Let Us Clarify Your Legal Needs Together
Violence is not only physical assault. Threats, psychological or economic violence and one-sided persistent stalking can also create a need for protection. The application is prepared taking into account the urgent need for safety and the particular circumstances of the person and the children.
Who Can Be Protected Under Law No. 6284?
Filing for divorce is not required
The Law covers women, children, family members and victims of one-sided persistent stalking who are subjected to violence or are at risk of being subjected to it. Protection does not arise only while the marriage continues. The specific risk, the existing relationship and the necessary measures should be set out clearly in the application.
Protective and Preventive Measures
An application consistent with the risk
Protective measures such as shelter, temporary protection, financial support and counseling are different in nature from preventive measures such as removal, non-approach, a ban on harassing through means of communication and surrender of weapons. Where necessary, confidentiality of address and identity information, personal contact with the children and temporary maintenance are also assessed. Not every measure is issued by the same authority.
Where to Apply, and Is Evidence Required?
Do not postpone your safety to gather documents
Depending on your situation, the appropriate route of application can be determined through the police, the gendarmerie, the public prosecutor’s office, the family court, the governorship or the district governorship. No evidence or document showing that violence was committed is required for a protective measure order; a preventive measure order must be issued without delay. Keep the messages, reports and decisions you already have in a safe way; do not put yourself at risk to obtain evidence.
Duration of the Order, Objection and Violation
Follow how the order is implemented
The scope, start and end of the measure should be checked from the decision. If the risk continues, the need for extension or modification is assessed. An objection to decisions under the Law can be filed with the family court within two weeks from pronouncement or notification. The start date and the nature of the decision should be checked from the file. In the event of a violation of the order, apply to law enforcement and the relevant authority; in urgent danger, call 112. A violation may, if the conditions are met, lead to imprisonment for coercion (zorlama hapsi) and, separately, a criminal investigation.

Frequently Asked Questions
Do I have to file for divorce first in order to be protected?
No. An application under Law No. 6284 can be assessed independently of a divorce action.
Should I wait for a reply from the firm in an emergency?
No. In urgent danger, call 112 or contact law enforcement safely. The online form is not an emergency help channel.
Is a protection order a criminal conviction?
No. The protection process and a criminal investigation and prosecution are different processes; the necessary applications can be assessed together.
