Summary

Does a new zoning status certificate start the limitation period for an action? Obtaining information, the implementing act, the 60-day period and the five-year limit explained through Council of State decisions.

Filing a new petition with the municipality does not in every case restart a missed time limit for a zoning action. It may be possible to challenge the underlying zoning plan on the strength of a genuine implementing act concerning the property. However, a reply given to a mere request for information may not have the same effect. The content of the application, the finalization of the plan, the notification of the implementing act and the special time-limit provisions must be examined together.

This article focuses on the procedural issue that comes before the correct calculation of the floor area ratio or the floor height on a parcel: against which act, and when, must an action be brought so that the court can examine the merits of the dispute? In an action dismissed as time-barred, a technical defect in the plan is not enough by itself.

First determine which act is the subject of the action

A zoning plan is a general regulatory act. A zoning status certificate, a building permit or the refusal of a permit request may be related to the application of the plan to a specific parcel. That a municipal letter is marked "information" or "reply" is not decisive by itself; whether its content produces a legal consequence is examined.

The difference between a zoning status certificate and an information letter

A zoning status certificate can make concrete the use and building conditions of a particular property within the framework of the plan. By contrast, a general explanation given in response to the question "has a plan amendment been made in this area?" may not constitute an applicable decision concerning the applicant's property. That both are obtained from the same institution does not equalize their effect on the time limit for an action.

For this reason, the application should clearly state the block and parcel of the property, the applicant's legal interest, which act is requested and the grounds of the request. Requesting the same letter again merely to create a limitation period is not a reliable method. A genuine request for implementation must be distinguished from a request for reconsideration of an earlier decision.

The display period and the period for bringing an action are not the same thing

Article 8 of Law No. 3194 regulates the announcement of zoning plans and the objection process. In general, an objection to the plan may be made within the one-month announcement period. After the announcement and objection process, the period for bringing an action is calculated by taking into account the Administrative Procedure Law (İYUK) and the applicable special provisions.

Under Article 7 of the İYUK, the general period for bringing an action in the administrative courts is 60 days. For regulatory acts that must be announced, the day following the date of announcement is taken as the basis; for zoning plans, the last day of announcement and the effect of an objection during the display period (askı) are particularly important. Simply adding 60 days to the calendar without determining the starting date is not sufficient.

If an objection was made during the display period, the date of the objection, the end of the display period, the date of the decision, the service and the absence of a reply must be recorded separately. The 60-day implied-rejection calculation found in older decisions should not be carried over unchanged to a current file: the waiting period for a reply in Articles 10 and 11 of the İYUK is 30 days under the current regulation.

What does the five-year upper limit mean?

Article 8 of Law No. 3194 provides that an action may in any event be brought against a finalized zoning or parcelling plan within five years of its finalization. This provision does not mean that everyone can wait five years after service or implementation. The general period for bringing an action and the upper limit are assessed together.

Particularly for older plans, the date the regulation entered into force, earlier implementing acts and debates on its application in time are important. Obtaining a new zoning status certificate should not be relied on as a basis for assuming that the five-year limit disappears of its own accord. Using a past Council of State decision regardless of the date of the event may create a serious time-limit risk in an application dated 2026.

Why should Articles 10 and 11 of the İYUK not be confused with each other?

Article 10 of the İYUK regulates an application to the administration for an act or action that could be the subject of an administrative action. If no reply is given within thirty days, the request is deemed rejected. Special rules in the law apply separately to a non-final reply and to a reply given later; the four-month limit on the period within which a final reply is awaited should also not be overlooked.

Under Article 11 of the İYUK, by contrast, the withdrawal, revocation or amendment of an existing act or the making of a new act is requested. An application made in time and to the appropriate authority may suspend the running period for bringing an action. The remaining period continues to run at the end of thirty days without a reply or after a reply of rejection. The days that elapsed earlier are not erased.

Does objecting again to the same rejection decision provide a new period?

As a rule, a petition that reopens discussion of an act whose period has expired does not by itself create a new right of action. Whether there is a new legal or factual situation, a different implementing act or a special application option in the law is examined separately. The explanation "this time I submitted the petition to a different directorate" is not decisive by itself.

For example, where the rejection of a permit request has been served, it cannot be assumed that the first rejection period is preserved merely by resubmitting the same request. By contrast, a new plan amendment or a new and final implementation concerning the property may be assessed as a separate act. This distinction must be established with the documents in the file.

Can an action against the plan be brought on the basis of an implementing act?

