CIVIL LAWSUITS / PROCESS GUIDE

How does it proceed, step by step?

The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.

  1. The scope of the claim, liability, damage, time limits and evidence are determined; the necessary preliminary applications are completed.

  2. After the petition and the exchange of pleadings, the preliminary examination is held.

  3. In the investigation phase (tahkikat), documents, witnesses, on-site examination and court-appointed expert review are carried out to the extent needed; objections to the report are submitted.

  4. The need to increase the claim or to amend it (ıslah) is assessed according to the current applicable provision and the stage of the file.

  5. Oral proceedings, judgment, service of the reasoned judgment and the available legal remedies are followed.

  6. Enforceability and, where required, the conditions for becoming final are examined and the judgment is carried out.

THIS DISTINCTION MATTERS

Do not overlook the conditions specific to your matter.

Not every monetary claim is heard under written procedure. The competent court and special laws may provide for simplified procedure. The type of claim is not selected automatically.
