Summary

Inheriting a vehicle bought with a special consumption tax (ÖTV) exemption: transfer to a single heir, the five-year and ten-year distinction, the tax calculation and a guide to objections based on two Council of State decisions.

The passing of a vehicle bought with an ÖTV exemption to the heirs, the leaving of the vehicle to one heir and its later sale are different tax transactions. A genuine succession transfer on the testator's death and a transfer of shares among the heirs cannot be treated as the same thing. The date of first acquisition, the basis of the exemption and the content of the estate must be examined together. [1]

First, determine which exemption applied

The vehicle invoice, the date of first registration, the exemption certificate, the registration document and the tax records are obtained. An exemption granted on account of disability, another special exemption and a customs exemption are not the same regime. The fact that the vehicle is commonly called a "disabled person's vehicle" does not by itself show which provision applies.

The frequency with which a new exempt vehicle may be acquired under Article 7 of the ÖTV Law and the later transfer tax under Article 15 are separate provisions. In the current text, the ten-year period for renewed use of the exemption and the provision on disposal after more than five years of use are found in different places. For this reason, a one-sentence explanation such as "it is now ten years for every transaction" or "it is five years in every case" should not be given. [1]

Transfer to all heirs

Article 15/2-a of the ÖTV Law separates transfer by succession, as a general rule, from the rule on the later taxation of exempt goods. However, this does not mean that inheritance and transfer tax, the notary transaction or the motor vehicle tax disappear. Each tax is assessed under its own conditions. [1, 2]

The tax and notary process is carried out with the certificate of inheritance, identity documents and vehicle records. Pledges, attachments and debts are checked separately. It must not be assumed that usage or insurance conditions specific to the deceased continue unchanged after death.

Leaving the vehicle to a single heir

Where the estate contains only the vehicle

The other heirs' leaving of their shares in the vehicle to one person may be treated as a transfer, with or without consideration, distinct from the first transfer by succession. Calling the transaction a "waiver" does not by itself prevent ÖTV from arising. The agreement of waiver of inheritance concluded while the deceased was alive and a transfer of shares after death are also different. [3]

Where the estate contains other assets

In the Revenue Administration (GİB) explanations, where the estate contains more than one asset or right, the true nature of the partition and the proportion of the value of the other assets to the vehicle are important. The presence of other assets of symbolic value does not automatically allow the vehicle to be left to one person without ÖTV. What values are given to the other heirs must be shown by declarations and partition documents. [4]

If the heir who takes over the vehicle personally meets the conditions of the exemption, a separate assessment may be made. These conditions must be verified against the current health, vehicle and first-acquisition provisions; the mere presence of a disabled person in the family is not sufficient.

Decision table

TransactionTax review
First transfer to all heirsSuccession exemption and other taxes
Transfer of shares to a single heirScope of the estate, consideration and time period
Transfer to a person who meets the conditionsConditions for benefiting from the exemption
Sale to a third partyDate of first acquisition and Article 15 conditions
Purchase of a new exempt vehicle againSeparate right and period under Article 7

This table is not a conclusive provision; it shows which questions must be answered. Obtaining an assessment from the tax office on the specific vehicle and documents before the transaction reduces the risk of an unexpected tax obstacle at the notary.

An heir abroad or a foreign heir

Identity documents, the certificate of inheritance, translations and a power of attorney are prepared. Residence abroad does not remove the ÖTV regime in Türkiye. If it is planned to take the vehicle to a foreign country, export, customs, foreign registration and conditions of use are researched separately. Owning a vehicle by inheritance does not create a right to import an exempt vehicle.

The powers needed for the transfer, partition or sale of the vehicle are set out in the power of attorney. If there is a minor heir, the conditions of representation and permission are completed. A document showing that another heir's right has been given up should not be signed without its consequences being explained.

Why is the first-acquisition file decisive?

Even if the heirs have found the vehicle registration document, they may need the first-acquisition invoice and the basis of the exemption. In a tax review, the date on which, the provision under which and the base on which the vehicle was acquired are important. Later modification or a change of the registration document does not by itself alter the legal nature of the first acquisition. It is useful to request from the tax office the existing exemption record and the documents required for an assessment of the planned transfer. [1]

The date of death, the date of first acquisition and the date of the planned sale should be shown on the same timeline. The expiry of one period does not show that another condition of the exemption is also met. In particular, whether ÖTV is sought in acquiring a new vehicle and in transferring the existing vehicle arises from different articles. Instead of a single outdated "five years" or "ten years" explanation found on the internet, the basis of the specific transaction is checked.

How is a genuine partition distinguished from a gift of shares?

