CIVIL LAWSUITS / PROCESS GUIDE
How does it proceed, step by step?
The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.
It is determined whether the claim concerns eviction, the rent amount, adjustment or a monetary claim; the contract, notices and payment records are reviewed.
The requirements for a formal notice (ihtar) and application are checked, and the court route is distinguished from the route of enforcement without a judgment.
On the court route, mediation is completed if required; the proceedings are conducted in the competent court under the appropriate procedure.
Depending on the type of case, payment records, the condition of the property, comparable data and, when needed, a court-appointed expert examination are assessed.
After the decision and the legal remedies, eviction or the enforcement of the claim is followed separately.
THIS DISTINCTION MATTERS
Do not overlook the conditions specific to your matter.
The exception for eviction through enforcement without a judgment under the Enforcement and Bankruptcy Law (İİK) should not be confused with the mediation requirement in a lease case. Time limits specific to the ground for eviction are examined separately.