The fourth paragraph of Article 7 of the İYUK provides that, upon the implementation of a regulatory act, the persons concerned may bring an action against the regulatory act, the implementing act or both. For this, the letter or decision in question must genuinely be an implementing act and the claimant must have a legally protectable interest.

Suing on both acts together is not mandatory. However, it should not be assumed that challenging only the plan will automatically eliminate the finalized individual act or all consequences connected to it. The subject matter and the requests must be framed according to the legal result sought.

The Council of State decision treating a zoning status certificate as a new implementation

In the decision of the 6th Chamber of the Council of State dated March 5, 2024, E.2023/3647, K.2024/1527, the fact that a zoning status certificate had been obtained earlier did not by itself remove the character of the later certificate as an implementing act. The Chamber found that the dismissal as time-barred of the action brought against the underlying plans on the basis of the new implementation was not lawful, and reversed the decision.

This decision is important for the question whether a genuine zoning status certificate can be treated as an implementation of the plan. However, the ruling does not concern the substantive unlawfulness of the plan. A conclusion such as "every new document gives an unlimited right of action" cannot be drawn by ignoring the date of the old plan and the specific timeline of the dispute. The Council of State decision holding that a reply to an information request does not renew the period

The decision of the 6th Chamber of the Council of State dated May 20, 2024, E.2020/5854, K.2024/3139, shows the opposite possibility. In the file, whether a plan amendment had been made and whether a particular use was envisaged were asked by way of an information request. The Chamber did not accept the application as a request for the issuance of the zoning status of the property and did not treat the reply as an implementing act that restarts the period.

The decision also discussed the interest in bringing an action against the related parcelling act. For this reason, merely having received a reply from the municipality is not enough; the character of an implementation and the claimant's interest are both required. The implied-rejection periods relating to older acts in the decision cannot be used in place of the current law. Full text published by the Council of State.

How is the time-limit file prepared?

In preparing for litigation, looking only at the latest municipal letter is misleading. All dates, from the first approval and announcement of the plan to the last reply, must be seen together. It should also be borne in mind that, in electronic service, the date of arrival in the system and the date on which service is deemed made by law may not be the same.

RecordWhy is it needed?
Plan approval and display recordsThe start and end of the announcement and finalization are investigated.
Display-period objection and registration documentIt is determined whether the objection was made in time.
Previous applications and repliesA repetition of the old act is distinguished from a new act.
Zoning status certificate or permit actThe concrete content of the implementation is examined.
Service envelope or electronic recordThe start of the period is verified.
Title deed and legal-interest documentsThe relationship of interest is established.

While the technical review of the plan is under way, the calculation of the time limit should not be postponed. Commissioning an expert report, waiting for an archive document from the municipality or settlement talks do not, as a rule, suspend the time limit for an action. The court's ability to request missing documents from the administration and the duty to bring the action in time are separate matters.

Special procedure and stay of execution

Not every zoning dispute is automatically subject to the general procedure. For example, for acts within privatization implementations, the expedited procedure in Article 20/A of the İYUK may come into play. This regime differs in that, for example, the period for bringing an action is 30 days and the Article 11 application does not apply. It is not a sufficient classification to call the act merely a "zoning plan."

Filing an action does not by itself stop the plan or its implementation. If a stay of execution is requested, manifest unlawfulness and damage that is difficult to remedy must be explained together. Where there is a time-bar, the examination of this request on the merits may also be prevented. For this reason, the first legal check should cover the admissibility of the action as much as the technical accuracy of the plan.

Conclusion

In zoning cases, choosing the right act and calculating the right time limit cannot be separated. A zoning status certificate may constitute a genuine implementing act; a general information letter may not produce the same result. Before a new application is made, earlier acts, display records, service documents and the five-year upper limit should be assessed together. Instead of trying to "recreate" the time limit, using the existing possibility of an action in time is the more reliable course.

Frequently Asked Questions

If I file a new petition with the municipality, do I gain 60 days again?

Not in every case. A new implementing act must be distinguished from a request for reconsideration of an old act.

Once I obtain a zoning status certificate, can the plan definitely be challenged?

The implementing character of the certificate, the interest, the date of notification, the general period and the upper limit in the law are examined together.

Does an application under the Right to Information Law suspend the time limit for an action?

A mere request for information cannot be assumed to be an Article 11 application under the İYUK or an implementing act. The content of the request is decisive.

Can I bring an action whenever I like within five years?

No. The five-year limit does not take the place of the applicable 60-day period or the special 30-day period.

Why do older decisions state a 60-day reply period?

The decision may have applied the law in force on the date of the act. The period in the current provisions of Articles 10 and 11 of the İYUK is 30 days.
