written file to be explained orally before the court. It is not held automatically in every tax case. At first instance, a request that meets the statutory conditions, the monetary threshold and the type of dispute matter; on regional appeal (istinaf) and appeal on points of law (temyiz), holding a hearing also depends on the decision of the relevant judicial authority. A hearing does not cure a missed filing deadline and does not remove the need to submit written evidence on time.

Preparing for a hearing should not be limited to reading the petition from beginning to end. The core issue the court must resolve, the opposing party’s strongest objection and the connection of the documents in the file to that issue should be identified. The value of an oral argument lies in making the facts already in the file clear and verifiable.

In which cases is a hearing held in a tax court?

Article 17 of the Administrative Procedure Law (İdari Yargılama Usulü Kanunu, İYUK) provides for a hearing to be held at the request of one of the parties in certain cases. In tax cases, what matters is whether the total of the assessed tax, duty, fee and similar financial burdens, together with their surcharges and penalties, exceeds the statutory monetary threshold. The threshold changes every year; the year in which the dispute was filed is assessed separately.

The hearing threshold for 2026 is TRY 486,000. Exceeding this amount matters for the mandatory-hearing rule that depends on the amount. However, a numerical comparison alone is not sufficient. The nature of the contested act and the provision of İYUK Article 17 into which it falls must be determined. For acts that cannot be measured in money, the general rules on annulment actions are assessed separately.

Which year’s monetary threshold applies?

The second paragraph of supplementary Article 1 of İYUK, as amended by Law No. 7550, provides that the monetary threshold on the date the action was filed is the basis for determining the cases in which a hearing is mandatory. Therefore, the 2026 threshold is not applied to an action filed in 2025 merely because the hearing will take place in 2026. For older files, the entry-into-force and transitional provisions should also be reviewed.

For example, in a TRY 500,000 tax dispute filed in 2026 and subject only to the amount-based rule, the threshold is exceeded. In a TRY 480,000 file filed in the same year, a mandatory hearing at the party’s request does not arise on the basis of that amount alone. The court’s power to hold a hearing on its own motion is separate from both assessments. These examples are not a real file or a case that was won.

When and how is a hearing requested?

İYUK 17/3 provides that a hearing may be requested in the petition, the reply and the pleadings. For the plaintiff, the clearest method is to state the request visibly in the petition and to repeat it in the conclusion section. Rather than relying on a box ticked in the electronic system, it should be checked that the signed petition also contains the request.

The existence of a request alone does not create a mandatory hearing in every file. The type of case and the monetary condition are still examined. Stating the total amount in dispute and the relevant year in the petition reduces uncertainty in the hearing assessment. Where there are several notices, periods or separate cases, it should be kept clear in which file each is being argued.

Can a hearing be requested later if the request was forgotten?

The stage of the file and the nature of the petition in which the request is submitted matter. It should not be accepted that every request made outside the petition stages provided by law creates a mandatory right to a hearing. However, under İYUK 17/4 the court may decide on its own motion to hold a hearing, independently of the monetary and request-related limits. In a late request, it can be explained concretely why an oral argument is necessary.

It is risky not to submit a request at the outset on the assumption that the court may hold a hearing on its own motion. Having the request and service records in the file also matters for assessing, later on, any claim that the right to a hearing was violated.

Do hearings on regional appeal and appeal on points of law follow the same rule?

Under İYUK 17/2, holding a hearing at the regional appeal and appeal on points of law stages depends on the parties’ request and the decision of the relevant judicial authority. The mandatory-hearing rule based on the amount at first instance is not carried over unchanged to these stages. A hearing may be requested in the application petition, but it cannot be said that a hearing will necessarily be held.

Whether a remedy is available and whether a hearing is held are different matters. Filing a petition requesting a hearing against a final decision does not open a closed remedy. Similarly, requesting a hearing does not by itself stop enforcement of the decision or collection.

How is the file prepared before the hearing?

First, the dates of the act, notification and application should be verified. Then the amounts in dispute should be separated by period and by act. A one-page working summary can make it easier to find, at the hearing, which document answers which question. This summary does not replace the supporting documents.

