Summary

In what order are residual value, debts, value to be added back and equalization calculated? Learn about mutual claims and the limits of a sample calculation.

Calculating a participation claim does not mean adding up all of one spouse’s assets and dividing them in two. For each spouse, personal property and acquired property are separated; the residual value is found after the relevant debts, equalization and values to be added back have been processed. The statutory sharing rule is applied to this net value.

Which Columns Should the Calculation Table Contain?

Each row should show the identity of the asset, its owner, its date of acquisition, its source, its status at the end of the regime, the valuation date, the gross value and the related debt. Equalization and the other spouse’s share in increased value should be explained in separate columns. If it is not clear why an item was added or removed, the arithmetic accuracy of the total is not sufficient on its own. [1]

Which Documents Are Decisive in Defending a Debt?

The actual drawdown of the loan, the purpose of the payment, the remaining principal and later payments are examined. A mortgage limit is not a debt balance. In an allegation of a debt to a close relative, the contract, the money transfer and the repayment conduct matter. However, the fact that a debt has not yet fallen due does not require that a debt that actually exists and belongs to the relevant asset group be disregarded in every case.

What Is Done If Both Spouses Have Acquired Property?

Hypothetically, let one spouse’s positive residual value be 4,000,000 Turkish lira (TL) and the other’s 1,000,000 TL. Where there is no other claim or contractual ratio, the mutual participation amounts are 2,000,000 and 500,000 TL. Netting can reach a result of 1,500,000 TL. This example rests on the assumption that all items are correctly classified and can be assessed procedurally; it does not include interest or independent claims.

What Does a Negative Residual Value Mean?

If one spouse’s acquired-property debts exceed the assets, this negative balance is not automatically loaded onto the other spouse as a half debt. Joint liability toward the bank, however, may arise from a separate cause. The internal liquidation account and liability toward a third party should therefore be explained under two separate headings.

Final Check of the Report

Has a personal contribution been separated twice, has a company debt been deducted both in the share value and in the personal account, has the same sale price been entered both as bank money and as value to be added back? These three checks can reveal significant duplications in reports that look detailed.

How Do Debts, Mortgages and Suretyships Affect Property Division?

That a debt arose during the marriage does not mean that half of the debt automatically passes to the other spouse or that it must necessarily be deducted from the liquidation balance sheet. Liability toward the creditor in the external relationship and the internal matrimonial property regime account between the spouses must be kept apart. Under Article 224 of the Turkish Civil Code, each spouse is, as a rule, liable for his or her own debts with all of his or her assets; cases of joint loans, suretyship, representation of the marital union and joint borrowing are examined separately.

Which Questions Are Asked for a Debt to Be Taken into Account in Liquidation?

  • Which spouse is legally responsible for the debt?
  • For the acquisition, preservation or improvement of which asset did the debt arise?
  • Does the debt actually exist on the date the matrimonial property regime ended?
  • Was the consideration for the debt used in the spouse’s assets or in family expenses?
  • Should the debt be charged to the personal property group or to the acquired property group?
  • After the cut-off date, by whom and from which asset group was it paid?
  • Is the debt a genuine economic transaction, or an apparent entry created in order to reduce the liquidation?
Type of debtSpecial examination in liquidation
Home/vehicle loanThe down payment, the instalments paid up to the cut-off date, the remaining principal, later payments and the mortgage are assessed together.
Credit card/consumer creditIt is investigated whether the spending was made for a family expense, the acquisition of an asset or personal consumption.
Tax and Social Security Institution (Sosyal Güvenlik Kurumu) debtThe income or business with which the debt is associated is identified; the status of items of a personal penal nature is separated.
Company debt and suretyshipThe debt of the company as a legal entity, the spouse’s personal suretyship and the value of the company share are not confused with one another.
Debt between spousesGift, family solidarity, obligation to return and genuine intent to lend are distinguished by evidence.
Debt to a close relativeThe date of the contract, the bank movement, repayment, economic capacity and the genuineness of the transaction are examined.
Mortgaged assetThe land registry value is not taken gross and the entire mortgage amount deducted mechanically; the actual debt balance is determined.

Are Joint and Several Suretyship and a Personal Mortgage Entered as Liabilities?

That a spouse stands surety for a company’s debt or mortgages his or her immovable property for a third party’s debt does not cause the entire maximum amount secured to be entered on the liquidation liabilities side. The following distinction is made:

SituationEffect on liquidation
The principal debt has arisen, is due and has been directed at the suretyThe actual debt balance, the right of recourse and the asset group to which the debt relates are examined.
The debt exists; but it is uncertain whether the surety will payA contingent risk does not automatically become a liability; the likelihood of its materializing, the security and the principal debtor’s ability to pay may be the subject of an expert examination.
There is only an old/high-limit mortgage entry in the land registryThe current closing balance and the debt relationship are requested from the bank; the entire limit is not deducted.
The surety spouse made a payment after the cut-offThe recourse claim for the payment, the internal relationship with the debtor spouse and the effect on the liquidation calculation are assessed separately.

