What should be done first after a safari accident?
The priority is the safety of the injured person and access to medical care. In an emergency, 112 should be called; the location of the incident, the access route and the number of injured people should be stated clearly. Medical intervention should not be delayed to collect evidence, nor should anyone re-enter a dangerous track. Reporting an incident involving injury or death to the law enforcement authorities matters for having the incident officially recorded and the necessary judicial procedures started. [3] [18] [19]
- Record the time and place of the incident. The tour name, departure point, route, location, vehicle/plate details, the driver’s identity and the time of the first response should be established as far as possible.
- Preserve the sales chain. The booking confirmation, tour participation document, invoice, payment receipt, online listing, hotel sales point and messages should be kept. The visible name of the tour and the company that received the money and actually provided the service may be different.
- Identify evidence that may change. Images of the vehicle and the track from a safe distance, the state of helmets/seat belts, tires, the braking area, the ground and weather conditions, and the contact details of witnesses should be recorded.
- Obtain the medical records as a whole. The initial examination, imaging, treatment, referral, prescription, sick leave and subsequent check-up documents, together with expense documents, should be kept within the same sequence of events.
- Understand the text you are asked to sign. An incident report, payment receipt, release, settlement or criminal reconciliation document may have different consequences. For a text in a language you do not understand, an explanation and, where necessary, a translation should be obtained.
The function of these steps is to allow claims raised later to be assessed together with the first records of the incident. A report prepared by the business is not, on its own, a conclusive fault report. A photograph or a witness statement likewise does not on its own prove all the conditions of liability; the evidence is considered so that it complements one another.
Why should a day-trip safari, a package tour and a vehicle rental be distinguished?
The relationship between a person who buys a tour for non-commercial and non-professional purposes and a business providing the service professionally is, if the conditions are met, a consumer transaction. Being a foreign tourist does not remove consumer status. However, a consumer transaction, a package tour, carriage and a vehicle rental are not the same legal relationship. What matters is the content of the promised service and of the actual organization as much as the name of the contract. [2]
Not every day-trip activity is a package tour
Under Consumer Protection Law No. 6502 Art. 51 and the Regulation on Package Tour Contracts, at least two of transport, accommodation or other tourism services that are not ancillary to them must be offered together at a total price, and the program must also last longer than twenty-four hours or include overnight accommodation. For this reason, selling a transfer, a lunch and a few hours of ATV riding at the same price does not by itself produce a package tour. Where a day-trip activity is a committed part of a broader package tour purchased in advance, the whole contract is examined separately. Splitting services that genuinely form a single package into separate invoices does not by itself exclude the package tour rules either. [2] [5]
The difference between handing over a vehicle and an organized tour service
The business may merely have made the vehicle available for a certain period; if, however, it chooses the track, forms the convoy, assigns a lead vehicle, gives a safety briefing and directs the participants, it may have assumed a broader service. The word “rental” in the document does not make the organization actually carried out invisible. Conversely, it is not accepted without documents that a platform merely providing a sales link or a hotel employee is the organizer of the whole tour. The examination must jointly assess the sales listing, the collection of payment, the participation document and the actual management of the service. [1] [2] [7]
Does the Highway Traffic Law apply on an off-road track?
That the accident occurred on a dirt or forest road does not by itself exclude the application of the Highway Traffic Law. Art. 2 of the Highway Traffic Law (KTK) also covers areas outside public highways that are open to the public, and the parts of certain places listed in the article that are used for vehicle traffic. The public use and the actual character of the road matter as much as its ownership. On the other hand, not every private and enclosed activity track can automatically be accepted as falling within this scope. [3]
After the legal and actual status of the track and the technical nature of the vehicle are established, the operator’s liability under traffic legislation, compulsory insurance and other relevant provisions are assessed. In an incident that falls outside the KTK, the examination continues under the contract, tort and the other liability provisions whose conditions are met. Therefore the approach that “it is an off-road accident, so there is no legal liability” is not correct. [1] [3]
Under what conditions are the tour organizer, agency, vehicle operator and guide liable?
