Summary

There is no single lawsuit deadline in malpractice cases. Review private and public hospitals, the cosmetic contract relationship, the date of discovery and how mediation affects the time limit.

In malpractice disputes there is no single time limit for filing a lawsuit that applies to everyone. Tort, mandate, contract for work and public health services are subject to different rules. When calculating the time limit, what matters is the date of the event, when the harm and the responsible person became known, when the claim became due, and which applications were made. A criminal complaint or discussions with the hospital do not by themselves preserve the time limit for compensation. [1] [2] [3]

For this reason, a result obtained by entering only the date of the operation is not sufficient. The legal relationship, the correct defendant and the type of claim must be identified first. Uncertainty about the time limit does not make waiting until the records are complete safe.

Is the limitation period the same as the time limit for an administrative action?

The statute of limitations is a defence that can be raised against a private law claim. Under Article 161 of the Turkish Code of Obligations (TBK), a judge cannot take the statute of limitations into account on their own initiative. Time limits for filing an administrative action, by contrast, are examined at the initial review stage in administrative proceedings and do not depend on a party's objection. This distinction changes the legal consequences of missing a deadline. [1] [2]

In addition, the time limit for a criminal complaint, the limitation period for a criminal case, the time limit for objecting to an expert report and the time limit for appeals are separate institutions. The continuation of one does not mean that another remains open. Several clocks may start to run at the same time in the same event.

The general process of filing a lawsuit is explained in our article how to file a malpractice lawsuit.

Principal time limits in private healthcare

Legal basisBasic time frameStarting point and key distinction
TortTBK Article 72: two and ten yearsDate on which the harm and the liable party became known, or the date of the act; a longer criminal period applies subject to conditions
Mandate (vekâlet)TBK Article 147/5: five yearsDue date and the specific contractual relationship are examined
General contract ruleTBK Article 146: ten yearsApplies where no special period exists; it is not applied automatically to every hospital claim
Defective workTBK Article 478: special periodsDelivery and defect; the twenty-year rule for gross fault is examined separately
Defective service to a consumerArticle 16 of the Consumer Protection Law No. 6502 (TKHK): special regulationPerformance of the service; longer protection, and gross fault or concealment by fraud, are taken into account

The table is not a list to choose from. A claimant cannot pick the longest period at will; it is determined whether the facts and the claim actually fall under the relevant legal basis. Where several liability grounds overlap, the conditions of each are assessed separately. [1] [3]

Two-year and ten-year periods in tort

Under TBK Article 72, the short period is two years from the date on which the harm and the person liable for compensation became known; the long period is, as a rule, ten years from the date of the act. Knowledge does not mean waiting until every lira of the harm has been calculated. However, the appearance of symptoms and the acquisition of information sufficient to bring an action against the harm and its perpetrator may not coincide. [1]

A harm that develops over time, a lasting effect that appears later, or an error revealed by another doctor may give rise to a debate about the starting point. The patient's first complaint petition, the date of consulting another doctor, the reports and the correspondence are important in this debate. A later report does not restart the period each time.

If the act also constitutes a crime subject to a longer limitation period, the special rule in TBK Article 72 may come into play. For this, the criminal nature of the specific act and the applicable criminal period must be determined. A complaint filed with the prosecutor's office does not automatically extend all claims. This rule cannot be carried directly over to administrative application periods against a public hospital.

Mandate and the hospital contract

The doctor-patient relationship established for treatment is in most cases assessed under the provisions on mandate. Under Article 147/5 TBK, a five-year period applies to claims arising from a mandate contract. The starting point is determined by the due date under Article 149 TBK and the specific features of the event; the knowledge rule for tort does not apply mechanically in every file. [1]

The mixed nature of the admission agreement with the hospital, the capacity of the parties and the obligation breached may affect the classification. For this reason, applying the same starting point and period to all claims against the doctor, the hospital and the insurer is not safe. For an insurance claim, the special periods under the policy and insurance law must also be examined separately.

Why do cosmetic contracts for work require particular attention to time limits?

Where the aesthetic purpose predominates, the contract for work and the agreed result matter. However, it is incomplete to say that "there is a contract for work, so the period is five years in every case." The fields of application of Article 147/6 TBK, which governs claims arising from contracts for work, and Article 478 TBK, which governs claims arising from defective work, must be kept separate. [1]

Under Article 478 TBK, for works other than immovable structures, the period is two years from delivery; for immovable structures, five years; and where the contractor is grossly at fault, a twenty-year rule applies regardless of the nature of the defective work. Whether the specific claim falls under that provision, how delivery is determined, whether the bodily harm has a separate basis, and the effect of consumer law must be examined before any single figure is given.

Notice of the defect and acceptance under Articles 474 and 477 TBK are also not the same as limitation. Messages in which the patient reports pain, a scar, asymmetry or another problem to the doctor may be important in this respect. However, applying every consequence of an ordinary delivery of goods mechanically, without regard to the characteristics of healthcare and of an intervention on the human body, would not be correct.

A proposal for free revision work does not by itself mean that the periods start again from the beginning. It must be determined whether a new performance has been undertaken, whether the debt has been acknowledged, whether a defect repair has been made or whether this is a new independent transaction. Records of the first and subsequent interventions should be kept separate.

