Unfair competition refers to conduct and commercial practices that are deceptive or otherwise contrary to the principle of good faith and that affect relations among competitors or between suppliers and customers. It is regulated in Articles 54 et seq. of the Turkish Commercial Code (TTK). Disparagement, misleading statements, causing confusion, disclosure of business secrets and inducing breach of contract are the main examples; they may be the subject of actions for declaration, prevention, restoration of the prior status and damages.

Unjust enrichment is a person’s enrichment, without a justified legal ground, at the expense of another’s assets or labor. Transfers based on a ground that is invalid, did not materialize or later ceased to exist may be reclaimed. The scope of restitution may vary depending on the good or bad faith of the enriched person.