For liability to be soundly established, the duty of each person or company, the obligation that was breached, and the effect of that breach on the accident or on the aggravation of the loss must be shown. More than one ground of liability may exist in the same incident; but merely having a connection with the tour is not sufficient for everyone to be automatically held liable for the same obligation. [1] [3]
| Person or business | Liability to be examined | Decisive records |
|---|---|---|
| Tour organizer / debtor under the contract | Safe organization in conformity with the contract; choice of track, vehicle, staff and training; acts of auxiliaries used in performance. | Program, listing, contract, organization and subcontract agreements. |
| Agency that sells or acts as intermediary for the tour | Its own commitment, its information duties and its intermediary role; the relevant special liability provisions if there is a package tour. | Collection of payment, invoice, agency license number, details of the agency that owns the product. |
| Vehicle operator / operating enterprise | If the KTK applies, the liability of the operator and of the owner of the operating enterprise; otherwise the appropriate general provisions. | License, rental relationship, economic operation and actual control over the vehicle. |
| Driver | The effect on the accident of speed, maneuvers, following distance and other personal conduct. | Law enforcement record, footage, witnesses, technical examination and, if any, location data. |
| Guide, tour leader or instructor | Duties of instruction, supervision, route and response within the actual duty undertaken. | Assignment, qualification documents, tour instructions and actual practice. |
| Hotel / sales point | On whose behalf it sold the service, its own commitment and participation in the organization; its own negligence, if any. | Hotel invoice, sales desk records, booking and the relationship between the businesses. |
Using an independent business does not release the organizer from liability in every case
For non-performance of a contract, Art. 112 of the Turkish Code of Obligations (TBK) is important; for the use of auxiliary persons in performance, Art. 116. Art. 66, on damage caused by an employee while doing the work, is a separate liability regime with different conditions. For this reason, the examination cannot be closed with the explanation that “the driver was not our employee” or “the vehicle belonged to another company.” In which relationship this constitutes a valid defense is determined by who the debtor of the service is and who was actually used. [1]
In a genuine package tour, the act of an independent service provider is also assessed for the liability of the organizer or the intermediary. The third-party exception in the Regulation concerns a person who is not involved in the performance process; a subcontractor used in carrying out the tour cannot be brought within this exception merely because it is a separate company. For a foreign organizer with no representative in Türkiye, the position of the intermediary is examined separately under Art. 17 of the Regulation. [5]
If the activity is the activity of an enterprise that poses a significant danger within the meaning of TBK Art. 71, the special liability of the owner and the operator of the enterprise may also be examined. The name ATV or safari does not by itself produce this result. The nature of the enterprise, the vehicles and power used, and its capacity to cause frequent or serious harm even where an expert takes all due care are assessed. Provisions of special laws are reserved. [1]
Vehicle ownership, operatorship and the tourist driving are not the same thing
Under KTK Arts. 3 and 85, the relationship among the registered owner, the long-term lessee and the person who operates the vehicle on their own account and at their own risk is investigated. A tourist briefly taking the wheel does not automatically make that tourist the vehicle operator. In incidents where the KTK can be applied, the liability of the operator and, where the conditions exist, of the owner of the enterprise operating the vehicle is assessed separately from the driver’s personal fault. Unless the statutory grounds for release are met in the concrete case, the explanation “the customer was driving the vehicle” alone does not provide full release. [3]
Guide, tour leader and driver should not be used interchangeably
The statutory professional capacity of a professional tourist guide, the technical duty of a tour leader directing a sports activity, and the capacity of the person driving the vehicle are different. For genuine tourist guiding services under Law No. 6326, the conditions for practicing the profession are required. Calling an employee a “guide” does not make that person responsible for all technical maintenance work; and carrying out the duty under another name does not remove the authorization conditions of the genuine guiding service. It must be established what instruction the person gave in the accident, what danger the person should have noticed, and what authority to intervene the person had. [10]
If the conditions for the liability of more than one person for the same loss are met, joint and several liability may arise under TBK Art. 61 and, to the extent applicable, KTK Art. 88. For this, the legal liability of each person must first be established. Recovery of the loss from one liable person does not make it possible to recover the same loss a second time; internal allocation among the liable persons and recourse are assessed separately. [1] [3]
How does the tourist being a driver or a passenger change the examination?