Drawing a clear connection between a document and a claim

For example, if the tax authority has treated bank deposits as unrecorded revenue, rather than objecting only to the total amount at the hearing, the distinction between duplicate transfers, loan repayments and the actual sale price should be shown. Each explanation should be tied to the date and page of an exhibit already submitted to the file. The court should not be expected to find the relevant record itself in a large folder of exhibits.

Preparing for the opposing party’s strongest defense

In preparing the defense, it is not enough to read only the documents that are favorable. The authority’s claims concerning capacity, period, formal requirements, limitation or inconsistency of documents should be assessed one by one. If an unfavorable document is ignored, the credibility of the oral argument weakens. If a real deficiency exists, its scope and legal consequence should be explained honestly.

Legal opinion and fact should not be confused. “No tax arose” is a claim about the outcome; the delivery date, the contract term and the actual transaction are the facts that allow that outcome to be assessed. The oral argument should make the basis understandable before the conclusion.

How are oral arguments made on the day of the hearing?

Within the framework of İYUK 18, the presiding judge conducts the hearing; giving the floor to the parties is subject to statutory procedure. The general rule is openness, but a closed hearing may be held in the cases provided by law. The oral argument should be addressed to the court and should not turn into a direct debate with the opposing party.

At the beginning, the subject of the case and the result sought can be stated briefly. Then the decisive procedural issues, the material facts and the legal grounds are addressed. Rather than repeating every detail already clarified in the file, it is more useful to focus on the disputes that could change the decision. If the court’s question cannot be answered, one should not speculate; an appropriate procedural request should be submitted so that the relevant record can be examined.

Submitting a new document at the hearing does not mean that it will necessarily be accepted. Under İYUK 21, the conditions for later submission and the opposing party’s right to present its views are assessed. Asking orally, for the first time, for the annulment of a new act does not bypass the rules on the subject of the case and time limits.

What is the limit on hearing witnesses and administering an oath?

A hearing in a tax case does not have the same structure as witness examination in a civil or criminal court. The evidence rules in VUK 3/B and the written procedure of administrative justice must be considered together. If a person’s knowledge is important, its connection to the dispute and how the court is asked to investigate it can be explained. However, preparation should not proceed as if there were an automatic right to have witnesses heard or to conclude the dispute by offering an oath.

Consequences of not attending the hearing and of an excuse

Under İYUK 18, if only one of the parties attends, that party’s statements are heard; if neither attends, the hearing is not opened and the review is carried out on the file. Therefore, non-attendance alone does not mean withdrawal of the action or an automatic loss. However, the opportunity to answer important questions and to explain the file may be lost.

If there is a valid excuse, it should be notified to the court in time, with documents and with a clear request. It should not be assumed that the excuse has been accepted or that the hearing has been postponed. The UYAP record and the court’s decision should be monitored. Under the ordinary procedure, there is a rule that hearing summonses are sent to the parties at least thirty days in advance; special procedural provisions are assessed separately.

When is the decision given after the hearing?

İYUK 19 provides that the decision is to be given within fifteen days at the latest after the hearing is held. Where an interim decision is required, the file is examined with priority once it has been complied with. This provision does not mean that, in every file, the reasoned decision will necessarily be served fifteen days after the hearing. Giving the decision, writing it and serving it should be distinguished.

Service should be monitored separately for tracking the time limit for legal remedies. The date on which the oral argument was made should not be treated as the start of the general regional appeal or appeal on points of law period. In the decision, how the request was assessed, the consequence of no hearing being held and whether the objections on the merits were answered are examined together.

Conclusion

Preparing for a hearing in a tax case begins with a request submitted at the right time and an orderly written file. The year to which the monetary threshold belongs, the type of case and the stage of the proceedings must be assessed separately. Oral arguments are useful when they connect the decisive claims with the documents. Holding a hearing does not by itself secure a favorable decision; nor does requesting one stop time limits or collection automatically.