Application to the public hospital administration and the lawsuit time limit

Under Article 13 of the Administrative Procedure Law No. 2577 (İYUK), persons whose rights have been violated by an administrative act must, before bringing an action, apply to the administration concerned and request that their rights be restored within one year from the date on which they learned of the act by written notice or otherwise, and in any event within five years from the date of the act. The harm, the knowledge and the administrative character of the act are subject to judicial assessment in the specific case. [2]

If the request is wholly or partly rejected, a general administrative action period of sixty days applies, counted from the day following notification of the rejection; if no reply is given within thirty days, it runs from the end of that period. The content of the application, whether it reached the correct administration and the date of notification must be documented. Special provisions and holiday rules apply separately when calculating the time limit. [2]

A statement to a patient rights unit that "I am complaining about the doctor" and an application to the administration seeking compensation for the harm are not necessarily the same thing. The use of CİMER or another channel should not be regarded as sufficient without examining the content of the application and its addressee. In every case, a pre-application for compensation suited to the file should be considered.

Harm learned of later and the risk of waiting

Learning, long after the event, that the harm arose from an administrative act may matter for the starting point of the period. However, the date of each report is not a new starting point. If the patient has already reported the error, the harm and the link to the public hospital in an earlier lawsuit or application, a later claim of knowledge may not be accepted.

In its decision in the case of Fatma Altuner, B.2014/17714, dated October 26, 2017, the Constitutional Court found that the applicant had knowledge of the administrative act and the harm from the account given in an earlier civil case; in the specific case, the rejection on grounds of time limit was not considered a violation of the right of access to a court. The decision shows that the principles on later-learned harm do not create an unlimited right to wait. [4]

Which steps affect the calculation of the time limit?

TBK Article 154 regulates causes of interruption, such as acknowledgement of a debt, an application to a judicial authority by lawsuit or plea of defence, and enforcement proceedings. Not every correspondence is an acknowledgement of debt. A reply stating that an incident will be investigated and a declaration accepting liability and the debt may be assessed differently. [1]

In mediation as a condition precedent to litigation, the period from the application to the mediation office until the final minutes is not taken into account in calculating the limitation period and the forfeiture period. In optional mediation, the starting conditions are determined separately. An ordinary negotiation with the hospital over a fee refund does not by itself provide this special protection. [5]

In a lawsuit brought before a court without jurisdiction or in the wrong judicial branch, an additional period or opportunity to apply may be available. Provisions such as TBK Article 158 and İYUK Article 9 apply only if their own conditions are met. It should not be assumed that applying to the wrong court will automatically resolve every time limit problem.

The details of the mediation process are discussed in our article mediation and settlement in malpractice disputes.

Is it necessary to wait for the criminal investigation?

A criminal investigation and a claim for compensation have different purposes and procedures. Whether there is a situation that requires waiting, such as an investigation permit, an expert report or a criminal judgment, is assessed concretely. The existence of criminal proceedings does not mean that the private law or administrative time limit is automatically suspended.

The rules on investigation permission for members of the health professions should not be presented as a general permission requirement for bringing a compensation claim. The effect of the permission and procedural requirements on criminal proceedings is examined separately. The fact that the file is proceeding through one channel does not make the follow-up of other applications unnecessary.

How to prepare a file-specific time schedule

  • The date of the first intervention, the follow-up and each revision are recorded separately.
  • The first symptom, the diagnosis, the assessment of lasting harm and the discovery of the responsible person are kept apart.
  • Earlier complaints, formal notices, lawsuits and payment records are added to the chronology.
  • For the hospital, the doctor, the administration and the insurer, the basis of each claim is identified separately.
  • The start of mediation, the final minutes and the notification documents are added.
  • In every scenario, the earliest risky date is also marked separately.

This work ensures the preservation of evidence on the starting date, not only the discovery of the last day. Where it is disputed whether the period has expired, favourable legal possibilities are researched; but a route that is still open is not postponed for use in time.

Conclusion

Malpractice time limits must be calculated together with the legal classification and the chronology of events. The public–private distinction, the cosmetic contract relationship, the date of discovery and the effect of applications are decisive. The most reliable approach is not to tie all claims to a single period, but to prepare a separate timeline for each addressee and legal basis.

Frequently Asked Questions

Does every malpractice lawsuit have a five-year period?

No. Tort, mandate, contract for work, consumer law and administrative court time limits are different.

Does the period restart when a new report is obtained?

Each report does not create a new starting point. It is examined whether the harm and the responsible party were already known.

Does the period stop while a hospital fee refund is being negotiated?

An ordinary negotiation alone is not enough. Special grounds, such as mediation or a written acknowledgement of debt, are examined under their own conditions.

Is the public hospital's response period sixty days?

Under the current text of Article 13 of İYUK, the period where no reply is given is thirty days. The general lawsuit period is then calculated separately; the sixty-day response period in older sources should not be applied as is.

Does the twenty-year period always apply to cosmetic surgery?

No. The conditions of gross fault and defective work under Article 478 TBK and the legal basis of the specific claim must be examined.
