Entry Bans to Türkiye and Restriction Codes

An entry ban to Türkiye may rest on a violation of lawful stay, an assessment of public order or public security, an earlier deportation, an unpaid administrative fine or another administrative record entered in the file. The legal consequence of records referred to in practice as a “restriction code,” “deportation code” or “entry ban code” varies according to the type of code and the underlying act.

In this context:

  • The basis of the entry ban and the restriction record is investigated.
  • Notifications, administrative decisions and file records are reviewed.
  • The options of an administrative application and an annulment action are assessed separately.
  • If an endorsed visa (meşruhatlı vize) or a special permit is possible, it is reviewed in terms of the specific conditions.
  • The effect on a new application of the violation of lawful stay, the fine and the manner of departure is determined.
  • Circumstances relating to family unity, education, work, health and private life are presented in the file.

An entry ban and a deportation decision are not the same act. Lifting an entry ban also does not mean that the foreign national automatically satisfies all the conditions required for another permit or visa.

Refusal at the Border Gate and Inadmissible Passenger Procedures

A foreign national may be subjected to inadmissible passenger procedures at the border gate for reasons such as the lack of a valid passport or permit document, insufficient validity of the document, an entry ban, an assessment of public order or inability to document the purpose of entry. In these processes, the act must be notified to the foreign national, the right to object must be explained and a request for international protection must not be obstructed.

In procedures carried out in the airport transit area or at land and sea border gates, the passport, visa, invitation, accommodation, return ticket, financial means, health insurance, family ties and earlier administrative records are assessed together. The foreign national’s need for legal representation and translation is also addressed according to the nature of the file.

Visa, Lawful Stay and Border Crossing Disputes

A visa or visa exemption alone does not give a definite right of entry to Türkiye. The passport validity, purpose of travel, length of stay, health insurance, sufficient financial means, earlier violations and entry ban records may be examined separately at the border gate.

The connection between a visa refusal or cancellation, a violation of the lawful stay period, a fine, the exit procedure and a later entry ban is assessed on the specific file. Residence permit applications and the actions relating to those applications are addressed on a separate practice area page.

Which Record Leads to Which Consequence?

First, the underlying act and the notification

A restriction record consisting of one letter and a number is not in itself a sufficient legal explanation. The authority that entered the record, the grounds, the duration, any accompanying entry ban and separate decisions are investigated. No definite conclusion about a person is drawn from general code lists on the internet; the current file record is the basis.

An action on an entry ban and a deportation action

The time limits and effects of the two acts should not be assumed to be the same. It is checked whether there is a special provision for the entry ban and the related administrative act; the general administrative litigation regime and, if any, a request for a stay of execution are assessed accordingly. The seven-day time limit in a deportation decision is not carried over to all visa and entry procedures.

At the airport or border gate

Ask for a copy of the written decision on non-admission or transit procedures, the passport pages and the notifications made. Convey where you are, your flight and transfer information and your need for an interpreter. Non-admission to the country and a deportation decision are not the same legal act. If there is a protection request, it is important that it be stated clearly to the competent authority and recorded.

Payment of a fine and a new visa

Paying the debt relating to the violation does not in every case automatically lift an entry ban or another restriction record. The options of an endorsed visa or a special entry permit depend on the administration’s assessment and the person’s circumstances. Being able to apply is not a positive outcome or an assurance of entry at the border.

Documents that are useful to prepare

Recent entries and exits, old passports, the refusal or entry ban decision, payment documents, earlier permits and documents relating to the purpose of travel are reviewed together. Which request your family, work, education or treatment connection in Türkiye supports is also determined separately.

Information Needed for the First Consultation

Prepare all pages of the decision, the notification record, your current status, earlier applications and a short chronology of events. If a transfer or application deadline is approaching, mention it in your first message. The file-specific document list and the method of representation are settled in the consultation.