The residual value cannot be reduced by a collateral risk that has not yet arisen or is entirely hypothetical. By contrast, an actual debt that exists on the cut-off date, can be quantified and belongs to the acquired property cannot be disregarded merely because it has not yet fallen due.

How Is a Defense of a Simulated or Subsequently Created Debt Reviewed?

A private instrument drawn up after the divorce dispute arose, an acknowledgment of a high-value debt to a family member, or a contract with no bank movement may not prove the genuineness of the debt on its own. The date of drawing up, whether the money was actually delivered, the creditor’s ability to pay, repayment conduct, tax and bank records and the relationship between the parties must be assessed together. A debt proven not to be genuine cannot reduce the liquidation balance sheet; however, the burden of proof and the third party’s status as a party are determined according to the specific claim.

How Is the Liquidation of the Matrimonial Property Regime Calculated?

What Is the Order of Calculation?

  • The start and end dates of the matrimonial property regime are determined.
  • The owner and the source of acquisition of each asset are established.
  • Personal and acquired property are separated.
  • Return and co-ownership in shares transactions are assessed.
  • The values to be added back under Article 229 of the Turkish Civil Code are determined.
  • Equalization between the asset groups of the same spouse under Article 230 of the Turkish Civil Code is carried out.
  • Debts relating to the acquired property are deducted.
  • The residual value is found; a decrease in value is not taken into account.
  • Each spouse acquires a participation claim over, as a rule, half of the other spouse’s residual value.
  • The net result is found by setting off the mutual claims.
  • The share in increased value and independent claims are added separately.
  • Payment, interest and, if necessary, deferral are assessed.

What Is the Basic Formula?

Residual value = Liquidation value of the acquired property + values to be added back + equalization in favor of the acquired property − debts relating to the acquired property − equalization in favor of the personal property

Participation claim = Half of the other spouse’s positive residual value

This formula gives only a skeleton. The share in increased value, mixed financing, a company, gratuitous transfer and the spouses’ mutual claims are separate layers of calculation.

Simplified Example

Let the market value, close to the date of the decision, of Spouse A’s acquired property entering the liquidation be 6,000,000 TL, the debt to be taken into account for this asset 1,400,000 TL, and the equalization in favor of the personal property 600,000 TL. On the assumption that there is no other item:

  • Residual value: 6,000,000 − 1,400,000 − 600,000 = 4,000,000 TL
  • Spouse B’s participation claim: 2,000,000 TL

This example does not include fees, interest, the spouses’ mutual claims, tax, sale expenses or the share in increased value. In a real file, each item must be built up with its document.

How Is the Liquidation of the Matrimonial Property Regime Calculated?

Liquidation is not a single operation of “half of the asset.” A separate balance sheet is drawn up for each spouse.

How Does the Result Change in Eight Practical Scenarios?

The examples below are not a judgment or a guarantee of outcome but simplified scenarios showing the correct order of analysis. In a real calculation, land registry, loan, cash flow, debt and expert data must be used.

ScenarioLegal focusPriority evidenceLikely direction of calculation
1. Personal down payment + loan during the marriageCan it be proven that the down payment was inheritance or pre-marital money? An uninterrupted bank movement from the inheritance or the sale of a former asset to the new homeAfter equalization in favor of the personal property or the share in increased value is set apart, the remaining acquired value is liquidated.
2. A home bought in 2001, whose loan was paid after 2002Separating the two regime periods for the same assetLand registry, initial loan schedule, instalment statement before and after 2002Ownership may remain personal; payments from an acquired source after 2002 may give rise to an independent claim/equalization calculation.
3. A home bought in the other spouse’s name with inheritance moneyWas the money gifted, lent or contributed gratuitously?Inheritance, sale and transfer chain; correspondenceIf there was no intention to donate, a share in increased value, return or another claim can be assessed.
4. Instalments paid after the divorce actionThe asset value and debt on the cut-off date versus later paymentDate of the action, debt balance, later bank receiptsLater payment is not automatically divided in half; the relationship between the debt on the cut-off date and the paying spouse’s assets is calculated separately.
5. Home transferred to the spouse’s mother before the divorceGratuitous disposition, intent to reduce or simulationOfficial deed, transfer of consideration, possession, rent, kinship and timingArticle 229 of the Turkish Civil Code, a simulation/title action, an injunction and, if necessary, Article 241 of the Turkish Civil Code produce different results.
6. Pre-marital company share + profit during the marriageDistinguishing the share itself from share income, pay for labor and increase in valueShare ledger, balance sheet, general assembly, current account, payrollThe share may remain personal; the existing dividend, pay and the increase in value from an acquired source are investigated separately.
7. Land registry title in equal halves, most of the price from one spouseRelationship between the title share, the intention to donate and the contribution claimSale price, bank movement, intention of the partiesWhile the co-ownership in shares is preserved, a claim may arise because of the contribution to the other share; no automatic change of registration is made.
8. Spouse’s death + family residence + inheritanceFirst the matrimonial property regime, then the estate and the inheritance shareDeath, land registry, debt, will and inheritance recordsThe surviving spouse’s liquidation claim is set apart as an estate debt; the remaining estate is divided according to the inheritance provisions, and Turkish Civil Code Article 240/652 is examined separately.