If the tourist is driving the ATV or buggy
The participant-driver’s speed, maneuvering, following distance, compliance with the instructions given, authorization to drive and declaration of experience are investigated. At the same time, the usability of the vehicle, the choice of a suitable track, adequate briefing, management of the convoy and allocation of a vehicle appropriate for the person are examined. A mistake by the participant and an organizational deficiency of the business may both be effective in the same accident. The expert assessment should distinguish between these two possibilities. [1] [3] [8]
Regarding protective equipment and the driving license
The name ATV, UTV, buggy or jeep does not show that the same license, passenger capacity, helmet and seat belt rule applies to all vehicles. The vehicle registration and technical class, the place where the activity is carried out, the permit conditions and the applicable local regulation must be read together. The conditions for using a foreign license in Türkiye are also examined on the actual document. Listing statements such as “no license required on the track” are not proof of legal compliance. For the effect of a missing document or item of equipment on compensation, its connection with the occurrence of the accident or the severity of the injury must be established separately. [1] [3] [8]
If the tourist is a passenger in a vehicle driven by the guide or business staff
A passenger’s control over the vehicle differs from a driver’s. Speed, curves, convoy spacing, the risk of the vehicle rolling over, the seating arrangement, passenger capacity and protective systems come to the fore. A transfer included in the tour price is not treated as gratuitous courtesy carriage merely because no separate carriage fee is written. The economic relationship and the place of the journey in the tour service are assessed. If the passenger acted contrary to warnings, the effect of this on the loss is also made concrete. [3] [4] [7]
If another vehicle or a third party is involved in the accident
The fault of another driver does not automatically remove a deficiency in the tour organization. On the other hand, an event that the organizer could not have prevented and that cannot be attributed to it does not mean it incurs a duty to pay compensation in every case. The grounds for release under the applicable liability regime, vehicle defects and the conduct of the persons on duty are examined together. Fault ratios should not be announced in advance as percentages without evidence. [1] [3] [5]
How is it investigated whether the accident was preventable?
Looking only at the steering movement at the moment of the accident in a liability examination may lead to an incomplete result. From the sale of the activity to the delivery of the vehicle, and from the choice of track to emergency response, the organization as a whole should be assessed. The expression “adventure tour” does not allow manageable risks to be placed on the participant without limit. At the same time, not every injury on its own proves that the business is at fault. [1] [2] [3] [8]
Track, weather conditions and activity permits
The slope of the track, ground irregularities, bends, water crossings, visibility and the likelihood of encountering other vehicles must be examined together with the capacity of the vehicle used and the experience of the participants. What precaution was taken for a previously known danger, recent rainfall or a change of route is investigated. The existence of a permit or qualification document is not on its own proof that the concrete organization was carried out safely; and the absence of a document likewise cannot be treated as the automatic cause of the entire loss without establishing its connection with the occurrence of the accident. [1] [3] [8]
The rules on tourism-related sports activities, decisions of governorates and the relevant boards, the special regulations of the area where the track is located and the actual nature of the activity are checked together. The age, vehicle-number or route requirements of another province cannot be applied directly to Antalya. The provision added by the October 2, 2026 amendment on the allocation or leasing of activity areas does not change the fact that the track permit and private-law liability are separate examinations. The local decisions in force on the date of the accident must be obtained for the file. [8] [9]
Vehicle maintenance, training and response organization
Characteristics such as the brakes, tires, steering, throttle mechanism, seat belt, rollover protective structure and the manufacturer’s passenger capacity are examined according to the vehicle type. The existence of a maintenance invoice should not be regarded as sufficient; the time and scope of the maintenance, earlier fault reports and changes made after the accident should be investigated. Repairing or disposing of a damaged vehicle without an examination may cause the technical evidence to be lost. [1] [3]
As to training, alongside a signed form, what was actually explained and whether a practical trial was conducted matters. It is investigated whether instructions such as braking, turning, following distance, behavior on a slope and how to stop in case of a fault were given in a way the participant could understand. The tourist not knowing Turkish does not justify a failure to communicate. Conversely, it should not be assumed that a single foreign language or the same training duration was provided for all activities. [1] [2] [7] [8]
Whether staff were required at the head and the end of the convoy, the means of communication, first aid equipment, the emergency call and the evacuation plan are also assessed according to the characteristics of the incident. Whether a delay in the response increased the loss independently of the initial injury may require medical and technical examination. The obligations under Art. 13 of the Regulation on Sports Activities for Tourism Purposes to keep a participant list, to notify changes in the qualification conditions before the activity, and to notify the Board immediately of an accident by report must be checked separately. [1] [8]
Does an “I accept all risks” form remove the right to compensation?