If the estate contains significant assets other than the vehicle, the leaving of the vehicle to one heir and the other assets to the other heirs may be a genuine partition. By contrast, where the estate consists only of the vehicle, the gathering of all shares in one person without consideration is assessed differently. Writing "partition of inheritance" in the agreement does not by itself determine the tax nature of the transaction. The existence and value of the other assets, and to whom they were actually left, must be documented. [4, 3]

For example, an estate with a bank deposit of economic value similar to the vehicle cannot be treated as the same as an estate with a bank account of a symbolic amount. This example does not establish an exact ratio or an automatic exemption threshold. For the tax administration to assess the nature of the specific partition, the inheritance tax return, the list of assets and the partition document are submitted together.

What should be asked before a transfer to a single heir?

It is determined which rights the other heirs are transferring, whether they receive consideration, how much time has passed since the vehicle's first acquisition, and whether the transferee personally meets the conditions of the exemption. A general waiver text signed without obtaining a valid tax assessment may give rise to an unexpected tax or a dispute over claims within the family. The heirs' consent must be clarified with regard to both its legal and its economic consequences.

Use, insurance and tax obligations

Until the transfer of ownership is completed, who may use the vehicle and under what conditions is researched. It should not be assumed that an exemption or a usage arrangement tied to the deceased passes unchanged to all the heirs. Compulsory traffic insurance, comprehensive insurance, the registration document and special equipment information are checked. If the vehicle will not be used for a long time, a temporary arrangement among the heirs may be made for safe storage and continuing expenses.

Apart from ÖTV, motor vehicle tax, traffic fines, pledges and attachments are assessed separately. The payment of one tax does not show that all notary obstacles have been removed. If there is life insurance for a loan debt on the vehicle, the insurance file is also investigated; the existence of insurance does not mean that the loan has closed automatically.

Specific review against the tax calculation

If the administration seeks ÖTV, the type of transaction, the provision applied, and the base and rate used should be seen in writing. The heirs' defense that "the market value has fallen" may not be sufficient on its own if the calculation method under the law is different. By contrast, a wrong date of first acquisition, or the treatment of a genuine succession transfer as a sale of shares, may be grounds for a legal objection. [1]

A private ruling (özelge), an information letter, a tax accrual and a payment order are distinguished from one another. The time limits for applications and lawsuits vary with the transaction; having requested an opinion does not stop every time limit. Even if the tax dispute is resolved, the notary registration and the amounts to be paid to the other heirs must be completed.

Which documents are obtained at closing?

The new registration document or registration record, the tax assessment and payment documents, the partition agreement, the sale receipt and the vehicle delivery record are kept. For a vehicle to be taken abroad, customs and foreign registration formalities are a separate file. Being an heir in Türkiye does not show that there is a right to duty-free import in the destination country. The concluding assessment is made according to the chosen transaction: joint transfer, transfer to a single heir and sale to a third party require different completion documents.

Why should five years and ten years not be confused?

The right to acquire a new vehicle and the transfer of an existing vehicle are governed by separate provisions

The ten-year rule in Article 7/2 of Law No. 4760 concerns the ability to make a first acquisition under the exemption again. Article 15/2-a, in turn, regulates the later acquisition of an exempt vehicle, transfer by succession and disposal after more than five years of use. It is not correct to carry the change of period in the first provision over to all sales without examining the text of the second. In the specific file, the date of first acquisition, the type of exemption and the date of the later transaction must be determined. Law No. 4760, Articles 7 and 15

The death of a person who benefited from the exemption does not pass on to the heirs, unchanged, the right to buy a new vehicle that rests on that person's personal health conditions. The transfer of an existing vehicle by succession is one assessment; the heir's own acquisition of a new vehicle with the exemption in the heir's own name is another. Likewise, a vehicle bought in Türkiye with an ÖTV exemption and a vehicle imported with a special customs exemption should not be tied to a single checklist.

A real Council of State decision: ÖTV assessed because of the other heirs' waiver

The tax court's annulment decision was upheld

In the decision of the Seventh Chamber of the Council of State dated 11.02.2021, E.2016/7522, K.2021/880, an assessment was reviewed that was made after the owner of a vehicle bought with the exemption in 2011 died in 2014 and the other heirs waived their shares in favor of one heir. The administration did not treat the shares other than the transferee's own inheritance share as a succession transfer; it applied ÖTV and a tax loss penalty on the ground of acquisition before five years had passed. The tax court annulled the acts on the ground that a distinction not found in the law could not be made the basis of a tax liability by means of a communiqué, and the Council of State upheld this result. Full text of the decision — De Jure; account access

This decision does not reach the same result as the explanations published by the administration. In GİB practice, a distinction is made between the transfer of shares to a single heir and a genuine partition of the estate. Therefore, conveying to the reader only the administrative explanation would make an important legal objection invisible. On the other hand, it cannot be concluded from a single decision that all later transactions will automatically be tax-free. The difference between administrative practice and judicial review must be kept open.

