IMMOVABLE PROPERTY TRANSACTIONS AND DISPUTES

Real Estate Law

Legal support in property sales, title deed transactions and ownership disputes, from the review of documents to applications and litigation.

SCOPE OF SERVICES IN REAL ESTATE LAW

From transaction to dispute, the legal status of the property

Real estate law covers the transactions and disputes relating to the acquisition, transfer and use of immovable property and the protection of ownership. Güneş & Güneş Law Firm provides advisory and representation services to buyers, sellers, owners, co-owners, tenants, landlords, landowners and contractors.

The review is carried out by assessing together the title deed and contract records, the actual condition of the property, the parties’ objectives and any pending proceedings. The required application route and the scope of services are determined according to the file.

The admissibility conditions, such as the application period, victim status, exhaustion of ordinary remedies and the violation allegation having been raised before the earlier authorities, are examined separately for the specific file.

BEFORE THE TRANSACTION

Legal distinctions that affect the decision

Not every transaction and dispute relating to an immovable property is subject to the same rules.

A title transfer and a promise to sell are different

Ownership of immovable property is, as a rule, acquired by registration in the land registry; statutory exceptions are reserved. A promise to sell, an earnest money receipt or a payment does not by itself transfer ownership. The form of the transaction, the authority to represent and the registration requirements are examined separately. [K1]

Mediation is not the same in every file

Mediation as a condition precedent to litigation comes into play in disputes arising from leases, dissolution of co-ownership, the Condominium Ownership Law and neighbor rights. The exception concerning eviction through enforcement proceedings without a judgment and the nature of the specific claim are assessed separately. [K2]

Filing a lawsuit does not stop a transfer by itself

If there is a possibility that the property will be transferred, that new rights will be created over it or that evidence will be lost, the need for an interim injunction and the preservation of evidence is addressed separately. The conditions of the request, the evidence and the necessary security are assessed according to the file. [K3]

The court and the time limit depend on the file

The competent court, jurisdiction and application period depend on the legal ground of the claim and the route to be followed. In actions concerning the property itself, exclusive territorial jurisdiction may apply. A single time limit or court rule cannot be applied to all title deed lawsuits. [K3]

Legal review complements technical review

Permits, occupancy, the project, the actual use and the land registry record are considered together. Where the safety, measurement, valuation or technical conformity of the building must be determined, it is assessed through the review of the relevant authorized experts.

Purchases by foreigners involve additional conditions

The capacity to acquire and its restrictions, the area where the property is located, foreign documents, the power of attorney and payment documents are reviewed as of the date of the transaction. The foreign currency purchase document and valuation requirements are checked according to the buyer and the type of transaction. [K4]

If there is a notification or an urgent action

If an auction, eviction, demolition, a possible transfer or an application deadline is involved, state it at first contact. Submitting a consultation request online does not stop statutory time limits.

HOW A FILE IS HANDLED

How do we work?

A working process determined by the needs of the file, from the initial assessment to the implementation stage.

Not every stage may be necessary in every file. The scope of the consultation, reporting, contract or representation service is determined separately.

  1. Identifying the matter and its urgency

The property, the parties, the transaction or dispute, the objective and the current stage are clarified. If a notification, auction, eviction, demolition or possible transfer is involved, it is stated first.

  2. Reviewing documents and records

Title deed, contract, payment and official transaction records are reviewed. Missing documents and the need for a technical expert or valuation are identified.

  3. Clarifying the legal route and scope

Consultation, contract, mediation, administrative application, litigation or enforcement options are assessed in terms of time limits, evidence and costs. The scope of services is determined in writing.

  4. Carrying out the procedures and keeping you informed

Applications and procedures are followed within the agreed scope. The client is informed of the stage of the file, important developments and the decisions required.

  5. Decision, transfer and implementation stage

Depending on the nature of the file, legal remedies, the enforcement of the decision, the title deed transaction, collection or the distribution of the sale proceeds are assessed.

The scope of work is determined by taking into account the location of the property, the competent authority, the needs of the file and any required on-site actions.

Clients living abroad

Document review, preparation of powers of attorney, title deed transactions and litigation follow-up concerning properties in Türkiye can be coordinated through remote communication within the framework of the conditions of representation.

Multilingual communication

Communication is available in Turkish, English, German and Russian. Where necessary, legal actions in a foreign country are coordinated separately with lawyers authorized in that country.

SCOPE AND COST

Consultation and fees

At the first consultation, the matter, the current stage, the documents and the request are assessed. If a detailed review, a written opinion, a risk report, contract preparation or a representation service is required, its scope is determined separately.

The attorney’s fee and expenses are explained separately

The fee is agreed by taking into account the nature, scope and stages of the work and the professional regulations in force. Court fees, notification, on-site examination, expert, valuation, translation and other third-party expenses are assessed separately.

A consultation request does not by itself mean that the matter has been taken on or that free advice is being provided. Representation and case handling begin after the necessary assessment and acceptance.

FREQUENTLY ASKED QUESTIONS

About real estate transactions

General explanations do not replace the review of the specific file.

What does an encumbrance (takyidat) in the title deed record mean?

Encumbrance is an expression used for records relating to the rights and restrictions on an immovable property. A mortgage, an attachment, an easement or an annotation does not produce the same result. By reviewing the type, content and ranking of the record, its effect on transfer, use and payment is assessed.

Is compensation for unjust occupation (ecrimisil) the same as a rent receivable?

A rent receivable is based on a lease relationship. Compensation for unjust occupation is a claim for compensation that may arise from the unjust use of a property. These claims cannot be used in place of one another without examining the relationship between the parties, the basis of the use, the period and the necessary conditions.

Is a legal review report the same as a valuation report?

A legal review focuses on entitlement, records, contracts and transaction risks. A valuation report is a separate expert study on the value of the property. Where a structural safety or technical conformity review is also needed, it is obtained from the relevant technical experts. The type and scope of the report are agreed in advance.

How is a property that is not yet completed reviewed?

Together with the land registry and project records, the permit, the landowner–contractor relationship, the sale agreement, the payment plan, the delivery conditions and the security are reviewed. A technical review may be needed for the current stage of construction and the conformity of the project. Promises concerning a building that is not yet completed are compared with the actual and legal situation.

Should I have a power of attorney prepared before the meeting?

The transaction to be carried out and the necessary authorities should be determined first. The authorities needed for a title deed transaction, litigation or settlement may differ. Especially for documents to be issued abroad, the text, certification or apostille and translation requirements should be confirmed before the transaction.

Why does the duration of a real estate lawsuit vary from file to file?

The type of dispute, the number of parties, notifications, on-site examination, expert review and legal remedies affect the duration. In addition, the issuance of the decision and its becoming final or being enforced may be different stages. No definite completion date or outcome can be promised before the file is reviewed.