Signing a standard risk acceptance form does not remove all of the business’s liability. TBK Art. 115/1 holds an agreement that excludes liability for gross negligence in advance absolutely void. Where the conditions of an expert service that depends on a statute or a permit of the competent authority are met, Art. 115/3 is also examined. In consumer transactions, unfair term control under Law No. 6502 Art. 5 additionally applies; standard terms that remove or limit liability for death, injury and material loss caused by the act or omission of the business are at the center of this control. [1] [2] [6]
In a relationship of the package tour kind, Art. 18 of the Regulation on Package Tour Contracts is taken into account; in liability under the KTK, KTK Art. 111 is taken into account separately. Writing “the signatory waives all rights” in the form does not make mandatory provisions ineffective. A signature does not by itself show that the text was genuinely negotiated individually either. [2] [3] [5] [6]
On the other hand, statements showing that a safety instruction was given, that a particular experience was declared, or that a clear warning was understood may constitute evidence. The language of the form, the possibility of translation or explanation, the conditions of signing and the content of the specific warning are examined. If the tourist did not use protective equipment or acted contrary to instructions, its real effect on the accident or on the aggravation of the loss must be determined. A signature in a language that was not understood does not automatically invalidate the whole contract, and a single signature does not cure all safety deficiencies either. [1] [2] [6]
Which evidence should be requested, from whom and when?
Photographs and hospital records are valuable as a starting point; but some of the important documents may be held by the business, agency, hotel or insurer. The records to be requested must be made specific by stating the date, time, vehicle and tour group of the incident. With regard to the protection of personal data and the rules on lawful acquisition, priority should be given to ensuring that the records are preserved and not deleted. [11]
| Record group | Specific information to be investigated |
|---|---|
| Sales and booking | The listing as it was on that date, program, contract, voucher, invoice, the recipient of payment, the actual service provider and safety promises. |
| Vehicle and technical condition | Registration or vehicle identification details, maintenance and repair history, fault reports, post-accident examination and replaced parts. |
| Track and organization | Route, original GPS data if any, weather, permits, participant list, division of duties and convoy order. |
| Training and delivery | Language and content of the instruction, trial ride, delivery of equipment, the vehicle used and the suitability of the protective equipment for the person. |
| Footage and witnesses | Camera, in-vehicle or action camera recordings; the witness’s identity, contact details and what the witness personally saw. |
| Health and economic loss | Initial examination, imaging, surgery and check-up records, sick leave, rehabilitation, income documents and expense receipts. |
| Post-incident procedures | Law enforcement and emergency response records, the business’s incident notification, correspondence with the insurer, the payment offered and the documents you were asked to sign. |
Although a preservation request sent to the business is useful, it does not replace a court decision on preservation of evidence. Where there is a risk that a record will be lost, a vehicle repaired, or the later production of the evidence will become considerably more difficult, court-ordered preservation of evidence under Code of Civil Procedure (HMK) Arts. 400–403 may be considered. Before an action is filed, this goes to the court that will hear the main action or the civil court of peace at the place where the relevant evidence is located; after an action is filed, as a rule, to the court hearing the case. In urgent cases, the conditions for proceeding without prior notice to the other party are examined separately. [11]
The expert should not be asked only “who is at fault?” Whether the defect existed before the accident, whether the chosen track was suitable for the vehicle, whether the training could have prevented the specific risk, the likelihood that the equipment would have reduced the injury, and the effect of the delay in response should be made concrete. The expertise required in mechanics, traffic, organization and medicine may differ; determining the outcome on legal liability is the task of the court. [1] [3] [11]
What losses can be claimed in the case of injury or death?
