WORDING IN THE TEXT

What do the authority wordings mean?

This section explains the wording found in the source; it does not add any new authority to the source text.

Collection and receipt

Covers wording on receiving a payment or a receivable. The amount to be received, from whom and by which method should be made clear.

Settlement

Wording on the authority to resolve a dispute by agreement. Whether the matter is open to settlement and the consequences of the agreement should be assessed separately.

Release (ibra)

May cover statements ending a debt or liability. The person to be released, the subject matter and the amount should be specified.

Sale and transfer

Covers wording on transferring goods or a right to another person. The subject matter, price, buyer and the limits of the transaction should be clarified.

Mortgage transactions

What matters is which of the wordings on creating, transferring or releasing security appears in the source. Authority to release security must not be read as authority to create security.

Application and signature

Refers to the authority to apply to the relevant institution or sign documents for the specified transaction. The scope of documents and transactions should not be treated as unlimited.

PREPARATION BY TRANSACTION

Check before the transaction

  1. Prepare, where applicable, the province, district, neighbourhood, block (ada), parcel and independent unit details.

  2. Determine whether the transaction is a purchase, sale, lease or something else, and the limits on price and term.

  3. Prepare your valid identity document and the attorney-in-fact's details; confirm with the notary office or consulate whether additional documents and photographs are required.

  4. If a foreign notary will be involved, clarify the sample text and the certification/translation route for the country concerned with the firm before the transaction.

Frequently asked questions

Can I use this text directly?

Assess the details and authorities in the sample against your specific transaction. The form of the notarial or consular act and the current legislation must also be checked separately.

How can I download or print the text?

Use the Print option, or download the Turkish original as a PDF or Word (RTF) file. Only the Turkish original is offered for download, because a power of attorney to be used in Türkiye is executed in Turkish. The RTF file can be edited in Word and compatible word processors.

What should I do if I will act from abroad?

First clarify the transaction and the scope of authority with our firm. Depending on whether you go through a consulate or a foreign notary, determine the preparation of documents, certification and translation.