How Are the Spouses’ Mutual Claims Netted?

A separate acquired-property balance sheet should be drawn up for each spouse, each one’s participation and share-in-increased-value claim against the other spouse should be found separately; set-off/offsetting should be carried out only after assessing its legal conditions and the parties’ claims. Calculating “half” from only one spouse’s list of assets makes the other spouse’s acquired property and counterclaim invisible.

Frequently Asked Questions

When a Participation Claim Is Calculated, Which Value of the Asset and Which Deductions Are Taken into Account?

First, personal and acquired property are separated; the acquired property existing when the regime ended is determined. The residual value is found by processing the values to be added back, equalization between asset groups and the relevant debts. For existing assets, the rule is the market value at the time of liquidation. In transfers to be added back, there is a special valuation rule in the calculation. The same debt or contribution must not be deducted twice.

Can I Ask for the Title to Be Registered in My Name Directly Instead of a Participation Claim?

A participation claim is essentially a personal claim right; it does not automatically confer half of the title. The law allows payment in kind; however, this possibility does not give every creditor the authority to demand registration of whichever immovable property they wish. In an asset held in co-ownership, special provisions such as superior interest or the surviving spouse’s right to the family residence, and a valid promise of transfer, are examined separately.

Why Is Equalization Made Between the Personal Property and Acquired Property Groups?

If a payment was made from the acquired property for the same spouse’s personal property, or from the personal property for the acquired property, equalization between the asset groups comes into play. The purpose is to record the contribution one group has made to the other group’s account in the right place. This operation is not the same as the share in increased value arising from a contribution to the other spouse’s asset. The ownership and the asset group that made the payment must be established first.

How Is the Equalization Amount Reflected in the Calculation Table?

Equalization is treated as a debt in the benefiting asset group and as a claim in the contributing asset group. If there is an increase or a decrease in the contribution made to the asset, the contribution ratio and the liquidation value are taken into account. In this way, a contribution made from a personal source to acquired property can be separated from the participation calculation. The same payment should not be entered again both as a debt reduction and as equalization.

Which Debts Can Be Deducted in a Property Division Calculation?

Actual debts relating to the acquired property group are taken into account in the residual value calculation. For whom the debt is in the name of matters as much as for which asset or purpose it arose. Personal expenditures after the end of the regime and unproven intra-family debt instruments do not automatically constitute a deduction. A loan, a mortgage and suretyship are also not the same concept; the actual debt, the security and the payment should be examined separately.

The Balance of an Ongoing Debt as of Which Date Is Taken as the Basis?

The debt position on the date the regime ended is the starting data. By contrast, taking the asset into account at its current value and later payments may require separating the loan financing by periods. Deducting all remaining instalments directly at today’s value is not correct in every file. Principal, interest, early closing and personal payments should be shown separately.

After Which Operations Does the Residual Value Emerge?

The residual value is found by subtracting the debts relating to this asset group from the total of the acquired property together with the results of the values to be added back and equalization. Not all personal property joins this pool. A negative residual value is not loaded onto the other spouse as an automatic debt. A separate calculation is made for each spouse; the statutory or valid contractual participation ratio is applied afterward.

Can the Share the Spouses Receive from the Residual Value Be Changed by Contract?

By a matrimonial property regime contract, the spouses can accept a basis different from the statutory half ratio. The reserved portions of children who are not joint are protected. In the case of divorce, annulment or separation of property by court decision, for a different division to be applied the contract must expressly provide for this situation. A settlement or release (ibra) made after the liquidation has arisen is assessed separately.

Can My Spouse’s Personal Debt Both Be Directed at Me and Be Deducted from the Division Calculation?

Whether a debt can be demanded from you by a third party and from which group it is deducted in the matrimonial property regime calculation are separate matters. Marriage alone does not create personal liability for all of the other spouse’s debts. There may be special grounds such as a joint debt, suretyship or representation of the marital union. By contrast, an actual acquired-property debt may reduce the residual value. Both results should be explained with their own basis.