Bodily harm and economic losses
Under TBK Art. 54, treatment expenses, loss of earnings, losses arising from reduction or loss of working capacity, and impairment of the economic future are examined. On what legal and medical basis necessary care, rehabilitation, transport or similar expenses are claimed must be explained. Not every invoice is automatically taken as the basis of the judgment; the necessity and appropriateness of the expense, its connection with the accident, and the nature of a payment made by another institution are assessed. [1] [3]
The foreign tourist’s job in their own country, actual income, working conditions and course of treatment also matter. Tax and wage documents, employer statements and medical records should be submitted in an appropriate manner. If the cost of returning home, medical escort or additional accommodation is claimed, it must be shown why this was necessary. If permanent effects cannot yet be determined, follow-up examinations and the report regime to be applied are taken into account; the initial hospital record is not always sufficient to determine a permanent loss of working capacity. [1] [11] [17]
Death, claims of relatives and non-pecuniary damages
In the event of death, funeral expenses, and, if death did not occur immediately, losses from treatment and loss of work, as well as compensation for loss of support, may arise. The right to compensation for loss of support does not depend solely on being an heir. The conditions of the support provided or expected to be provided by the deceased are investigated. Non-pecuniary damages of the injured person, and the non-pecuniary damage claims of relatives in cases of serious bodily harm or death, are assessed separately within the framework of TBK Art. 56. [1]
A reliable figure for the amount of compensation cannot be given from a diagnosis or an accident photograph alone. Variables such as age, income, occupation, the effect on working capacity, fault, the support relationship, and the legal nature of social security and insurance payments affect the result. The same loss cannot be recovered twice from different liable persons; it must be understood which head of loss a payment offer covers and whether it is tied to a release. [1] [3] [12]
The tour price and wasted holiday time
Failure to provide safety or the promised service may, depending on its conditions, also bring the defective service provisions into play. Together with the remedies of the consumer’s choice under Art. 15 of Law No. 6502, compensation under the TBK can also be claimed; the victim’s claim cannot be reduced to a refund of the tour price alone. However, not all of the remedies of the consumer’s choice can be used together and without limit; the nature of the service and the conditions of the claimed remedy are assessed. [1] [2]
Where a genuine package tour is concerned, appropriate compensation for wasted holiday time may also arise under Law No. 6502 Art. 51 and Art. 13 of the Regulation on Package Tour Contracts. This special possibility does not apply automatically to every day-trip activity. The program, accommodation and health records showing which part of the holiday the accident made unusable, to what extent and why are important. [2] [5]
Which insurance may come into play?
The explanation “the tour is insured” is not sufficient on its own. The insured person or liability, the scope of the activity, the policy period, the date of the incident, the limit and the exclusions must be determined. The business’s policy and the travel policy the tourist took out in their own country serve different functions. The absence of a policy does not by itself remove the right to compensation against other liable persons. [3] [4] [8] [21]
| Insurance or guarantee | Subject of examination |
|---|---|
| Accident and financial liability policies relating to the activity | Policies required for staff and tourists in a business that falls within the sports activity legislation; the activity, person, track, date and coverage limits. |
| Compulsory traffic insurance | The legal nature of the vehicle and the place of the incident, the scope of the KTK, the capacity of the injured party, insured liability, the dates of the accident and the policy. |
| Package tour liability insurance | Under Law No. 1618 Art. 12/a, liability arising from the promised service not being provided at all or not being provided properly; the package nature and the coverage conditions. |
| Personal travel, health or personal accident policy | Adventure activity and vehicle driving exclusions, additional cover if any, emergency assistance notification, the conditions for treatment and repatriation costs. |
| Guarantee Account (Güvence Hesabı) | The statutory conditions for the relevant compulsory insurance, certain bodily losses and limits; it is not a general fund covering every uninsured tour accident. |
The obligation to insure package tour liability under Art. 12/a of Law No. 1618 should be separated from the duty to inform the customer under Art. 12/b that accident, illness, treatment and return costs can be insured separately. The second provision does not mean that all bodily losses of all tourists are automatically and unlimitedly insured. It should also not be assumed that Turkish general terms and conditions apply as they stand to a policy issued in a foreign country. [4] [17]
In traffic insurance, the July 1, 2026 entry-into-force date of the June 12, 2026 amendment and the transitional regime tied to the contract date in General Terms and Conditions C.11 must be checked. Blanket exclusion statements based on old texts should not be used for temporary and permanent incapacity to work and caregiver costs. The statute, the current general terms and conditions, judicial review and the concrete policy are assessed together. Non-pecuniary damages are outside the scope of compulsory traffic insurance (KTK Art. 92/f); claims that may be directed at other liable persons are assessed separately. [3] [15] [23]
Application to the insurer and insurance arbitration
For compulsory traffic insurance, under KTK Art. 97 a written application to the insurer must be made first. An arbitration application may be considered if the insurer has rejected the claim wholly or partly by a final written reply, or, if there is no reply, once 15 days in traffic insurance and 15 business days in other insurance have passed. The content of the application, its attachments and the date of delivery should be kept. Notifying the insurer merely by a general complaint and properly submitting a concrete compensation claim are not the same step. [3] [16]
For arbitration, the scope of the dispute, the distinction between compulsory and voluntary insurance, membership and the relevant dates, and whether the same dispute is being heard by another authority are checked. Not every policy of a foreign insurer can be brought to insurance arbitration in Türkiye. A complaint to the regulatory authority does not in itself replace an action or an arbitration route in which compensation is awarded. [16]
Consumer arbitration committee, consumer court or another court?