What comparison is made in a file today?

The subject of the decision is a transaction dated 2014. In a file today, the text of the law at the date of the transaction, the scope of the partition, the legal ground on which the vehicle passed to the single heir, and the basis of the assessment are compared. An objection based on the legality of taxation should be built not merely by writing the decision number but by explaining what additional condition the administration has imposed on which statutory concept. The decision is not a document that automatically secures a refund after procedural time limits have been missed.

The main records that can be submitted to the court are the first-acquisition invoice, the death and inheritance documents, the partition or transfer text, the vehicle's registration dates, and the assessment and notification documents. If the other assets in the estate were genuinely partitioned, this distribution is documented. Preparing a text that presents a partition that was not actually carried out as if it existed is not a legal solution.

A counter-example: death before the vehicle is registered

In the decision of the Seventh Chamber of the Council of State dated 31.12.2020, E.2016/5963, K.2020/5372, death occurred before registration in the name of a disabled person had been completed, although the vehicle invoice had been issued in that person's name. The dismissal in the lawsuit brought against the rejection of the heir's request for exempt registration was upheld. In the file, the court relied on the conditions of the personal exemption and on the fact that registration had not been completed. Full text of the decision — De Jure; account access

This second decision does not address the same event as the passing to the heirs of an exempt acquisition that had already been completed. The difference between the two decisions is not a superficial distinction of "in favor of" or "against" the heir: in one, a vehicle whose exempt acquisition was completed is later transferred; in the other, death occurs at the registration stage of the first acquisition. Establishing separately the invoice, delivery, payment, declaration and registration dates is therefore decisive. The vehicle and rate conditions in the older decision should not be used as current acquisition conditions.

How are the base, the share and the rate separated in the tax calculation?

If the administration counts the act as a later acquisition under Article 15/2-a, the first-acquisition base and the rate at the date of registration are important. Treating the current second-hand sale price directly as the tax base may not be correct. The calculation for the part relating to the transferee's own inheritance share should also be shown separately according to the administration's legal characterization. First the taxability of the transaction is discussed, and then the correctness of the calculation method; a calculation that is mathematically correct does not prove that the transaction is legally taxable.

Suppose that in a hypothetical file the vehicle passes to four equal heirs and three of them transfer their shares to the fourth. Under the administration's approach to the transfer of shares, the transferee's own one-quarter share and the other three-quarters are treated separately. However, this example does not mean that tax will necessarily be paid in a specific transaction, or that annulment will necessarily be obtained by the Council of State decision mentioned. The genuine partition of the estate, the acquisition period and the legal characterization must be assessed separately.

How are time limits protected when preparing an objection and a lawsuit?

The tax office's opinion letter, assessment, accrual and payment order are not the same act. The general time limit for filing a lawsuit in the tax court is, as a rule, thirty days; however, the starting point, the type of act and special time limits are determined separately. Where a payment order or a tax based on the person's own declaration is concerned, a different legal framework applies. Sending a request for a private ruling or an explanation does not stop all lawsuit time limits. Law No. 2577, Article 7

In preparing the file, it is determined which act is to be annulled, which amount is to be refunded and, where necessary, which interim protection is sought. Declaring the tax under reservation of rights (ihtirazi kayıt) or the correction-complaint route should not be recommended automatically without examining their suitability for the specific act. If the choice of administrative application and judicial route is rushed by a wish to sell immediately, a loss of rights may result.

Even if ÖTV is resolved, with which transactions does the file close?

ÖTV, inheritance and transfer tax, and MTV are separate file items. The position after death of an MTV exemption tied to the deceased is determined separately. The documents required for the notary and registration, and the checking of insurance, pledges and attachments, continue. The resolution of the ÖTV discussion does not mean that the vehicle automatically belongs to one heir or that the amount payable to the other heirs has been paid.

For an heir living abroad, the concluding file should contain together the tax letter or decision, the payment/refund document, the new registration, the partition amounts and the delivery record. If it is wished to take the vehicle abroad, customs and the import conditions of the destination country are completed separately.

Conclusion

In the inheritance of a vehicle with an ÖTV exemption, the right plan separates the first transfer from the later transfer. A decision to transfer to a single heir or to sell should not be made until the time period, the basis of the exemption and the partition of the estate have been verified with documents.
