Electronic money

Finance, Capital Markets, Enforcement and Compliance

Electronic money is monetary value that is issued in exchange for funds deposited with an institution, stored electronically, used in payment transactions and also accepted as a payment instrument by persons other than the issuer. In Turkish law it is regulated by Law No. 6493; only banks, PTT and electronic money institutions that have obtained a permit from the Central Bank may issue it. The issuing institution issues electronic money equal to the funds it receives; these funds are not regarded as deposits and no interest linked to the holding period is paid.

Evidence (delil)

Obligations, Compensation, Consumer and Dispute Resolution

Evidence (delil) is a means of proof that serves to convince the judge whether a fact (an event) disputed between the parties in a lawsuit is true. In civil procedure, instruments and other documents, oath, witnesses, expert examination and on-site examination are the principal forms of evidence; unless the statute makes a particular form of evidence mandatory, other evidence may also be used. Evidence obtained unlawfully cannot be taken into account by the court in proving a fact.

Explicit consent

Technology, Data, Intellectual Property and Media

Explicit consent is the approval that a person gives, on the basis of prior information and of their own free will, for data processing on a specific subject. It is defined in Article 3/1-a of Law No. 6698 on the Protection of Personal Data and appears in Article 5 as one of the conditions for processing personal data. Where another processing condition listed in the Law exists, explicit consent is not required. Consent that has been given can be withdrawn at any time; withdrawal has effect for the future.