The competent authority is determined by whether the claim rests only on the service price, on bodily harm or on an insurance receivable, by the capacity of the claimant and the defendants, and by the nature of the legal relationship. It is not correct to name a single court for all safari accidents. In disputes that remain within a consumer transaction and fall within the competence of the arbitration committee, the Consumer Arbitration Committee is considered for values below TL 186,000 for 2026; the court route is considered for disputes at or above this amount. Since the threshold may change every year, the amount on the date of application must be checked. [2] [13]
For actions to be filed in the consumer court, mediation as a condition precedent to litigation under Law No. 6502 Art. 73/A and its exceptions are examined. For money receivables or compensation claims of a commercial-case nature, Turkish Commercial Code (TTK) Art. 5/A may come into play. As to where to apply, the consumer’s place of residence and the other rules of jurisdiction, and, where there is a foreign element, international jurisdiction, are also assessed separately. The routes of insurance arbitration, court action and the arbitration committee are not simply consecutive stages of one another. [2] [16] [17] [20] [21]
The distinction shown by the Court of Cassation’s passenger carriage decision
The decision of the Court of Cassation 4th Civil Chamber dated July 8, 2025, E.2025/5636, K.2025/11567, which resolves a conflict among the decisions of the regional courts of appeal, addresses claims directed jointly at the carrier, the compulsory traffic insurer and other liable persons in bus and minibus carriage. The decision distinguishes the consumer court for the injured passenger’s own bodily loss from the commercial court of first instance for the independent claims of those who lost the support of the deceased. [14]
This decision cannot be applied automatically to the file of every tourist who drove their own ATV, or to every dispute in which the carrier is not a defendant. The carriage relationship in a safari tour, the parties to the contract and the loss claimed must be established separately. The value of the decision is that it shows concretely that all claims arising from the same accident are not necessarily bound by the same rule of jurisdiction. [14]
Why should limitation periods be calculated separately?
Compensation, insurance notification, criminal complaint and condition-precedent procedures are not subject to the same time limit. While treatment continues, the preservation of evidence and the assessment of time limits should not be postponed. The rules below show the general framework; the special provision to be applied, the legal basis of the claim, and the dates of learning and of the incident must be determined from the file. [1] [2] [3] [18] [20] [21]
| Legal basis | General time-limit framework and important distinctions |
|---|---|
| Tort — TBK Art. 72 | 2 years from learning of the loss and of the liable person, and in any case 10 years from the act; the conditions for applying a longer criminal limitation period are reserved. |
| Contract — TBK Arts. 146, 149 | 10 years unless another provision exists; the start is, as a rule, the due date of the receivable. Not every contractual claim is automatically subject to this period. |
| Defective service — Law No. 6502 Art. 16 | As a rule, 2 years from performance of the service; the provisions on a longer period and on concealment of the defect by gross negligence or fraud are reserved. It cannot be generalized on its own to all bodily harm claims. |
| Pecuniary loss from a motor vehicle accident — KTK Art. 109 | As a rule, 2 years from learning of the loss and of the person liable to pay compensation, and 10 years from the accident; a longer criminal limitation period and special provisions are examined separately. The basis of the time limit for a non-pecuniary damages claim is assessed separately. |
| Insurance and complaint periods | Policy notification, the limitation period of the insurance receivable and the period of an offense dependent on complaint are calculated separately. The type of insurance and the claimant affect this distinction. |
In mediation as a condition precedent to litigation, the suspension of the statute of limitations and the non-running of the forfeiture period from the application to the office until the final minutes are drawn up are regulated in Law No. 6325 Art. 18/A/15. On the other hand, sending an email to the business, talking to the hotel or filing a criminal complaint does not automatically protect all the time limits of the civil claim. Which procedure affects the time limit in respect of which claim and which person must be determined separately. [1] [3] [20]
How do the 2026 amendments affect the compensation calculation and the form of the action?
Law No. 7589, published on July 31, 2026, requires two different date checks. In the amendment to TBK Art. 55, the date of the event causing the loss is the basis. For compensation for loss of working capacity and loss of support under the new provision, statutory interest is to run from the date of the event on the amount calculated for the period in which the earnings are known, and from the date of the decision on the amount calculated for the period in which the earnings are not known; proportional set-off is provided for performance payments made before the investigation phase (tahkikat) begins. Because of the transitional provision, the old regime continues for earlier events; this special rule cannot be extended in the same way to all heads of loss. [1] [12]
On procedure, the date the action is filed matters. HMK Art. 107 has been repealed, with its application to continue for actions filed earlier. HMK Art. 109/4 introduces a new rule allowing the claim in a partial action to be increased once in the same action until the end of the investigation phase, with the limitation period deemed interrupted on the date of the action for the increased portion. For this reason, the type of action, the scope of the claim, the interest and the payment calculation should not be carried over from an old template. [11] [12]
How do a criminal complaint and reconciliation affect the compensation file?
A fault in driving or in the safety organization may, where the conditions exist, be the subject of an investigation for negligent homicide or negligent injury under Turkish Penal Code (TCK) Art. 85 or 89. The criminal liability of a company manager, guide or driver is determined by their duty, personal conduct and causal link with the result. The investigation of fault in a criminal investigation does not mean that all the conditions of private-law compensation are automatically met. [1] [18]
In offenses dependent on complaint, the six-month period under TCK Art. 73, running from learning of the act and the perpetrator, matters; the scope and the exception of Art. 89/5 in negligent injury are assessed separately. Together with the criminal complaint, the time limits of the civil and insurance applications must also be monitored. [18]
Under Code of Criminal Procedure (CMK) Art. 253/19, reconciliation (uzlaşma) has an effect on the compensation action. The current provision makes an exception for losses that could not be identified at the time of the reconciliation or that emerge later. It therefore cannot be said that “reconciliation only closes the criminal file” or that “all future losses are definitively extinguished.” The scope of a reconciliation, release or payment document submitted before the permanent health consequences are known must be assessed carefully. [19]
How does a foreign tourist pursue the claim after leaving Türkiye?
Leaving Türkiye does not by itself end the right to compensation. The claim can be pursued through a lawyer under a duly executed power of attorney. However, there may be file-specific conditions for personal statements, examinations, evidentiary procedures or participation that the court considers necessary; it should not be promised in any case that a return to Türkiye will not be required. [11] [17]
For health and income documents issued abroad, legible originals or suitable copies should be kept; translation and, where necessary, certification conditions should be determined. HMK Arts. 223–224 regulate translation and the verification of foreign official documents according to the nature of the document. It should not be assumed that an apostille is automatically required for every hospital invoice; the authority issuing the document, the country and the applicable treaties matter. [11]
The tourist’s citizenship does not alone determine the applicable law. Arts. 24, 26 and 34 of the Private International and Procedural Law (MÖHUK) are examined together with the provisions on international jurisdiction. In particular, Art. 26/4 excludes from the conflict-of-laws rule specific to consumer contracts, apart from package tours, contracts of carriage and contracts under which the service must be supplied in a country other than the consumer’s country of habitual residence. It cannot be concluded that the law of the tourist’s own country applies to every activity purchased on the spot in Antalya. This distinction also does not mean that consumer status is automatically lost under Turkish substantive consumer law. [2] [17]
The path to follow in preparing the file
In the first assessment, a short chronology of the accident, the position as driver or passenger, the purchase channel, the recipient of payment, vehicle and track details, health condition and the existing documents should be brought together. Then the liable persons and the policies are identified, and preservation of evidence, the insurance application, mediation if required, and litigation options are planned. As treatment and loss of income are updated, the loss table is also updated. At each stage, who will do which step by which date should be clearly determined.
For the general framework of the relationship, our Tourism Law service page and the Travel Agency, Package Tour and Accommodation Guide can be read together. The focus of this article is the assessment, in a concrete file, of the organization, vehicle, participant and evidence characteristics of a safari accident.

Conclusion
An effective legal assessment of jeep safari, ATV and buggy accidents rests on correctly determining the nature of the service, separating the liable persons by their real roles, and preserving the evidence specific to the incident in time. That the tourist drove the vehicle does not by itself release the business from liability; that the activity involves risk does not mean all losses will automatically be compensated. The conditions of the track, maintenance, training, protective equipment, driving and response must be examined together.
Compensation and insurance claims should be prepared together with the health consequences, economic loss, the dates of the incident and the policy, application periods and the current provisions to be applied. Orderly document work carried out before a foreign tourist returns to their country, or before vehicle and camera records change, in particular, strengthens the basis of the legal claim to be made later.
Frequently Asked Questions
I was driving the ATV. Can I still claim compensation?
Having driven the vehicle does not by itself show that all liability lies with you. If there was a fault, inadequate training, an unsuitable track or an organizational deficiency, their effect on the accident is examined. The contribution of your own fault to the loss is also assessed; the outcome of the claim depends on the evidence and the liability regime applied. [1] [3]
Does not having a driver’s license remove all my rights?
The required license is determined according to the vehicle’s actual class and the area where it is used. The causal link between a missing license and the accident, and the conditions on which the business handed over the vehicle, are investigated separately. Not having a license can have significant consequences for fault and insurance; but it is not in every case a single criterion that automatically extinguishes all of the victim’s claims. [1] [3] [23]
If the tour was a day trip, can I not benefit from consumer rights?
That a day-trip activity is not a package tour does not automatically remove its character as a consumer transaction. For a service purchased for non-commercial and non-professional purposes, the relevant protections of Law No. 6502 can be considered. For the rights specific to package tours, the combination of services, the total price, and the duration or overnight conditions are required separately. [2] [5]
I bought the tour at the hotel. Must I necessarily sue the hotel?
The persons who received the payment, concluded the contract, committed to the service and actually organized it must be identified. A hotel merely giving a recommendation is not the same as selling a service in its own name. The liability of the hotel and of the other persons must be established through their concrete role and any breach of duty. [1] [2] [5] [7]
If there is a signed risk form or waiver, can no action be filed?
A pre-drafted exclusion-of-liability clause is reviewed with regard to gross negligence, unfair terms in a consumer contract, and package tour and traffic legislation. A signature alone does not remove all rights. However, statements about safety instructions and reconciliation and release documents signed after the accident must be assessed separately. [1] [2] [3] [5] [6] [19]
If the business has no insurance, does the compensation claim end?
A lack of insurance does not by itself remove the claim against the liable person or business. Other policies and, where the statutory conditions exist, the Guarantee Account may also be examined. However, the Guarantee Account does not cover every uninsured safari accident or all types of loss. [1] [3] [22]
What can be claimed besides a refund of the tour price?
Depending on the conditions, claims for treatment, loss of earnings, loss of working capacity, impairment of the economic future and non-pecuniary damage may arise. Different rights, such as loss of support in the case of death, may arise. In a package tour, wasted holiday time is also assessed separately; each head requires a legal condition and proof. [1] [2] [5]
What should I do before the camera footage is deleted?
It is helpful to request, without delay, that the footage be preserved, stating the date, time, vehicle and place of the incident. If there is a risk of deletion or access becoming more difficult, court-ordered preservation of evidence should be considered. Sending a message to the business does not replace a court decision and does not guarantee that the footage is preserved. [11]
Must I file an action before leaving Türkiye?
The mere fact that you will be leaving the country does not in every case create an obligation to file an action immediately. However, it matters that evidence, time limits, power of attorney, health records and contact details are put in order before leaving. The later follow-up can be carried out through a lawyer; procedures requiring personal participation may vary according to the file. [11] [17]
Is there a single two-year period for every safari accident?
No. Tort, contract, defective service, motor vehicle and insurance claims may be subject to different provisions. The dates of learning and of the incident, the special provisions and the conditions for a longer criminal limitation period are examined separately. Continuing to correspond with the business does not protect all the time limits. [1] [2] [3] [21]
Does reconciling in the criminal file affect the right to compensation?
It may. CMK Art. 253/19 attaches a consequence to reconciliation for the compensation action; it excepts losses that could not be identified at the time of reconciliation or that emerge later. A decision should not be made without understanding the scope of the document, the clarity of the health condition and the payment items. [19]
In an action to be filed in 2026, can I use the old indeterminate-claim action template?
Because of the repeal of HMK Art. 107 and the transitional provision for actions filed earlier, the date of the action should be checked. The new Art. 109/4 is also considered for increasing the claim in a partial action. For the separate amendment to TBK Art. 55, the date of the event matters; an old template should not be used without a currency check. [11] [12]
